A RESOLUTION OF THE BOARD OF DIRECTORS OF THE
RANCHO CUCAMONGA FIRE PROTECTION DISTRICT,
RANCHO CUCAMONGA, CALIFORNIA, REVISING THE
TECHNOLOGY FEE ESTABLISHED BY RESOLUTION NO. FD
12-057 AND WAIVING THE COLLECTION OF THE
TECHNOLOGY FEE IN ACCORDANCE WITH RESOLUTION FD
13-032.
A. Recitals
(i) The Government Code requires that prior to levying a new fee or
increasing an existing fee or service charge as hereinafter set forth, the
local agency shall hold a noticed public hearing to consider the matter.
(ii) On March 2, 2016, the Rancho Cucamonga Fire Protection District
conducted and concluded a duly noticed public hearing concerning the
proposed fees and service charges, as required by law.
(iii) All legal prerequisites to adoption of this Resolution have occurred.
B. Resolution
NOW, THEREFORE, the Board of Directors of the Rancho Cucamonga Fire Protection
District hereby finds and resolves as follows:
1. The facts set forth in Recitals, Part A of this Resolution, are true and
correct.
2. The Board of Directors has determined that the fee established herein
does not exceed the reasonable estimated cost of providing the service to
which the fee applies or the actual cost recovery of the materials,
products, and/or use of facilities.
3. The Technology Fee is revised to be five percent (5%) of inspection and
permit fees.
4. The collection of the Technology Fee is waived in accordance with
Resolution No. FD 13-032.
5. This Resolution shall take effect 60 days from the date of approval.
6. The Secretary to the Rancho Cucamonga Fire Protection District shall
certify to the adoption of this Resolution.
