HomeMy WebLinkAbout90-12 - Resolutions RESOLUTION NO. 90-12 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, CONDITIONALLY APPROVING TENTATIVE PARCEL MAP NUMBER 12733, LOCATED ON THE NORTHEAST CORNER OF HAVEN AVENUE AND ACACIA STREET - APN 209-401-01 WHEREAS , Tentative Parcel Map Number 12733, submitted by Glenfed Development, applicant, for the purpose of subdividing into 2 parcels, the real property situated in the City of Rancho Cucamonga, County of San Bernardino, State of California, identified as APN(s) 209-401-01 , located at the northeast corner of Haven Avenue and Acacia Street; and WHEREAS, on November 8, 1989, and continued to January 10 and January 24, 1990, the Planning Commission held a duly advertised public hearing for the above-described map. NOW, THEREFORE, THE RANCHO CUCAMONGA PLANNING COMMISSION RESOLVED AS FOLLOWS: SECTION 1 : That the following findings have been made: 1. That the map is consistent with the General Plan and the Industrial Specific Plan. 2. That the improvement of the proposed subdivision is consistent with the General Plan and the Industrial Specific Plan. 3. That the site is physically suitable for the proposed development. 4. That the proposed subdivision and improvements will not cause substantial environmental damage or public health problems or have adverse effects on abutting property. SECTION 2: This Commission finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby issues a Negative Declaration. SECTION 3 : That Tentative Parcel Map No. 12733 is hereby approved subject to the attached Standard Conditions and the following Special Conditions: 1 . Existing Overhead Utilities a. 8th Street (vacated) - The existing overhead utilities (communications for 66KV electrical ) along the project' s north boundary shall be undergrounded from the first pole on the west side of Haven Avenue to the first pole off-site PLANNING COMMISSION RESOLUTION NO. 90-12 TENTATIVE PARCEL MAP 12733 - GLENFED JANUARY 24, 1990 PAGE 2 east of the project' s east boundary, prior to public improvement acceptance or occupancy, whichever occurs first. The developer may request a reimbursement agreement to recover one-half the City adopted cost for undergrounding from future development as it occurs on the north side of the AT&SF Railroad. b. Railroad Right-of-Way - An in-lieu fee as contribution to the future undergrounding of the existing overhead utilities (railroad telecommunication lines) on the project side of the AT&SF Railroad shall be paid to the City prior to recordation of the Final Parcel Map. The fee shall be the full adopted unit amount times the length from the center of Haven Avenue to the east project boundary. The developer may request a reimbursement agreement to recover one-half the City adopted cost from future development as it occurs on the north side of the AT&SF Railroad. 2. Chino Basin Municipal Water District owns and operates the Non-Reclaimable Waste Sewer on the north side of this map. The developer shall be responsible for any relocation, modification, or other construction of this system required due to the development. Such work shall include but not be limited to adjusting manholes to grade, realignment of lines to allow other utilities to be constructed and other similar construction. If any modification or adjustment to District facilities is desired, plans shall be approved by the District before proceeding. In addition, the easement for the sewer and other utilities on the north side of this subdivision shall be shown on the Final Parcel Map. 3. Record a reciprocal parking agreement concurrent with the map. 4. The City' s slope easement adjacent to Haven Avenue shall be extended to the north property line. 5. A Convenant and Agreement Regarding Maintenance of Yard Easements for Building B shall be recorded with the Final Parcel Map. The agreement shall be submitted for review and approval by the Building and Safety Division prior to recordation. 6. The Metropolitan Water District easement on the north side of Acacia Street shall be dimensionally tied to the map boundaries on the Final Parcel Map. 7. A permit from the Metropolitan Water District is required for work within its right-of-way.
