HomeMy WebLinkAbout91-39 - Resolutions RESOLUTION NO. 91-39 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, RECOMMENDING APPROVAL OF INDUSTRIAL AREA SPECIFIC PLAN AMENDMENT 91-03, ESTABLISHING REGULATIONS FOR AN INDOOR WHOLESALE/RETAIL COMMERCIAL USE, MODIFYING THE DEFINITION OF EXTENSIVE IMPACT COMMERCIAL USE, AND MAKING FINDINGS IN SUPPORT THEREOF. A. Recitals (i) The City of Rancho Cucamonga has initiated an application for Industrial Area Specific Plan Amendment 91-03 as described in the title of this Resolution. Hereinafter, in this Resolution, the subject Time Extension request is referred to as "the application. " (ii) On April 24, and continued to May 8, 1991, the Planning Commission of the City of Rancho Cucamonga conducted duly noticed public hearings on the application and concluded said hearing on that date. (iii) All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission, during the above-referenced public hearings on April 24, and May 8, 1991, including written and oral staff reports, this Commission hereby specifically finds as follows: (a) The proposed amendments will not have a significant impact on the environment as evidenced by the conclusions and findings of the Initial Study, Part II; (b) The application applies to properties located within Subareas 8-11 and 13-15 of the Industrial Area Specific Plan. (c) The proposed amendment would be in the best interest of the health, safety and welfare of the citizens of the City of Rancho Cucamonga for the reasons as follows: 1) That the proposed amendment will distinguish between the Extensive Impact Commercial use and the Indoor Wholesale/Retail Commercial use. PLANNING COMMISSION RESOLUTION NO. 91-39 ISPA 91-03 - CITY OF RANCHO CUCAMONGA May 8, 1991 Page 2 2) That the proposed amendment will establish a parking criteria of 1 space per 100 square feet for the Indoor Wholesale/Retail Commercial use within the Industrial Area Specific Plan. 3) That the proposed amendment identifies the additional submittal requirements of a Management Plan and a Traffic Study to ensure that surrounding land uses are not negatively impacted. 4) That the proposed amendment will prohibit outdoor swap meets because of their associated aesthetic, traffic, parking, maintenance, and security impacts. 3. Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and concludes as follows: (a) That the proposed amendment is consistent with the objectives of the Industrial Area Specific Plan, and the purposes of the District in which the site is located. (b) That the proposed amendment will not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity. (c) That the proposed amendment is in compliance with each of the applicable provisions of the Industrial Area Specific Plan. (d) That the proposed amendment will not be detrimental to the objectives of the General Plan or the Industrial Area Specific Plan. 4. This Commission hereby finds that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby recommends issuance of a Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and 4 above, this Commission hereby resolves as follows: (a) That the Planning Commission of the City of Rancho Cucamonga hereby recommends approval of Industrial Area Specific Plan Amendment 91-03 per the attached Ordinance. 6. The Secretary to this Commission shall certify to the adoption of this Resolution. APPROVED AND ADOPTED THIS 8TH DAY OF MAY 1991. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING INDUSTRIAL AREA SPECIFIC PLAN AMENDMENT 91-03, ESTABLISHING REGULATIONS FOR THE INDOOR WHOLESALE/RETAIL COMMERCIAL USE, MODIFYING THE DEFINITION OF EXTENSIVE IMPACT COMMERCIAL USE, AND MAKING FINDINGS IN SUPPORT THEREOF. The City Council of the City of Rancho Cucamonga does ordain as follows: SECTION 1: Part III, Table III-1 is hereby amended to read, in words and figures, as shown in the attached Exhibit "A". SECTION 2: Part III, Table II1-2, Land Use Type Definitions, Section D is hereby added to read, in words and figures, as follows: D. COMMERCIAL USE TYPES Indoor Wholesale/Retail Commercial: Activities typically include, but are not limited to: retail, wholesale, or discount sales. These types of businesses exclusively involve multiple vendors selling new goods in separate, permanent display structures. Uses typically include, but are not limited to: discount outlets and indoor swap meets. SECTION 3: Part III, Table III-2, Subsection D, land use type of definition for Extensive Impact Commercial is hereby amended to read, in words and figures, as follows: Extensive Impact Commercial: Activities typically include, but are not limited to: those which produce or may produce a substantial impact upon the surrounding area. Uses typically include, but are not limited to: amusement parks, and drive-in movie theaters. SECTION 4: Part III, Section IV - Subsection F.3, parking and loading requirements, is hereby amended to add: g. Indoor Wholesale/Retail Commercial use: 1 space per 100 square feet. Alternatively, as part of the conditional use permit review, the Planning Commission may allow 1 space per 150 square feet subject to presentation of traffic and parking studies. ISPA 91-03 - CITY OF RANCHO CUCAMONGA May 8, 1991 Page 2 SECTION 5: Part IV is hereby amended to add "Indoor Wholesale/Retail Commercial" as a conditionally permitted use within Subareas 8-11 and 13-15. SECTION 6: This Council finds that this amendment will not adversely affect the environment and hereby issues a Negative Declaration. SECTION 7: The City Council declares that, should any provision, section, paragraph, sentence, or word of this Ordinance be rendered or declared invalid by any final court action in a court of competent jurisdiction, or by reason of any preemptive legislation; the remaining provisions, sections, paragraphs, sentences, and words of this Ordinance shall remain in full force and effect. SECTION 8: The City Clerk shall certify the adoption of this Ordinance and shall cause the same to be published within 15 days after its passage at least once in the Inland Valley Daily Bulletin, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of Rancho Cucamonga, California.
