CALL TO ORDER An adjourned meeting of the City Council of the City of Rancho Cucamonga met on Wednesday, January 24, 1990, at the Rancho Cucamonga Neighborhood Center, 9791 Arrow Route, Rancho Cucamonga, California. The meeting was called to order at 6:58 p.m. by Mayor Dennis L. Stout. Present were Councilmembers: William J. Alexander, Deborah N. Brown, Charles J. Buquet II, Pamela J. Wright,. and Mayor Dennis L. Stout. Also present were: Jack Lam, City Manager; Jerry B. Fulwood, Deputy City Manager; Linda D. Daniels, Deputy City Manager; Duane Baker, Sr. Administrative Assistant; Patty Riffel, Executive Assistant; Undersheriff Dick Williams, Deputy Chief Tom Wickum, San Bernardino County Sheriff's Department; Capt. Eugene Gilmore, Lt. Bruce Zeiner, Lt. Bob Peppler, Lt. Mike Ingram, Rancho Cucamonga Sheriff's Station; and Debra J. Adams, City Clerk. , , , , , Mayor Stout stated this is an informal meeting between the City Council and the San Bernardino County Sheriff's Department to discuss law enforcement issues relating to the City of Rancho Cucamonga. Jack Lam, City Manager, stated this meeting has been scheduled to assist in answering some of the questions that came up from the November 29, 1989 meeting with the Sheriff's Department. , , , , , , B. ITEMS OF DISCUSSION B1. DISCUSSION OF SHERIFF'S DEPARTMENT EMPLOYEE ROTATION POLICIES. Jack Lam, City Manager, introduced the item and referred to his outline of questions for this item. (0502-02 PERSONNEL) (1301-00 SHERIFF) Deputy Chief Wickum explained in detail how the deputies are assigned. (i) City Council Minutes January 24, 1990 Page 2 Undersheriff Williams, Sheriff's Department, added there are no minimum/maximum tenures for duties and assignments. He further stated that even after the discussions tonight on this subject, that it will take a lot of further work to get the balance the City Council needs, but did agree that the City needs stability. Undersheriff Williams, Sheriff's Department, continued to express to the City Council that one advantage of having the Sheriff's Department provide law enforcement services is that if there is a Deputy working in the City of Rancho Cucamonga that they do not approve of, it is a lot easier to move that Deputy to another area, because they could not do this as easily with their own Police Department. Jack Lam, City Manager, asked how we go about resolving this issue to achieve satisfaction for everyone. Undersheriff Williams, Sheriff's Department, suggested that we look at copies of contracts from other cities that contract for law enforcement services with the Sheriff's Department. He added that whatever is established for Rancho Cucamonga would probably be established County-wide. Mayor Stout asked if there was a way to protect the City from getting a Deputy transferred into Rancho Cucamonga that has had disciplinary problems at other work locations. Undersheriff Williams, Sheriff's Department, stated we would have to work this into the policy. Councilman Alexander asked if promotions were the reason for transfers. Undersheriff Williams, Sheriff's Department, stated they needed to look at promoting people already in Rancho Cucamonga to a higher position. Deputy Chief Wickum, Sheriff's Department, stated he did not feel it was that bad to have someone promoted out of Rancho Cucamonga because of the learning experience they get from it. Mayor Stout felt we needed to work on keeping Rancho Cucamonga personnel in Rancho Cucamonga for promotions. Captain Gilmore, Sheriff's Department, concurred that a Deputy does get good experience from going to other areas within their system. Jack Lam, City Manager, asked for a time limit to accomplish getting the contracts from the other cities the Sheriff's Department is involved with. Undersheriff Williams, Sheriff's Department, stated that hopefully after June 1990, he would have a lot more input on what is going to happen after Sheriff Tidwell retires. He felt a lot of work needed to be done between now and June because by then there would be a new Sheriff and the City's law enforcement study would probably be completed. City Council Minutes January 24, 1990 Page 3 Mayor Stout suggested that the contract modifications be done between now and July before the budget. B2. DISCUSSION OF DEGREE OF DISCRETION GIVEN BY THE SHERIFF'S DEPARTMENT TO THE STATION COMMANDER AND COMMAND STAFF TO IMPLEMENT LOCAL LAW ENFORCEMENT PROGRAMS AND INTERFACE AS A POLICE CHIEF IN RESPONDING TO LOCAL NEEDS. Jack Lam, City Manager, introduced the item, and referred to his outline of questions for this item. (0502-02 PERSONNEL) (1301-00 SHERIFF) Undersheriff Williams, Sheriff's Department, stated that at the present time, they do not get input from the City Manager before a decision is made, but felt they needed to make assurances that the City does have involvement. Deputy Chief Wickum, Sheriff's Department, explained how the Sheriff Department's disciplinary action policy works. Mayor Stout asked if Captain Gilmore has a personnel file once someone comes to Rancho Cucamonga. Captain Gilmore, Sheriff's Department, stated yes, that the files comes with the deputy. Mayor Stout stated he did not care how a disciplinary action occurs because he would hold Jack Lam, City Manager, responsible for whatever happens in the City. Councilwoman Wright stated she felt the Station Commander should have the authority and responsibility for their employees, and felt he should have a say so in disciplining his employees. She added she felt it was important for the person being disciplined to know the Station Commander has this authority so they would be aware that they work for the Commander and the City of Rancho Cucamonga. Undersheriff Williams, Sheriff's Department, felt the Station Commander needed to be the authority to start and stop programs. He added they would be doing an assessment of the command level positions. Councilman Buquet stated there needed to be an understanding of who has the ultimate decision making for what goes on in law enforcement. He added he felt the Council needs to have more input in the decision making efforts at the Rancho Cucamonga Station. Councilwoman Brown stated the residents feel the City Council is to be held accountable for what the Sheriff's Department is doing and stated that she did not feel the City Council has the answers; therefore, they cannot be accountable to the people. Mayor Stout stated he felt the people of the City wanted to have one place they could go for all City services. City Council Minutes January 24, 1990 Page 4 (3) (4) Undersheriff Williams, Sheriff's Department, said he understood the City's desire for getting more control. Jack Lam, City Manager, stated this discussion also refers to Item B5 in regards to the Station Commander's authority. B3. DISCUSSION OF SHERIFF'S DEPARTMENT PHILOSOPHY FOR A CITY INPUT PROCESS FOR SELECTION OF ADMINISTRATIVE PERSONNEL FOR THE LOCAL SUBSTATION. Jack Lam, City Manager, introduced the item and referred to his outline of questions for this item. (0502-02 PERSONNEL) (1301-00 SHERIFF) Undersheriff Williams, Sheriff's Department, stated that he did not feel the City would want to get involved in the selection of some of these people if they have the right Station Commander making these decisions, but felt there should be a level of participation by the City. Councilman Buquet felt a lot of the City's participation has already occurred because of the old City Council Subcommittee that had met with the Sheriff's Department. Councilwoman Wright stated that she felt the City has had involvement, i.e., CHOICES, but would like to have more involvement. Deputy Chief Wickum, Sheriff's Department, stated he felt these meetings needed to take place on a regular basis. Councilwoman Brown felt the City should add the Sheriff's Department on the list of meetings the City Council has scheduled with outside agencies. She stated she felt the Sheriff's Department should be a part of the City team, and that it would be better for everyone. She stated she has to feel good about the service the City gets from the Sheriff's Department. Undersheriff Williams, Sheriff's Department, felt the Public Safety Commission should also get involved in the discussions. B4. DISCUSSION OF SHERIFF'S DEPARTMENT POLICIES WITH REGARDTO PUBLIC RELATIONS TRAINING CURRENTLY AND/OR PLANNED TO ENHANCE AND REINFORCE THE POSITIVE PROFESSIONAL IMAGE OF LOCAL LAW ENFORCEMENT PERSONNEL. Jack Lam, City Manager, introduced the item and referred to his outline of questions for the item. (1301-00 SHERIFF) (0507-02 TRAIN PROG) Undersheriff Williams, Sheriff's Department, stated he did not have a problem with the City getting access to everything that goes on with the Sheriff's Department as long as it is legal for them to have it. City Council Minutes January 24, 1990 Page 5 Undersheriff Williams, Sheriff's Department, explained the briefing and training that is given to the Deputies. He advised about the programs they are involved in with their staff and stated he knew the City did not know of these. Councilwoman Wright asked if City employees were involved in a certain educational program, would it be possible for the Sheriff to also be a part of this. Undersheriff Williams, Sheriff's Department, stated yes, that they are supportive of any City program. He added he felt the Sheriff's Department might have some good programs they would like to share with the City. B5o DISCUSSION OF SHERIFF'S DEPARTMENT RECEPTIVITY TOWARD THE CONSIDERATION OF LOCAL LAW ENFORCEMENT IDEAS AND PROGRAM. (1301-00 SHERIFF) See discussion for item B2. B6. DISCUSSION OF CURRENT CONTRACT - DOES THE CURRENT FORM OF THE CONTRACT MEET THE NEEDS OF THE CITY TODAY? Jack Lam, City Manger, introduced the item and referred to his outline of questions for this item. He further asked if there was agreement to work on the existing contract. (1301-00 SHERIFF) (0602-01 CONTRACT) Undersheriff Williams, Sheriff's Department, stated he does not have a problem with sitting down and taking a look at the contract and working with the City on it. Jack Lam, City Manager, stated he felt the City staff and Sheriff's staff should work together on the contract so this will be ready by June 1990. Captain Gilmore, Sheriff's Department, suggested representatives from the City and the Sheriff's Department go to other contract cities and have discussions with them on what is covered in their contracts. Deputy Chief Wickum, Sheriff's Department, suggested that the Public Safety Commissioners also tour their facilities as the City Council has done. Councilwoman Brown stated she felt if a Commissioner complained to Captain Gilmore, that a written report should be written with a copy sent to Jack Lam, and felt this should be shared with the Commissions.
