A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION
APPROVING A MODIFICATION OF A CONDITION OF APPROVAL FOR
VESTING TENTATIVE TRACT MAP NO. 13945 , LOCATED ON THE
SOUTH SIDE OF HIGHLAND AVENUE, EAST OF EAST AVENUE, AND
MAKING FINDINGS IN SUPPORT THEREOF - APN 207-071-018
A. Recitals
(i) On December 14 , 1988, the Planning Commission approved, subject
to specified conditions, Vesting Tentative Tract Map 13945 , Resolution No.
88-238, which provides for the development of 35 single-family lots on 15
acres of land in the Low Density Residential district of the Etiwanda Specific
Plan.
( ii ) On April 18 , 1990, the City Council of the City of Rancho
Cucamonga conducted a meeting and denied the use of Systems Development Fees
for the construction of full intersection improvements, including traffic
signals at the intersection of Highland and East Avenues, as specified in
Special Condition No. 7 of Planning Commission Resolution No. 88-238, thereby
causing said condition to be waived .
( iii ) All legal prerequisites to the adoption of this Resolution have
occurred .
B. Resolution
NOW, THEREFORE, it is hereby found, determined and resolved by the
Planning Commission of the City of Rancho Cucamonga as follows :
1 . This Commission hereby specifically finds that the
facts set forth in the Recitals, Part A, of this
Resolution are true and correct.
2 . This Commission concludes that with the waiver of
Condition No. 7 , as previously stated under
Recitals , Item (ii ) , it becomes unnecessary to
construct full improvements within Highland Avenue
from East Avenue to the westerly boundary of Vesting
Tentative Tract 13945 at this time.
3. Based upon the findings and conclusions set forth in
paragraphs 1 and 2 above, including written and oral
staff reports , this Commission hereby approves the
requested condition modification as follows :

a) Modify Condition No. 6 to read as follows :
Construct Highland Avenue full width from the
west boundary of Vesting Tentative Tract 13945
to the east boundary of Tract 13063 to the
east. The developer may request a reimbursement
agreement to recover the costs of constructing
the improvements and acquisition of the
necessary right-of-way fronting Tract 13063 at
the time of their development.
4. The Secretary to this Commission shall certify to
the adoption of this Resolution .
