A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, CONDITIONALLY APPROVING
TENTATIVE PARCEL MAP NUMBER 13825, LOCATED AT THE
SOUTHEAST CORNER OF MILLIKEN AVENUE AND BASE LINE ROAD,
AND MAKING FINDINGS IN SUPPORT THEREOF - APN : 227-151-21
WHEREAS , Tentative Parcel Map Number 13825, submitted by Lewis
Development, applicant, for the purpose of subdividing into 10 parcels, the
real property situated in the City of Rancho Cucamonga, County of San
Bernardino, State of California, identified as APN 227-151-21, located at the
southeast corner of Milliken Avenue and Base Line Road; and
WHEREAS, on February 13, 1991, the Planning Commission held .a duly
advertised public hearing for the above-described map.
NOW, THEREFORE, THE RANCHO CUCAMONGA PLANNING COMMISSION RESOLVES AS
FOLLOWS:
SECTION 1 : That the following findings have been made:
1. That the map is consistent with the General Plan.
2. That the improvement of the proposed subdivision is
consistent with the General Plan.
3. That the site is physically suitable for the
proposed development.
4. That the proposed subdivision and improvements will
not cause substantial environmental damage or public
health problems or have adverse affects on abutting
properties.
SECTION 2 : This Commission finds and certifies that the project has
been reviewed and considered in compliance with the California Environmental
Quality Act of 1970; and further, this Commission hereby issues a Negative
Declaration.
SECTION 3 : Tentative Parcel Map Number 13825 is hereby approved
subject to the attached Standard Conditions and the following Special
Conditions:
1 . Full width street dedications shall be provided for Terra Vista
Parkway (100 feet) and Ellena West (72-79 feet) .
2. The following streets shall be constructed full width including
off-site street lights, except for off-site parkway improvements
which may be deferred until development of the adjacent
properties:

a) Milliken Avenue from Base Line Road to Foothill Boulevard,
including a landscaped median;
b) Base Line Road from Milliken Avenue to Mountain View Drive,
including a landscaped median; and
c) Terra Vista Parkway (including a landscaped median) and
Ellena West adjacent to the project, including a complete
intersection of the two.
3. Median island and parkway landscaping along Terra Vista Parkway,
Milliken Avenue, and Base Line Road shall conform to the results
of the respective beautification studies.
4. Provide 6-foot-wide street tree easements behind the sidewalk as
follows :
a) Along all right turn lanes where curb-adjacent sidewalk
occupies the minimum 7-foot right-of-way; and
b) Wherever driveway and intersection lines of sight cross the
parkway, as indicated on the grading and landscaping plans
for CUP 89-18.
5. An in-lieu fee as reimbursement for the previously undergrounded
overhead utilities (electrical , except for 66KV electrical ) on
the opposite side of Base Line Road shall be paid to the City
prior to the issuance of building permits. The fee shall be
one-half the City adopted unit amount times the length from the
center of Milliken Avenue to the center of Ellena West.
6. All project driveways shall be constructed per City Standard No.
306, including a maximum radius of 20 feet. The public sidewalk
shall cross the drive approach immediately behind the radius
return and be located within the right-of-way or a public
sidewalk easement.
7 . Provide right turn deceleration lanes which are a minimum of 11
feet wide and 230 feet long, including 90 feet of taper, for
project driveways on Milliken Avenue, Base Line Road, and Ellena
West as shown on the CUP 89-18 Site Plan. The right-of-way line
shall be parallel to and 7 feet behind the curb.
8. Terra Vista Parkway shall be widened to accommodate a continuous
right turn lane along the entire project frontage, including a
full 12-foot parkway.

9 . Construct bus bays on the east side of Milliken Avenue south of
Terra Vista Parkway and on the south side of Terra Vista Parkway
east of Milliken Avenue to the satisfaction of the City Traffic
Engineer.
10. Provide reciprocal parking easements for parcels 1 through 8 and
10.
11. If the on-site fire protection system is privately maintained,
joint maintenance agreements shall be provided by CC&Rs and
shall be recorded concurrent with the map.
12. The non-buildable easement on parcel 9 shall be approved by the
Building and Safety Division.
13. Contact the Building and Safety Division regarding plan check
requirements prior to first review of structures. Compliance
with Chapter 5 of the Uniform Building Code, 1988 Edition, shall
mean either:
a) That all buildings shall comply with the wall and opening
protection provisions, or
b) If unlimited area is used, reciprocal easements for 60 feet
around the perimeter of the structure shall be provided by
CC&Rs and shall be recorded concurrent with the map.
14. Pursuant to provisions of California Public Resources Code
Section 21089(b), this application shall not be operative,
vested or final , nor will building permits be issued or a map
recorded, until (1) the Notice of Determination (NOD) regarding
the associated environmental action is filed and posted with the
Clerk of the Board of Supervisors of the County of San
Bernardino; and (2) any and all required filing fees assessed
pursuant to California Fish and Game Code Section 711.4,
together with any required handling charges, are paid to the
County Clerk of the County of San Bernardino. The applicant
shall provide the Planning Department with a stamped and
conformed copy of the NOD together with a receipt showing that
all fees have been paid.
In the event this application is determined exempt from such
filing fees pursuant to the provisions of the California Fish
and Game Code, or the guidelines promulgated thereunder, except
for payment of any required handling charge for filing a
Certificate of Fee Exemption, this condition shall be deemed
null and void.
