This is the time and place for the general public to address the Historic Preservation
Commission or Planning Commission on any item listed or not listed on the agenda. State law
prohibits the Commission from addressing any issue not previously included on the Agenda.
The Commission may receive testimony and set the matter for a subsequent meeting.
Comments are to be limited to five minutes per individual or less, as deemed necessary by the
Chair, depending upon the number of individual members of the audience. This is a professional
business meeting and courtesy and decorum are expected. Please refrain from any debate
between audience and speaker, making loud noises or engaging in any activity which might be
disruptive to the decorum of the meeting.

The following Consent Calendar items are expected to be routine and non-controversial. They
will be acted upon by the Commission at one time without discussion. Any item may be removed
for discussion.
C1. Consideration to adopt Regular Meeting Minutes of January 10, 2018
C2. Consideration to adopt Adjourned Meeting (Workshop) Minutes of January 10, 2018
Moved by Munoz, seconded by Wimberly, carried 4-0-1 (Macias abstain) to adopt the Consent
Calendar.
D. PUBLIC HEARINGS/PLANNING COMMISSION •
The following items have been advertised and/or posted as public hearings as required by law.
The Chairman will open the public hearing to receive testimony. All such opinions shall be
limited to 5 minutes per individual or less as determined by the Chairman. Please sign in after
speaking.
D1. ENTERTAINMENT PERMIT DRC2017-00734- GAGGLES, INC. (SEPTEMBERS TAPROOM
AND EATERY) - A request for live entertainment to include live bands with amplified music, a
disc jockey and karaoke within an existing restaurant within the Neighborhood Commercial
District, located at 6321 Haven Avenue-APN:0201-272-06. This action is categorically exempt
from the California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines
Section 15301 — Existing Facilities
Nikki Cavazos, Assistant Planner gave the staff report and a brief PowerPoint presentation.
She noted one person had a concern regarding noise from the entertainment and requested
the hours of entertainment be ceased one hour earlier than proposed. Ms. Cavazos briefly
summarized the conditions in place that mitigate her concerns.
Commissioner Wimberly asked for the number and type of service calls received by the Police
Department.
Ms. Cavazos said there were about 10 disturbance calls in the last two years; some were from •
the business'staff calling the Police themselves. The Police indicate this is a normal range of
calls for service.

Commissioner Wimberly noted that in the past, the prior owners put out advertisements and
the clientele they drew at the time was not desirable. He said the Commission can review the
permit in 6 months.
Ms. Cavazos said the Police will have all the calls received detailed and can be discussed at
that review.
Chairman Oaxaca opened the public hearing.
• Anne Lungu, a local resident expressed concern re. noise and amplified music. She
questioned if there is no dancing allowed, why would they need bands. She said she believes
they will have dancing anyway. She reported that in December all her doors and windows
were closed and she could still hear the DJ and music until about 1:30 a.m. She said they
were doing it without a permit and expressed concern that if they are willing to do it without a
permit. they may go ahead and do things with the permit anyway. She said surnmer will be
worse because her windows will be open. She said she believes 10.00 p.m. during the week
and Friday & Saturday at 12.00 p.m. is late enough for entertainment. She said decibel rating
is too loud-should be lowered. She said she did not see how the findings required could be
met because her quality of life is compromised. She said she is concerned about loitering and
other activities. She asked if the doors will be closed to the outside patio. She said the CUP
should expire if these owners leave and she would like some other use at that location.
Mike Towles said he appreciated her comments. He noted that he initially believed the CUP
and EP were together and he noted that was their fault. He said they are responsible with the
entertainment and have a decibel meter. He said the goal is to keep customers there and for
them to enjoy their visit and listen to live music. He said there is not heavy metal being played,
it is a mellow crowd with a focus on food. He said he also owns Corky's.
Chairman Oaxaca closed the public hearing.
Commissioner Macias said he did not have any major problems with the application. He said
we need to give the owner a shot at doing it for 6 months to see if they can do it without
complaints. He said the Commission will re-evaluate the permit in 6 months.
• Commissioner Munoz said he hears the concerns of the neighbor. He concurred with
Commissioner Macias-give them opportunity to see if moving forward they can be successful

and re-evaluate. He said we do have a good relationship with the police and if it is not working
we will come back and can revoke the permit if necessary. He cautioned the owner and noted
that their success can be easily tripped up by little things like leaving the door open. He said
they need to watch the small stuff and be vigilant - sound travels. He said we should give the
owner the opportunity to prove it can work. He told the applicant that if they have issues, they
can come see us for assistance.
Commissioner Wimberly concurred with Commissioners Macias and Munoz. He reiterated
his concern about the type of customers that had frequented the establishment. He said they
have a security plan in place and their staff have to rnonitor the doors and he cautioned that
they are under review. •
Commissioner Guglielmo concurred.
Chairman Oaxaca emphasized that between staff and police the City is active in monitoring
permits. He said we want businesses to succeed but also businesses must operate by the
letter of the permit issued. He said the Commission will review it in 6 months and anytime
thereafter. He said it has happened before and can happen again. He stated the applicants
should read the permit and do what it says. He added that we are optimistic and want an
acceptable outcome.
Moved by Munoz, seconded by Wimberly, carried 5-0 to adopt the Resolution Approving
Entertainment Permit DRC2017-00734. The Commission will review the permit in 6 months.
D2. TIME EXTENSION DRC2017-00982 - WSI HIGHLAND INVESTMENTS, LLC - A request for
a 1-year time extension for previously approved Tentative Tract Map 1474, to subdivide
168.77 acres into 269 residential lots located in the Low (L) Residential District and Flood
Control (FC) District within the Etiwanda North Specific Plan, at the northeast corner of Day
Creek Boulevard and Etiwanda Avenue — APNs: 1087-081-04, 05, 06, 07, 08, 09, 10, 11 &
14. Related Files: Annexation DRC2003-01051, Specific Plan Amendment DRC2003-00409,
General Plan Amendment DRC2003-00410 and Development Agreement DRC2003-00411.
Staff finds the project to be within the scope of the project covered by a prior Environmental
Impact Report certified by City Council in June 21, 2004, (State Clearinghouse#2003081085)
by Resolution 04-240 and does not raise or create new environmental impacts not already
considered in the Environmental Impact Report. •

Commissioner Munoz asked if the Etiwanda Preserve is to the north of this site. He
recommended that it should be noted in the report and the exhibit maps that the Preserve is
nearby.
Mr. Perez agreed to the validity of the point, and stated that it would be noted in the future.
Chairman Oaxaca opened the public hearing.
Natasha Walton stated she appreciated the mentioned preserve. She asked that the
• environmental review be reevaluated as it was analyzed in 2004, things have changed, many
developments have come in since then. She said she doubted that all that has been
considered and they are barely able to manage the preserve as it is-she mentioned Alluvial
Fan Sage Scrub is endangered She said they should look at new issues in the area as plant
and wildlife populations can change over time.
John Schafer stated he represents the owner. He said they have continued to do endangered
species surveys over the years and no new information regarding endangered species has
occurred there. He said they also have conservation land provided.
Commissioner Guglielmo asked if there is any indication as to when development there is
anticipated.
Mr.Schafer noted they also own land to the south that has 388 homes entitled He said there
have been delays in satisfying the environmental permits. He said the plans for the property
to the south are in engineering plan check and following that it could take a few more years
before development occurs.
Chairman Oaxaca closed the public hearing.
Commissioner Munoz said this is fairly routine, there are extensions available to them and he
recommended approval.
Commissioner Wimberly concurred.

Commissioner Macias noted the EIR was done in 2004 and according to CEQA, staff reviews
the EIR and if new andlor significant information is brought forward then new studies and/or
mitigations would be required. He said this is the checkpoint for this provided by CEQA and
a safeguard for environmental review. He offered support of the time extension.
Nick Ghirelli, Assistant City Attorney clarified that map time extensions are a discretionary
decision and not entitled by right. He confirrned it does cause staff to look at the environmental
docs again as part of their review of the requested time extension(s).
Moved by Wimberly, seconded by Guglielmo, carried 5-0 to adopt the Resolution of Approval
for Time Extension DRC2017-00982. •
E. COMMISSION BUSINESS/HISTORIC PRESERVATION AND
PLANNING COMMISSION
INTER-AGENCY UPDATES: Commissioner Munoz reported on the Transportation. Telecommunication, and
Public Works Policy Committee activities (League of California Cities).
a. The League will continue bill SB 1 (Transportation Funding) and notes that there are still very real threats
to this legislation. The League Board has decided not to support opposition given the political capital
expended getting this passed, and focusing on measures to protecting revenues earmarked for
transportation.
b. Continue to support existing bill ACA-5 proposed for the June ballot. to do just that. (ACA-5 Motor vehicle
fees and taxes: restriction on expenditures. appropriations limit.) A key section (SEC. 15 has been added
reading "SEC. 15. This also includes Article XIX D which includes protecting Vehicle License Fee revenues
for transportation purposes.
c. We heard from Speaker: George Lolas, Chief Operating Officer, State Controller's Office who discussed
new funding levels coming in 2018 e.g., Transportation dollars of $1.2 billion as compared to last year's
partial year of hording of$445 million, which are divided equally between and counties, and this will eventually
grow to $1.5 billion by 2019. This item was informational only and didn't require action by the committee.
He noted the Transportation, Telecommunication, and Public Works Policy Cornrnittee took on two other
focus measures this week: a) Local Government Plans for Micro-Wireless Facility Permitting and Leasing
(approved by the Committee), and b) Proposed City and County Pavement Improvement Center (CCPI�
(Request by committee to make this a study issue because there are still questions here, and item will
brought back to the committee before any League decision to move forward.)

Council).
