HomeMy WebLinkAbout1991/01/23 - Minutes - PC-HPCCITY OF RANCHO CUCAMONGA PLANNING COMMISSION MINUTES Regular Meeting January 23, 1991 Chairman McNiel called the Regular Meeting of the City of Rancho Cucamonga Planning Commission to order at 7:00 p.m. The meeting was held in the Council Chan~3er at Rancho Cucamonga Civic Center, 10500 Civic Center Drive, Rancho Cucamonga, California. Chairman McNiel then led in the pledge of allegiance. ROLL CALL COMMISSIONERS: PRESENT: Suzanne Chitlea, Larry McNiel, John Melcher, Wendy Vallette ABSENT: Peter Tolstoy STAFF PRESENT: Brad Bullet, City Planner; Dan Coleman, Principal Planner; Barrye Hanson, Senior Civil Engineer; Ralph Hanson, Deputy City Attorney; Barbara Krall, Assistant Engineer; Scott Murphy, Associate Planner; Steve Ross, Assistant Planner; Paul Rougeau, Acting Deputy City Engineer; Gail Sanchez, Planning Commission Secretary , , , , ANNOUNCEMENTS Brad Bullet, City Planner, announced that on Saturday, January 26, 1991, staff would be accompanying three City Council Members on a field trip to visit multiple housing projects in the City. He invited the Commissioners to join the group. , , , , · APPROVAL OF MINUTES Motion: Moved by Chitlea, seconded by Vallette, carried with Tolstoy absent, to adopt the minutes of December 12, 1990, as amended. Motion: Moved by Vallette, seconded by Melcher, carried with Chitlea abstaining and Tolstoy absent, to adopt the Minutes of January 9, 1991. Motion: Moved by Melcher, seconded by Vallette, carried with Chitlea abstaining and Tolstoy absent, to adopt the Minutes of the Adjourned Meeting of January 10, 1991. CONSENT CALENDAR DESIGN REVIEW FOR TRACT 13674 - MIGHTY DEVELOPMENT - The design review for building elevations and detailed site plan for a previously approved Tentative Tract Map consisting of 18 single family lots on 11.29 acres of land in the Very Low Residential District (less than 2 dwelling units per acre) located on the west side of Amethyst Street, north of Valley View Drive - APN: 1061-401-03. Commissioner Melcher requested that the item be pulled from the Consent Calendar. He requested clarification on the lack of a turnaround outside the gate at Amethyst. Barrye Hanson, Senior Civil Engineer, responded that the tract was approved prior to the new standards requiring a turnaround. He thought that traffic would be fairly limited. Commissioner Melcher questioned the drainage pattern. Mr. Hanson replied that some of the water would be contained in a debris basin in the southwest corner of the tract and would then exit to Valley View Street. He indicated the majority of the drainage would exit to Amethyst. Chairman McNiel invited public comment. David Wilson, 9361 Valley View, Rancho Cucamonga, was concerned about the grading and drainage. He said that currently the streets fill with water when it rains. He was worried that people would not landscape their back yards and excess rainwater would flow into the drainage pipes. He objected to a 24-inch drainage pipe emptying into Valley View, as he indicated it would be right across from his property. Cynthia Parlier, 9494 Valley View, Rancho Cucamonga, was concerned about the lack of a turnaround because she thought Amethyst to be very narrow. She did not feel that Amethyst could accommodate the additional traffic from the 18 homes unless it were made a no parking street. She questioned why the tract was not graded sufficiently to drain all of the 18 lots to the north. She thought the sidewalk should continue beyond her property to discourage children from riding their bicycles on the street. Adele Brown, 9416 Valley View, Rancho Cucamonga, was concerned about the drainage. She asked if the stone wall north of her property would remain because she stated the wall has acted as a dam during some past rainy seasons. She requested that some of the lots behind existing residences have one-story homes. She thought that funds were paid and land was dedicated to widen Ameythst before the City incorporated, and she questioned why the street hadn't been widened. Mitsuko Oland, 9388 Valley View, Rancho Cucamonga, questioned if a horse trail would be located on the property, and if so, what type of fence would be used. She was concerned about her privacy. Brad Buller, City Planner, stated that the current matter before the Planning Commission was the design review of units in an already approved tract. He Planning Commission Minutes -2- January 23, 1991 said that some of the issues raised by the residents had been raised at the time of approval of the map. He suggested that there be clarification for the residents regarding their concerns, but indicated the current matter involved only design review. Chairman McNiel asked Mr. Hanson to respond. Mr. Hanson indicated that the drainage study was based on a 100-year storm. He said there is a trail in front of the tract which can be used by pedestrians or bicyclists. Steve Ross, Assistant Planner, stated that the developer proposed a wall on the interior side of the perimeter equestrian trails and a split rail peeler log fence on the other side of the trail. He said the fence would replace the stone wall. He indicated the project will deflect a large amount of the current drainage from Valley View onto Amethyst and he outlined the projected drainage flows. Dan Coleman, Principal Planner, stated that part of the construction will include a concrete drainage swale on the northern side of the trail. Commissioner Melcher stated that the 24-inch drainage pipe would not outlet directly onto the street, but would transition into a curb outlet structure and would appear as an opening in the curb. Mr. Hanson indicated that the construction should actually decrease the amount of water getting into Valley View. Chairman McNiel requested that Mr. Hanson follow up with the residents to discuss their concerns. John Wang, Mighty Development, 9229 discussed the drainage plans. He calculations on the water capacity. Utica, Room 120, Rancho Cucamonga indicated the engineer performed Commissioner Chitiea asked which homes would be placed on Lots 9 through 12. Herbert Kaiser, 1810 Fair Oaks Avenue, South Pasadena, architect, stated they had reviewed the reports from the City and taken into account the concerns of the neighbors. He indicated that some of the houses were designed to appear as though they are one story with bedrooms having dormer windows in the attic area. He reported that the yards will be terraced. He stated that the slope of the land precluded having one-story homes on the lots in question. He showed slides of house renderings. Hearing no further testimony, Chairman McNiel closed the public hearing. He stated that during the Design Review phase great pains were taken to be sure the houses would fit in the neighborhood and not be overbearing. Motion: Moved by Melcher, seconded by Vallette, to adopt the Resolution approving Design Review for Tract 13674. (Continued from November 14, 1990.) Ce ENVIRONMENTAL ASSESSMENT AND TENTATIVE TRACT 14536 - WILLIAM LYON COMPANY - A residential subdivision of 57 single family lots on 12.4 acres of land within the Low-Medium Residential District (4-8 dwelling units per acre) of the Victoria Planned Community, located on the south side of Highland Avenue east of Woodruff Place - APN: 227-011-20. (Continued from November 14, 1990.) Tentative Tracts 14535 and 14536 were withdrawn by the applicant. , , , , D. ENVIRONMENTAL ASSESSMENT AND TENTATIVE PARCEL MAp 13707 - MICHAEL INVESTMENT CO. - A subdivision of 2.25 acres of land to create one parcel for industrial condominium purposes in the General Industrial District, (Subarea 1) of the Industrial Specific Plan, located at the northeast corner of 8th Street and Baker Avenue - APN: 207-271-01. Staff recommends issuance of a Negative Declaration. Barbara Krall, Assistant Engineer, presented the staff report. Commissioner Melcher requested clarification on industrial condominiums. He questioned the purpose of the CC&Rs and asked if the owners would be required to join an Owners' Association. Ms. Krall replied that the standard conditions require reciprocal access and maintenance agreements. Commissioner Melcher felt the idea to create industrial condominiums was probably a good solution, but he was concerned about landscape maintenance and sign control with various owners. Commissioner Chitlea asked if individual owners would have the right to paint the exterior of their buildings in differing colors. Planning Commission Minutes -4- January 23, 1991 Ralph Hanson, Deputy City Attorney, stated that the design of the buildings was covered by a previously approved Development Review. He indicated the parcel map application was merely a financing and ownership change. Chairman McNiel felt an Owners' Association should be required. Commissioner Melcher concurred. He said he was concerned that with a multiplicity of owners there could be problems regarding maintenance of landscaping and building upkeep. Chairman McNiel opened the public hearing. Russel Silva, 9035 Haven Avenue, Rancho Cucamonga, project engineer, stated the intent of the parcel map was to allow the occupants to own the air space within the interior portions of the building. He stated the owners would be jointly responsible for common maintenance and could not arbitrarily change the outside of the units. He said he was not sure how it would be best to handle the common maintenance requirements. Commissioner Melcher asked if there were any similar developments in the City and how they operate. Dan Coleman, Principal Planner, responded that Arrow Industrial Condos have an Owners' Association which is responsible for maintaining the exterior structures, landscaping, common areas, parking lots, etc. Mr. Silva stated he was not opposed to having an Owners' Association. Patrick King, 1824 North Sacramento, Ontario, expressed concern about the environmental impacts of the subdivision of ownership. He said that the development currently has automotive repair type uses and there are some cars that have been parked there longer than 30 days, including one in a handicapped space. He felt the City should not approve the project until they were sure the property would be properly maintained. He thought the various owners would make it more difficult and CC&Rs are only as good as the courts. Hearing no further testimony, Chairman McNiel closed the public hearing. Commissioner Melcher was pleased by the strong support for an Owners' Association. Moved by Melcher, seconded by Chitiea, to adopt the Resolution approving Environmental Assessment and Tentative Parcel Map 13707 with modification to require formation of an Owners' Association. Motion carried by the following vote: AYES: COMMISSIONERS: CHITIEA, MCNIEL, MELCHER, VALLETTE NOES: COMMISSIONERS: NONE ABSENT: COMMISSIONERS: TOLSTOY -carried Planning Commission Minutes -5- January 23, 1991 ENVIRONMENTAL ASSESSMENT AND CONDITIONAL USE PERMIT 90-36 - DIMENSION CABLE SERVICE - A request to establish a cable television receiving site consisting of four satellite dishes, a 30 foot antenna, and a temporary building in the Recreational Commercial designation of the Terra Vista Planned Community, located east of Milliken Avenue north of Church Street - APN: 227-151-17. Staff recommends issuance of a Negative Declaration. Scott Murphy, Associate Planner, presented the staff report and suggested an additional condition to provide for reconsideration of the use when development plans are proposed for the area. Commissioner Melcher questioned what type of structure is planned, what type of gates will be installed, and if people would be working at the site. Mr. Murphy responded that the structure would be similar to a small trailer, the gates will be solid metal, and he understood there would probably be only one or two visits to the site per week in order to check on the equipment. Commissioner Melcher suggested that the building be painted a neutral color to camouflage it as much as possible. He thought perhaps the gravel drive should be paved. Mr. Murphy stated that the applicant proposed a gravel driveway beyond the first 100 feet because they felt it would blend in more with the site and not call attention to the building. Chairman McNiel felt that it would not take long for a black asphalt driveway to fade to the same color as gravel, so he saw no reason not to pave it all the way. Commissioner Chitlea questioned the color and style of satellite dishes and asked to see elevations for the building. Chairman McNiel opened the public hearing. George Theodorou, Forma, 10790 Civic Center Drive, Rancho Cucamonga, stated the satellite dishes would be a solid white material, approximately 10 feet in diameter with the top of the dish approximately 12 feet off the ground. He said there would be a 6 foot wall around the perimeter of the site and additional landscaping would be used as screening of the dishes. He indicated they proposed a gravel driveway to partially discourage people from going to the equipment building. He said the building would be approximately 9 feet high with wooden siding and they were planning to paint to blend in with the landscaping behind it. Mr. Theodorou requested clarification to determine if staff would conduct the annual reviews to determine compatibility with the surrounding area, or if the matter would have to return to the Commission each year. Planning Commission Minutes -6- January 23, 1991 Chairman McNiel responded that it would be a paper process unless there is a problem. Mr. Theodorou stated that Dimension Cable requested that they be allowed a two-year period to relocate if the permit is revoked in order to arrange another site. Ralph Hanson, Deputy City Attorney, suggested that problems of relocation would be addressed during any revocation hearing. He felt that the City would probably not want to deny service to residents. Chairman McNiel asked if the cable site is on a separate parcel. Mr. Theodorou replied that it is not. He said there is a contract between Dimension Cable and Lewis Homes for Lewis to provide the location and Dimension to provide the service. Chairman McNiel was concerned about eventual driveway placement and compatibility with surrounding development. Mr. Murphy stated that the driveway access off Milliken is consistent with the YMCA. He indicated that the project is conditioned to be sure that the use is appropriate once development occurs. He said additional conditions regarding placement of the building, pavement areas, or landscaping could be placed on the property as it develops. Chairman McNiel asked what type of winds the 30 foot tower would be able to withstand. Richard Guerrero, Dimension Cable, 26858 Cherry Hills Boulevard, Sun City, stated the tower will be a free-standing, self-supporting steel structure with a concrete base engineered to withstand all types of weather conditions. Barrye Hanson, Senior Civil Engineer, observed that Building & Safety would carefully study the plans before issuing building permits. Chairman McNiel felt the entire driveway should be paved. Commissioner Melcher concurred. Mr. Guerrero stated it would be acceptable to pave the entire driveway if the Commission so desired. Brad Buller, City Planner, stated that Joe Oleson, Lewis Homes had sent word that he was unable to attend tonight's hearing, but he wished the Commission to know that he supported the project. Hearing no further testimony, Chairman McNiel closed the public hearing. Commissioner Chitiea was concerned that the white color would call attention to the satellite dishes and she preferred a color that would blend into the Planning Commission Minutes -7- January 23, 1991 environment. She was willing to accept a temporary building so long as it went through the Design Review process to be sure it met standards. She did not feel that a gravel driveway was appropriate. She thought a permanent structure should be considered with development of the remainder of the parcel, if it were determined that the use were compatible. Commissioner Melcher agreed that the building should be reviewed. Commissioner Vallette concurred with the permanent driveway and the desire to have the Design Review Committee consider the temporary building. Chairman McNiel suggested that the satellite dishes be painted beige to match the walls. Commissioner Chitlea thought perhaps green to blend in with the landscaping may be a better choice. Mr. Buller stated that typically a smog gray is preferred. Commissioner Chitlea felt it would be best to paint the dishes whatever color would make them the least visible. Mr. Bullet asked if the Commission would prefer to have staff handle the annual reviews. It was the consensus of the Commission that staff could handle the annual reviews. Chairman McNiel suggested the Design Review may wish to review the metal gate. Commissioner Melcher indicated that Design Review had already reviewed the gate. Motion: Moved by Chitlea, seconded by Melcher to adopt the Resolution approving Environmental Assessment and Conditional Use Permit 90-36 with modifications to require design review approval of the temporary building, the entire driveway to be paved, the antennas to be painted to the satisfaction of the City Planner, and replacement of the building with a permanent structure when development of the remainder of the parcel occurs. SELECTION OF TWO COMMISSIONERS FOR JOINT CITY COUNCIL/PLANNING COMMISSION SUBCOMMITTEE ON DEVELOPMENT REVIEW PROCESSING (Oral report) Brad Bullet, City Planner, reported that City Council had appointed two members to a subcommittee to review the development review process. He indicated that the Planning Commission should also appoint two members to serve on the subcommittee. Commissioner Melcher expressed an interest in serving on the subcommittee, stating that he felt he could provide a balanced perspective. Chairman McNiel indicated he would also like to serve on the subcommittee. It was the consensus of the Commission that Chairman McNiel and Commissioner Melcher would serve on the subcommittee. , , , , , Chairman McNiel and Commissioners Melcher and Vallette all stated they would like to attend the field tour of multiple family housing on Saturday, January 26.
