DISPOSITION OF CITY OWNED PROPERTY ADJACENT TO SANTA CLARA COURT (REFERENCE TRACT NO. 14116) - SHEFFIELD HOMES - A request to find the quit claiming of Lot C of Tract 12952 in conformance with the General Plan - APN: 1076-611-03. V. Public Comments This is the time andplace for the general public to address the Commission. Items to be discussed here are those which do not already appear 'on this agenda. VI. Commission Business VII. Adjournment The Planning Commission has adopted Administrative Regulations that set an 11:00 P.M~ adjournment time. If items go beyond that time, they shall be heard only with the consent of the Commission. Miller, Associate Engineer SUBJECT: D~[SPOSITION OF CITY OWNED PROPERTY ADJACENT TO SANTA CLARA COURT (REF. TRACT NO. 14116~ - SHEFFIELD HOMES - A request to find the quit claiming of Lot C of Tract 12952 in conformance with the General Plan o APN 1076- 611-03. BACKGROUND/ANALYSIS: On April 9, 1986, the Planning Commission approved Tentative Tract 12952 with a condition that the small parcel east of Santa Clara Court be added to the property to the east by lot line adjust~nent or dedicated as right-of-way. Tract 12952 was ~corded on November 14, 1986, with Lot "C" dedicated to the City in Fee Simple, On December 9, 1992, the Planning Commission approved Tentative Tract 14116, a residential ~ubdivision of 19 single family lots located south of Highland Avenue and west of Deer Creek Channel. The~City Council modified one Planning Division condition on appeal on February 3, 1993. Engineering Division condition number 4, which was not modified, reads as follows: "The developer shall request that the City appropriately process and quit claim Lot C of Tract 12952 prior to final map approval" The developer is preparing to record Tract 14116, utilizing Lot "C" as part of lots 16, 17 and 18, per the December, 1992, approval. RECOMMENDATION: Staff recommends the Planning Commission make the finding through minute action that the subject proposed quit claim of LOt "C" of Tract 12952 by the City is in conformance with the General Plan. This finding will be forwarded to the City Council for further,:processing and disposition of excess property.
