A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, APPROVING TENTATIVE TRACT
MAP NO. 14368, A RESIDENTIAL SUBDIVISION OF 157
CONDOMINIUMS ON 8.67 ACRES OF LAND IN THE MEDIUM-HIGH
RESIDENTIAL DISTRICT (14-24 DWELLING UNITS PER ACRE) OF
THE TERRA VISTA PLANNED COMMUNITY, LOCATED ON THE WEST
SIDE OF MILLIKEN AVENUE, NORTH OF CHURCH STREET, AND
MAKING FINDINGS IN SUPPORT THEREOF - APN: 1077-421-16.
A. Recitals.
(i ) Western Properties has filed an application for the approval of
Tentative Tract Map No. 14368 as described in the title of this Resolution.
Hereinafter in this Resolution, the subject Tentative Tract Map request is
referred to as "the application."
(ii ) On the 13th of February 1991, the Planning Commission of the
City of Rancho Cucamonga conducted a duly noticed public hearing on the
application and concluded said hearing on that date.
(iii ) All legal prerequisites prior to the adoption of this Resolution
have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined, and resolved by the
Planning Commission of the City of Rancho Cucamonga as follows:
1 . This Commission hereby specifically finds that all of the facts
set forth in the Recitals, Part A, of this Resolution are true and correct.
2. Based upon substantial evidence presented to this Commission
during the above-referenced public hearing on February 13, 1991, including
written and oral staff reports, together with public testimony, this
Commission hereby specifically finds as follows:
(a) The application applies to property located on the west
side of Milliken Avenue, north of Church Street. The site has a street
frontage of 860 feet along Milliken Avenue. The site is presently vacant; and
(b) The property to the north and a portion of the property to
the east are being developed with parks (West Greenway and Milliken,
respectively) . The property to the south is developed with a 384 unit
apartment project (Del Mar Apartments). The property to the west and a
portion of the property to the east are vacant; and
(c) The project is proposed to be an extension of the existing
384 unit, Del Mar Apartments located to the south; and

(d) The project, with the recommended conditions of approval ,
complies with all minimum development standards of the City of Rancho
Cucamonga; and
(e) The development of 157 condominium units on 8.67 acres of
land is consistent with the Medium-High Residential designation of the Terra
Vista Community Plan and Development Code.
3. Based upon the substantial evidence presented to this Commission
during the above-referenced public hearing and upon the specific findings of
facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and
concludes as follows:
(a) That tentative tract is consistent with the General Plan,
Development Code, and Specific Plans; and
(b) The design or improvement of the tentative tract is
consistent with the General Plan, Development Code, and Specific Plans; and
(c) The site is physically suitable for the type of development
proposed; and
(d) The design of the subdivision is not likely to cause
substantial environmental damage and avoidable injury to humans and wildlife
or their habitat; and
(e) The tentative tract is not likely to cause serious public
health problems; and
(f) The design of the tentative tract will not conflict with
any easement acquired by the public at large, now of record, for access
through or use of the property within the proposed subdivision.
4. This Commission hereby finds and certifies that the project has
been reviewed and considered in compliance with the California Environmental
Quality Act of 1970 and, further, this Commission hereby issues a Negative
Declaration.
5. Based upon the findings and conclusions set forth in paragraphs
1, 2, 3, and 4 above, this Commission hereby approves the application subject
to each and every condition set forth below and in the attached Standard
Conditions attached hereto and incorporated herein by this reference.
Planning Division
1 . Prior to the recordation of the final map or the issuance
of building permits, whichever comes first, the applicant
shall consent to, or participate in, the establishment of a
Mello-Roos Community Facilities District pertaining to the
project site to provide in conjunction with the applicable

School District for the construction and maintenance of
necessary school facilities. However, if any School
District has previously established such a Community
Facilities District, the applicant shall , in the
alternative, consent to the annexation of the project site
into the territory of such existing District prior to the
recordation of the final map or issuance of building
permits, whichever comes first.
Further, if the affected School District has not formed a
Mello-Roos Community Facilities District within twelve
months of the date of approval of the project and prior to
the recordation of the final map or issuance of building
permits for said project, this condition shall be deemed
null and void. If the developer and any affected school
districts reach a private agreement, this condition shall
be deemed null and void.
2. Pursuant to provisions of California Public Resources Code
Section 21089(b) , this application shall not be operative,
vested or final , nor will building permits be issued or a
map recorded, until (1) the Notice of Determination (NOD)
regarding the associated environmental action is filed and
posted with the Clerk of the Board of Supervisors of the
County of San Bernardino; and (2) any and all required
filing fees assessed pursuant to California Fish and Game
Code Section 711.4, together with any required handling
charges, are paid to the County Clerk of the County of San
Bernardino. The applicant shall provide the Planning
Department with a stamped and conformed copy of the NOD
together with a receipt showing that all fees have been
paid.
In the event this application is determined exempt from
such filing fees pursuant to the provisions of the
California Fish and Game Code, or the guidelines
promulgated thereunder, except for payment of any required
handling charge for filing a Certificate of Fee Exemption,
this condition shall be deemed null and void.
Engineering Division
1 . Milliken Avenue shall be constructed from Base Line Road to
Foothill Boulevard as follows:
a. Full improvement for both roadbeds; and
b. Full median with landscaping; and

c. Sidewalk and parkway landscaping beyond the tract
boundary may be deferred until development of the
adjacent property.
2. The following storm drain facilities shall be constructed
prior to occupancy (per the Terra Vista Master Plan of
Drainage) :
a. Storm drain line no. 1 from Deer Creek Channel to the
subject project; and
b. La Mission Park basin, located at the northwest corner
of Church Street and Elm Avenue.
3. An easement for reciprocal access across the project drive
aisles in favor of Tract 13270 shall be provided prior to
final map approval .
4. Landscaping within the "Area of Concern" of the vehicular
line of sight shall be approved by the City Engineer. A
tree maintenance easement shall be required for street
trees placed on private property.
5. A southbound right turn deceleration land shall be
constructed for the project entrance to the satisfaction of
the City Engineer.
6. Additional street right-of-way shall be dedicated along
right turn lanes, to provide a minimum of 7 feet measured
from the face of curb. If curb adjacent sidewalk is used
along the right turn lane, a paralleled street tree
maintenance easement shall be provided.
7 . Install a traffic signal at the project entry on Milliken
Avenue to serve this site and the YMCA driveway across the
street.
8. The parkway and median island landscaping on Milliken
Avenue shall conform to the results of the City' s
beautification study for Milliken Avenue.
9. Construct the Secondary Greenway Trail Type "D" along the
east boundary of the future school site from Elm Avenue
northerly to the West Greenway Corridor.
6. The Secretary to this Commission shall certify to the adoption
of this Resolution.
