A Director's Report on the status of a condition of
approval to install a Eucalyptus Windrow along the
south side of Tract 18122, a nearly completed 76 -lot
subdivision with a combined area of about 53 acres
in the Very Low (VL) Residential District, Etiwanda
Specific Plan, located at the east side of East Avenue
and about 150 feet north of the Foothill Freeway (SR -
210).
Tract 18122 Background
Tract 18122 was approved by the Planning
Commission on November 9, 2011,
Associated with the tentative tract map approval was
Tree Removal Permit DRC2009-00224 which
permitted the removal of numerous trees from
throughout project site. A condition of approval for
this Tree Removal Permit reads as follows:

reads as follows:
"A set of replacement Eucalyptus windrows shall be
planted along the entire south perimeter (parallel to
the proposed equestrian trail) and part of the east
perimeter (at Lot 16) of the subdivision as shown on
the Preliminary Tree Removal Plan and Windrow
Exhibit dated September 10, 2010."
Tract 18122 Background
• Following approval of the tentative tract map and
associated entitlements, the project was sold to
KB Home;
• KB Home received approval from the City to
construct homes of the subdivision in 2014;
• Construction began shortly afterwards;
• Inspection of the final lot/house prior to full release
of subdivision occurred in the Summer of 2018,

Section 17.14.100 Modification:
Any person holding a permit granted under this Title
may request a modification or amendment to that
permit. For the purpose of this Section, the
modification of a permit may include modification of
the terms of the permit itself, project design, or the
waiver or alteration of conditions imposed in the
granting of the permit.

Authority Granted to Planning
Director
If the Planning Director determines that a proposed
project action is not in substantial conformance with
the original approval, the Planning Director shall
notify the property owner of the requirement to
submit a permit modification application for
consideration and action by the same approving
authority as the original permit. A permit modification
may be granted only when the approving authority
makes all findings required for the original approval.

Conditional Use Permit

• The Code states that a Conditional Use Permit
provides a process for a determination of requests
for uses and activities whose effects on adjacent
sites and surroundings need to be evaluated;
• Uses qualifying for a Conditional Use Permit are
considered minor, only have an impact on
adjacent properties, and can be modified and/or
conditioned to ensure compatibility.

fire stations, other fire prevention and firefighting
facilities, and police and sheriff substations and

order to approve the Conditional Use Permit:
Finding #1: The proposed use is allowed within the
applicable zoning district and complies with all other
applicable provisions of this Development Code,
General Plan, and any City regulations/standards,

Finding #2: The site is suited for the type and
intensity of the proposed use including access,
utilities, and the absence of physical constraints and
can be conditioned to meet performance criteria and
standards; and
Finding #3: Granting the permit would not be
detrimental to the public interest, health, safety,
convenience, or welfare, or materially injurious to
persons, property, or improvements in the vicinity.

a wall along the northeasterly property line,
• Within residential districts the maximum height
allowed for walls is 6 feet along the yard area and
property line that is adjacent to a street;

enforcement of the specified regulation would result
in a difficulty or unnecessary physical hardship
inconsistent with the objectives of this Code;

Design and Technical Review
Committees
The proposed project was reviewed by the Design
Review Committee and Technical Review
Committees on May 15, 2018;
No significant issues with the project were
identified and the conditions of approval were
accepted by the applicant;
Both Committees accepted Staff recommendation
to approve the project as proposed, and
recommend approval to the Planning Commission.
Neighborhood Meeting
A Neighborhood Meeting was conducted at Valle
Vista Elementary School located at 7727 Valle Vista
on May 17, 2018;
Notifications for the meeting were sent to all owners
of property within 660 feet of the project site;
In attendance were approximately 6 property owners
and residents; representatives from HMC Architects;
and representatives from the Fire, Police, and the
City.

Environmental Assessment
• Pursuant to the California Environmental Quality
Act, RCFPD and the City contracted an
environmental consultant, to prepare an Initial
Study of the potential environmental effects of the
project,
• Based on the findings contained in that document,
it was determined that, with the imposition of
mitigation measures related to environmental
topics, there would be no substantial evidence that
the project would have a significant effect on the
environment;
Environmental Assessment
• Based on that determination,
Declaration was prepared
review; and
• Public notice of the public
the City's intent to adopt
Declaration was provided;
a Mitigated Negative
for circulation and
comment period and of
the Mitigated Negative
• Comments were received from:
1. Burrtec Waste Industries, Inc.,
2. San Manuel Band of Mission Indians; and
3. SB County Public Works Department
Environmental Assessment
• No revisions to the Initial Study and Mitigated
Negative Declaration were required in response to
the comments that were received,
• A Mitigation Monitoring Program has also been
prepared to ensure implementation of, and
compliance with, the mitigation measures for the
project.
Public Notification
• Newspaper advertising;
• Two Notice of Filing signs;
• Mailed notices to owners of property located within
660 feet of the project site; and
• No comments were received in response to these
notifications except a phone call.
Conclusion
Staff recommends that the Planning Commission
approve:
• Design Review DRC2018-00097;
• Conditional Use Permit DRC2018-00243; and
• Variance DRC2018-00162
through the adoption of the attached Resolutions of
Approval.
