HomeMy WebLinkAbout2003/11/12 - Minutes - PC-HPC CITY OF RANCHO CUCAMONGA PLANNING COMMISSION MINUTES Regular Meeting November 12, 2003 Chairman Macias called the Regular Meeting of the City of Rancho Cucamonga Planning Commission to order at 7:00 p.m. The meeting was held in the Board Room at Cucamonga County Water District, 10440 Ashford Street, Rancho Cucamonga, California. Chairman Macias then led in the pledge of allegiance. ROLL CALL COMMISSIONERS: PRESENT: Richard Fletcher, Rich Macias, Cristine McPhail, Larry Mc Niel, Pam Stewart ABSENT: None STAFF PRESENT: Brad Buller, City Planner, Dan Coleman, Principal Planner; Kevin Ennis, Assistant City Attorney; Douglas Fenn, Associate Planner; Donald Granger, Assistant Planner; Dan James, Senior Civil Engineer; Debra Meier,Associate Planner; Gail Sanchez, Planning Commission Secretary; Alan Warren, Associate Planner; Emily Wimer, Assistant Planner ANNOUNCEMENTS Brad Buller, City Planner, stated there would be no second meeting in November because of a lack of quorum. Mr. Buller also noted that several Commissioners would be taking a tour of Ladera Ranch on Thursday, November 13. APPROVAL OF MINUTES Motion: Moved by McNiel, seconded by Fletcher, carried 4-0-0-1 (Macias abstain), to approve the minutes of October 22, 2003. CONSENT CALENDAR A. TIME EXTENSION FOR TENTATIVE TRACT MAP SUBTT14759 — LENNAR HOMES - A request for an extension of a previously approved residential subdivision of 358 single-family homes, and 3 lettered lots for common open space/parks totaling 18.3 acres, on 132 acres of land in the Low Residential District (2-4 dwelling units per acre), located on the east and west sides of Wardman Bullock Road, south of Wilson Avenue -APN: 0226-102-17. B. ENVIRONMENTAL ASSESSMENT AND DEVELOPMENT REVIEW DRC2003-00551 - MANNING HOMES-A request to review the architectural elevations for 10 single-family homes on 3.10 acres of land in the Low Residential District(2-4 dwelling units per acre)located at 6134 Archibald Avenue-APN: 1062-401-08. ENVIRONMENTAL ASSESSMENT AND TENTATIVE TRACT MAP SUBTT16545-MANNING HOMES - A residential subdivision of 10 single family lots on 3.10 acres of land in the Low Residential District(2-4 dwelling units per acre), located at 6134 Archibald Avenue-APN: 1062- 401-08. Chairman Macias opened the public hearing. Jim Manning, Manning Homes, 20151 SW Birch Street, Suite 150, Newport Beach, agreed with the conditions. Hearing no further testimony, Chairman Macias closed the public hearing. Commissioner McNiel felt the application was a simple one. Motion: Moved by Fletcher, seconded by McPhail, to issue a Negative Declaration and adopt the resolutions approving Tentative Tract Map SUBTT16545 and Development Review DRC2003-00551. ENVIRONMENTAL ASSESSMENT AND TENTATIVE TRACT MAP SUBTT16421 -JONG -A request to subdivide 2.8 acres into 8 single family lots in the Low Residential District located at 10213 and 10217 Wilson Avenue-APN: 0201-182-03 thru 06. Related Files: Tree Removal Permit DRC2003-00756 and General Plan Amendment DRC2003-00132. Emily Wimer, Assistant Planner, presented the staff report and indicated the addition of some Engineering Standard Conditions, which had been inadvertently omitted from the resolution. Chairman Macias opened the public hearing. There were no comments, and he closed the hearing. Motion: Moved by Stewart, seconded by McPhail, to issue a Negative Declaration and adopt the resolution approving Tentative Tract Map SUBTT16421 as amended by staff. ENVIRONMENTAL ASSESSMENT AND CONDITIONAL USE PERMIT DRC2002-01023 - STOR-N-LOCK PARTNERS -A request to construct a 68,457 square foot self storage facility with a manager's unit on 2.24 acres of land in the General Industrial District(Subarea 8), located on the southwest corner of Arrow Route and White Oak Avenue-APN: 0209-145-01. Related File: Tree Removal Permit DRC2002-01025. Emily Wimer, Assistant Planner, presented the staff report. Commissioner McNiel observed that the Design Review Committee directed the applicant to work with staff regarding the trellis element. Ms. Wimer replied that the trellis design is being revised to be a lighter weight so it will be non- climbable while still providing vines to crawl up the trellis to provide an accent. Chairman Macias opened the public hearing. Rick Wallace, Valli Architecture, 81 Columbia, Suite 200, Aliso Viejo, stated he was available to answer questions, as was the owner. Commissioner McNiel asked if the trellis issue was resolved. Mr. Wallace replied it was not finalized but he will work it out with staff. Commissioner Fletcher asked if the Tree Removal Permit was for the trees in the footprint area only, as he thought there had been discussion at the Design Review Committee regarding thinning some of the trees on Arrow Route. Mr.Wallace stated the intent is to keep the image along Arrow Route the same. He said they plan to prune and maintain the trees and augment the ground cover. He stated they will put in any additional trees needed to fill in bare spots. Henry Reiter, III, 9650 Business Center Drive, Rancho Cucamonga, stated he has been building office buildings for the last 25 years and built the project next to this property about 9 yeas ago. He felt there are a lot of huge box buildings and not enough business parks. He stated this is the last area for multi-tenant users and he thought the property should be used for a 30,000 to 40,000 square foot business park. He believed the business parks in Rancho Cucamonga are 100 percent leased. He stated he realized the project had been in process for a long time and he would hate to see the Commission deny the project but he wanted the Commission to consider the application because there is a storage unit nearby to the west. Hearing no further testimony, Chairman Macias closed the public hearing. Commissioner McNiel commented that many projects are market driven. He felt there may be a small vacancy rate for office space but thought there is virtually no vacancy rate for storage buildings. He thought that if there is a market for office buildings in the future, this property could become an office building. He felt the proposed use was acceptable for an interim use. He thought it is a good-looking building. Commissioner Stewart concurred with Commissioner McNiel and stated it is a very good-looking building. She said she visited the site after reading Mr. Reiter's letter in the packet. She believed the use is compatible and it is a high-end design for a storage facility. She thought there is a business park that has been approved for condominium purposes and others are in the works at various locations in the City. Planning Commission Minutes -3- November 12, 2003 Commissioner McPhail concurred that it is a compatible use and is an attractive addition to the area. Commissioner Fletcher thought it is well designed. He agreed there are several other self-storage facilities along Arrow Route. He thought the location is good in spite of that and believed it will generate minimal traffic compared to other uses. , Chairman Macias agreed it is compatible. Motion: Moved by Stewart, seconded by McPhail,,to issue a Negative Declaration and adopt the resolution approving Conditional Use Permit DRC2002-01023. TENTATIVE PARCEL MAP SUBTPM16245 - IJPI WESTCOAST DEVELOPMENT, L.P. - A request to subdivide 23.56 acres of land into 2 lots to develop 467 multi-family apartment units and a 29,571 square foot retail center in the Mixed Use District (IASP Subarea 18 Specific Plan), located at the northwest corner of 4th Street and Milliken Avenue -APN: 0210-082-47. Related File: Development Review DRC2003-00505. Commissioner McPhail recused herself because her company receives remuneration from the applicant's firm. Douglas Fenn, Associate Planner, presented the staff report. He said the applicant had asked for the deletion of the requirement for a bike lane on 4th Street from Standard Condition H1 because it was deleted fro the Development Review portion of the project. Commissioner Stewart observed this project would add 467 units and she asked if there had been consideration of the fact that there are a lot of apartments in the area and no schools. She felt the project has limited open space. She asked if the anything had been done to encourage retail as she felt the comer should have a larger percentage of retail. Mr. Fenn stated that the project fit within the master plan that was reviewed by the Planning Commission in August. � Brad Buller, City Planner, indicated the entire site was originally designed for commercial; however the applicant could not secure a large enough commercial user for the entire site. He stated the applicant asked if they could submit a mixed use project and the Commission gave general support. He noted projects in the Subarea 18 Specific Plan area are subject to City Planner approval. He said the City expressed concern that the site should be,a mixed use and that the applicant could not submit another application to delete the commercial use after the housing project is built. He reported the project was therefore conditioned that the commercial be developed concurrently with the residential. Mr. Fenn observed that three of the retail buildings will need to come before the Commission for review. Chairman Macias opened the public hearing. Chuck Buquet, Charles Joseph Associates, 10681 Foothill Boulevard, #395, Rancho Cucamonga, stated he represented the applicant. He said that the bike lane requirement should be deleted from the Standard Conditions, as it is within the scope of 4th Street improvements and will be installed in the City of Ontario's plan. He noted the applicant is paying a fair share for the improvements. He Planning Commission Minutes -4- November 12, 2003 said the applicant is building all infrastructure around the retail center and there will be future restaurant components. He introduced Heidi Mather. Heidi Mather, JPI Westcoast Development, L.P., 8910 University Center Lane, #150, San Diego, stated they purchased the site from General Dynamics. She said the Parcel Map was merely needed to implement approvals already granted by the Planning Commission and City Council. Commissioner McNiel believed the 29,571 square foot retail center was not very large. Ms. Mather replied it was consistent with the approvals granted earlier in the year. She stated that Ashleigh Properties has been retained by JPI to be the retail developer. Commissioner McNiel questioned the retail components. Ms. Mather replied they plan two restaurants on the corner, a financial institution, and in-line retail tenants. Commissioner McNiel asked if there will be fast food users. Ms. Mather responded negatively. She said there will be a bagel shop but no drive-thrus. Commissioner McNiel felt drive-thrus would not be appropriate. He believed they have a limited ability to develop the area because it is so small. Hearing no further testimony, Chairman Macias closed the public hearing. Commissioner McNiel noted the General Dynamics properties go through an expedited process. He asked what guarantees the City has that the retail will be developed. Mr. Buller responded that two-thirds of the housing units would not be released until the retail portion is ready to be occupied. Dan Coleman, Principal Planner, observed that the Parcel Map was required to allow the retail. Mr. Buller noted that JPI would like to sell the commercial component. Commissioner McNiel noted the project has to pencil out. He felt it is a high-end neighborhood for apartments. He was concemed the requirements would be put on a small project that does not pencil out. He was not sure the City has appropriate leverage. Mr. Buller responded that staff believes the City has appropriate leverage. He said they will be required to fill the commercial as quickly as possible. He indicated staff believes there is a market for commercial and this is a reasonable blend. He observed the mix had been brought before the Commission at a workshop. Commissioner McNiel stated he had anticipated a larger retail center and he thought this is only token commercial. Commissioner Stewart was also concerned about the size of the commercial portion. She asked if it was similar to what was presented at the workshop. Mr. Buller replied the commercial square footage was actually larger than what the applicant originally submitted. Commissioner Stewart was not concerned about leverage and acknowledged the Parcel Map application was clean up work. Planning Commission Minutes -5- November 12, 2003 Commissioner Fletcher stated he was originally conbemed that the service retail would not be done concurrently with the residential. Mr. Buller stated he took direction from the Commission and he therefore placed the condition that the retail is to be built concurrently. Commissioner Fletcher stated he likes JPI's products. He felt apartments would be consistent in this location. He indicated special care should be taken regarding the design of the retail because this is a main entry into the City. Chairman Macias recalled the project and the workshop. He felt staff followed the Commission's direction and agreed they had expressed concerns about getting the commercial. He also recalled they expressed concerns about the size of the retail but were relatively comfortable with what was proposed. He concurred with Commissioner Fletcher that the center must be well planned, as it is a major City entry. He supported staffs recommendation. Commissioner McNiel stated he supported the project but he wanted to be sure a decent product is built at the entry and he was concerned it may not pencil out. He thought it must be aesthetically terrific. Mr. Buller observed that some of the commercial buildings have been approved and there are three • more to be approved. He stated he would send an linteroffice memo to the Commission regarding what was approved and what is proposed. Dan James, Senior Civil Engineer, observed that the applicant had requested deletion of the requirement for a bike lane on 4th Street. He said staff believes the condition could be deleted because a bike lane currently exists. Mr. Buller indicated staff could interpret the condition to say that it has been satisfied. Motion: Moved by McNiel, seconded by Fletcher, to I adopt the resolution approving Tentative Parcel Map SUBTPM16245. ENVIRONMENTAL ASSESSMENT AND TENTATIVE PARCEL MAP SUBTPM16167 - CHARLES JOSEPH ASSOCIATES - A request to subdivide 20.52 acres into 7 parcels for industrial purposes in the General Industrial District(Subarea 2), located at the southeast comer of 9th Street and Vineyard Avenue - APN: 0209-013-01, 02, 11 and 18. Related Files: Development Review DRC2003-00239 and Preliminary Review DRC2002-00707. N. ENVIRONMENTAL ASSESSMENT AND DEVELOPMENT REVIEW DRC2003-00239 - CHARLES JOSEPH ASSOCIATES-The master plan and design review of 7 buildings totaling 339,377 square feet on 20.52 acres of land in the General Industrial District(Subarea 2), located at the southeast comer of 9th Street and Vineyard Avenue-APN: 0209-013-01, 02, 11,and 18. Related Files: Tentative Parcel Map SUBTPM16167 and Preliminary Review DRC2002-00707. Donald Granger, Assistant Planner, presented the staff report. He stated that as of 6 p.m. this evening staff received a fax from the State of California Department of Fish and Game (CDFG) expressing two areas of concern: the possible presence of burrowing owls and the potential loss of a streambed. He observed that a biologist had looked at special status species and did not find any and did not feel the site was likely suitable habitat. He noted the letter from CDFG suggested Planning Commission Minutes -6- November 12, 2003 mitigating stream impacts by requiring a 2:1 replacement ratio. Mr. Granger reported that the applicant is conditioned to obtain all necessary regulatory permits from jurisdictional agencies including the CDFG; therefore, CDFG has the authority to enforce whatever mitigations they deem necessary. Commissioner McNiel asked how long CDFG had to respond to the proposed Mitigated Negative Declaration. Mr. Granger responded 20 days. Brad Buller, City Planner, indicated the applicant had been given a copy of the letter and he suggested the Commission ask the applicant to discuss the matter. Chairman Macias opened the public hearing. Chuck Buquet, Charles Joseph Associates, 10681 Foothill Boulevard, #395, Rancho Cucamonga, stated that CDFG usually responds at the last minute. He said the applicant had a survey conducted by a biologist. He noted that the 401 Permit process started out with trying to determine which agency has jurisdiction. He said he had reviewed the letter and it requires mitigations if burrowing owls are found onsite and construction is during the nesting season. Chairman Macias thought the biologist had found it was not suitable habitat. Mr. Buquet confirmed that was correct. He asked that Engineering Condition 8 regarding utility undergrounding be deleted. He stated that a project was recently approved on the southwest comer of 9th Street and Vineyard Avenue without having to underground. He said he sent a letter to the City Engineer requesting that they be permitted to pay a fair share portion rather than undergrounding. He commented they are continuing to work with Engineering on the issue. He thanked staff, particularly Donald Granger, for assistance on processing the project. Chairman Macias requested that the City Attorney advise the Commission if it had enough information to ensure that the City is complying with California Environmental Quality Act(CEQA) requirements. Kevin Ennis,Assistant City Attomey, stated that based upon the study referenced in the Initial Study and the requirement for the applicant to secure regulatory permits, he believed the City has evidence of adequate mitigations to address the concerns raised in the letter. Hearing no further testimony, Chairman Macias closed the public hearing. Commissioner McNiel observed that the project mentioned by Mr. Buquet at 9th Street and Vineyard Avenue was the redevelopment of the old chicken ranch. He noted the applicant requested that he pay a portion of the costs and have the remainder absorbed elsewhere. He did not believe the Commission had granted similar requests in the past. He asked if staff was recommending any relief from the undergrounding requirement. Mr. Buller responded negatively. Commissioner McNiel stated it seems to be a pattem that letters are submitted from various agencies at the eleventh hour. He felt it is obstructionist at most and inconvenient at least. He asked if the City could adjust the timeframe for comments. Mr. Ennis replied that staff could individually contact that agency for projects such as this. He noted they were responding to a 20-day comment period that the City sets. He commented that if the City wishes to have a comment period separate from the hearing date, it would require separate and individual public notices, which would increase the cost. Planning Commission Minutes -7- November 12, 2003 Mr. Coleman stated the length of time does not seem to affect CDFG. He felt their staff is probably overwhelmed and he noted that the City routinely receives responses after projects have already been approved. Chairman Macias asked if the Commission could act on the project. Mr. Ennis responded the Commission cold act or continue the item and ask the applicant to respond to the agency. Commissioner McNiel felt that might be the objective of the CDFG. Chairman Macias felt CDFG is trying to cover its bases at everybody else's expense. Commissioner McNiel did not favor the expense of two mailings and advertisements. Chairman Macias noted the other agencies go to CDFG and do not act until they have the go ahead from them. Mr. Buller suggested that the undergrounding condition remain as written. He said neither he nor the City Engineer are in a position to change the Planning Commission policy. He noted the project across the street was adaptive reuse of an old rundown project and the restoration was a significant enhancement and a benefit to the City. He stated the Commission could direct that any further intensification of use on the project across the street would trigger undergrounding requirements. Commissioner McNiel stated that Buildings 6 and 7 abut at the lot line. He asked if that was allowed under Code. Mr. Buller responded that Building and Safety are part of the technical review process. Commissioner McPhail believed the undergrounding requirement should remain as is. Commissioner Stewart agreed. Commissioner Macias felt it is a nice project. Motion: Moved by Stewart, seconded by Fletcher to issue a Negative Declaration and adopt the resolutions approving Tentative Parcel Map SUBTPM16167 and Development Review DRC2003- 00239. Debra Meier, Associate Planner, presented the staff report and suggested deletion of Engineering Condition 10 regarding traffic impacts and the addition of some Engineering Standard Conditions that were inadvertently omitted. Chairman Macias opened the public hearing. Glen Crosby, KB Home, 801 Corporate Center Drive, #201, Pomona, stated the conditions as amended were acceptable. Hearing no further testimony, Chairman Macias closed the public hearing. Commissioner McNiel stated he was on the Design Review Committee. He noted the project has plenty of amenities and he believed it is consistent with Terra Vista. Commissioner Fletcher stated it was a nice project and he liked the elevations. Commissioner Stewart asked if the Variance request would have any implications for the Tentative Tract approval. Ms. Meier responded negatively. She said the Variance request was submitted after the Grading Committee meeting and is to control drainage onto Southern California Edison land. She stated staff feels comfortable with the direction and the Commission would hear the Variance request at its December 10 meeting. Chairman Macias opened the public hearing. Planning Commission Minutes -9- November 12, 2003 Chuck Buquet, Charles Joseph Associates, 10681 Foothill Boulevard, #395, Rancho Cucamonga, stated he was representing D R Horton. He was pleased about the triplex product and felt the project creates an open feeling. He thanked staff for assistance and thanked the Commission for holding a workshop. He agreed with the conditions. He stated the Senior Vice President of D R Horton was available to answer questions. Hearing no further testimony, Chairman Macias closed the public hearing. Commissioner Stewart felt it is a really nice project and stated the applicant followed suggestions. She thought the Variance would not be problematic. Commissioner Fletcher agreed the project is attractive. He thought the project would add affordable housing. Commissioner McPhail concurred. Commissioner McNiel supported the project. He felt it would be good to add a new product type. Chairman Macias agreed it is a good project. Motion: Moved by Stewart, seconded by McNiel,to adopt the resolutions approving Tentative Tract Map SUBTT16612 and Development Review DRC2003-00638. CONDITIONAL USE PERMIT DRC2003-00552 - CARRIAGE ESTATES III - A request to develop 33 single-family lots within the Etiwanda Avenue Overlay in the Very Low and Estate Residential Districts of the Etiwanda Specific Plan (.1-2 and .1-1 dwelling units per acre, respectively);located north of Banyan Street, between Bluegrass and Etiwanda Avenues-APN: 0225-111-18, 20, 24, 25, and 27. Related Files: Tentative Tract Map SUBTT16466, Development Review DRC2003-00880, and Tree Removal Permit DRC2003-00533. Dan Coleman, Principal Planner, presented the staff report and suggested changes to the resolutions to add an Engineering condition with respect to storm drains and verbiage to the Conditional Use Permit application to clarify the environmental findings. Chairman Macias opened the public hearing. Glen Daigle, Carriage Estates III, 4141 Inland Empire Boulevard, Suite 345, Ontario, stated the project has the same housing type as in Carriage Estates I and II. He stated they reviewed the additional conditions suggested by staff and agreed to them. He thought the new storm drain condition was to replace Engineering Condition No. 2. Brian Peterson, Banyan Avenue, stated he represented family owners of two of the lots immediately south of the project. He said he spoke to staff this evening but had not had a chance to look over Planning Commission Minutes -10- ' November 12, 2003 the report. He asked what type of access the construction company will have and need during construction. He said their property had been used in the past without their permission for construction vehicle traffic. He commented he would like to preserve as many trees as possible if they are in good shape and can be saved. He wanted the trees saved for their heritage quality and for wind breaks and erosion control. He asked if any streets will come off Banyan Avenue. Mr. Coleman stated no streets are proposed to come from Banyan Avenue. He indicated access will be from Bluegrass Avenue and Etiwanda Avenue. Alfred (unknown last name and address), opposed any removal of trees as he felt they are part of Etiwanda. He said the City is losing all its trees. He felt there should be a plan for the replacement of any trees that must be removed because they are sick. • Mr. Coleman said the trees will be replaced at 8 feet on center with Spotted Gum Eucalyptus instead of the Blue Gum. He indicated the Spotted Gum trees are less messy and don't grow as large but do retain the same characteristics. He said it is a tree the City has been using for the last 15 years. Rosa Elena Salcedo, 12720 Amber Lane, Rancho Cucamonga, stated she lives on Amber Lane north of Banyan near Etiwanda and Bluegrass Avenues and she looks at her Eucalyptus trees every day. She thought the proposal was to save only around 50 of the trees. She complained that many trees were destroyed in order to build the 210 Freeway and asked that no more trees be destroyed. She stated that destroying the trees hurts the oxygen level. Ms. Salcedo said she moved to the area from Pomona to get away from the smog but the City keeps approving development and cutting down trees. She stated her sons had asthma before and they have been helped because of the trees. She indicated kids now play paintball in the empty field and she preferred the area be left undisturbed because she enjoys hearing the kids and having the wildlife in the area. She asked why homes must be built there. ' Hearing no further testimony, Chairman Macias closed the public hearing. He observed that Mr. Peterson had asked about construction access. Mr. Coleman stated that access would not go through Mr. Peterson's property and it would be illegal for the construction traffic to do so. He said the access would be over Blue Grass and Etiwanda Avenues, which are both approved streets. Brad Buller, City Planner, encouraged the applicant to give his business card to the residents so they would have someone to call if problems arise. Dan James, Senior Civil Engineer, stated that the additional Engineering Condition regarding storm drain system was to be in addition to Engineering Condition No. 2. He said Condition No. 2 is for Etiwanda Avenue,which is a major storm drain, and the new condition covers issues on the westerly portion of the property. Commissioner McNiel felt it is a good looking project. He observed that historically the area was an agricultural community and the trees were imported to build windrows to protect the crops. He noted they worked well and there are provisions in the City Code to maintain the windrows image. He stated that as development occurred, the City adopted a tree replacement program to allow the removal of dangerous windrows, as there have been injuries. He remarked the replacement trees are Spotted Gum, which are less subject to blight and serve the same general purpose. He explained the older trees were basically abandoned when the citrus left and have become more dangerous without proper irrigation and care. He felt the same windrow.effect will be achieved in 3-5 years, but the trees will be less inclined to break. He supported staffs recommendation. Commissioner McPhail stated the developer will have to irrigate the new trees and that will be helpful to the existing trees as well. She felt it is a sad fact that there are several diseases and insect Planning Commission Minutes -11- November 12, 2003 infestations that are destroying the Blue Gums. She felt it is necessary to replace with a variety that will be sturdier over time. Commissioner Fletcher preferred to preserve the trees in place where possible but noted that Blue Gum Eucalyptus were brought to the area at a different time. He said he did not know many people who like them on their private lots. He did not feel it is possible to stop development because there are trees there. He felt there will be a better variety of plant life after the new trees mature. Commissioner Stewart agreed that tree removal is an unfortunate fact of development. However, she thought it best to allow removal of the diseased trees because of the possibility of litigation. She noted a certified arborist had indicated a good number of the trees can't be saved. Chairman Macias supported the project. Motion: Moved by McNiel, seconded by McPhail to issue a Negative Declaration and adopt the resolution approving Tentative Tract Map SUBTT16466 and Conditional Use Permit, with the modifications suggested by staff.
