A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, APPROVING CONDITIONAL USE
PERMIT NO . 90-36 FOR THE ESTABLISHMENT OF A TEMPORARY
CABLE TELEVISION RECEIVING SITE CONSISTING OF FOUR
SATELLITE DISHES, A 30 FOOT ANTENNA, AND A TEMPORARY
BUILDING IN THE RECREATIONAL COMMERCIAL DESIGNATION OF
THE TERRA VISTA PLANNED COMMUNITY, LOCATED EAST OF
MILLIKEN AVENUE AND NORTH OF CHURCH STREET, AND MAKING
FINDINGS IN SUPPORT THEREOF - APN: 227-151-17.
A. Recitals.
(i ) Dimension Cable Service has filed an application for the
issuance of Conditional Use Permit No. 90-36 as described in the title of this
Resolution. Hereinafter in this Resolution, the subject Conditional Use
Permit request is referred to as "the application."
(ii ) On the 23rd day of January 1991, the Planning Commission of the
City of Rancho Cucamonga conducted a duly noticed public hearing on the
application and concluded said hearing on that date.
(iii ) All legal prerequisites prior to the adoption of this Resolution
have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined, and resolved by the
Planning Commission of the City of Rancho Cucamonga as follows:
1. This Commission hereby specifically finds that all of the facts
set forth in the Recitals, Part A, of this Resolution are true and correct.
2. Based upon substantial evidence presented to this Commission
during the above-referenced public hearing on January 23, 1991, including
written and oral staff reports, together with public testimony, this
Commission hereby specifically finds as follows:
(a) The application applies to property located east of
Milliken Avenue and north of Church Street and is presently vacant; and
(b) The property to the north of the subject site is
designated for park purposes and is presently vacant. The property to the
south is designated for Recreational Commercial uses and is currently
vacant. The properties to the east and west are designated for residential
uses and are vacant and developed with an apartment complex, respectively; and
(c) The cable receiving site is defined within the Terra Vista
Community Plan as a Community Facility and is allowed in any zoning
designation subject to approval of a Conditional Use Permit; and

(d) Considering the present zoning and development plans for
the area, the installation of a temporary cable receiving site provides for an
efficient use of the property until permanent development occurs in the
area. If, however, development plans are proposed for the area, the use of
the site for cable receiving shall be reconsidered with the proposed uses.
(e) The temporary cable receiving site proposal , together with
the recommended Conditions of Approval , complies with the minimum development
standards of the City of Rancho Cucamonga.
3. Based upon the substantial evidence presented to this Commission
during the above-referenced public hearing and upon the specific findings of
facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and
concludes as follows:
(a) That the proposed use is in accord with the General Plan,
the objectives of the Development Code, and the purposes of the district in
which the site is located.
(b) That the proposed use, together with the conditions
applicable thereto, will not be detrimental to the public health, safety, or
welfare or materially injurious to properties or improvements in the vicinity.
(c) That the proposed use complies with each of the applicable
provisions of the Development Code.
4. This Commission hereby finds and certifies that the project has
been reviewed and considered in compliance with the California Environmental
Quality Act of 1970 and, further, this Commission hereby issues a Negative
Declaration.
5. Based upon the findings and conclusions set forth in paragraphs
1, 2, 3, and 4 above, this Commission hereby approves the application subject
to each and every condition set forth below and in the attached Standard
Conditions, attached hereto and incorporated herein by this reference.
Planning Division
1) Approval of Conditional Use Permit No. 90-36 shall be
granted for an initial period of two years.
Thereafter, annual reviews shall be conducted to
determine the compatibility with the surrounding
area. If, based on the findings of the review, it is
determined that the use is incompatible with the
surrounding area, revocation proceedings may be
commenced. Upon revocation of the Conditional Use
Permit or relocation of the use to a permanent site,
the equipment and building shall be removed from the
site and the site restored to its former condition.

2) The block wall shall be stuccoed and painted to match
the YMCA approved color. The final plans shall be
reviewed and approved by the City Planner prior to
the issuance of building permits.
3) The landscaping along the south wall shall be pulled
away from the wall and more evenly dispersed to
better screen the dishes. The final Landscape Plans
shall be reviewed and approved by the City Planner
prior to the issuance of building permits.
4) Pursuant to provisions of California Public Resources
Code Section 21089(b), this application shall not be
operative, vested or final , nor will building permits
be issued or a map recorded, until (1) the Notice of
Determination (NOD) regarding the associated
environmental action is filed and posted with the
Clerk of the Board of Supervisors of the County of
San Bernardino; and (2) any and all required filing
fees assessed pursuant to California Fish and Game
Code Section 711.4, together with any required
handling charges, are paid to the County Clerk of the
County of San Bernardino. The applicant shall
provide the Planning Department with a stamped and
conformed copy of the NOD together with a receipt
showing that all fees have been paid.
In the event this application is determined exempt
from such filing fees pursuant to the provisions of
the California Fish and Game Code, or the guidelines
promulgated thereunder, except for payment of any
required handling charge for filing a Certificate of
Fee Exemption, this condition shall be deemed null
and void.
5) The driveway for the project shall be paved. Revised
plans shall be reviewed and approved by the City
Planner prior to the issuance of building permits.
6) The design of the temporary building shall be
reviewed and approved by the Design Review Committee
prior to the issuance of building permits.
7) Upon submittal of development plans for the remainder
of the parcel , if it is determined that the use is
compatible, plans for a permanent facility shall be
submitted for review and approval by the Design
Review Committee.

8) The color of the satellite dishes and the antenna
shall be reviewed and approved by the City Planner
prior to the issuance of building permits.
6. The Secretary to this Commission shall certify to the adoption
of this Resolution.
