B. PUBLIC COMMUNICATIONS
This is the time and place for the general public to address the Historic Preservation
Commission or Planning Commission on any item listed or not listed on the agenda. State law
prohibits the Commission from addressing any issue not previously included on the Agenda.
The Commission may receive testimony and set the matter for a subsequent meeting.
Comments are to be limited to five minutes per individual or less, as deemed necessary by the
Chair, depending upon the number of individuals members of the audience. This is a
professional business meeting and courtesy and decorum are expected. Please refrain from
any debate between audience and speaker, making loud noises or engaging in any activity
which might be disruptive to the decorum of the meeting.
Gwynn Frost, representing the Etiwanda Historic Society distributed flyers (copy on file) for a "Sleepy Hollow"
event to be held on Saturday, October 2111 at 6:00 p.m. $7 for children and for $12 adults. She said there
will be other events such as the annual open house on November 12th, Pictures with Santa on December
9th, and a Valentines dinner in the Chaffey-Garcia House.
Luanna Hernandez, 6797 Hellman Avenue asked what is currently being done about the China town house.
isShe said the Water District has made no improvements and numerous groups are trying to purchase and

save this as it is the last one io the Inland Empire. She said the old service station is a beacon -and shows
what gyve can do. She asked staff to talk to CVWD and ask for them to do something.
Chairman Oaxaca said staff has been in touch with them over time. He asked Staff for an update report at
a future meeting.

D1. TIME EXTENSION DRC2017-00652 - ALEX MUSTAPHA - A request to allow for a one (1)
year time extension of a previously approved Tract Map (SUBTT18928) for an 8-unit
townhouse development on 1.02 acres in the Medium (M) Residential District, on the west
side of Carnelian Street, approximately 180 feet south of Calle Del Prado, located at 7490
Carnelian Street; APN: 0207-022-11. This item is exempt from the requirements of the
California Environmental Quality Act (CEQA) and the City's CEQA guidelines as a Class 32
Exemption (CEQA Section 15332) for In -fill Development Projects.
Tom Gratin, Associate Planner gave the staff report and PowerPoint presentation (copy on
file).
• Chairman Oaxaca opened the public hearing and seeing and hearing no comment asked the
applicant for comment.
Mr. Mustapha stated the time extension is to accommodate a need for extra time for utility
approvals.
Seeing and hearing no further comment, Chairman Oaxaca closed the public hearing.
Moved by Munoz seconded by Macias carried 5-0 to adopt the Resolution of Approval for
Time Extension DRC2017-00652.
D2. DESIGN REVIEW MODIFICATION DRC2017-00391 - FENG XIAO ARCHITECT, INC - A
proposed design modification for six (6) previously approved single-family homes in the Low
(L) Residential District, located approximately 200 feet south of Wilson Avenue on the east
side of Winchester Court; APN: 0201-182-36. The City adopted a Mitigated Negative
Declaration on November 10, 2010 in connection with the City's approval of Tentative Tract
Map SUBTT18391. The California Environmental Quality Act provides that no further
environmental review or Negative Declaration is required for subsequent projects within the
scope of a previous Negative Declaration,

Feng Xiao stated she is the applicant and had nothing to add as it was a complete report. She
said they took the original design and brought it up a level to match the existing neighborhood.
Chairman Oaxaca closed the public hearing and then asked about the provision of a second
kitchen.
Ms. Xiao said it is to cater to those who like to have the option of cooking in an open or closed
kitchen.
Moved by Munoz seconded by Macias carried 5-0 to adopt the Resolution of Approval for
Design Review Modification DRC201 7-0039 1. •
D3. CONDITIONAL USE PERMIT DRC2016-00999 — DUNKIN' DONUTS — The request to
develop a drive-thru lane associated with the development of a 6,001-square foot multi -tenant
commercial building on a vacant parcel of 0.95-acres in the General Commercial (GC)District,
on the south side of Foothill Boulevard, about 500 feet east of Rochester Avenue, located at
11995 Foothill Boulevard; APN: 0229-023-10. Related Files: Design Review DRC2016-
00998, Minor Exception DRC2017-00424. The City adopted a Mitigated Negative Declaration
on January 24, 2007 in connection with the City's approval of Tentative Parcel Map
SUBTPM17818. The California Environmental Quality Act provides that no further
environmental review or Negative Declaration is required for subsequent projects within the
scope of a previous Negative Declaration.
D4. DESIGN REVIEW DRC2016-00998 - DUNKIN' DONUTS — The request to develop a 6,001-
square foot multi -tenant commercial building on a vacant parcel of 0.95-acres in the General
Commercial (GC)District, on the south side of Foothill Boulevard, about 500 feet east of
Rochester Avenue, located at 11995 Foothill Boulevard, APN: 0229-023-10. Related files:
Conditional Use Permit DRC2016-00999, Minor Exception DRC2017-00424. The City
adopted a Mitigated Negative Declaration on January 24, 2007 in connection with the City's
approval of Tentative Parcel Map SUBTPM17818. The California Environmental Quality Act
provides that no further environmental review or Negative Declaration is required for
subsequent projects within the scope of a previous Negative Declaration.
D5. MINOR EXCEPTION DRC2017-00424 - DUNKIN' DONUTS — A request to reduce the
required setback from 45 feet to 40.5 feet for a drive-thru lane associated with the development •
of a 6,001-square foot multi -tenant commercial building on a vacant parcel of 0.95-acres in
the General Commercial (GC)District, on the south side of Foothill Boulevard, about 500 feet

• Commissioner Fletcher asked what would happen if "Restaurant #2" also proposed a drive-
thru — he asked if they would use a shared drive. He said it would be an odd configuration
and they would have to add a drive thru window.
Commissioner Wimberly asked about conditioning the project to prohibit an additional drive
thru on other property.
Chairman Oaxaca opened the public hearing.
Damien Picharch, representing the owner and the architect said they would not entertain the
idea of a second drive-thru. He said the proposed drive-thru goes around the entire building.
The other restaurant would have to be a walk in.
Seeing and hearing no further comment, Chairman Oaxaca closed the public hearing.
Moved by Wimberly seconded by Macias carried 5-0 to adopt the Resolutions of Approval for
Conditional Use Permit DRC 2016-00999, Design Review DRC2016-00998 and Minor
Exception DRC2017-00424.
D6. DESIGN REVIEW DRC2017-00378 - MANNING HOMES - A request for site plan and
architectural review of 16 single-family residences on 6.59 acres of land within the Low (L)
District (2-4 dwelling units per acre) of the Etiwanda Specific Plan on the south side of Carnesi
Drive and east of Etiwanda Avenue; APNs: 0227-061-03 and 82. Related Files: General Plan
Amendment DRC2013-00961, Etiwanda Specific Plan Amendment DRC2013-00962,
Tentative Tract Map SUBTT18936, Variance DRC2014-00219 and Tree Removal Permit
• DRC2014-00113. Pursuant to the California Environmental Quality Act ("CEQA") and the
City's local CEQA Guidelines, the City adopted a Mitigated Negative Declaration on October

21, 2015, in connection with the City's approval of Tentative Tract Map SUBTT18936.
Pursuant to CEQA Guidelines Section 15162, no subsequent or supplemental EIR or Negative
Declaration is required in connection with subsequent discretionary approvals of the same
project.
Tabe van clef Zwaag. Associate Planner gave the staff report and PowerPoint presentation
(copy on file). He noted a condition placed before the Commissioners to be deleted from the
standard conditions as requested by staff. The condition was for a prior required EVA.
Commissioner Fletcher asked why the condition is being removed
Mr. van der Zwaag said the Fire Department says they never use them, and it is unnecessary •
to provide them. He said ultimately Planning would like the streets to pull through but the
neighbors did not want the extra traffic that would come through. Therefore, we provided the
EVA but now Fire says it is no longer useful. He said the pedestrian connection was kept.
Jim Manning stated he is the applicant and he worked with staff. He thanked staff for their
assistance through the process and hoped this project is as successful as their prior projects.
Chairman Oaxaca opened the public hearing.
Mr. Johnson stated Cross & Crown church is in support. He said Mr. Manning has been
tremendous and worked toward a smooth project. He said the homes are gorgeous and fit
welt with the neighborhood.
Seeing and hearing no comment, Chairman Oaxaca closed the public hearing.
Commissioner Munoz said he likes what he sees -it turned out well.
Commissioner Wimberly agreed and remembered the challenges at the beginning. He said
he is glad they made it fit with the neighborhood.
Commissioner Fletcher noted this project has been in the works for long time and there was
some 'back and forth'. He said the site plan worked and the project is a good addition. He
said he would like the single -story houses to have more Spanish influence. He, said the two •
story is a better design. He said in the future he would like for staff ensure all elements of
Spanish design.

Commissioner Macias said it is a good project design/well clone.
Chairman Oaxaca said he remembers numerous conversations about this project and was
pleased to see Mr. Manning's narne attached to the project as the City has good experience
with his firm.
Moved by Munoz seconded by Wimberly carried 5-0 to adopt the Resolution of Approval with
amended conditions for Design Review DRC2017-00378.
E. COMMISSION BUSINESS/HISTORIC PRESERVATION AND
PLANNING COMMISSION
INTER -AGENCY UPDATES:
Commissioner Munoz noted there are several laws regarding housing that passed but the League is
looking for more information as to the impacts of these laws on cities. He said he would bring more
information at a later state.
Commissioner Fletcher commented on an article in Western City Magazine related to Mello Roos fees
imposed on a developer in San Ramon. He asked legal counsel to comment with respect to the role of
the Planning Commission in their action.
Nick Ghirelli, Assistant City Attorney said he was unsure of the specifics of their action in San Ramon but
noted similarly, the Empire Lakes project required a CFO to be created to fund public improvements and
to maintain those improvements. He said we needed to be sure the CFD was in place at the right time
to ensure the City was not paying for them out of the General Fund.
Commissioner Fletcher said he asked for a workshop with the Council so they could explain the budget
to the Commission. He said the Commission was told at one time the Commission is not responsible for
the financial aspects of the project. He said he did not believe the Commission was given enough detailed
financial analysis and that he was not satisfied with what they received.
Mr. Ghirelli noted the plan in San Ramon may have had a zone change and that may have been the
• legislative hook that allowed their Commission to look at the economics. If it had conformed to all
development standards then the financial pail may not be under the purview of the Commission.

Any handouts for the Planning Commission should be given to the Planning Commission Secretary for distribution

APPEALS
Any interested party who disagrees with the City Planning Commission decision may appeal the Commission's
decision to the City Council within 10 calendar days. Any appeal filed must be directed to the City Clerk's Office
and must be accompanied by a fee of $2,725 for all decisions of the Commission. (Fees are established and
governed by the City Council).
