1. Presentation of Proclamations to the Business Press 2000 Women of
Distinction Award recipients.
C. COMMUNICATIONS FROM THE PUBLIC
This is the time and place for the general public to address the City
Council. State law prohibits the City Council from addressing any
issue not previously included on the Agenda. The City Council may
receive testimony and set the matter for a subsequent meeting.
Comments are to be limited to five minutes per individual.
D. CONSENT CALENDAR
The following Consent Calendar items are expected to be routine and
non-controversial. They will be acted upon by the Council at one time
without discussion. Any item may be removed by a Councilmember
or member of the audience for discussion.
1. Approval of Warrants, Register Nos. 7/12/00 and 7/19/00, and Payroll 1
ending 7/20/00 for the total amount of$2,092,200.46.
2. Approval to authorize the advertising of the "Notice Inviting Bids"for the 12
Construction of 61h Street Rehabilitation from Haven Avenue to Milliken
Avenue, to be funded from Account No. 32-4637-9904.
RESOLUTION NO. 00-142 13
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF RANCHO CUCAMONGA,
CALIFORNIA, APPROVING PLANS AND
SPECIFICATIONS FOR THE "6T" STREET
PAVEMENT REHABILITATION FROM HAVEN
AVENUE TO MILLIKEN AVENUE" IN SAID
CITY ANDAUTHORIZING AND DIRECTING
THE CITY CLERK TO ADVERTISE TO
RECEIVE BIDS
3. Authorization to appropriate $7,360 in Account No. 01-4333-6028 to 18
supplement funding of the City's share of the Multi-Species Habitat
Conservation Plan.

4. Approval of a Professional Services Agreement with Bruce W. Hull & 19
Associates (CO 00-056) to perform appraisal services in conjunction
with a proposed Community Facilities District (Catellus) in an amount
not to exceed $25,000, to be funded by the project developer.
5. Approval to appropriate $530,440.00 to Account No. 22-4637-9843 and 25
the approval of a Professional Services Agreement (CO 00-057) with
Parsons Brinckerhoff Quade & Douglas, Inc., to provide engineering
design services for street widening and median island construction on
Foothill Boulevard from Grove Avenue to Vineyard Avenue, in the
amount of $875,650.00 ($796,045.00 plus 10% contingency), to be
funded from Account No. 22-4637-9843.
6. Approval to accept Improvements, release the Faithful Performance 27
Bond, accept a Maintenance Bond, and file a Notice of Completion for
Improvements for DR 97-33, located on the southwest corner of Sixth
Street and Rochester Avenue, submitted by Dove Investments, Inc.

CUCAMONGA — The additions of Section 17.20.060 — Hillside Overlay
District, to Development Code Chapter 17.20 in order to implement the
addition of a Hillside Overlay District on the Zoning Map.
ENVIRONMENTAL ASSESSMENT AND DEVELOPMENT DISTRICT
AMENDMENT 00-02 — CITY OF RANCHO CUCAMONGA — The
addition of a Hillside Overlay District to the city of Rancho Cucamonga
Zoning Map in order to geographically define the Hillside area, as
defined in the Development Code, Chapter 17.24.

RECOMMENDATION:
It is recommended that the City Council approve plans and specifications for the construction of60,
Street Pavement Rehabilitation from Haven Avenue to Milliken Avenue and approve the attached
resolution authorizing the City Clerk to advertise the"Notice Inviting Bids".
BACKGROUND/ANALYSIS:
6th Street Pavement Rehabilitation scope of work to be performed in general consists of, but not limited to,
excavation, sawcutting, removal of existing A.C. pavement, cold planing, crack sealing, rubberized overlay,
asphalt paving, re-striping and pavement markings. The project is to be funded from Measure "I" funds,
Account No. 32-4637-9904. Staff has determined that the project is categorically exempt per Article 19,
Section 15301(c)of the CEQA guidelines.
The Engineer's estimate for the 6th Street Pavement Rehabilitation is $270,000. Legal advertising is
scheduled for August 3, 2000 and August 8, 2000, with bid opening at 2:00 p.m. on Tuesday, August 15,
2000.

CITY OF RANCHO CUCAMONGA APPROVING
PLANS AND SPECIFICATIONS FOR THE "6TH
STREET PAVEMENT REHABILITATION FROM
HAVEN AVENUE TO MILLIKEN AVENUE" IN SAID
CITY AND AUTHORIZING AND DIRECTING THE
CITY CLERK TO ADVERTISE TO RECEIVE BIDS
WHEREAS, it is the intention of the City of Rancho Cucamonga to construct
certain improvements in the City of Rancho Cucamonga.
WHEREAS, the City of Rancho Cucamonga has prepared plans and
specifications for the construction of certain improvements.
NOW, THEREFORE, BE IT RESOLVED that the plans and specifications
presented by the City of Rancho Cucamonga be and are hereby approved as the plans and
specifications for "6TH STREET PAVEMENT REHABILITATION FROM HAVEN
AVENUE TO MILLIKEN AVENUE".
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and
directed to advertise as required by law for the receipt of sealed bids or proposals for
doing the work specified in the aforesaid plans and specifications, which said
advertisement shall be substantially in the following words and figures, to wit:

Pursuant to a Resolution of the Council of the City of Rancho Cucamonga, San

PREVAILING WAGE: Notice is hereby given that in accordance with the provisions of
California Labor Code, Division 2, Part 7, Chapter 1, Articles 1 and 2, the Contractor is
required to pay not less than the general prevailing rate of per diem wages for work of a

similar character in the locality in which the public work is performed, and not less than
the general prevailing rate of per diem wages for holiday and overtime work. In that
regard, the Director of the Department of Industrial Relations of the State of California is
required to and has determined such general prevailing rates of per diem wages. Copies
of such prevailing rates of per diem wages are on file in the office of the City Clerk of the
City of Rancho Cucamonga, 10500 Civic Center Drive, Rancho Cucamonga, California,
and are available to any interested party on request. The Contracting Agency also shall
cause a copy of such determinations to be posted at the job site.
Pursuant to provisions of Labor Code Section 1775, the Contractor shall forfeit, as
penalty to the City of Rancho Cucamonga, not more than fifty dollars ($50.00) for each
laborer, workman, or mechanic employed for each calendar day or portion thereof, if
such laborer, workman or mechanic is paid less than the general prevailing rate of wages
herein before stipulated for any work done under the attached contract, by him or by any
subcontractor under him, in violation of the provisions of said Labor Code.
Attention is directed to the provisions in Sections 1777.5 and 1777.6 of the Labor Code
concerning the employment of apprentices by the Contractor or any subcontractor under
him.
Section 1777.5, as amended, requires the Contractor or subcontractor employing
tradesmen in any apprenticable occupation to apply to the joint apprenticeship
committee nearest the site of the public work's project and which administers the
apprenticeship program in that trade for a certificate of approval. The certificate will also
fix the ratio of apprentices to journeymen that will be used in the performance of the
contract. The ratio of apprentices to journeymen in such cases shall not be less than one
to five except:
A. When unemployment in the area of coverage by the joint apprenticeship
committee has exceeded an average of 15 percent in the 90 days prior to
the request of certificate, or
B. When the number of apprentices in training in the area exceeds a ratio of
one to five, or
C. When the trade can show that it is replacing at least 1/30 of its
membership through apprenticeship training on an annual basis statewide
or locally, or
D. When the Contractor provides evidence that he employs registered
apprentices on all of his contracts on an annual average of not less than
one apprentice to eight journeymen.
The Contractor is required to make contributions to funds established for the
administration of apprenticeship programs if he employs registered apprentices or

journeymen in any apprenticable trade on such contracts and if other Contractors on the
public works site are making such contributions.
The Contractor and subcontractor under him shall comply with the requirements of
Sections 1777.5 and 1777.6 in the employment of apprentices.
Information relative to apprenticeship standards, wage schedules, and other requirements
may be obtained from the Director of Industrial Relations, ex-officio the Administrator of
Apprenticeship, San Francisco, California, or from the Division of Apprenticeship
Standards and its branch offices.
Eight (8) hours of labor shall constitute a legal day's work for all workmen employed in
the execution of this contract and the Contractor and any subcontractor under him shall
comply with and be governed by the laws of the State of California having to do with
working hours as set forth in Division 2, Part 7, Chapter 1, Article 3 of the Labor Code of
the State of California as amended.
The Contractor shall forfeit, as a penalty to the City of Rancho Cucamonga, twenty-five
dollars ($25.00) for each laborer, workman, or mechanic employed in the execution of
the contract, by him or any subcontractor under him, upon any of the work herein before
mentioned, for each calendar day during which said laborer, workman, or mechanic is
required or permitted to labor more than eight(8)hours in violation of said Labor Code.
Contractor agrees to pay travel and subsistence pay to each workman needed to execute
the work required by this contract as such travel and subsistence payments are defined in
the applicable collective bargaining agreement filed in accordance with Labor Code
Section 17773.8.
The bidder must submit with his proposal, cash, cashier's check, certified check, or
bidder's bond, payable to the City of Rancho Cucamonga for an amount equal to at least
10% of the amount of said bid as a guarantee that the bidder will enter into the proposed
contract if the same is awarded to him, and in event of failure to enter into such contract
said cash, cashiers' check, certified check, or bond shall become the property of the City
of Rancho Cucamonga.
If the City of Rancho Cucamonga awards the contract to the next lowest bidder, the
amount of the lowest bidder's security shall be applied by the City of Rancho Cucamonga
to the difference between the low bid and the second lowest bid, and the surplus, if any
shall be returned to the lowest bidder.
The amount of the bond to be given to secure a faithful performance of the contract for
said work shall be 100% of the contract price thereof, and an additional bond in an
amount equal to 100% of the contract price for said work shall be given to secure the
payment of claims for any materials or supplies fiunished for the performance of the
work contracted to be done by the Contractor, or any work or labor of any kind done

thereon, and the Contractor will also be required to furnish a certificate that he carries
compensation insurance covering his employees upon work to be done under contract
which may be entered into between him and the said City of Rancho Cucamonga for the
construction of said work.
No proposal will be considered from a Contractor to whom a proposal form has not been
issued by the City of Rancho Cucamonga.
On the date and at the time of the submittal of the Bidder's Proposal the Prime Contractor
shall possess any and all contractor licenses, in form and class as required by any and all
applicable laws with respect to any and all of the work to be performed under this
contract; Including but not limited to a Class "A" License (General Engineering
Contractor) or a Class "C-12" License (Earthwork or Paving Contractor) sufficient to
cover all the work to be performed by the Prime Contractor in accordance with the
provisions of the Contractor's License Law (California Business and Professions Code,
Section 7000 et. seq.) and rules and regulations adopted pursuant thereto.
The Contractor, pursuant to the "California Business and Professions Code," Section
7028.15, shall indicate his or her State License Number on the bid, together with the
expiration date, and be signed by the Contractor declaring, under penalty of perjury, that
the information being provided is true and correct.
The work is to be done in accordance with the profiles, plans, and specifications of the
City of Rancho Cucamonga on file in the Office of the City Clerk at 10500 Civic Center
Drive, Rancho Cucamonga, California. Copies of the plans and specifications, available
at the office of the City Engineer, will be fiunished upon application to the City of
Rancho Cucamonga, and payment of$35.00 (THIRTY-FIVE DOLLARS), said $35.00
(THIRTY-FIVE DOLLARS) is non refundable. Upon written request by the bidder,
copies of the plans and specifications will be mailed when said request is accompanied by
payment stipulated above, together with an additional non reimbursable payment of
$15.00 (FIFTEEN DOLLARS)to cover the cost of mailing charges and overhead.
The successful bidder will be required to enter into a contract satisfactory to the City of
Rancho Cucamonga.
In accordance with the requirements of Section 9-3.2 of the General Provisions, as set
forth in the Plans and Specifications regarding the work contracted to be done by the

Recommendation:
It is recommended that the City Council by minute action authorize an appropriation in
the amount of $7,360 in account number 01-4333-6028 to supplement the amount
currently budgeted for the City of Rancho Cucamonga's share of the Multi-Species
Habitat Conservation Plan coordinated by the County of San Bernardino. The
appropriation will be funded from the development fee reserve established in FY
1999/2000.
Background:
During the FY 2000/2001 budget process, a final dollar figure for the City's share of the
Multi-Species Habitat Conservation Plan was not available. Consequently, an estimate
of $14,230 was included in the budget as a placeholder. The City was recently notified
by the County that its total share for FY 2000/2001 is $21,590. The supplemental
appropriation of $7,360 requested in this staff report combined with the budgeted
amount will provide full funding of the City's obligation.

RECOMMENDATION
It is recommended that the City Council approve the attached Professional Services
Agreement with Bruce W. Hull & Associates to provide appraisal to the City in relation to a
proposed Community Facilities District(CFD). The amount for these services will not exceed
$25,000. The developers requesting the formation of this CFD will pay the total cost for these
services.
BACKGROUND
The proposed CFD is being requested by Catellus Development Corporation to fund public
improvements on Milliken Ave., Arrow Rte., and Foothill Blvd. necessary for their
development. The appraisal is necessary to insure that the property in question has sufficient
value to support the proposed bonded indebtedness per City policy.
The developer who is requesting this CFD is paying the cost for the appraiser. Because there
is no impact to the City financially and because of the need for an appraisal of the proposed
CFD to insure compliance with City policy, it is recommended that this Professional Services
Agreement be approved.

PROFESSIONAL SERVICES AGREEMENT
This Agreement is made and entered into this day of 2000, between the City
of Rancho Cucamonga, a body corporate and politic (hereinafter referred to as "City"), and Bruce W. Hull
& Associates, Inc. (hereinafter referred to as "Consultant").
A. Recitals
(1) City has heretofore expressed its intent to contract for professional services with respect to
assistance in the appraisal of properties associated with a proposed Community Facilities
District(Catellus).
(2) Consultant has now submitted its proposal for the performance of such services, a full, true,
and accurate copy of which is attached hereto as Exhibit "A", and by this reference made a
part hereof.
(3) City desires to retain Consultant to perform professional services necessary to render advice
and assistance to City,City Council, and staff in the preparation of an appraisal of the CFD.
(4) Consultant represents that it is qualified to perform such services and is willing to perform
such professional services as hereinafter deemed.
NOW, THEREFORE, it is agreed by and between City and Consultant as follows:
B. Agreement
1. Consultant agrees as follows:
(a) Consultant shall forthwith undertake and perform the services in accordance with Exhibits
"A" attached hereto, and all in accordance with Federal, State, and City statutes,
regulations, ordinances and guidelines, all to the reasonable satisfaction of the City.
(b) Consultant shall, at Consultant's sole cost and expense, secure and hire such other persons
as may, in the opinion of Consultant, be necessary to comply with the terms of this
Agreement. In the event that any such other persons are retained by Consultant,
Consultant hereby warrants that such persons shall be fully qualified to perform such
services required hereunder. Consultant further agrees that no subcontractor shall be
retained by Consultant except upon the prior written approval of the City.
(c) Consultant shall supply copies of all maps, surveys, reports, plans and documents
(hereinafter collectively referred to as "documents") including all supplemental technical
documents, as described in Exhibit "A" to City. Copies shall be in such numbers as are
required by City. City may thereafter review and forward to Consultant comments
regarding said documents and Consultant shall thereafter make such revisions to said
documents as are deemed necessary. City shall receive revised documents in such form
and in the quantities determined necessary by the City.
2. City agrees as follows:
(a) To pay Consultant a maximum sum not to exceed Twenty Five Thousand Dollars
(S25,000.00) for the performance of the services required hereunder. This sum shall cover
the cost of all staff time and all other direct or indirect costs or fees, including the work of
employees, consultants and subcontractors to Consultant. Payment to Consultant shall be
made in accordance with the schedule set forth below.
(b) Payments to Consultant shall be made by City in accordance with the invoices submitted
by Consultant, on a monthly basis, and such invoices shall be paid within a reasonable
amount of time after said invoices are received by City. In no event, however, will said
invoices exceed Twenty Five Thousand Dollars($25,000.00).
(c) Consultant agrees that, in no event, shall City be required to pay to Consultant any sum in
excess of Twenty Two Thousand Five Hundred Dollars ($22,500.00) prior to receipt by

City of all final documents, together with all supplemental technical documents, as
described herein, in acceptable form and content to City. Final payment shall be made not
later than Sixty (60) days after presentation of final documents and acceptance thereof by
City.
(d) Additional services: Payments for additional services requested in writing by City,and not
included in Exhibit "A" hereof, shall be paid on a reimbursement. Charges for additional
services shall be invoiced on a monthly basis and shall be paid by City within a reasonable
time after said invoices are received by City.
J. City agrees to provide Consultant
(a) Information and assistance as necessary.
(b) Photographically reproducible copies of maps and other information, if available, which
Consultant considers necessary in order to complete the Project.
(c) Such information as is generally available from City files applicable to the Project.
(d) Assistance, if necessary, in obtaining information from other governmental agencies and/or
private parties. However, it shall be Consultant's responsibility to make all initial contact
with respect to the gathering of such information.
4. Ownership of documents: All documents and other writings of any nature prepared by
Consultant pursuant to this Agreement shall be considered the property of the City and, upon
payment for services performed by Consultant, such documents and other identified materials
shall be delivered to City by Consultant. Consultant may, however, make and retain such
copies of said documents and materials as Consultant may desire. Any reuse of such
documents on any other project without Consultant's prior written consent shall be at City's
sole risk.
5. Termination: This Agreement may be terminated by City upon the giving of a written "Notice
of Termination" to Consultant at least Fifteen (15) days prior to the date of termination
specified in said Notice. In the event this Agreement is so terminated, Consultant shall be
compensated at Consultant's applicable hourly rates, as set forth in Exhibit "A", on a pro rata
basis with respect to the percentage of the Project completed as of the date of termination. In
no event, however, shall Consultant receive more than the maximum specified in paragraph
2(a), above. Consultant shall provide to City any and all documents, data, studies, surveys,
drawings, maps, models, photographs, and reports, whether in draft or final form, prepared by
Consultant as of the date of termination. Consultant may not terminate this Agreement except
for cause.
6. Notices and Designated Representatives: Any and all notices, demands, invoices and written
communications between the parties hereto shall be addressed as set forth in this paragraph 6.

T Insurance: Consultant shall neither commence work tinder this Agreement until it has obtained
all insurance required hereunder in a company or companies acceptable to City nor shall
Consultant allow any subcontractor to commence work on a subcontract until all insurance
required of the subcontractor has been obtained. Consultant shall take out and maintain at all
times during the term of this Agreement the following policies of insurance:
(a) Workers' Compensation Insurance: Before beginning work, Consultant shall furnish to
City a certificate of insurance as proof that it has taken out full workers' compensation
insurance for all persons whom it may employ directly or through subcontractors in
carrying out the work specified herein, in accordance with the laws of the State of
California. In accordance with the provisions of California Labor Code Section 3700,
every employer shall secure the payment of compensation to his employees. Consultant
shall,prior to commencing work, sign and file with City a certification as follows:
"I am aware of the provisions of California Labor Code Section 3700 which requires every
employer to be insured against liability for workers' compensation or to undertake self
insurance in accordance with the provisions of that Code, and I will comply with such
provisions before commencing the performance of this Agreement."
(b) Public Liability and Property Damage: Throughout the term of this Agreement, at
Consultant's sole cost and expense,Consultant shall keep, or cause to be kept, in full force
and effect, for the mutual benefit of the City and Consultant, comprehensive, broad form,
general public liability and automobile insurance against claims and liabilities for personal
injury, death, or property damage arising from Consultant's activities, providing protection
of at least One Million Dollars ($1,000,000.00) for bodily injury or death to any one
person or for any one accident or occurrence and at least One Million Dollars
($1,000,000.00)for property damage.
(c) General Insurance Requirements: All insurance required by express provision of this
Agreement shall be carried only in responsible insurance companies licensed to do
business in the State of California and policies required under paragraphs 7(a) and(b) shall
name as additional insured City, its elected officials, officers, employees and agents. All
policies shall contain language, to the extent obtainable, to the effect that : (1) the insurer
waives the right of subrogation against City and City's elected officials, officers,
employees, and agents;(2)the policies are primary and noncontributing with any insurance
that may be carried by City; and(3)they may not be canceled or materially changed except
after thirty (30) days notice by insurer to City by certified mail. Consultant shall furnish
City with copies of all such policies promptly upon receipt of them, or certificate
evidencing insurance. Consultant may effect for its own account insurance not required
under this Agreement.
8. Indemnification: Consultant shall defend, indemnify and save harmless City, its elected
officials, officers, employees and agents from all liability from loss, damage or injury to
persons or property, including the payment by Consultant of any and all legal costs and
attorney's fees, in any manner arising out of or incidental to the performance by Consultant of
this Agreement, including, but not limited to, all consequential damages, to the maximum
extent permitted by law.
9. Assignment: No assignment of this Agreement or of any part or obligation of performance
hereunder shall be made, either whole or in part, by Consultant without the prior written
consent of City.
10. Damages: In the event that Consultant fails to submit to City the completed project, together
with all documents and supplemental material required hereunder, in public hearing form, to
the reasonable satisfaction of the City, within the time set forth herein, or as may be extended
by written consent of the parties hereto, Consultant shall pay to the City as liquidated damages
an amount equal to any and all amounts paid by City to Consultant under the terms of this
Agreement, which sum represents a reasonable endeavor by the parties hereto to estimate a
fair compensation for the foreseeable losses that might result from such a default in
performance by Consultant, and due to the difficulty which would otherwise occur in
establishing actual damages resulting from such default, unless said default is caused by City,
or by acts of God, acts of the public enemy, fire, flood,epidemic, or quarantine restrictions.
1 I. Independent Contractor: The parties hereto agree that Consultant and its employees, officers.
and agents are independent contractors under this Agreement and shall not be construed for
any purpose to be employees of the City.
12. Governing Law: This Agreement shall be governed by and construed in accordance with the
laws of the State of California.
13. Attorneys' Fees: In the event any legal proceeding is instituted to enforce any term or
provision of this Agreement, the prevailing party in said legal proceeding shall be entitled to
recover attorneys' fees and court costs from the opposing party in an amount determined by
the Court to be reasonable.
14. Entire Agreement: This Agreement supersedes any and all other agreements, either oral or
written, between the parties with respect to the subject matter herein. Each party to this
Agreement acknowledges that no representation by any party which is not embodied herein
nor any other agreement, statement, or promise not contained in this Agreement shall be valid
and binding. Any modification of this Agreement shall be effective only if it is in writing,
signed by all parties.

Boulevard from Grove Avenue to Vineyard Avenue, in the amount of $875,650.00
($796,045.00 plus 10% contingency) to be funded from Account No. 22-4637-9843.
BACKGROUND/ANALYSIS:
The City desires plans, specifications and a cost estimate for improvements to Foothill
Boulevard between Grove Avenue and Vineyard. The project consists of street
widening from four to six lanes, landscaped medians, realignment of Red Hill Country
Club Drive, traffic signals, storm drain work, bridge widening over Cucamonga Channel,
disposition of the East Upland Underpass Bridge, and environmental and cultural
assessment.
In selecting a consultant for this sensitive project, a Request for Qualifications was sent
to 11 engineering firms. From the replies to our design request, two firms were selected

CUCAMONGA, CALIFORNIA, APPROVING DEVELOPMENT CODE
AMENDMENT 00-02, TO ADD SECTION 17.20.060 — HILLSIDE
OVERLAY DISTRICT TO THE DEVELOPMENT CODE.
A. RECITALS.
1. On June 14, 2000, the Planning Commission of the City of Rancho Cucamonga
conducted a duly-noticed public hearing with respect to the above-referenced Development
Code Amendment and, following the conclusion thereof, adopted its Resolution No. 00-51,
recommending that the City Council of the City of Rancho Cucamonga adopt said amendment.
2. On July 19, 2000, the City Council of the City of Rancho Cucamonga conducted
and concluded a duly-noticed public hearing concerning the subject amendment to the
Development Code.
3. All legal prerequisites prior to the adoption of this Ordinance have occurred.
B. ORDINANCE.
NOW, THEREFORE, it is hereby found, determined, and resolved by the City Council of
the City of Rancho Cucamonga as follows:
SECTION 1: This City Council hereby specifically finds that all of the facts set forth in the
Recitals, Part A, of this Ordinance are true and correct.
SECTION 2: This City Council hereby finds and determines that the subject amendment
identified in this Ordinance is exempt from the requirements of the California Environmental
Quality Act of 1970, as amended, and the Guidelines promulgated thereunder, pursuant to
Section 15061(b)(3) of Chapter 3 of Division 6 Title 14 of the California Code of Regulations.
SECTION 3: The Development Code Amendment No. 00-02 is hereby amended by
incorporating Section 17.20.060 into the Development Code, as shown on Exhibit"A."
SECTION 4: If any section, subsection, sentence, clause, pharos, or word of this Ordinance
is, for any reason, deemed or held to be invalid or unconstitutional by the decision of any court
of competent jurisdiction, or preempted by legislative enactment, such decision or legislation
shall not affect the validity of the remaining portions of this Ordinance. The City Council of the
City of Rancho Cucamonga hereby declares that it would have adopted this Ordinance and
each section, subsection, sentence, clause, phrase, or word thereof, regardless of the fact, that
any one or more sections, subsection, sentence, clause, phrase, or words might subsequently
be declared invalid or unconstitutional or preempted by subsequent legislation.
SECTION 5: The City Clerk shall certify to the adoption of this Ordinance and shall cause
the same to be published within 15 days after its passage at least once in the Inland Valley
Daily Bulletin a newspaper of general circulation published in the City of Ontario California and

Section 17.20.060 — Hillside Overlay District
A. Purpose. The Hillside Overlay District is intended to identify the
geographical area of the City which is subject to the regulations of
Section 17.24—Hillside Development Regulations.
B. District Boundaries. The Hillside Overlay District is generally located
north of Hillside Avenue, with variations, along with the area around Red
Hill and Beryl Hill, as depicted on the Development District Map. There
may be other isolated areas of the City that would be subject to Section
17.24 (i.e. slope greater than or equal to 8%) as identified on a case-by-
case basis as development applications are submitted for review and
processing.
C. Applicability. The area within the Hillside Overlay District shall be subject
to all procedures, standards and guidelines of Section 17.24 — Hillside
Development regulations.

California Environmental Quality Act of 1970, as amended, and the State CEQA guidelines
promulgated thereunder; that said Negative Declaration and the Initial Study prepared therefore
reflect the independent judgment of the City Council; and further, this Council has reviewed and
considered the information contained in said Negative Declaration with regard to the application.
b) That based upon the changes and alterations, which, have been
incorporated into the proposed project, no significant adverse environmental effects will occur.
c) Pursuant to the provisions of Section 753.5(c) of Title 14 of the California
Code of Regulations, the City Council finds as follows: In considering the record as a whole, the
Initial Study and Negative Declaration for the project, there is no evidence that the proposed
project will have potential for an adverse impact upon wildlife resources or the habitat upon

Rancho Cucamonga Development Code Section 17 24 020
Section 17.24.020 - Review Procedures
All projects within the Hillside Overlay District and all properties with an a hillside area(8 percent
slope or greaten-, including but not limited to, parcel maps, tentative tract maps, and site plans for
development review,as well as General Plan and Development District Amendments,shall be subject
to Grading Committee and Design Review Committee review with approval by the City Planner, or
Planning Commission in accordance with the provisions contained in Sections 17.06.010 and
19.04.060. Additionally, review by the Grading Committee and Design Review Committee with
approval by the City Planner or Planning Commission will also be required for other types of
development or grading which meet the criteria specified in Sections 17.24.020A, B, and C.
A. City Planner Review. The City Planner shall review all site development applications and shall
impose conditions deemed appropriate when one or more of the following activities are
proposed:
1. Natural slopes which are 8 percent or greater but less than 15 percent on all or part of a
subject site, or on less steep land which may be affected by areas of greater slope(e.g.,
flat parcel between or adjacent to steep hillside).
2. For fills or excavations equal to or exceeding 3 feet but less than 5 feet in vertical depth,
at their deepest point measured from the natural ground surface.
3. For excavations or fills, or any combination thereof, equal to or exceeding 100 cubic
yards, but less than 1,500 cubic yards.
4. Residential construction involving four or less dwelling units, such as custom homes,
regardless of natural slope or the amount of fill or excavation.
B. Planning Commission Review. The Planning Commission shall review site development
applications and impose conditions deemed appropriate when one or more of the following
activities are proposed:
1. Natural slopes equal to or greater than 15 percent on all or part of a subject site.
2. For fills or excavations equal to or exceeding 5 feet in vertical depth at their deepest point
measured from the natural ground surface.
3. For excavations or fills, or any combination thereof, equal to or exceeding 1,500 cubic
yards.
4. Any excavation or fill which will encroach onto or alter a natural drainage channel or
watercourse. (Should be prohibited unless alternate drainage is provided.)
5. Any other proposal referred to the Planning Commission by the Grading Committee or
City Planner.
C. Exceptions. Projects which are limited in scope (e.g., regrading of yard areas, pool/spa
construction,additions to existing structures,and/or construction of accessory structures which
are less than 250 square feet)may be deferred to staff level review and approval by the City
Planner. However, projects which require grading of large flat areas, including,but not limited
to,such items as tennis courts or riding rings, shall be reviewed by the City Planner or may be
referred to the Planning Commission if determined necessary by the City Planner.

A. Recitals.
1. Charles Joseph Associates has filed an application for Industrial Area Specific Plan
Amendment 99-05 as described in the title of this Ordinance. Hereinafter in this Ordinance, the
subject Industrial Area Specific Plan Amendment is referred to as the "application."
2. On the 24th of May 2000, the Planning Commission of the City of Rancho Cucamonga
conducted a duly noticed public hearing on the application and, following the conclusion of said

FACIE SPEED LIMIT OF 30 MPH ON PALO ALTO STREET BETWEEN
ARCHIBALD AVENUE AND HELLMAN AVENUE
RECOMMENDATION
Approve staffs recommendation to amend Section 10.20.020 of the Municipal Code in
order to establish a prima facie speed limit of 30 mph on Palo Alto Street between
Hellman Avenue and Archibald Avenue.
BACKGROUND/ANALYSIS
On June 12, 2000, City staff received a request from a resident to install speed limit
signs on Palo Alto Street between Hellman Avenue and Archibald Avenue. City staff
investigated, and discovered that Palo Alto Street does not have a posted speed limit.
Palo Alto Street is 44 ft in width, and therefore, does not qualify as a local street with a
prima facie speed limit of 25 mph. According to the California Vehicle Code, the
maximum width of a local street is 40 ft. City staff conducted an Engineering and Traffic
Survey, and determined that the 85w percentile speed on Palo Alto Street is 33 mph.
Therefore, City staff is recommending that a prima facie speed limit of 30 mph be
established for Palo Alto Street.
City staff checked the accident records, and there were no reported accidents on Palo
Alto Street between Hellman Avenue and Archibald Avenue during the last 2 years. City
staff did not identify any "not readily apparent" conditions that would justify any further
reduction in the posted speed limit.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA,AMENDING SECTION
10.20.020 OF THE RANCHO CUCAMONGA CITY CODE TO
ESTABLISH A PRIMA FACIE SPEED LIMIT OF 30 MPH ON
PALO ALTO STREET BETWEEN ARCHIBALD AVENUE AND
HELLMAN AVENUE
A. Recitals
(i) California Vehicle Code Section 22357 Provides that this City Council may,
by ordinance, set prima facie speed limits upon any portion of any street not a state highway.
(ii) The City Traffic Engineer has conducted an engineering and traffic survey, of
certain streets within the City of Rancho Cucamonga which streets as specified in Part B of this
Ordinance.
(iii) The determinations concerning prima facie speed limits set forth in Part B,
below, are based upon the engineering and traffic survey identified in Section A (ii), above.
B. Ordinance
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMONGA DOES HEREBY ORDAIN AS FOLLOWS:
Section I
Section 10.20.020 hereby is amended to the Rancho Cucamonga City Code to read,
in words and figures, as follows:
10.20.020 Decrease of state law maximumspeed. It is determined by City Council
resolution and upon the basis of an engineering and trattic investigation that the speed permitted by
state law is greater than is reasonable or safe under the conditions found to exist upon such streets,
and it is declared the prima facie speed limit shall be as set forth in this section on those streets or
parts of streets designated in this section when signs are erected giving notice hereof:

(iv) The Traffic Engineer is hereby authorized and directed to install appropriate signs
upon said streets giving notice of the prima facie speed limit declared herein.
Section 2
The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be
published as required by law.
Section 3
The Mayor shall sign this Ordinance and the City Clerk shall cause the same to be published
within fifteen(15) days after its passage at least once in The Inland Dail Bulletin, a newspaper of
general circulation published in the City of Ontario, California, cr�d in the City of
Rancho Cucamonga.

SUBJECT: System Transfer of Comcast Cablevision to Adelphia Communications
Corporation
RECOMMENDATION:
It is recommended that the City Council approve the cable system transfer of Comcast
Cablevision to Adelphia Communications Corporation.
BACKGROUND:
In November 1993, the City of Rancho Cucamonga approved an interim operating
agreement for cable television services with Comcast Cablevision. The purpose of this
agreement was to provide cable service to the "Redhill" area as the existing cable
operators at the time were not able to do so. In April 1999, the City and Comcast
Cablevision finalized the cable television franchise agreement, and Comcast completed
its technical upgrade to its system, including internet service and digital television. To
date, Comcast Cablevision serves nearly 2,000 Rancho Cucamonga residents.
Adelphia Communications Corporation is the fifth largest cable television operator in the
United States, serving over 5.5 million cable subscribers. Its business operations
include cable entertainment, high-speed internet access, long distance telephone
service and paging.
Adelphia recently acquired Century Communications, who owns and operates cable
television systems with significant subscribers in California, Colorado and Puerto Rico.
ANALYSIS:
In adherence to the Federal Communications Commission (FCC) current regulations
and Section 7.02.020 (F) of Chapter 7.02 of Title 7 of the City of Rancho Cucamonga
Municipal Code, Comcast Cablevision and Adelphia Communications Corporation have
jointly submitted a copy of FCC Form 394 required for the proposed cable system
exchange of Comcast Cablevision to Adelphia Communications Corporation. After
reviewing the FCC Form 394, the City has found that Adelphia has legal, technical and
financial ability to operate and maintain the Comcast Cablevision cable system. Upon
the approval of system exchange, Adelphia will assume all agreed duties and
responsibilities between the City of Rancho Cucamonga as expressed in the City's
current Cable Television Franchise Agreement.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA AUTHORIZING AND
CONSENTING TO THE TRANSFER OF CONTROL OF A
CABLE TELEVISION FRANCHISE HELD BY COMCAST
CABLEVISION OF INLAND EMPIRE, INC.
RECITALS:
A. Comcast Cablevision of Inland Empire, Inc., a Delaware corporation
("Franchisee"), is the duly authorized holder of a franchise ("Franchise") that authorizes the
construction, operation, and maintenance of a cable television system within the City of Rancho
Cucamonga ("Franchise Authority"). The Franchise became effective on April 7, 1999.
B. On March 2, 2000, the Franchise Authority received from Comcast
Cablevision Corporation of California, the parent company of the Franchisee, and from Clear
Cablevision, Inc., an indirect, wholly-owned subsidiary of Adelphia Communications Corporation
("Transferee"), an application for the Franchise Authority's consent to a transfer of control of the
Franchise. This application was made on FCC Form 394 entitled "Application for Franchise
Authority Consent to Assignment or Transfer of Control of Cable Television Franchise."
Supplemental information relating to this application was provided to the Franchise Authority by
the applicants in letters dated June 1, 2000, and June 30, 2000.
C. In accordance with Section 7.02.020(F) of Chapter 7.02 of Title 7 of the
Rancho Cucamonga Municipal Code, the Franchise Authority has the right to review and to
approve the financial, technical, and legal qualifications of Adelphia Communications
Corporation, as the ultimate parent corporation of the Transferee, in connection with the
proposed transfer of control of the Franchise.
D. The staff of the Franchise Authority has reviewed the documentation that
accompanied FCC Form 394 and, based upon the representations set forth in that
documentation, has concluded that Adelphia Communications Corporation, as the ultimate
parent corporation of the proposed Transferee, Clear Cablevision, Inc., has the requisite financial,
technical, and legal qualifications to adequately perform, or to ensure the performance of, all
obligations required of the Franchisee under the Franchise, and that the Franchisee will continue
to be bound by all existing terms, conditions, and obligations under the Franchise previously
owned and operated by Comcast Cablevision of Inland Empire, Inc.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMONGA RESOLVES AS FOLLOWS:
Section 1. In accordance with Section 7.02.020(F) of Chapter 7.02 of Title 7 of the
Rancho Cucamonga Municipal Code, the Franchise Authority consents to and approves the
proposed cable system exchange transactions by and between Comcast Corporation, on the one
hand, and Adelphia Communications Corporation, on the other hand, which cable system
exchange transactions when consummated will result in a change of control of the Franchise and
of the Franchisee. The Franchise Authority further consents to and approves the internal
reorganization among subsidiaries of Comcast Corporation, the ultimate parent company of the
Franchisee, the conversion of the Franchisee from a corporation to a limited liability company,
and the transfer by Comcast Cablevision Corporation of California of its limited liability company
ownership interests in the Franchisee to Clear Cablevision, Inc.
Section 2. The authorization, consent and approval of the Franchise Authority to
the proposed assignment and change of control is conditioned upon compliance by the applicants
with the following requirements, as to which they are jointly and severally responsible:
1. Adelphia Communications Corporation, as the ultimate parent corporation
of the Transferee, Clear Cablevision, Inc., will execute and file with the office of the City Clerk an
"Unconditional Guarantee of Transferee's Obligations" in substantially the form attached as
Exhibit A to this resolution.
2. An original or conformed copy of the written instrument evidencing the
closing and consummation of the proposed cable system exchange transaction that will result in a
change of control of the Franchise must be filed in the office of the City Clerk within 30 days after
that closing and consummation.
3. Regardless of whether the transaction described in the FCC Form 394
actually closes, the Franchise Authority will be reimbursed for all costs and expenses reasonably
incurred by the Franchise Authority in processing and evaluating the information relating to the
proposed assignment and change of control of the Franchise; provided, however, that those costs
and expenses will not exceed the sum of $2,500 and will be set forth in an itemized statement
transmitted by the City Manager, or the City Manager's designee, to the applicants within 60 days
after the effective date of this resolution. The total amount set forth in the statement must be paid
by the applicants to the Franchise Authority within 30 days after the date of the statement.
Section 3. Nothing contained in this resolution may be construed to modify the
franchise service area of the Franchisee, which is restricted to that area designated in Exhibit C to
the Franchise dated April 7, 1999, which Franchise was approved by Resolution No. 99-084, as
adopted by the City Council on April 7, 1999.
Section 4. Nothing contained in this resolution may be construed to extend the
term of the Franchise, which will terminate in its entirety on April 6, 2014.
Section 5. The City Clerk is directed to transmit a certified copy of this resolution

SUBJECT: TRAFFIC CONTROL FOR QUAKES GAMES
At the direction of the City Council, the Police Department has reviewed the need to continue
with the road closure of Rochester during Quakes home games.
The Rancho Cucamonga Police Department has recently monitored traffic at the Quakes
Stadium. This review of traffic f ow was conducted during a recent home stand. The review
indicated that attendance during home games has declined to the point that Lot A (the parking
lot located east of Rochester) is seldom being used. This has produced a light quantity offoot
traffic crossing Rochester to get to the Stadium. Our review also indicated that attendance
during the weekend is, in fact, higher than during the week. We also monitored the time it takes
for traffic to clear and exit the Stadium and found the Stadium is cleared in approximately ten to
fifteen (10-1 S) minutes for both weekday and weekend games.
On July 19, 2000, members of the Rancho Cucamonga Police Department, the Quakes, and City
staff met to discuss the closure of Rochester. During this meeting, traffic f ow and attendance
numbers were discussed, and as a result, the following recommendation is being made to the
City Council for adoption:
During home games on Monday through Thursday, Rochester will be left open with a
specific traffic-cone pattern being utilized. On Friday, Saturday, and Sunday, Rochester
will continue to be closed during the game.
At the end of the current baseball season, we will again explore any pertinent issues for the need
to close or open Rochester for the 2001 Quakes baseball season.
