HomeMy WebLinkAbout90-20A - Resolutions RESOLUTION NO. 90-20A A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING MODIFICATIONS TO THE DESIGN REVIEW FOR TRACT NO. 13717 , LOCATED WITHIN THE TERRA VISTA PLANNED COMMUNITY ON THE NORTHEAST CORNER OF CHURCH STREET AND SPRUCE AVENUE IN THE MEDIUM- HIGH RESIDENTIAL DISTRICT, AND MAKING FINDINGS IN SUPPORT THEREOF - APN : 1077-421-13. A. Recitals. (i ) Western Properties has filed an application for a modification to Design Review of Tract No. 13717 as described in the title of this Resolution. Hereinafter, the subject Design Review request is referred to as "the application." (ii ) On February 14, 1990, Western Properties received approval for Tentative Tract 13717 for the development of 394 condominium units from the Planning Commission. (iii ) On February 14, 1990, Western Properties received approval from the Planning Commission for the Design Review of Tentative Tract 13717 . Along with that, Tree Removal Permit 89-70 also received Planning Commission approval . (iv) On the 13th day of February 1991, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. (v) All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced meeting on February 13, 1991, including written and oral staff reports, this Commission hereby specifically finds as follows : (a) That the proposed project is consistent with the objectives of the General Plan; and PLANNING COMMISSION RESOLUTION NO. 90-20A TENTATIVE TRACT 13717 - WESTERN PROPERTIES February 13, 1991 Page 2 (b) That the proposed design is in accord with the objectives of the Development Code and the purposes of the district in which the site is located; and (c) That the proposed design is in compliance with each of the applicable provisions of the Development Code; and (d) That the proposed design, together with the conditions applicable thereto, will not be detrimental to the public health, safety or welfare or materially injurious to properties or improvements in the vicinity. 3. Based upon the findings and conclusions set forth in Paragraphs 1 and 2 above, this Commission hereby approves the application subject to each and every condition set forth below: 1. The tract shall be subject to all conditions set forth in Resolution No. 90-20 approved on February 14, 1990. 2. The Spruce Avenue entry design shall be reviewed and approved by the City Planner prior to the issuance of Building Permits. 3. The driveway locations and widths shall remain in their originally approved locations per the City Engineer. 4. Landscaping shall be added to the circular element for the Spruce Avenue entry. The final design shall be reviewed and approved by the Fire District and the City Planner prior to the issuance of building permits. 5. The access road between Buildings 38 and 42 shall be blocked from the west side with a landscape planter. The final design shall be reviewed and approved by the City Planner prior to the issuance of building permits. 6. The balcony structures on the rear elevation of building Type A shall be eliminated and hip elements shall be added to break up the elevation, providing relief and variation. Revised elevation shall be reviewed and approved by the City Planner prior to the issuance of Building Permits. 7 . The applicant shall replace any Olive trees required to be preserved by Tree Removal Permit No. 89-70 which are dead, dying, or which in the opinion of the City Planner are no longer worthy of preservation due to decline, poor form, or weak structure. Replacement trees shall be mature field grown specimens with a minimum 20 foot - 25 foot height. The final design and location of the tot lot(s) shall be approved by the Design Review Committee prior to issuance of building permits. 9. The sidewalk located on the north side of the Spruce Avenue entry shall be deleted. Landscaping shall be provided to screen the adjoining parking area. The final plans shall be reviewed and approved by the City Planner prior to the issuance of building permits. 4. The Secretary to this Commission shall certify the adoption of this Resolution.
