A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION
DENYING A REQUEST FOR MODIFICATION OF A CONDITION OF
APPROVAL FOR CONDITIONAL USE PERMIT 88-12 LOCATED AT THE
NORTHEAST CORNER OF HAVEN AVENUE AND FOOTHILL BOULEVARD
- APN 1077-421-36, 37 AND 40
A. Recitals.
(i) On April 27, 1988, the Planning Commission approved, subject to
specified conditions, Conditional Use Permit 88-12 which provides
for the development of an integrated Community Shopping Center on
71 acres at the northeast corner of Haven Avenue and Foothill
Boulevard.
( ii) On December 19, 1989, a request was filed by Western Properties to
modify the condition of approval requiring the developer to
construct traffic signals prior to occupancy of any buildings.
(iii) On December 20, 1989, Western Properties expanded their request to
include substantial completion of street improvements prior to
occupancy. Essentially, the request would allow occupancy of the
Target Store prior to completion of the Foothill Boulevard
improvements including signals.
( iv) On January 10, 1990, the Planning Commission of the City of Rancho
Cucamonga conducted a duly noticed public hearing on the
application and concluded said hearing on that date.
(v) All legal prerequisites to the adoption of this Resolution have
occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined and resolved by the
Planning Commission of the City of Rancho Cucamonga as follows:
1. This Commission hereby specifically finds that all the facts set
forth in the Recitals, Part A, of this Resolution are true and correct.
2. Based upon substantial evidence presented to this Commission during
the above-referenced public hearing on January 10, 1990, including written and
oral staff reports, together with public testimony, this Commission hereby
specifically finds as follows:
( a) The requirement to have street improvements and traffic
signals on Foothill Boulevard completed (operational) prior to occupancy of
any buildings is necessary for public safety and traffic circulation; and

( b) Current City policy is sufficiently flexible to allow
occupancies proportionate to improvement completion if public safety is not
compromised.
3. Based upon substantial evidence presented to this Commission during
the above-referenced public hearing and upon the specific findings of facts
set forth in paragraphs 1 and 2 above, this Commission hereby finds and
concludes as follows:
( a) That the requirement that Foothill Boulevard street
improvements, including traffic signals , be completed ( operational) prior to
occupancy is necessary and reasonable.
4. Based upon the findings and conclusions set forth in paragraphs 1,
2, and 3 above, this Commission hereby denies the requested condition
modification.
5. The Deputy Secretary to this Commission shall certify to the
adoption of this Resolution.

Rancho Cucamonga, do hereby certify that the foregoing Resolution was duly and
regularly introduced, passed, and adopted by the Planning Commission of the
City of Rancho Cucamonga, at a regular meeting of the Planning commission held
on the 10th day of January, 1990, by the following vote-to-wit:
