PUBLIC COMMUNICATIONS This is the time and place for the general public to address the Historic Preservation Commission or Planning Commission on any item listed or not listed on the agenda. State law prohibits the Commission from addressing any issue not previously included on the Agenda. The Commission may receive testimony and set the matter for a subsequent meeting. Comments are to be limited to five minutes per individual or less, as deemed necessary by the Chair, depending upon the number of individual members of the audience. This is a professional business meeting and courtesy and decorum are expected. Please refrain from any debate between audience and speaker, making loud noises or engaging in any activity which might be disruptive to the decorum of the meeting. Renee Massey, a resident of Red Hill, expressed concern regarding Item D6. She explained that the new home proposed to the south of her home will block their view of the valley. She asked in several meetings to share the view and they felt the owners should lower their home by 5 additional feet. She indicated that just meeting the requirements is not enough and the value of her home will be lessened if the home is built as proposed. • C. They will be acted upon by the Commission at one time without discussion. Any item may be removed for discussion. C1. Consideration to adopt Regular Meeting Minutes of January 24, 2018 Moved by Wimberly, seconded by Macias, carried 4-0-1 (Munoz absent) to adopt the minutes as presented. D. PUBLIC HEARINGS/PLANNING COMMISSION • The following items have been advertised and/or posted as public hearings as required by law. The Chairman will open the public hearing to receive testimony. All such opinions shall be limited to 5 minutes per individual or less as determined by the Chairman. Please sign in after speaking. D1. TIME EXTENSION DRC2017-00901 - JAIME CAMPOS - A request for a one (1) year time extension for a previously approved Tentative Parcel Map (SUBTPM18626) to subdivide a property of 0.63-acre into three (3) lots in the Low (L) Residential District located at the southeast corner of Lemon Avenue and Day Lily Court at 9923 Lemon Avenue - APN: 0201-902-16. This action is Categorically Exempt from the California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines Section 15315— Minor Land Divisions, Nikki Cavazos, Assistant Planner gave the staff report and PowerPoint presentation. Assistant City Attorney, Nick Ghirelli said the extension is for the map. The Code allows Staff to amend the map and it was an administrative decision that is minor and does not affect their vote on the map time extension. Jaime Campos, the applicant, said he needed a little more time to finish the map, hence the request for the extension. • Chairman Oaxaca opened the public hearing. Moved by Macias, seconded by Wimberly, carried 4-0-1 (Munoz absent) to adopt the Resolution of Approval for Time Extension DRC2017-00901 as presented. D2. ENVIRONMENTAL ASSESSMENT AND DESIGN REVIEW DRC2017-00084 — DEDEAUX PROPERTIES LLC — A proposal to construct a 56,560-square foot commercial trucking facility for office, storage, freight handling, shipping and trucking services on an 11.82 acre site located within the Heavy Industrial (HI) District at the • northwest corner of the Burlington Northern Santa Fe railway and Etiwanda Avenue at 8822 and 8768 Etiwanda Avenue -APNs: 0229-131-15, 16 and 26. The project includes a request to remove thirty-two (32) trees with the development of the site. A Mitigated Negative Declaration of environmental impacts has been prepared for consideration. Dominick Perez, Associate Planner noted the applicant had concerns regarding the engineering conditions. Additionally, a letter was received from the Department of Toxic Substances Control regarding some hazmat concerns. Staff requested a continuance of the item to an unspecified date. Chairman Oaxaca opened the public hearing and seeing and hearing no comment, closed the public hearing. Moved by Guglielmo, seconded by Wimberly, carried 4-0-1 (Munoz absent) to continue the item to a date unspecified to allow time to resolve the concerns. Items D3-D5 are related and therefore were heard concurrently. D3. TIME EXTENSION DRC2017-00922 — YOULITA AND KIRYAKOS, LLC. - A request to allow for a one (1) year time extension of a previously approved Tentative Tract Map (SUBTT18823) to subdivide 3 parcels of land totaling 12.93 acres into 19 lots for the future development of single-family residences in the Very Low (VL) District of the Etiwanda North Specific Plan (.1 to 2 dwelling units per acre), located on the west side of Wardman Bullock Road, south and east of Blue Sky Court - APN. 0226-081-15, 16 and 17. Related files Tentative Tract Map SUBTT18823, Variance DRC2012-00135 and • Minor Exception DRC2012-00513. On January 23, 2013, a Mitigated Negative Declaration of environmental impacts was adopted by the Planning Commission for Tentative Tract Map SUBTT18823. D4. TIME EXTENSION DRC2017-00952 — YOULITA AND KIRYAKOS, LLC. - A request to allow for a two (2) year time extension of a previously approved Variance (DRC2012- 00135) to reduce the minimum lot depth from 150 feet to 124 feet on Lot #9 of Tentative Tract Map SUBTT18823 in the Very Low (VL) District of the Etiwanda North Specific Plan (.1 to 2 dwelling units per acre) located on the west side of Wardman Bullock Road, south and east of Blue Sky Court -APN: 0226-081-15, 16 and 17. Related files Tentative • Tract Map SUBTT18823, Variance DRC2012-00135 and Minor Exception DRC2012- 00513. Related files Tentative Tract Map SUBTT18823, Variance DRC2012-00135 and Minor Exception DRC202-00513. He noted the conditions of approval have been modified regarding Water Quality Management and copies have been provided on the dais for the Commissioners' • review. Chairman Oaxaca confirmed the applicant is aware of the amended conditions. Carlos Cueva spoke on behalf of the applicant and noted they are aware of the conditions. Chairman Oaxaca opened the public hearing. Seeing and hearing no comment, Chairman Oaxaca closed the public hearing. • Commissioner Macais commented the item is straightforward. Moved by Wimberly, seconded by Macias, carried 4-0-1 (Munoz absent), to adopt the Resolutions of Approval for Time Extensions DRC2017-00922, DRC2017-00952 and DRC2017-00951 with the modified conditions. D6. HILLSIDE DESIGN REVIEW DRC2015-00604 — AARON SEMLER - A request for site plan and architectural review of a 3,778-square foot single-family residence on a 23,320- square foot lot on the south side of Camino Predera in the Hillside Overlay District of the Low (L) District (2 —4 dwelling units per acre) -APN: 0207-641-04. The project qualifies as a Class 3 exemption under Section 15303, of the California Environmental Quality Act, which permits the construction of a single-family residence in a residential zone. Tabe van der Zwaag, Associate Planner, gave the staff report and PowerPoint presentation. The applicant's architect, Pete Volbeda, said they tried to minimize view obstructions wherever possible and they were able to eliminate all but 4 retaining walls from the prior plans. Karlyn Semler, the property owner said they have received ernails letters and calls of support. She said they have been in process for 2.5 years and have done more than due diligence and did their best to consider everyone. She said the current vacant lot is attractive for trash and drug paraphernalia and for people who do not live in the area to park and loiter. She said they believe their new home will raise properly value and will help complete the neighborhood. She said If the home was any lower they would be living subterranean. • Chairman Oaxaca opened the public hearing. She said their lot is between two homes but because of the curve in the road, the view will be obstructed (Ms. Massey also spoke during public comment and wishes those comments to be included in the record. They are repeated below) Renee Massey, a resident of Red Hill, expressed concern regarding Item D6. She explained that the new home proposed to the south of her home will block their view of the valley. She asked in several meetings to share the view and they felt the owners should lower their home by 5 additional feet. She indicated that just meeting the requirements is not enough and the value of her home will be lessened if the home is built as proposed and she believes she has not been • "heard". Paul Bardos said he owns a lot on the south side of Camino Predere. He said he has been a builder for 40 years and understands the lot challenges. He said this project well designed, it has grading challenges and some retaining walls but they achieved excellent balance to keep the profile low and minimize view obstructions. He said he has built two homes on this street; they did an excellentjob. Chairman Oaxaca dosed the public hearing. Nick Ghirelli, Assistant City Attorney recommended the Chairman allow the applicant to reply. The applicant declined. Commissioner Wimberly thanked Mr. van der Zwaag for the comprehensive report and thanked the applicants for diligently working with and considering the neighbors. Commissioner Guglielmo noted a letter requesting the applicants to lower the height of the home 5 more feet. Mr. van der Zwaag said they looked into it but it would have required more retaining walls. Chairman Oaxaca said this is an example of we will see more of in the future—more challenging properties. He said it takes lot of extra work to fit in these existing neighborhoods. He said we • have to look for the best possible outcome. This applicant met and exceeded the requirements and achieved the best balance possible and addressed as many concerns of the neighbors as possible.
