HomeMy WebLinkAbout91-13 - Resolutions RESOLUTION NO. 91-13 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING A TIME EXTENSION FOR VARIANCE 88-09, A REQUEST TO REDUCE THE REQUIRED PARKING SETBACK ALONG FOOTHILL BOULEVARD FROM 50 FEET TO 40 FEET AND ALONG VINEYARD AVENUE FROM 50 FEET TO 43 FEET FOR A RETAIL CENTER AND SERVICE STATION TOTALING 4,416 SQUARE FEET ON 0.63 ACRES OF LAND IN THE COMMUNITY COMMERCIAL DISTRICT (SUBAREA 2) OF THE FOOTHILL BOULEVARD SPECIFIC PLAN, LOCATED AT THE SOUTHEAST CORNER OF FOOTHILL BOULEVARD AND VINEYARD AVENUE, AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 208-192-06. A. Recitals. (i ) Wheeler & Wheeler Architects has filed an application for the extension of Variance 88-09 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Time Extension request is referred to as "the application." (ii ) On January 18, 1989, the City Council adopted its Resolution No. 89-015 thereby approving, subject to specific conditions and time limits, Variance 88-09. (iii ) All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1 . This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission, including written and oral staff reports, this Commission hereby specifically finds as follows : (a) In originally approving Variance 88-09, the City Council provided facts to support the findings as outlined in City Council Resolution No. 89-015, hereby incorporated by reference; and (b) The conditions and/or circumstances in effect at the time of original approval of the Variance have not significantly changed; and (c) The extension of the Variance is not likely to cause public health or safety problems; and (d) The extension is within the time limits prescribed by state law and local ordinance. Based upon the findings and conclusions set forth in paragraphs 1 and 2 above, this Commission hereby grants a Time Extension for: Variance Applicant Expiration 88-09 Wheeler & Wheeler January 18, 1992 Architects 4. The Secretary to this Commission shall certify to the adoption of this Resolution. APPROVED AND ADOPTED THIS 13TH DAY OF FEBRUARY 1991.
