HomeMy WebLinkAbout1998/04/22 - Minutes - PC-HPC CITY OF RANCHO CUCAMONGA PLANNING COMMISSION MINUTES Regular Meeting April 22, 1998 Chairman Barker called the Regular Meeting of the City of Rancho Cucamonga Planning' Commission to order at 8:00 p.m. The meeting was held in the Council Chamber at Rancho Cucamonga Civic Center, 10500 Civic Center Drive, Rancho Cucamonga, California. Chairman Barker then led in the pledge of allegiance. ROLL CALL COMMISSIONERS:PRESENT: David Barker, Larry McNiel, Peter Tolstoy ABSENT: William Bethel, Rich Macias STAFF PRESENT: Brad Bullet, City Planner; Michael Estrada, Deputy City Attorney; Elline Garcia, - ' - - "'~ Associate Planner; Dan James, Senior Civil Engineer; Brent Le Count, Associate Planner; Gall Sanchez, Planning Commission Secretary ANNOUNCEMENTS Brad Bullet, City Planner, announced that a request had been received from the applicant requesting continuance of Item B to May 13, 1998. APPROVALOF MINUTES Motion: Moved by McNiel, seconded by Tolstoy, carried 2-0-2-1 (Bethel, Macias absent; Barker abstain), to approve the minutes of April 8, 1998. CONSENT CALENDAR A. ENVIRONMENTAL ASSESSMENT FOR DEVELOPMENT REVIEW 97-41 - MASTER DEVELOPMENT - A request to construct 8 industrial buildings ranging in size from 10,924 square feet to 28,129 square feet for an total of 129,533 square feet on 6.9 acres of land within Subarea 8 (General Industrial) of the Industrial Area Specific Plan, located at the nodhwest comer of Jersey Boulevard and White Oak Avenue - APN: 209-144-07. Staff has prepared a Mitigated Negative Declaration of environmental impacts for consideration. Related File: Parcel Map 15155. Moved by McNiel, seconded by Tolstoy, carded 3-0-2 (Bethel, Macias absent), to adopt the Consent Calendar. PUBLIC HEARINGS B. INDUSTRIAL AREA SPECIFIC PLAN AMENDMENT 98-01 - MASI COMMERCE CENTER PARTNERS - A request to amend the definition of Auto Service Court within the Industrial Area Specific Plan. Chairman Barker observed the applicant had requested a continuance to May 13, 1998. He pointed out that the hearing remained open from April 8. There were no public comments. Hearing no objections,- Chairman Barker continued the matter to May 13, 1998. C. ENVIRONMENTAL ASSESSMENT AND CONDITIONAL USE PERMIT 97-36 - CHEVRON - A request to construct a 2,930 square foot gas station/mini-market facility on a 1.06 acre parcel within the Foothill Marketplace Shopping Center, within the Regional Related Commercial District (Subarea 4 ) of the Foothill Boulevard Specific Plan, located on the southwest corner of Foothill Boulevard and Marketplace Drive - APN: 229-031-34. Brent Le Count, Associate Planner, presented the staff report. Chairman Barker thought there had been a use change granted in exchange for a modification to . .. _ the internal circulation. Brad Bullet, City Planner, stated the parcel immediately east of the westerly drive, by In 'N Out was originally all designated as parking owned by Price Club. He said Price Club asked to convert the area from all parking to a retail pad, at which time the westerly driveway was reconfigured. He indicated the zoning always allowed retail, but the master plan did not show it. Chairman Barker recalled that the City allowed the building in lieu of the parking with the understanding that they would try to address the circulation problems. Mr. Buller confirmed the City thought the change in the master plan would add to the traffic congestion. Mr. Le Count stated that staff does not recommend requiring Chevron to install the traffic lane. Commissioner McNiel asked if they will be developing the corner. Mr. Bullet responded that the curb, gutter, and landscaping are already in place. He said if the turning lane is conditioned, the curb and gutter would have to be reconfigured. He explained the service station was shown on the original master plan for the site, so the applicant does not feel the turning lane should be their responsibility. Commissioner McNiel feared that the turning lane may never be installed if it is not placed as a condition on the service station. Mr. Buller acknowledged there is a possibility the pad currently conditioned to install the turning lane to the west may never develop. Chairman Barker opened the public hearing. J. Marconi, RFA, Inc., 205 South Santa Cruz Avenue, Suite 2100, Anaheim, stated he was speaking on behalf of Chevron. He said that there had been considerable discussion regarding the right-turn lane. He observed construction of the lane was placed as a condition on a previously approved project on the adjacent parcel. He felt that the service station should not further impact the center because traffic impacts were planned for since the station had been on the original master plan. Planning Commission Minutes -2- April 22, 1998 Greg Wattson, the Wattson Group, 3600 Birch Street, #250, Newport Beach, stated they are the owners and developers of the center. He said the right-turn lane was approved on the original design review. He commented the three-way stop has now been changed to a four-way. He said his company had never seen the traffic study. He stated the right-turn lane is a mitigation for development of the adjacent parcel. He indicated that Chevron will submit construction documents and dedicate land with reimbursement of $3,800 Commissioner McNiel asked if they were going to submit plans for the right-turn lane to be attached to future development of the adjacent parcel. Mr. Wattson confirmed that was correct. Mr. Bullet noted the proposed resolution does not contain any requirement for reimbursement. He said that Engineering is asking that the plans be submitted for approval and the applicant is asking for reimbursement. Commissioner McNiel asked if staff is comfodable the lane will eventually be built if the adjacent parcel does not develop. Mr. Bullet acknowledged there is no guarantee. Hearing n~-'fur~her testimony, Chairman Barker closed the public hearing. Commissioner Tolstoy stated he uses the center frequently and he felt there have been traffic problems within the center since it opened. He acknowledged it is better since the modifications. He said that when the original traffic study was conducted, there were no plans for building on this pad so the report did not take it into account. He said he would like to use the proposed Chevron but he would not do so without the installation of a right-turn lane. He felt that if the Chevron is built, it will increase the traffic and he thought the lane is needed now. Commissioner McNiel agreed with Commissioner Tolstoy. He said the center is busy and he was concerned about deferring the right-turn lane. He felt that any additional building will increase the traffic. Chairman Barker commented that the circulation element is in need of work; however, he was reluctant to attach the right-turn lane to this project since the parcel was originally master planned for a service station. Commissioner Tolstoy asked what will happen if the parcel to the west does not materialize because of the size of the property and the cost of the right-turn lane. He feared the lane will never be built. Chairman Barker reopened the public hearing. Mr. Wattson stated the configuration of the parking lot was dictated by Engineering as part of the negotiations to secure Price Club. He said the center developer has already addressed all of its conditions. He commented that the service station was pre-approved in the master plan. Commissioner McNiel stated that this large of a project is a living entity and changes may be necessary in the course of developing it. Mr. Wattson responded that the service station was shown on the master plan. Commissioner Tolstoy stated the master plan was merely a plan. He said there have been cimulation problems right from the beginning. He felt changes should now be made to make it work better. He observed that the driveway has been realigned and he felt the City should now take this opportunity to make things better. Planning Commission Minutes -3- April 22, 1998 Mr. Marconi stated this pad was shown as a service station on the original master plan. He said the Kimley-Hom traffic study was a follow up to the original study. He felt the service station will not increase traffic to the center. Mr. Wattson requested a continuance to the May 13 meeting with the hope that the balance of the Commission will be available. Motion: Moved by McNiel, seconded by Tolstoy, to continue Conditional Use Permit 97-36 to May · 13, 1998. Motion carried by the following vote: AYES: BARKER, MCNIEL, TOLSTOY NOES: NONE ABSENT: BETHEL, MACIAS - carried D. ENVIRONMENTAL ASSESSMENT AND CONDITIONAL USE PERMIT 97-41 - DELRAHIM - A request to construct a 4,162 square foot service station, an 1,840 square foot auto lube facility, and a 1,400 square foot self serve drive thru car wash on 1.8 acres of land in the General Commercial District, located at the southwest corner of Arrow Highway and Hermosa Avenue - APN: 209-041-09, 22, and 31. Brent Le Count, Associate Planner, presented the staff report. Chairman Barker opened the public hearing. Chuck Buquet, Chades Joseph Associates, 10681 Foothill Boulevard, # 395, Rancho Cucamonga, observed that when they held the neighborhood meting, the only individual who showed up was concerned that they planned to use the whole 6.2 acres and was satisfied they are only utilizing the 1.8 acre corner. He reported that the lube and carwash will be open from 8:00 a.m. to 6:00 p.m. daily. Commissioner Tolstoy asked if there has been any progress on developing the rest of the site. Mr. Buquet replied there has not been as yet. He said they would be processing a lot line adjustment. He said some people have expressed an interest. He indicated the applicant was available to answer questions. Hearing no further testimony, Chairman Barker closed the public hearing. Motion: Moved by McNiel, seconded by Tolstoy to issue a Negative Declaration and approve Conditional Use Permit 97-41. Motion carried by the following vote: AYES: BARKER, MCNIEL, TOLSTOY NOES: NONE ABSENT: BETHEL, M^CIAS - carried DIRECTOR'S REPORTS E. USE DETERMINATION 98-01 - OPPORTUNITY SALES, INC. - A request to determine that a product storage warehouse (grocery, health, and beauty items) is similar to other supply/storage uses and is a permitted use within the General Commercial zone. Elline Garcia, Associate Planner, presented the staff report. Planning Commission Minutes -4- April 22, 1998 Commissioner McNiel asked if staff had discussed the process with the applicant. Ms. Garcia replied the applicant agrees with staff. Chairman Barker invited public comment. John McEuen, President, Opportunity Sales, Inc., 2975 Leopold Avenue, Suite 101, Hacienda Heights, stated they agree with staff. There were no additional public comments. Commissioner Tolstoy hoped the fee submitted by the applicant would be applied toward the conditional use permit fee. Brad Buller, City Planner, stated staff heard concerns from the neighborhood about the potential intensification of the site on Roberds Street. Commissioner Tolstoy felt this use would not produce a lot of traffic. He felt the use will be less intense than the previous use. Motion: Moved by Tolstoy, seconded by McNiel to approve the resolution denying Use Determination 98-01 and recommend that the applicant process a Non-Construction Conditional Use Permit. ADJOURNMENT Motion: Moved by McNiel, seconded by Tolstoy, carried 3-0-2 (Bethel, Macias absent) to adjourn. 8:58 p.m. - The Planning Commission adjourned to a workshop immediately following regarding Pre-Application Review 98-02 and Pre-Application Review 98-03. That workshop adjourned at 10:00 p.m. to April 29, 1998, at 6:30 p.m. for. a Joint City Council Planning Commission Meeting regarding Victoria Arbors.
