A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA APPROVING DESIGN REVIEW AND
THE AMENDED TRACT MAP FOR TRACT NO. 14121 FOR THE
DEVELOPMENT OF 46 SINGLE FAMILY HOMES LOCATED IN THE
LOW-MEDIUM RESIDENTIAL DISTRICT AT THE SOUTHWEST CORNER
OF HIGHLAND AND MILLIKEN AVENUES, AND MAKING FINDINGS IN
SUPPORT THEREOF - APN: 202-211-48.
A. Recitals.
(i ) Rhoades Development has filed an application for the Design
Review and amended tract map for Tract No. 14121 as described in the title of
this Resolution. Hereinafter, the subject Design Review request is referred
to as "the application" .
(ii ) On February 28, 1990, the Planning Commission of the City of
Rancho Cucamonga held a duly public noticed meeting to consider the
application.
(iii ) All legal prerequisites prior to the adoption of this
Resolution have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined and resolved by the
Planning Commission of the City of Rancho Cucamonga as follows:
1 . This Commission hereby specifically finds that all of the
facts set forth in the Recitals, Part A, of this Resolution are true and
correct.
2. Based upon substantial evidence presented to this Commission
during the above-referenced meeting on February 28, 1990, including written
and oral staff reports, this Commission hereby specifically finds as follows :
a. That the proposed project is consistent with the
objectives of the General Plan; and
b. That the proposed design is in accord with the objectives
of the Development Code and the purposes of the district in which the site is
located; and
c. That the proposed design is in compliance with each of the
applicable provisions of the Development Code; and
d. That the proposed design, together with the conditions
applicable thereto, will not be detrimental to the public health, safety, or
welfare, or materially injurious to properties or improvements in the
vicinity.

3. This Commission hereby finds that, with respect to the design
review application, the environmental effects of this project are similar
enough to the environmental effects identified for Tract 14121 , for which a
Negative Declaration was granted on August 23, 1989; therefore, this
Commission finds that this previously prepared Negative Declaration will
adequately cover this project. Further, with respect to the amended map, this
Commission hereby finds and determines that the project identified above in
this Resolution is categorically exempt from the requirements of the
California Environmental Quality Act of 1970, as amended, and the Guidelines
promulgated thereunder pursuant to Section 15305 of Division 6 of Title 14 of
the California Code of Regulations.
4. Based upon the findings and conclusions set forth in
paragraphs 1 and 2 above, this Commission hereby approves the application
subject to each and every condition set forth below and in the attached
Standard Conditions, attached hereto and incorporated herein by this
reference.
Planning Division:
1) All conditions of Resolution No. 89-112 approving
Tentative Tract 14121 shall apply, except for
Planning Division conditions No. 4 and 7 which
shall become null and void.
2) A final acoustical report shall be submitted for
review and approval by the City Planner prior to
the issuance of building permits. The report
shall identify mitigation measures which shall be
incorporated into the final site plans, wall
plans, and construction documents.
3) To mitigate significant adverse noise impacts from
the proposed freeway, the applicant shall
construct a sound attenuation wall along the north
property line of Lots 9-18 prior to the issuance
of final occupancy release. The wall shall be
constructed in accordance with the requirements of
the final acoustical study.
4) The perimeter wall along Highland Avenue, adjacent
to the future freeway shall be consistent with the
approved wall design for Highland Avenue and the
Victoria Planned Community theme wall , to the
extent feasible, and shall be reviewed and
approved by the Design Review Committee prior to
issuance of any building permits for this tract.

The Design Review Committee shall also review
grading modifications adjacent to and around the
perimeter wall should the grading concept be
revised to incorporate the final acoustical wall
design.
This acoustical barrier wall shall be staggered
and offset to increase visual interest and to
ensure adequate area to landscape the Highland
Avenue streetscape with a windrow style of
planting consistent with the designated design
standards of the Victoria Planned Community.
Where necessary, the wall shall step down and
transition in height as it wraps around the
project along Fairmont Way and Milliken Avenue.
Landscape maintenance easements will be required
where the perimeter wall encroaches onto private
lots and are to be dedicated on the Final Map.
Final plotting of all walls and locations of all
landscape easements are to be determined prior to
recordation of the Final Map.
5) The developer shall provide each prospective buyer
with written notice of the potential Fourth Street
Rock Crusher project in a standard format as
determined by the City Planner, prior to accepting
a deposit on any property.
6) The design of the side yard walls (including
gates) shall be of a permanent decorative
material . The final design of the walls shall be
submitted for review and approval by the City
Planner.
7) All single family residential developments with
more than two models shall be required to
landscape at least one half of the models entirely
with water saving landscaping and irrigation.
Each "water saving" model home shall contain
exclusively low water use plant materials, low
flow irrigation systems , and appropriate signs and
information for prospective home buyers in
accordance with Rancho Cucamonga Municipal Code
Section 19.16.070.
8) The two emergency vehicle access points at the
southern end of each cul-de-sac shall be
constructed to the standards of, and approved by

the Rancho Cucamonga Fire Protection District.
Engineering Division :
1) It appears that the toe of the slope on Kenyon way
is encroaching on the limited use area . Slopes or
any obstructions that could restrict the view
within the limited use area shall be corrected as
approved by the City Engineer.
2) An amended final map shall be approved by City
Council prior to the issuance of building permits.
5. The Secretary to this Commission shall certify to the adoption
of this Resolution.
