HomeMy WebLinkAbout16-199 - ResolutionsResolution No. 16-199 – Page 1 of 8 RESOLUTION NO. 16-199 A RESOLUTION OF THE CITY COUNCIL OF RANCHO CUCAMONGA, CALIFORNIA, ADOPTING AN UPDATED FEE SCHEDULE APPLICABLE TO ANIMAL SERVICES, COMMUNITY IMPROVEMENT, COMMUNITY SERVICES, ENGINEERING SERVICES, PLANNING, AND POLICE DEPARTMENT TRAFFIC SERVICES A. Recitals. 1. The California Government Code allows the City to establish fees and charges for municipal services, provided such fees and charges do not exceed the estimated reasonable cost to the City in providing the service to which the fee or charge applies. 2. Data indicating the estimated or actual cost to provide each service, for which the fees and charges set forth herein apply, was made available to the public at least ten (10) days prior to the date of the public hearing. 3. On December 7, 2016, City Council of the City of Rancho Cucamonga conducted a duly noticed public hearing on the amendment. 4. All legal prerequisites prior to the adoption of this Ordinance have occurred. B. Resolution. The City Council of the City of Rancho Cucamonga finds and resolves as follows: SECTION 1: The City Council hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Ordinance are true and correct. SECTION 2: The City Council hereby specifically finds that the fees and charges set forth do not exceed the estimated reasonable cost of providing the service for which the fee or charge be levied. SECTION 3: The City hereby amends Resolution 07-047 and adopts the following fees for services performed by the Animal Services Department: Resolution No. 16-199 – Page 2 of 8 SECTION 4: The City hereby adopts the following fees for services performed by the Community Improvement Division: Title Description Cost Abatement - Emergency Emergency abatement of hazardous or nuisance conditions, such as open & vacant properties, unsecure pools or stagnant water. Actual contractor and legal service costs will be added. $230.00 Abatement – Re- inspection fee when non-compliant Inspection costs to be assessed on follow-up inspection after issuance of Notice to Abate and re- inspection shows correction has not been completed or attempted and staff will assign a contractor to abate the hazard or nuisance. Fees for second and additional vehicles will be 50% of current administrative fee. Actual contractor and legal services costs to be added. $352.00 Administrative Hearing Fee Administrative Hearing for appeal of Notice to Abate, Administrative Citation or other administrative action. Fees to be deposited or Hardship Waiver filed prior to appeal period expiration. Fees shall be refunded when the appellant prevails, retained by the City when the citation or notice is upheld and may be modified by the hearing officer. $220.00 Notice & Order Costs for the preparation of a Notice & Order. Fees to be waived when compliance is achieved prior to the required correction date. Actual costs of property profile and mailing to all parties shall be added. $149.00 Notice of Pendency Release Upon receiving satisfaction of a demand, this fee will be charged for filing a Release of Abatement Lien or Withdrawal of Notice of Pendency with the County Recorder. Actual County fees will be added. $151.00 Warrant - Procure/Process Costs for the procurement, service and related processing of inspection and/or abatement warrants. Actual costs for legal services shall be added. Additional costs to the City may be added when in excess of established fee by more than 10%. $485.00 SECTION 5: The City hereby amends Resolutions 14-003, 16-004, and adopts the following fees for services performed by the Community Services Department: General Facility Use Fees City Staff Fees One staff person is included in the rental fees and additional staff may be required depending on the type of event, as determined by the Community Services Department. New inspection rate is good from 1-10 poles. Poles will be billed in increments of 10. $53.00 Street Light Plan Check Provide cost recovery for administrative staff time and for Electrical Engineering Consultant for street light pole plan check. $715.00 Street Light Plan Check – Additional Pages Street light plan check to provide for cost recovery for Electrical Engineering Consultant to review additional pages. $284.00 Illegal Bin Removal Notice Fee Provide cost recovery to Environmental Programs for administrative staff time to process and post 24-hour Notice to Remove for Illegal Bin. $110.00 Illegal Bin Removal Administrative Fee Provide cost recovery to Environmental Programs for administrative staff time and costs related to the removal of illegal hauler bin. $43.00 SECTION 7: The City hereby amends Resolution 12-196 and adopts the following fees for services performed by the Planning Department, including a technology fee of 5%: Title Description Current Fee New Fee Hillside Development Review(>5 dwelling units) To reflect hours required to process and provide necessary consistency with Design Review application for non-hillside projects. $3,468 $11,187.00 The fee set forth in this section shall be adjusted annually, commencing on July 1, 2017, and each year thereafter, without further action of the City Council, based on the Employee Cost Index for State and Local Government Employees, Total Compensation, during the 12 month period ending on December 31st of the immediately preceding year, as released by the U.S. Department of Labor’s Bureau of Labor Statistics and rounded to the nearest whole dollar. If this index is discontinued, a replacement index, as determined by the City Council, shall be utilized.
