A. C~T.T. TO ORDER
A regular meeting of the Rancho Cucamonga City Council was held on Wednesday,
November 20, 1991, in the Council Chambers of the Civic Center, located at 10500
Civic Center Drive, Rancho Cucamonga, California. The meeting was called to
order at 7:11 p.m. by Mayor Dennis L. Stout.
Present were Councilmembers: William J. Alexander, Charles J. Buquet II, Diane
Williams, Pamela J. Wright, and Mayor Dennis L. Stout.

F1. CONSIDERATION OF COST 'RECOVERY FOR COMMUNITY SERVICES PROGRAMS Staff
report presented by Joe Schultz, Community Services Director. He also stated the
staff report has been distributed to anyone who had not received it prior to the
start of the meeting. (0401-12 FEES)
Kathy Sorensen, Recreation Superintendent, displayed the various sports
organizations with their current fee that they pay and the proposed fee from the
Griffith Study recommendation.
Joe Schultz, Con~nunity Services Director, also pointed out that anyone playing
under the lights would be subsidized. He mentioned that Erin Griffin of David
M. Griffith and Associates was available to answer any questions pertaining to
the study itself.

Councilmember Buquet stated this had been a very difficult issue for him to deal
with. He stated this is not to collect 100% of the cost involved.
Mayor Stout Opened the meeting for public hearing. Addressing the City Council
were:
Larry Meracle asked why the City needs the Sports Complex if they cannot
afford fields for the kids. He stated he did not want to make it where
the kids could not afford to play sports. He felt if the cost of sport
activities goes up and was too expensive for some kids to play, that gangs
would result because of that.
Laura Raponi, stated she has lived in the community for ten years, felt
the lights in the park also~made it safer for people who were walking
through the parks.
Peter Bryan, 9496 Hillside, felt that through sports they have been able
to bring kids together. He felt there was a group of residents in the
northwest quadrant of the City that were already paying taxes for this
same matter. He suggested there be a Citywide assessment instead of only
charging those playing sports.
Sandy Oerly, 5652 Emerald, distributed a letter to the City Council and
read her statement, which is on file in the City Clerk's Office.
Bob Olari, 9637 Manzanita, also distributed a letter to the City Council
and read it into the record, which is on file in the office of the City
Clerk.
Primo Morales, 8210 Malvern, felt this would place a great burden on the
sports people. He continued to point out the costly items the City is
already maintaining or has purchased. He asked where the City's
priorities were. He asked the City Council to read Section 5, pages 46,
47 and 48, before making a decision.
Linda Eddie, a resident for twelve years, stated she did not think the
entire con~nunity appreciated the impact of the Griffith Study. She stated
she was troubled that the City Council did not grant more time to allow
the public to read through the information pertaining to the study. She
stated she had also conducted her own study for report information as to
what other cities are charging for usage of fields and associated costs.
She stated she was not sure that this proposal was the only way for our
City Council to go.
Jean Lo~bardo, 8452 Garden Street, did not agree with the fees being
proposed. She felt if the kids could not afford to play, they would be
hardened. She also read a letter which asked the City Council not to
raise the registration fees which she had received from someone.

Carmen Angelo, 12774 Basil Street, with the Rancho Cucamonga Spirit,
stated they are not being charged the $75.00 as was previously mentioned.
He felt if volunteers were to run the programs, they could run it cheaper
than the City was running it.
Cassandra Henderson, 8242 Rosebud, with the 4-H Club, stated she supports
the Park and Recreation Commission's recommendation, but felt equestrian
should be considered differently. She pointed out that Group 2 users are
non-profit.
Steve Ribbon, 10006 Balsa, felt because of sports it has helped kids to
raise their grade point average. He felt they were being penalized by
having to pay increases to play sports.
Jim Rob, 11550 Mr. Rainier, asked what the increases would go to. He did
not know why only one side of the City has lighted fields and the other
side does not. He asked if the City Council was pushing out the sports
groups.
Marsha Young, 12324 Daisy Court, pointed out various projects the City is
involved in and felt they were taking precedence over the sports groups.
She stated she cannot afford to pay the increase in fees.
Eric Snedeker, 7534 Plymouth, stated he did not have a problemwith paying
his share of the increase.
John Rose, 7072 Jasper, felt the youth programs were not City programs but
community programs, because they were established long before the City was
a city. He did not feel cost recovery should come from the sports groups.
Bob Olari, 9637 Manzanita, also read a letter from Donnie McKay of
Southern California Edison on lighting costs, which is on file in the
office of the City Clerk. He continued to give more information on
lighting costs. He felt the City should look at the number of lights at
each site and determine how much should be charged for each location, and
only charge each location its fair share. He felt there should be further
study.on this matter.
Gary Luke, 6886 Saddleback, did not feel the youth should be directly
involved in this cost recovery.
Cheryl Moody, 6355 Jadeite, asked the City Council who subsidizes all the
nice things that the City has and uses.
Wilma Brenner, a senior citizen, stated she also was upset with the
Griffith Study.
Chuck Smoot, 8957 Mandarin, did not agree with the Griffith Study.
Bob Martin, 8263 Alta Loma Drive, stated he has never asked to have his
volunteer time cost recovered.

Jerry Dykas, 9934 C Highland Avenue, con~nented on the freedom of speech
that everyone in the room was able to express. He stated he wants to help
clean up the con~nunity. He felt everyone should try to make Rancho
Cucamonga the best place to live.
Sandy Oerly, 5652 Emerald, offered the City Council a "citizen's cost
recovery program." She also submitted a petition which was signed by
numerous residents. She stated that in addition to paying taxes, there is
still a lot of money being spent on youth sports.
Primo Morales, 8210 Malvern, did not agree with the cost to fill out
paperwork to be handed to the City for them to deliver the papers to a
school, and leaving himto do the negotiating with the school. He stated
he could not see the use of charging a fee for this paperwork handling.
Art Jenkins felt the love of sports was what was important. He also felt
the monetary increases would come fro~ somewhere.
John Rose, 7072 Jasper, felt the priority the City should be considering
was the kids.

Councilmember Buquet commented on the importance of volunteers within the
community. He stated these are City operated programs that the cost study was
for, not youth sports programs. He felt the City Council should be allowed the
opportunity to askquestions of the consultant, and for the consultant to comment
on the study as to pages 46, 47 and 48.
Erin Griffin, DMG & Associates, made comments about the study and how they
obtained their information.
Kathy Sorensen, Recreation Superintendent, further explainedthe formula and also
explained how Mr. Olari calculated his figures as far as lighting.
Joe Schultz, Comfnunity Services Director, pointed out that the costs proposed are
the maximum that would be charged to the user.
Councilmember Buquet asked for Jim Hart to clarify how different things come out
of different funds or accounts.
Jim Hart, Administrative Services Director, explained the various funds and what
can be charged out of them.
Councilmember Buquet asked Joe Schultz if any lighting fees have been paid to the
City.
Joe Schultz, Community Services Director, stated no, not to his knowledge.
Councilmember Willjams asked for Jim Hart to clarify that the City does not
receive all the money that is collected for citations.

Councilmember Buquet pointed out that the Subconunittee has offered the City
Council various alternatives to help them come to a decision.
Councilmember Alexander stated he felt the City Council should take the least
painful way out. He stated he is willing to go the least possible way to recover
the costs.
Councilmember Alexander had one request of all the sports people, and asked that
they allow all the players the saune amount of time in playing a sport, and not
to Just play the best players of the team. He felt this was very important to
all the kids playing the sport.
Councilmember Wright thanked the City Council Subcommittee for all the work they
had done on this matter. She stated she did not agree with the user fee nexus,
and that she had her own philosophy. She stated she did not agree with charging
for the picnic shelters. She stated she understood that there are some people
who cannot afford the increases no matter how small. She stated she felt the
volunteers were very important. She asked if the sports groups could not afford
the fields that the City controlled, what would happen then. She stated she is
against charging the kids for the use of the fields and also the seniors. She
stated the City has done what Proposition 4 said it should do, and now it should
be filed.
Mayor Stout gave background as to how legislators have made it a law that the
City's fees are studied. He felt an equitable way to determine the electrical
costs should be determined, and that the City charge not more than 50% the first
year, then go to 100%.
Councilmember Buquet pointed out that this was one of the options before the
Council to consider tonight.
Councilmember Buquet reiterated what he heard Mayor Stout suggesting, and that
was to delete the field allocation portion, to do the cost recovery
recommendations in all other areas, and take the 50% implenentation on
electricity at the present time, and felt this was option number five as given
to the Council with a modification. The modification to option number five was
removing the field allocation recovery cost.

Mayor Stout opened the meeting for public hearing. Addressing the City Council
were=
John Mannerino, 9333 Base Line Rd., Suite 100, etated there were three
issues for the City Council to review at this meeting, which were
identified on the Council agenda. He continued by giving the background
of previous actions taken by the Planning Co~unission and City Council. He
stated it is his understanding that certain City staff prefer Sam's Place
be moved to Foothill Boulevard. He stated he did not feel there was a
place on Foothill Boulevard to move to except the old Gemco building,
which would not be appropriate. He stated tonight there is an offer in
the works for another site for Sam's Place. He stated he and Mr.
Pellegrino felt that they would go ahead with the public hearing tonight.
Mr. Mannerino stated he did not feel there have been the complaints on
Sam's establishment as was done in the pest before Mr. Pellegrino owned
the establishment.
Mr. Pellegrino stated he is trying to establish a situation where the old
and young can work together. He stated he did not feel he has broken any
law. He stated he did not want to lose his business by the City Council
shutting him down at 11=00 p.m.

Robert Crinlon, 9280 Highland, stated he has been going to Sam's Place for
a long time. He stated he did not agree with the 11=00 p.m. curfew. He
felt Sam has made an effort to get along with the City.
James Markman, City Attorney, clarified that the Conditional Use Permit runs with
the land as the property is sold, and that it cannot be made personal to Mr.
Pellegrino. He stated that when Mr. Pellegrino bought the property, he knew the
CUP had the condition that the property could not stay open after 11=00 p.m. Mr.
Markman stated he did not know of any city where there was not a special
requirement for live entertainment to be included.
Donald King, who resides near Sam's Place, felt Sam should be allowed to
do whatever he wants.
Linda Taflinger, 2655 King Way, Claremont, stated she has not witnessed
any problem behavior at Sam's Place. She stated she felt safe when coming
there.
Sean Jenkins, 1059 Foothill, an employee of Sam's, asked if there was any
way Sam's curfew of 11=00 p.m. could be changed.
Mayor Stout gave further background on how this condition came about.
Sean Jenkins stated he did not feel Sam's Place could stay in business if
he had to close at 11=00 p.m.
Jay Yurim, 8377 Orange Street, Alta Loma, felt Sam's was a good place and
should not be made to leave.
Sherry Rosenstein, 9600 19th Street, felt Sam's Place was a safe place, as
was mentioned before. She asked for the City to change the condition to
allow them to stay open after 11=00 p.m.
Linda Paulson, 8260 Garden, felt Sam's Place was a good place and felt Sam
should be able to stay open past 11=00 p.m.
Mayor Stout asked for everyone supporting Sam's Place to stand. It should be
noted that a large group from the audience stood.
John Cane, 6880Archibaid, stated he supported Sam Pellegrino and felt the
conditions should be altered.
John Mannerino stated he knew the CUP's run with the land. He reminded
the City Council they can revoke a CUp also. He stated he did not have a
problem with the requirement of an entertainment permit.

Brad Buller, City Planner, stated 2:00 a.m., and that at the present time they
are only allowed to stay open until 11:00 p.m.
Nancy Fong, Senior Planner, pointed out that Sam has been violating the CUP for
almost six months.
Councilmember Wright stated it was not Sam she had the problem with, it was who
might have the establishment after Sam that she is concerned with. She felt the
appeal should be denied.
Councilmember Williams stated when she first did her canvass of the neighborhood
around Sam's Place, the establishment was closing at 11~00 p.m., and at that time
there were no complaints, and now the City was receiving complaints because they
are staying open longer.
Councilmember Alexander asked how long does it take to revoke a CUP.
James Markman, City Attorney, stated it could be processed within two months, or
possibly faster.
Councilmember Alexander stated he did not think the location was bad.
Councilmember Buquet stated he feels it has been inappropriate that Sam has
violated the CUP and stayed open past 11:00 p.m. He feels Sam is being punished
for something that someone prior to him has done. He felt Sam should be given
an opportunity to prove himself.
Councilmember Willjams asked if the issue of staying open late only on weekends
was still being considered.
John Mannerino stated the Planning Con~nission did review this proposal.
He stated that Mr. Pellegrino did agree to it, but that the City Council
turned this down the last time.
James Markman, City Attorney, stated this alternative could be considered.
Councilmember Willjams stated it was her understanding the complaints generated
between 11:00 p.m. and 2=00 a.m. were on the weekends. She stated she did not
agree with Sam presently violating the CUP.
John Mannerino stated that Mr. Pellegrino has a gentleman at the door
serving as a "bouncer," and someone patrolling the parking lot for any
problame around the establishment.
Mayor Stout stated he did not, and still does not, feel any business should be
allowed to stay open at that location after 11=00 p.m. because of its proximity
to residential neighborhoods.
Councilmember Buquet suggested that possibly two City Councilmembers meet with
Mr. Mannerino and Mr. Pellegrino to work something out.
Councilmember Williams stated she felt the past should be put away.

Betty Miller, Associate Engineer, stated it has been proposed whereby the
applicant would pay for Haven Avenue instead of placing them underground at this
time, and would bond for the Highland Avenue lines rather than paying a fee,
because both of the lines were located within the Caltrans right-of-way. She
stated it is hard to say at this time whether Caltrans will go underground or
not, although she felt they probably would. She stated staff supported this
recommendation by the applicant.

MOTION: Moved by Alexander, seconded by Willjams to approve Resolution Nos. 91-
204 and 91-205. Motion carried unanimously, 5-0.
Mayor Stout stated there has been a request by U.S. Homes that their ten acre
piece be Low-Medium instead of Medium.
Brad Buller, City Planner, stated if they were to leave it as proposed (Medium),
they would have to add one more amendment to their Etiwanda North Specific Plan
Amendment request that would say if you have a Medium density zone (8-14 dwelling
units per acre), you may have single-family also. He stated they could do this.
He felt if their portion of Subarea 5 were to be separated out, it was the
Planning Division's opinion that they have created a planning problem with the
small triangular piece.
Mayor Stout stated he did not want to do anything to create a problem for the
process they are going through.
Brad Bullet, City Planner, suggested they could designate their portion Low-
Medium and the other parcels adjacent to the freeway also be included, and the
remainder of Subarea 5 to be Medium.
Mayor Stout suggested that Subarea 5, with the exception of the triangle, remain
as Medium as suggested, the triangle itself go to Low-Medium, including the tip
of the triangle portion and the U.S. Ho~es portion.

Brad Buller, City Planner, stated that Alan Warren has pointed out to him that
the provision of the amendment to the Etiwanda Specific Plan would require an
Ordinance. He stated the Ordinance would have to be in front of the Council in
order to conduct a first reading. He recommended that the Ordinance come back
at the next meeting.
MOTION= Moved by Alexander, seconded by Williams to direct staff to prepare the
appropriate Ordinance for the balance of Subarea 5 to be before the Council for
first reading at the December 4, 1991 meeting. Motion carried unanimously, 5-0.

Mayor Stout opened the meeting for public hearing. Addressing the City Council
was:
Scot Sellers, Lincoln Properties, Irvine, in discussing Subareas A and E,
stated there project is beyond the preliminary stages. He stated they are
surprised that this down zoning was being proposed.
Gary Luque, William Lyon Company, stated he was there regarding Subareas
M, D, K, H, F, and G, and stated they accepted staff's recommendation for
M, D, K, J, and H, but felt that the Medium Density be retained for
Subareas F and G.

Dave Dennis, 6816 Padova Court, and lives near Subarea F, stated they

Paul Adair, 11410 Lomello, supported the Planning Commission
recommendation.
Robert Gates, 11442 Lomello, was interested in Subareas A, E and B. He
asked the Council to be fair to Lincoln Properties. He added because of
what is being proposed, Lincoln would have to change their plans after all
of the work they have done already. He stated he did not agree with the
recommendation. Mr. Gates stated with respect to Subarea B, which belongs
to Mrs. Alena, the proposed zoning would cut the value of her property in
half. He stated Mrs. Alena asked that her property not be cut in half.
There being no further response, the public hearing was closed.
Councilmember Alexander stated he had concerns about the reconm~ndation for
Subareas A and E.
Councilmember Buquet stated he felt a statement needed to be made once and for
all with this.
Councilmember Williams stated she had no problem with leaving Subarea A Medium-
High and leaving Subarea E Medium.
Brad Buller, City Planner, stated if that was what the Council wanted to do,
there would be no action or denial of this recommendation.
