A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION
DENYING CONDITIONAL USE PERMIT NO. 89-29 FOR THE
ESTABLISHMENT OF A BAR IN A LEASED SPACE OF 2,700 SQUARE
FEET LOCATED AT 9583 FOOTHILL BOULEVARD IN THE COMMERCIAL
OFFICE DISTRICT, SUBAREA 3 OF THE FOOTHILL BOULEVARD
SPECIFIC PLAN, AND MAKING FINDINGS IN SUPPORT THEREOF -
APN: 208-261-47.
A. Recitals.
(i) Johnny Winters has filed an application for the issuance of the
Conditional Use Permit No. 89-29 as described in the title of this
Resolution. Hereinafter in this Resolution, the subject Conditional Use
Permit request is referred to as "the application".
(ii) On the 13th of December, 1989, the Planning Commission of the
City of Rancho Cucamonga conducted a duly noticed public hearing on the
application and continued said hearing to January 10, 1990, at the request of
the applicant.
( iii) On the 10th of January, 1990, the Commission conducted a public
hearing and concluded said hearing on that date.
( iv) All legal prerequisites prior to the adoption of this
Resolution have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined and resolved by the
Planning Commission of the City of Rancho Cucamonga as follows :
1. This Commission hereby specifically finds that all of the facts
set forth in the Recitals, Part A, of this Resolution are true and correct.
2. Based upon substantial evidence presented to this Commission
during the above-referenced public hearings on December 13, 1989 and
January 10, 1990, including written and oral staff reports and a report from
the Sheriff's station, together with public testimony, this Commission hereby
specifically finds as follows:
(a) The application applies to property located at 9583
Foothill Boulevard with a street frontage of 182.37 feet and lot depth of
260.94 feet and is presently improved with a multi-tenant commercial center;
and
( b) The property to the north, east and west of the subject
site is existing commercial , the property to the south of that site consists
of existing single family detached homes.

(c) The application is for the sales of alcoholic beverages for
consumption on the premises.
( d) The subject property is separated from a single family
neighborhood by a twenty-foot-wide alley;
( e) The proposed hours of operation are from 11:00 AM until
2:00 AM, seven days a week, which coincide, in part, with the hours of Central
Elementary School which is located less than 1500 feet away.
( f) The application contemplates the relocation of the existing
Dew Drop Inn bar, from its present location approximately one-half mile to the
west, to the subject property.
(g) The application would not be in the best interest of the
health, safety and welfare of the citizens of the City of Rancho Cucamonga and
would be materially detrimental to persons and property in the immediate
vicinity of the subject site.
(h) That there is an established history of excessive requests
for public services , including police and fire.
3. Based upon the facts found hereinabove, this Commission hereby
concludes that the approval of the application would adversely affect the
health, safety and welfare of the citizens of the City of Rancho Cucamonga and
would be materially detrimental to persons and property in the immediate
vicinity of the subject site.
4. Based upon the findings and conclusions set forth in paragraphs
1, 2 and 3 above, this Commission hereby denies the application.
5. The Deputy Secretary to this Commission shall certify to the
adoption of this Resolution.

I, Otto Kroutil , Deputy Secretary of the Planning Commission of the City of
Rancho Cucamonga, do hereby certify that the foregoing Resolution was duly and
regularly introduced, passed, and adopted by the Planning Commission of the
City of Rancho Cucamonga, at a regular meeting of the Planning Commission held
on the 10th day of January, 1990, by the following vote-to-wit:
