A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, APPROVING CONDITIONAL USE
PERMIT NO. 89-18 FOR THE DEVELOPMENT OF AN INTEGRATED
SHOPPING CENTER TOTALING 119,204 SQUARE FEET ON 14.1
ACRES OF LAND LOCATED AT THE SOUTHEAST CORNER OF MILLIKEN
AVENUE AND BASE LINE ROAD WITHIN THE TERRA VISTA PLANNED
COMMUNITY IN THE NEIGHBORHOOD COMMERCIAL DISTRICT, AND
MAKING FINDINGS IN SUPPORT THEREOF - APN: 227-151-13
A. Recitals.
(i) Lewis Development Co. has filed an application for the issuance
of the Conditional Use Permit No. 89-18 as described in the title of this
Resolution. Hereinafter in this Resolution, the subject Conditional Use
Permit request is referred to as "the application."
(ii ) On the 27th day of June, 1990, the Planning Commission of the
City of Rancho Cucamonga conducted a duly noticed public hearing on the
application and concluded said hearing on that date.
(iii ) All legal prerequisites prior to the adoption of this Resolution
have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined, and resolved by the
Planning Commission of the City of Rancho Cucamonga as follows:
1 . This Commission hereby specifically finds that all of the facts
set forth in the Recitals, Part A, of this Resolution are true and correct.
2. Based upon substantial evidence presented to this Commission
during the above-referenced public hearing on June 27 , 1990, including written
and oral staff reports, together with public testimony, this Commission hereby
specifically finds as follows :
(a) The application applies to property located at the
southeast corner of Milliken Avenue and Base Line Road with a street frontage
of approximately 915 feet on Base Line Road and lot depth of approximately 760
feet and is presently vacant; and
(b) The property to the north of the subject site is vacant,
the property to the south of that site consists of vacant land, the property
to the east is vacant land, and the property to the west is vacant land and
condominiums .
(c) The application contemplates construction of a
neighborhood shopping center with 525 parking spaces.

3. Based upon the substantial evidence presented to this Commission
during the above-referenced public hearing and upon the specific findings of
facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and
concludes as follows :
(a) That the proposed use is in accord with the General Plan,
the objectives of the Development Code, the Terra Vista Community Plan, and
the purposes of the district in which the site is located .
(b) That the proposed use, together with the conditions
applicable thereto, will not be detrimental to the public health, safety, or
welfare, or materially injurious to properties or improvements in the
vicinity.
(c) That the proposed use complies with each of the applicable
provisions of the Development Code and the Terra Vista Community Plan.
4 . This Commission hereby finds and certifies that the project has
been reviewed and considered in compliance with the California Environmental
Quality Act of 1970 and, further, this Commission hereby issues a Negative
Declaration.
5 . Based upon the findings and conclusions set forth in paragraphs
1 , 2, 3 , and 4 above, this Commission hereby approves the application subject
to each and every condition set forth below and in the attached Standard
Conditions attached hereto and incorporated herein by this reference.
Planning Division
1 . A colored, exposed aggregate concrete shall be provided to
compliment the tile, stucco, colors, and details approved
for use outside the storefronts. The City Planner shall
review and approve the final design.
2 . A separate Conditional Use Permit Application shall be
submitted for review and approval of the proposed tire
center (Pad A) , day care center, and fast food restaurant
(Pad B) .
3. A separate Development/Design Review or Conditional Use
Permit shall be submitted for review and approval of any
proposed freestanding building.
4. A uniform hardscape and street furniture treatment,
including trash receptacles, freestanding potted plants,
bike racks, light bollards, benches, etc ., shall be
utilized for the shopping center and shall be designed to

be compatible with the architectural style. Detailed
designs shall be submitted for Planning Division review and
approval prior to issuance of building permits.
5 . The site shall be developed and maintained in accordance
with the approved site plan which includes architectural
elevations, exterior materials and colors, landscaping,
sign programs, grading on file with the Planning Division,
the conditions contained herein, Development Code
regulations, and the Terra Vista Community Plan. Tree
maintenance criteria shall be developed and submitted for
review and approval by the City Planner for the project to
encourage the natural growth characteristics of the
selected tree species.
6. A Uniform Sign Program for the shopping center, including
the major tenants for Buildings D and A, shall be designed
to be compatible with the architectural style. Variation
of sign color shall be minimal . The size of the sign copy
shall be visually balanced and proportionate to the
building and the architecture style. The Uniform Sign
Program shall be reviewed and approved by the Design Review
Committee prior to issuance of building permits.
7. Graffiti shall be removed within 72 hours.
8. The entire site shall be kept free of trash and debris at
all times, and in no event shall trash and debris remain
for more than twenty-four (24) hours.
9. The applicant shall resolve any Building Code compliance
difficulties (with construction of canopies, property lines
in relation to walls and other openings, and roof tile
installation to withstand severe winds) with the Building &
Safety Department prior to issuance of building permits.
10. There shall be provision for the following design features
in the trash enclosure to the satisfaction of the City
Planner:
a) Architecturally integrated into the design of the
shopping center.
b) Separate pedestrian access that does not require
opening the main doors to include a self-closing
pedestrian door.

c) Large enough to accommodate two trash bins .
d) Roll-up doors.
e) Trash bins with counterweighted lids.
f) Architecturally treated overhead shade trellis.
g) Chain link screen on top to prevent trash from blowing
out of enclosure and designed to be hidden from view.
11 . Trash collection shall occur between the hours of 9:00 a.m.
and 10:00 p.m. only.
12 . All operations and businesses shall be conducted to comply
with the following standards, which shall be incorporated
into the lease agreement of all tenants:
a) Noise Levels. All commercial activities shall not
create any noise that would exceed an exterior noise
level of 60dBA during the hours of 10:00 p.m. to 7 :00
a .m. and 65dBA during the hours of 7 :00 a.m. to 10:00
p.m.
b) Loading and Unloading. No person shall cause the
loading, unloading, opening, closing, or other
handling of boxes, crates, containers, building
materials, garbage cans, or similar objects between
the hours of 10:00 p.m. and 7 :00 a .m. , unless
otherwise specified herein, in a manner which would
cause a noise disturbance to a residential area .
13. All future graded building pads shall be seeded and
irrigated for erosion control . Detailed plans shall be
included in the landscape and irrigation plans to be
submitted for Planning Division approval prior to issuance
of building permits.
14. All future projects within the shopping center shall be
designed to be compatible and consistent with the
architectural program established.
15. Any outdoor vending machines shall be recessed into
building faces and shall not extend out into the pedestrian
walkways. The design details shall be reviewed and
approved by the City Planner.

16. Parking lots shall be screened from public view along
perimeter streets with a combination of berming and
continuous screen hedges.
17. Provide trees in planters along the front of Shops 1 , 2,
and 3 and the west elevation of Major A.
18. The following trees shall be at least 36-inch box size, or
equivalent as approved by the City Planner:
a) In front of Ralph's & Thrifty's.
b) Entry accent trees.
c) Plaza trees at intersection of Milliken and Base Line
Road.
19. Dense landscaping, including trees and shrubs shall be used
to screen the service bays of the Firestone Tire Center.
Architectural solutions to screening the service bays (such
as building offsets, special roof elements, spandrel glass,
etc .) shall also be used .
20. Outdoor eating areas are encouraged for use where
restaurants are developed.
21 . The project shall meet all the requirements of the City's
adopted Xeriscape Ordinance. Details shall be provided on
the final landscape plan.
22. The lighting fixture design shall compliment the
architectural program. It shall include the plaza area
lighting fixtures, building lighting fixtures (exterior) ,
and parking lot lighting fixtures.
23. All shopping cart storage shall be inside enclosed
buildings, with the exception of temporary storage in the
cart corrals within parking areas, except as may be
approved by the Design Review Committee subject to proper
screening.
24. The 6-foot screen wall shall be relocated to wrap around
the two parking spaces and the proposed recycling center to
maximize screening of public views from Terra Vista
Parkway.
25 . A separate Recycling Facility Permit shall be submitted for
review and approval by the City Planner.

26. The main circulation aisle shall be posted as a "Fire Lane
- No Parking."
27 . Bicycle storage spaces ( i .e. , security racks) shall be
provided, at a minimum equal to five (5) percent of the
number of automobile spaces, in convenient locations that
do not obstruct pedestrian movement.
28. Tree maintenance criteria shall be developed and submitted
for review and approval by the City Planner for the project
to encourage the natural growth characteristics of the
selected tree species.
Engineering Division
1 . Full width street dedications shall be provided for Terra
Vista Parkway (99 feet) and Ellena West (66-73 feet) prior
to the issuance of building permits.
2 . The following streets shall be constructed full width,
including off-site street lights, except for off-site
parkway improvements which may be deferred until
development of the adjacent properties:
a) Milliken Avenue from Base Line Road to Foothill
Boulevard, including the traffic signal at Foothill
Boulevard and a landscaped median; and
b) Base Line Road from Milliken Avenue to Mountain View
Drive, including a landscaped median; and
c) Ellena West and Terra Vista Parkway (including a
landscaped median) adjacent to the project, including
a complete intersection of the two.
3. Complete all missing portions of the Terra Vista Master
Plan of Storm Drains, systems 3 and 4, from the site to
Deer Creek Channel .
4. Median island and parkway landscaping along Terra Vista
Parkway, Milliken Avenue, and Base Line Road shall conform
to the results of the respective beautification studies.
5 . Provide 6-foot-wide street tree easements behind the
sidewalk as follows :
a) Along all right turn lanes where curb adjacent
sidewalk occupies the minimum 7-foot right-of-way; and

b) Wherever driveway and intersection lines of sight
cross the parkway, as indicated on the Grading and
Landscaping Plans.
6. All landscaping within driveway and intersection lines of
sight shall be approved by the City Traffic Engineer.
7. All project driveways shall be constructed per City
Standard No. 306, including a maximum radius of 20 feet.
The public sidewalk shall cross the drive approach
immediately behind the radius return and be located within
the right-of-way or a public sidewalk easement. Textured
pavement shall be located outside the street right-of-way
and the sidewalk easement.
8. Provide right turn deceleration lanes which are a minimum
of 11 feet wide and 230 feet long, including 90 feet of
taper, for project driveways on Milliken Avenue, Base Line
Road, and Ellena West, as shown on the approved Site
Plan. The right-of-way line shall be parallel to and 7
feet behind the curb.
9. Terra Vista Parkway shall be widened to accommodate a
continuous right turn lane along the entire project
frontage, including a full 12-foot parkway.
10. Construct bus bays on the east side of Milliken Avenue
south of Terra Vista Parkway and on the south side of Terra
Vista Parkway east of Milliken Avenue to the satisfaction
of the City Traffic Engineer.
11 . The Milliken Avenue driveway shall be 45 feet in width at
the right-of-way line. The southerly drive aisle edge may
taper northerly so that a minimum width of 35 feet is
maintained at the first intersecting drive aisle on site,
to the satisfaction of the City Engineer and City Planner.
12. Install "No Stopping Any Time" (NSAT) signs along Base Line
Road, Milliken Avenue, Terra Vista Parkway, and Ellena
West. Delete all references to "No Trucks" signs at the
project entrances .
13. An in-lieu fee as reimbursement for the previously
undergrounded overhead utilities (electrical , except for
the 66KV electrical ) on the opposite side of Base Line Road
shall be paid to the City prior to the issuance of building
permits. The fee shall be one-half the City adopted unit
amount times the length from the center of Milliken Avenue
to the center of Ellena West.

6. The Secretary to this Commission shall certify to the adoption
of this Resolution.
