RESOLUTION NO. 91-108 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO. 90-42 FOR THE DEVELOPMENT OF AN INTEGRATED SHOPPING CENTER INCLUDING 13 COMMERCIAL BUILDINGS TOTALING 318,283 SQUARE FEET AND A SERVICE STATION/CAR WASH BUILDING TOTALING 2,300 SQUARE FEET ON 31.13 ACRES OF LAND WITH PHASE I DEVELOPMENT CONSISTING OF 5 BUILDINGS TOTALING 267,960 SQUARE FEET ON APPROXIMATELY 22 ACRES IN THE REGIONAL RELATED OFFICE/COMMERCIAL DISTRICT OF THE VICTORIA COMMUNITY PLAN, LOCATED ON THE SOUTH SIDE OF FOOTHILL BOULEVARD, WEST OF THE FUTURE DAY CREEK BOULEVARD, AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 229-021-10, 15, 19, and 28. A. Recitals. (i) Hughes Investments has filed an application for the issuance of the Conditional Use Permit No. 90-42 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Conditional Use Permit request is referred to as "the application." (ii) On the 10th day of July 1991, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. (iii) All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced public hearing on July 10, 1991, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: (a) The application applies to property located on the south side of Foothill Boulevard, west of the future Day Creek Boulevard, with a Foothill Boulevard frontage of approximately 1,000 feet and lot depth of 2,255 feet and is presently unimproved; (b) The property to the north of the subject site is vacant, the property to the south of the site incorporates the existing Devore Freeway right-of-way and the properties to the east and west are vacant Southern California Edison Utility corridors; PLANNING COMMISSION RESOLUTION NO. 91-108 CUP 90-42 - HUGHES INVESTMENTS July 10, 1991 Page 2 (c) The property is zoned "Regional Related Office/Commercial" by the Victoria Community Plan; and (d) The project development is proposed to be phased with the construction of Buildings 4 and 11 through 14 occurring initially. All other buildings, which are considered to be within the second phase of development, will require specific review and approval through the Development Review process in the future. 3. Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and concludes as follows: (a) That the proposed use is in accord with the General Plan, the objectives of the Development Code and the Victoria Community Plan, and the purposes of the district in which the site is located. (b) That the proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. (c) That the proposed use complies with each of the applicable provisions of the Development Code and Victoria Community Plan. 4. This Commission hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby issues a mitigated Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and 4 above, this Commission hereby approves the application subject to each and every condition set forth below and in the Standard Conditions attached hereto and incorporated herein by this reference. Planning Division: 1. Pursuant to provisions of California Public Resources Code Section 21089(b) , this application shall not be operative, vested, or final, nor will building permits be issued or a map recorded, until (1) the Notice of Determination (NOD) regarding the associated environmental action is filed and posted with the Clerk of the Board of Supervisors of the County of San Bernardino; and (2) any and all required filing fees assessed pursuant to California Fish and Game Code Section 711.4, together with any required handling charges, are paid to the County Clerk of the County of San Bernardino. The applicant shall provide PLANNING COMMISSION RESOLUTION NO. 91-108 CUP 90-42 - HUGHES INVESTMENTS July 10, 1991 Page 3 the Planning Department with a stamped and conformed copy of the Notice of Determination together with a receipt showing that all fees have been paid. In the event this application is determined exempt from such filing fees pursuant to the provisions from such filing fees pursuant to the provisions of the California Fish and Game Code, or the guidelines promulgated thereunder, except for payment of any required handling charge for filing a Certificate of Fee Exemption, this condition shall be deemed null and void. 2) Metal grill work shall be utilized within the openings on all dome towers above the tile roof areas. The metal grill work shall be similar in design and color to the metal grill work proposed in other areas within the center. Details of the grill treatment shall be reviewed and approved by the City Planner prior to the issuance of building permits. 3) Alternative decorative tile styles and finishes shall be reviewed and approved by the Design Review Committee on a Consent Calendar basis prior to the issuance of building permits. 4) Twenty-four inch box size, or larger, trees shall be used exclusively in the planter within the long row of parking spaces south of the K-Mart Garden Center. 5) All back sides of towers shall be treated architecturally equal to the satisfaction of the City Planner. 6) Additional enriched pavement shall be provided across vehicular drive aisles at key pedestrian crossing locations subject to review and approval of the City Planner prior to the issuance of building permits. 7) A reef stone wainscot with protective curbing shall be utilized on all planters adjacent to building and pedestrian areas. 8) Additional landscape fingers or tree wells shall be provided to break up long rows of parking stalls and to provide trees to shade PLANNING COMMISSION RESOLUTION NO. 91-108 CUP 90-42 - HUGHES INVESTMENTS July 10, 1991 Page 4 the parking lot at a ratio of one tree per three stalls. The location of these fingers shall be subject to review and approval by the City Planner prior to issuance of building permits. This requirement shall not waive the minimum numerical parking requirements for the entire conceptually approved project. 9) Berming, low walls, dense hedgerows of evergreen shrubs, or a combination thereof, shall be provided to sufficiently screen all parking areas from view of perimeter special boulevards, to the satisfaction of the City Planner. The detailed landscape/irrigation plans shall indicate this requirement. 10) Any landscaping within existing or future sewer easements shall be required to comply with all requirements of the affected agencies. Letters of authorization from these affected agencies shall be submitted to the Planning Division prior to approval of the detailed landscape/irrigation plans. 11) The Devore Freeway right-of-way adjacent to the project shall be landscaped in accordance with a master plan for the entire segment of the freeway within the City as approved by Caltrans, the City Planner, and the City Engineer. However, if Caltrans will not allow the incremental construction of this freeway landscaping with this project, a cash payment in lieu of construction, as a contribution to a future comprehensive project, shall be made to the City prior to the issuance of building permits. The developer's responsibility shall be limited to the area west of the west edge of the first travel lane across the project frontage. 12) Additional cart corral storage areas shall be provided, especially in the center and at the far ends of rows of parking stalls adjacent to Home Depot and K-Mart; however, this shall not reduce required parking spaces. 13) All trash enclosures shall be located in areas concealed from view of main streets so as not to hide key architectural elements on adjacent buildings or cause internal circulation conflicts. The exact location shall be PLANNING COMMISSION RESOLUTION NO. 91-108 CUP 90-42 - HUGHES INVESTMENTS July 10, 1991 Page 5 reviewed and approved by the City Planner prior to the issuance of building permits. 14) Any satellite dish shown on the conceptual plans is not approved as part of the application; it will be subject to a separate Minor Development Review application prior to installation. 15) A separate Conditional Use Permit application shall be submitted for review and approval of the proposed service station. 16) A separate Development/Design Review or Conditional Use Permit shall be submitted for review and approval of any proposed building on all future pad parcels. Any future drive-thru uses shall comply with the policies contained within Planning Commission Resolution No. 88-96. 17) A Uniform Sign Program for the shopping center, including the major tenants for Buildings K, M, and B, shall be designed to be compatible with the architectural style. Variation of sign color shall be minimal. The size of the sign copy shall be visually balanced and proportionate to the building and the architecture style. The Uniform Sign Program shall be reviewed and approved by the Design Review Committee prior to issuance of building permits. 18) Graffiti shall be removed within 72 hours. 19) A uniform hardscape and street furniture treatment, including trash receptacles, free- standing potted plants, bike racks, light bollards, benches, etc. , shall be utilized for the shopping center and shall be designed to be compatible with the architectural style. Detailed designs shall be submitted for Planning Division review and approval prior to issuance of building permits. 20) The following trees shall be at least 36-inch box size: a) Trees framing the primary Home Depot and K-Mart entrances: PLANNING COMMISSION RESOLUTION NO. 91-l08 CUP 90-42 - HUGHES INVESTMENTS July 10, 1991 Page 6 b) Entry access trees; c) Plaza trees at the intersection of Day Creek and Foothill Boulevard and all plaza nodes. 21) Lot A (the linear parcel east of Day Creek Boulevard, near the south central portion of the site) shall be landscaped to the satisfaction of the City Planner and City Engineer. 22) All future building pads shall be seeded and irrigated for erosion control. Detailed plans shall be included within the landscape and irrigation plans which shall be submitted for Planning Division review and approval prior to issuance of building permits. 23) All future projects within the shopping center shall be designed to be compatible and consistent with the architectural program established. 24) Any outdoor vending machines shall be recessed into building faces and shall not extend out into the pedestrian walkways. The design details shall be reviewed and approved by the City Planner. 25) The entire site shall be kept free of trash and debris at all times, and in no event shall trash and debris remain for more than 24 hours. 26) The applicant shall resolve any Building Code compliance difficulties (with construction of canopies, property lines in relation to walls and other openings, and roof tile installation to withstand severe winds) with the Building & Safety Division prior to issuance of building permits. 27) There shall be provisions for the following design features in the trash enclosure to the satisfaction of the City Planner: a) Architecturally integrated into the design of the shopping center. PLANNING COMMISSION RESOLUTION NO. 91-108 CUP 90-42 - HUGHES INVESTMENTS July 10, 1991 Page 7 b) Separate pedestrian access that does not require opening the main doors to include self-closing pedestrian door. c) Large enough to accommodate two trash bins. d) Roll-up doors. e) Trash bins with counter-weighted lids. f) Architecturally treated overhead shade trellis. g) Chain link screen on top to prevent trash from blowing out of enclosure and designed to be hidden from view. 28) Stacking of materials shall not exceed the height of the screen walls for the K-Mart and Home Deport Garden Centers. 29) Outdoor displays shall not be allowed in the passenger pull-off areas in front of Home Depot or any other areas within the center that blocks vehicular or pedestrian circulation. 30) There shall be a provision for a security patrol of the shopping center at least three times per evening, seven days per week, between the hours of 10:00 p.m. and 6:00 a.m. by a licensed private patrol. 31) A bus shelter on Day Creek Boulevard shall be installed with street improvements. Final location shall be submitted for City Planner review and approval prior to issuance of any building permits for the center. 32) No occupancy shall be permitted for any user until all street improvements have been installed to the satisfaction of the City. 33) If phasing is proposed, the phasing plan shall be reviewed and approved by the Planning Commission prior to the issuance of any building permits for the center. 34) No permanent outdoor storage of shopping carts shall be permitted, unless otherwise approved by the Planning Commission. PLANNING COMMISSION RESOLUTION NO. 91-108 CUP 90-42 - HUGHES INVESTMENTS July 10, 1991 Page 8 35) Bicycle storage spaces shall be provided at a rate equal to 5 percent of the required automobile parking stalls, up to a maximum of 100 bicycle storage spaces. Security racks shall be provided for each storage space and shall be located near main building entrances in highly visible areas to minimize theft and vandalism. An aisle or other space shall be provided for bicycles to enter and leave the storage spaces with a minimum width of 5 feet to the front or rear of a standard 6-foot bicycle parked in the space. 36) A revised landscaping plan for Lot "A" shall be reviewed by the Design Review Committee on a consent calendar basis prior to the issuance of building permits. Engineering Division: 1) Provide necessary right-of-way and construct Foothill Boulevard full width from Rochester Avenue to Route 15. Sidewalk and parkway landscaping shall be constructed along the south side of the street from the centerline of the Day Creek Channel to the centerline of the Southern California Edison Corridor on the east side of Day Creek Boulevard and may be deferred for the remaining portion of the street until development of the adjacent property. The limits of the off-site improvements may be reduced if approved by the City Council. 2) Provide necessary right-of-way and construct Day Creek Boulevard/Pioneer Way full width from Foothill Boulevard to Rochester Avenue. The median island shall extend from Foothill Boulevard to the north side of the most southerly driveway. The street curb-to-curb width shall be increased by 2 feet (from 64 to 66 feet) to accommodate the median within the Pioneer Way portion of the street. Sidewalk, and parkway landscaping may be deferred until development of the adjacent property for the portion west of the centerline of Day Creek Channel. 3) The developer shall be eligible for fee credit against and reimbursement from the Transportation Development Fees for the PLANNING COMMISSION RESOLUTION NO. 91-108 CUP 90-42 - HUGHES INVESTMENTS July 10, 1991 Page 9 portion of the improvement on Foothill Boulevard and Day Creek Boulevard/Pioneer Way determined by the City Engineer to be of supplemental size and length or capacity over that needed for the impacts of the development in conformance with City policy. In addition, the developer may request a Reimbursement Agreement to recover the cost of off-site street improvements from future development of the adjacent property for non-backbone improvements. 4) Construct drainage facilities in conformance with the Victoria Lakes Area "Drainage Improvement Implementation Policy" as follows: a) All facilities within Day Creek Boulevard/Pioneer Way from Day Creek Channel to north of Foothill Boulevard as necessary to serve and protect the site; and b) Reconstruct the existing channel parallel to the freeway, as necessary, as approved by the City Engineer. 5) Acquire easements and construct interim drainage facilities as determined necessary in the final drainage study to protect the site from flows from the north or as otherwise approved by the City Engineer. 6) Construct traffic signals at the intersections of Foothill Boulevard with Day Creek Boulevard and Rochester Avenue with Pioneer Way to the satisfaction of the City Engineer. The developer shall be eligible for fee credit against and reimbursement from the Transportation Development Fees for construction of the traffic signals beyond those needed to mitigate the impacts of this development, in conformance with City policy. 7) Construct a traffic signal at the project's main entrance on Day Creek Boulevard to the satisfaction of the City Engineer. 8) An in-lieu fee as contribution to the future undergrounding of the existing overhead utilities (electrical, except for 66KV electrical) on the opposite side of Arrow PLANNING COMMISSION RESOLUTION NO. 91-108 CUP 90-42 - HUGHES INVESTMENTS July 10, 1991 Page 10 Route shall be paid to the City prior to approval of final map or issuance of building permits, whichever occurs first. The fee shall be one-half the City adopted unit amount times the length from the center of the I-15 Freeway right-of-way to the center of Day Creek Channel. 9) A temporary easement for a Foothill Boulevard detour for the Day Creek project shall be provided to the satisfaction of the City Engineer. Improvements within this easement cannot be constructed until the construction of the bridge on Foothill Boulevard is complete. 10) Landscaping within the area for concern for all project driveways shall be approved by the City Engineer. 11) Construct drainage facilities within Pioneer Way as determined necessary by a Final Drainage Study approved by the City Engineer considering the area bounded by Pioneer Way, Rochester Avenue, Foothill Boulevard, and Day Creek Channel. 12) The maintenance of the parkway on the east side of Day Creek Boulevard/Pioneer Way from the east side of the Edison Corridor to Foothill Boulevard including Lot "A" shall be the responsibility of the shopping center. Lot "A" shall be included in Parcel 11 or some other method shall be provided to guarantee the perpetual maintenance and ownership of Lot "A" as approved by the City Engineer and City Attorney. 13) Approval from Southern California Edison shall be provided for the construction of the service driveway within their easement or provide proof to the satisfaction of the City Engineer and City Attorney that the driveway can be legally constructed. 14) The service driveway on Foothill Boulevard shall be 35 feet in width as measured at the right-of-way line. 6. The Secretary to this Commission shall certify to the adoption of this Resolution. They shall be recorded concurrently with the Final Map or prior to the issuance of building permits, whichever occurs first. A recorded copy shall be provided to the City Engineer. 16. All pathways, open areas,and landscaping shall be permanently maintained by the property owner, homeowners' association, or other means acceptable to the City. Proof of this landscape maintenance shall be submitted for City Planner and City Engineer review and approval prior to issuance of building permits. 17. Solar access easements shall be dedicated for the purpose of assuming that each lot or ��- dwelling unit shall have the right to receive sunlight across adjacent lots or units for use of a solar energy system.The easements may be contained in a Declaration of Restrictions for the subdivision which shall be recorded concurrently with the recordation of the final map or issuance of permits, whichever comes first. The easements shall prohibit the casting of shadows by vegetation, structures,fixtures or any other object, except for utility wires and similar objects, pursuant to Development Code Section 17.08.060-G-2. 18. The project contains a designated Historical Landmark. The site shall be developed and _1_1._ maintained in accordance with the Historic Landmark Alteration Permit No. . Any further modifications to the site including,but not limited to,exterior alterations and/or interior alterations which attest the exterior of the buildings or structures,removal of landmark • trees,demolition,relocation,reconstruction of buildings or structures,or changes to the site, shall require a modification to the Historic Landmark Alteration Permit subject to Historic Preservation Commission review and approval. C. Building Design 1. An alternative energy system is required to provide domestic hot water for all dwelling units �—J- and for heating any swimming pool or spa, unless other alternative energy systems are demonstrated to be of equivalent capacity and efficiency.
