HomeMy WebLinkAbout92-131 - Resolutions RESOLUTION NO. 92-131 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING A TIME EXTENSION FOR TENTATIVE TRACT NO. 14771, A PREVIOUSLY APPROVED TRACT MAP LOCATED EAST OF HAVEN AVENUE AND NORTH OF RINGSTEM DRIVE IN THE VERY LOW RESIDENTIAL DISTRICT (LESS THAN 2 DWELLING UNITS PER ACRE) , AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 201-121-24 A. Recitals (i) Brock Homes has filed an application for the extension of Tentative Tract No. 14771 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Time Extension request is referred to as "the application. " (ii) On November 14, 1990, this Commission adopted its Resolution No. 90-138, thereby approving, subject to specific conditions and time limits, Tentative Tract No. 14771. (iii) On September 16, 1992, the applicant filed a request for a twelve-month time extension. (iv) On October 28, 1992, the Planning Commission of the City of Rancho Cucamonga conducted a meeting on the application and concluded said meeting on that date. (v) All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission, including written and oral staff reports, this Commission hereby specifically finds as follows: a. The previously approved tract map is in substantial compliance with the City's current General Plan and Development Code. b. That prevailing economic conditions have caused a distressed market climate for development of the project. c. That current economic, marketing, and inventory conditions make it unreasonable to develop the project at this time. d. That strict enforcement of the conditions of approval regarding expirations would not be consistent with the intent of the Development Code. That the granting of said time extension will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. f. The extension is within the time limits prescribed by State law and local ordinance. 3. Based upon the findings and conclusions set forth in paragraphs 1 and 2 above, this Commission hereby grants a Time Extension for: Tract Applicant Expiration 14771 Brock Homes November 14, 1993 4. The Secretary to this Commission shall certify to the adoption of this Resolution. APPROVED AND ADOPTED THIS 28TH DAY OF OCTOBER 1992. PLANNING CO .
