CITY OF RANCHO CUCAMONGA
CITY COUNCIL MINUTES
Regular Meeting
A regular meeting of the City Council of the City of Rancho Cucamonga met on
Wednesday, May 18, 1988. in the Lions Park Community Center, 9161 Base Line
Road, Rancho Cucamonga, California. The meeting was called to order at 7:31
p.m. by Mayor Dennis L. Stout.
Present were Councilmembers: Deborah N. Brown, Charles J. Buquet II, Jeffrey
King, P~mela J. Wright, and Mayor Dennis L. Stout.
Also present were: City Manager. Lauren M. Wasserman; Legal Counsel, James
Markman; Assistant City Manager, Robert Rizzo; City Clerk, Beverly A. Authelet.;
Community Development Director, Jack Lam; City Planner. Brad Buller; City
Engineer, Russell Maguire; Community Services Manager, Joe Schultz; Senior

Councilwoman Wright wanted to clarify her role in this appeal she had filed.
She stated that a group of residents had stopped her at the Planning Commission
meeting where this item was discussed, and stated they had concerns about this
project. She felt it was her duty to help these people, so she filed the
appeal. She stated she did not realize all of the traffic would be dumping
into Deer Creek until the staff report came out. She stated her main reason
for the appeal was for safety reasons.
Mayor Stout opened the public hearing stating that the Council should either
deny the appeal or grant an extension.

Addressing the Council were:
Mel Chambers, President of the Deer Creek Homeowner's Association, stated
he felt this plan was at the expense of the Deer Creek Homeowners, which
only would help the other development. He felt the City Council should
deny the appeal.
Mark Roy, President of Haven View Estates Homeowner's Association, stated
he felt if there was a mistake in the tract map, that it should be
corrected because the problem would not go away. He felt there should be
a circulation study done on the 42 lots and 53 lots. He did feel that the
emergency exit was the question to be decided tonight. He did not feel
Council had enough information in front of them to make a decision at this
time.
Phillip Norafshon, Owner of the property between Deer Creek Channel and
Deer Creek Development, stated he would like to see the bridge go east of
the Deer Creek Channel rather than the Hillside Channel.
Milt Madole, 1820 E. 6th, Santa Ana, said' they are not opposing the tract
but are questioning the access. He felt that the Deer Creek Channel
should be bridged for access.
Bruce Ann Hahn,' 5087 Granada Court, was concerned about the amount of
traffic on Haven and wanted to know where Milliken would be going in the
future and could there be some kind of exit to Milliken. She stated she
did not know why the 53 lots were going down into Deer Creek Development.
Sandy Stickler, 5219 Valinda, questioned how the emergency access would be
handled.
Russell Maguire, City Engineer, stated that only police, fire, and emergency
vehicles would have keys to the locked access.
Councilman King asked what the time limit was on the extension.
James Markman, City Attorney, stated it was not very close at this time in
meeting the deadline.
Mayor Stout closed the public hearing.
Councilman King stated he did not feel comfortable with the emergency access to
the north. He said he did feel uncomfortable with the circulation of the area
because it was sandwiched between two channels. He felt the City Council
should look at the circulation a little more.
Councilwoman Wright stated she agreed with what Mr. Chambers had said about
hurting one project to help another. She felt that maybe a bridge over the
Deer Creek Channel onto Milliken was the answer.

Councilman Buquet was not sure that the gate being blockaded was the answer,
because if that were true, Cucamonga Cannon problems would be resolved at the
present time. He did not feel the Deer Creek Development should be impacted to
the south. He felt all of these issues should be worked out before ground is
broken on the proposed tract.
Mayor Stout stated that there are two issues to think about tonight. One is
the time extension of the project, which includes 150 lots, and what do we do
in the future on the 95 lots. He said there is the issue of permanent access
in the future and the issue of emergency access for this particular tentative
tract map. He felt the traffic issue for the 42 lots and the 53 lots should be
resolved before these projects are allowed to develop. He also stated that he
knew the county was concerned about this issue being resolved before the land
is developed also. He stated he agreed on the design issue. He also felt
before the development of this tract begins, the homeowner's associations be
involved in the establishment of the guidelines to be sure there is
compatibility between these areas. He stated he did not feel there should be
more traffic going through Deer Creek.
Councilman King again stated the circulation needs to be looked at and said he
would vote no against the extension.
MOTION: Moved by Wright, seconded by Brown to deny the appeal, approve the
time extension based on the Planning Commission findings in the Planning
Commission Resolution. Motion carried 4-1 (King voted no).
Jim Markman, City Attorney, stated that what we need is a motion to modify the
approval to require the receipt of an emergency access, and the developer must
agree to it.
The developer stated he does not have a problem in working with the county
on the emergency access. He stated that as far as an access from the
project easterly property line to the bridge, which was an emergency or
alternative emergency access, they would be happy to do that along with
the support of city staff and the county in order to complete it.
Mayor Stout stated that what they need is more of a commitment from the
developer other than just being happy to do this. He stated he should agree to
it if it is made a condition.
The developer said that he would to this.

Pete Pitassi, Architect of the project, who gave details about the project
and how it is designed. He did not feel traffic was a problem at this
particular location. He did, however, have a problem with the agreement
on page 3, item 3, which refers to the effective date of the project. He
felt they needed more time in order to get the escrow closed, but that
they would go ahead and enter into the agreement. Another area of concern
was on page 9, item 23, which was regarding the 30 day enforcement
clause. He felt they needed 60 days. His last area of concern was
regarding 87-02A, the secondary agreement, which is a three-party
agreement. He felt that from a lending standpoint this would be almost
impossible to tie both projects together.
Mr. Pitassi introduced Peter Norse, Developer of the Seniors Project, who
stated they are not asking for the project designation to change after 20
years has passed. He also reiterated many of the things Mr. Pitassi had
stated that they felt were problems.
Mr. Markman, City Attorney, stated he agreed with Mr. Pitassi in that he felt
it was not necessary for 30 days to acquire title. He stated the Council
should go ahead and keep the 30 day curable period. He stated he urged the
Council to retain the 30 year restriction. He stated that on the 75-50% low to
moderate income, he felt that this was strictly a Council policy decision to
make. As far as tying the two projects together, he felt that was how the
applicant had originally wanted the item to be considered. As the senior
project is completed, a certificate of occupancy would be issued for that
project. It did not mean that if both projects were not completed within three
years, that the conditions had not been met in the agreement.
Brad Buller, City Planner, stated that the Planning Commission had wanted the
office project to be completed concurrently or before the senior project.
Bob Dutton, also associated with the project, gave more clarity regarding
the two projects being considered together.
There being no further response, the public hearing was closed.
Councilwoman Wright asked what would happen if the senior project failed.
Jim Markman, City Attorney, stated some kind of a new agreement would be
brought before the City Council at that time.
The City Council concurred that they did not have a problem with the concept of
this project.
Councilwoman Wright said she had problems with the left turns into the project
from Base Line. She also wanted Design Review to consider the view situation
to the west of the project.
Pete Pitassi, Architect for the project, said the Design Review process
has already taken place.

Brad Buller, City Planner, said that based on the Planning Commission's denial
of the general plan amendment, they denied the design review and that is why
this appeal is being filed. Mr. Bullet further stated that if the Council
agrees with this project, he felt it should be referred back to the Planning
Conunlsslon on the design issues they have not yet resolved, which is the
covered parking, open space, and any additional design issues that may be
raised.
It was agreed by the City Council that: 1) The term of the development
agreement should be for 20 years, 2) Market rate versus Target. The Council
concurred that 50% is reasonable. Jim Markman, City Attorney, stated that the
last sentence in paragraph 3 should be deleted from that agreement, and 3)
Enforcement clause - 30 days was agreed upon.
Councilwoman Wright asked what would happen if the office project did not
build, where would the senior project drain.
Brad Bullet, City Planner, said the senior project could not build unless they
tied into another project.
Mayor Stout felt this item needed to be referred back to the Planning
Commission to get some of the details worked out. He did feel there needed to
be covered parking, and he did feel the left turn issue from Base Line into
this project needed to be addressed and the issue of neighborhood compatibility
needs to be addressed. He also felt that the landscaping issue needs to be
addressed. Mayor Stout did not feel they needed to have the same standards as
apartments have.
Councilwoman Wright disagreed with what Mayor Stout had said regarding having
the same standards as apartments. She felt they should have the same standards
that apartments have.
Councilwoman Wright again reiterated her concerns about the left turn from Base
Line into the project.
Russell Magulre, City Engineer, did not feel this was a hazard and did not feel
the project would have gotten as far as it had if it were.

Councilman Buquet questioned the lights going off at 10:00 p.m. and that no
inning could start after 9:45 p.m.
Mayor Stout opened the meeting for public input. Addressing the City Council
were:
Dave Bonham, Little League Administrator and a resident of Rancho
Cucamonga, who stated that the curfews for both the Little League and
Senior Leagues usually go beyond the 10:00 p.m. time limit.
Bob Stallings, 7333 Vineyard Avenue, said he would llke the curfew for the
lights to stay on beyond the 10:00 p.m. time limit.
Rocky Reynolds stated it is very difficult sometimes for an inning to get
over between 9:45 and 10:45 p.m. He felt the time limit should be
extended.
William Johnson, a resident on Vineyard Avenue, wanted the curfew to stay
at 10:00 p.m.
Councilman Buquet suggested that possibly the time limit be set at 10:30 p.m.
Councilman King felt we should do everything we could to encourage these
games. He had no objection to extending the light policy to whatever time is
needed.
Councilwoman Brown felt it was a good idea for those league games to be in
Rancho Cucamonga. She said she would agree to not starting a new inning after
10:30 p.m.
Councilman Buquet suggest 10:30 p.m. curfew for the Little League and 11:00
p.m. for the Seniors.
Councilwoman Wright said she had a problem with extending the curfew beyond
10:00 p.m.
Note: A letter was received by Mr. & Mrs. William J. Johnson. They wanted to
make it part of the record stating that they were against the lights being left
on after 10:00 p.m.
MOTION: Moved by Brown, seconded by King for no new innings to start after
10:30 p.m. for the Little League, and no new innings to start after 11:00 p.m.
for the Senior League. Motion carried unanimously 5-0.
