This is the time and place for the general public to address the Historic Preservation
Commission or Planning Commission on any item listed or not listed on the agenda. State law
prohibits the Commission from addressing any issue not previously included on the Agenda.
The Commission may receive testimony and set the matter for a subsequent meeting.
Comments are to be limited to five minutes per individual or less, as deemed necessary by the
Chair, depending upon the number of individual members of the audience. This is a professional
business meeting and courtesy and decorum are expected. Please refrain from any debate
between audience and speaker, making loud noises or engaging in any activity which might be
disruptive to the decorum of the meeting.

D1. ENVIRONMENTAL ASSESSMENT AND DESIGN REVIEW DRC2018-00912 AND MINOR
EXCEPTION DRC2019-00205 – PHELAN DEVELOPMENT - A request to develop an 11.73
acre site with three (3) industrial/warehouse buildings totaling 236,534 square feet and a
request to reduce the building setback from neighboring residential properties within the
General Industrial (GI) District, located on the north side of 9th Street, west of Vineyard Avenue,
at 8768 9th Street – APN: 0207-262-28, 0207-262-35, 0207-262-36, 0207-262-41, and 0207-
262-42 . A Mitigated Negative Declaration of environmental impacts has been prepared for
consideration.

Commissioner Dopp, asked if there was any consideration moving traffic to prevent it going
north or east?
Brian Sandona, Engineer, answered the trucks can turn east on 9th street, not west so not to
impose traffic in residential area.

Chairman Guglielmo, asked what kind of walls will be on the northwest corner?
Tania Chavez, Phelan Development, representing the applicant answered, regarding the wall
on west side of the project, there is an existing block wall and landscape will be placed along
that wall to add additional buffer. In regards to traffic, trucks would typically go thourgh
Vineyard and stay on 9TH Street, that leads to the 10 fwy.
Josh Bourgeois, Golden State Environmental Justice Alliance, stated he believes a full EIR
(Environmental Impact Report) should be completed.
Thomas Ruiz, spoke on behalf of Labors Local Union 783 in San Bernardino, that he is present
tonight to support the project and hopefully it will be given consideration.
Commissioner Dopp, mentioned he read the environmental impact, especially the air quality
numbers and most thresholds were well below the state standards. Project is very well
designed.
Commissioner Oaxaca, stated he does not see any issues with the design of the project.
Encourge to ensure that access is reasonable to each of the structures, as well as the overall
design features. It will be a positive addition to the City, bringing valuable jobs to some of our
local residents.
Commisioner Williams mentioned it will be a good addition to 9th Street to clean it up. It will
do a lot to improve the entire look of the street.
Commission Morales, stated it’s great to see the development of the property. Everything was
done well.
Chairman Guglielmo, stated he seen the project presented at DRC with two different proposals
because they were not sure they would be able to secure that house on the southeast corner.
He was happy to see they were able to put it together. He also likes the overall design of the
project and the need for it in that area because of the zoning.

DESIGN REVIEW DRC2019-00502 – GCA LAND - A request for site plan and architectural
review of 6 single-family residences on 3.19 acres of land within the Very Low (VL) Residential
District (1-2 dwelling units per acre) at the northeast corner of Sapphire Street and Brittany
Lane; APNs: 1061-691-22 through 27. This item is exempt from the requirements of the
California Environmental Quality Act (CEQA) and the City’s CEQA guidelines under CEQA
Section 15332 – In-Fill Development Projects.
Continued from January 8th meeting due to noticing error.
Sean McPherson, Sr. Planner, presented Commissioners with a Staff Report and PowerPoint

Candyce Burnett, with Kimley Horn representing the applicant, was present to answer
questions.
Commissioner Dopp, asked if the residents are satisified with some of the remedies that took
place at the neighborhood meeting?
Candyce Burnett, replied they did have a series of conversations at the neighborhood meeting
and they continue to work with adjacent neighbors. Will have to respond specifically to issues
with the trees on the trail because they are conditioned to build a trail, so that would be an
ongoing converstation with those neighbors.
Chairman Guglielmo, asked the trail going to 15 feet, what is the width is as it continues on
towards Jasper.
Sean McPherson, answered this is a local feeder trail so that width would be expected to be
15 feet. Just a note; immediately to the north of where this trail would be is another 15 foot
wide local feeder trail as well.
Robbie Gonzalez, owns property on 88 Brittany Lane and expressed his concern regarding
the drainage in front of his residence where the inlet is. The current development, the inlet is
too small.
Commissioner Dopp, expressed he likes the architectural accents. Appreciates the thought
that went into creating the horse related properties in that specific subdivision. His concern is
making sure the residents, in terms of the process, things get smoothed out along the way.

Vice Chairman Oaxaca mentioned the applicant has done a great job on this particular project.
He appreciates the applicants continued efforts to workout any remaining concerns with the
surrounding residents.
Commissioner Williams, agrees it will be a great addition to that area with a good variety.
Chairman Guglelmo, expressed he likes the farmhouse and Tuscan design. Applicant did a
good job.

D3. DESIGN REVIEW DRC2018-00430 – RC STORE MAINTENANCE - A request for site plan
and architectural review of an industrial building totaling 25,399 square feet on 1.87 acres of
land located east of Vineyard Avenue and north of 8th Street in the General Industrial (GI)
District; APN: 0209-013-13, -43, -44. This item is exempt from the requirements of the
California Environmental Quality Act (CEQA) and the City’s CEQA guidelines under CEQA
Section 15332 – In-Fill Development Projects.

Sean McPherson, Sr. Planner, presented Commissioners with a Staff Report and PowerPoint
presentation (copy on file). Applicant contacted Staff this morning regarding revisions to the
Conditions of Approval and Commissioners have the most revised copy on the dais.
Serge Bonaldo with Bonaldo Engineering representing the applicant. He expressed Staff did
a great job presenting and in support of everything said.
Commissioner Dopp expressed, he looked over the Design Review and the applicant did a
great job in creating a premium product.
Vice Chairman Oaxaca agrees, the applicant did a real good job. It will be a nice addition to
the City.
Commissioner Williams mentioned she also likes the design. It will be a real improvement in
that particular area.
Commissioner Morales agrees the project looks good.

D4. ENVIRONMENTAL ASSESSMENT, TENTATIVE TRACT MAP SUBTT20118 AND DESIGN
REVIEW DRC2019-00674 - LCD EMPIRE LAKES HOLDING COMPANY, LLC – A request
to construct 867 for rent apartments that will include duplexes, two and three-story stacked
flats, and two and three-story townhomes. The project will also include a commercial pad at
the southwest corner of 6th street and The Resort Parkway, and roughly 5,000 square feet of
commercial space integrated with four live/work townhome buildings located along the
westside of the roundabout on The Resort Parkway. The project will be developed on roughly
39.68 acres within the Empire Lakes Specific Plan, Planning Area 1 and will provide a variety
of open space areas, associated onsite parking, and additional onsite amenities. APN’s 0210-
102-08, 0210-102-09, and 0210-102-10. Pursuant to the California Environmental Quality Act
(CEQA), the City certified an Environmental Impact Report (EIR) (SCH No. 2015041083) on
May 18, 2016, in connection with the City’s approval of General Plan Amendment DRC2015-
00114, Specific Plan Amendment DRC2015-00040, and Development Code Amendment
DRC2015-00115. Pursuant to CEQA Guidelines Section 15162, no subsequent or
supplemental EIR is required in connection with subsequent discretionary approvals of the
same project.
David Eoff, Sr. Planner, presented Commissioners with a Staff Report and PowerPoint
presentation (copy on file). Applicant has provided some requested changes and clarifications
to the Conditions of Approval and Commissioners have the most revised copy on the dais.
Also, additional change, the Resolution references 5,000 sq ft. commercial space, when there
is actually 10,000 of future commercial building sq. feet.
No Public Comments.
Vice Chairman Oaxaca, inquired about the draft conditions of approval revisions on Page 2,
Item 16. Asked why was it struck? Seemed straight forward.
David Eoff, answered it was one of the Engineering conditions. A lot of the improvements
being done on the primary street, which are Resort Parkway (6th and 4th Street) are typical of
this condition. The interior streets are designed to be private street but are maintanded by

HOA, not by City. They are designed to function as public streets where they are open to the
public, giving it an open feeling. The maintnenace of it is done on a private basis.
Randall Lewis with Lewis Corporation thanked staff and Planning Commission. He expressed
his excitement for the project.
Brian Jacobson with Lewis Corporation, Project Manager mentioned it has been a
collaborative effort to get this project before you tonight. Wanted to make one clarification for
purposes of the resolutions, in addition to the 867 dwelling units in total, we are proposing “in
total” 20,000 square feet of non-residential space, within the mixed space overlay south of 6th
Street.
Commissioner Williams expressed she is excited for the project and asked to make sure there
will be a Kiddie Park.
Brian Jacobson, answered yes and assured her there would be.
Chairman Guglielmo, asked how long will it take to construct.
Brian Jacobson, answered they are hoping to start this summer. It will take 2 1/2 to 3 years
to complete the entire 867 dwelling units.
Commissioner Dopp, expressed his thanks and mentioned this is potentially an exciting
opportunity. Did a great job addressing our concerns looking at the project as it moves
forward.
Vice Chairman Oaxaca, agrees and added we set the bar especially some of the aspects of
sustainability that will connect the residents, not only to the non-residential portion of the
project but also to the transit station and some of the other features in the community side.
We set the bar where we all want it to be. Looking forward to seeing us keep the bar at that
point for any future applicants looking to contribute to the project.
Commissioner Williams, expressed her excitement about it and agees we have set the bar
where we want it.

Commissioner Morales, mentioned after looking at all the details on the report, he was
pleased. Everything looks great, good quality and a good project. It helps us meet the City’s
goals with affordable pricing in the right places.
Chairmain Guglielmo stated, seeing what the applicant has done throughout the past year, it
really is fascinating to see how they have been able to adapt and meet some of the concerns
we had. This is really a new and exciting type of living we really do not have in the Inland
Empire. Rancho is fortunate to have the driving economic force to allow this to occur. Lewis
Corporation has really raised the bar with some of the higher standards and variation of design
and walkability.
Moved by Commissioner Williams, second by Vice Chair Oaxaca; carried 5-0-0 with the
revised Conditions of Approval.
D5. MUNICIPAL CODE AMENDMENT DRC2020-00007 - CITY OF RANCHO CUCAMONGA - A
request to amend Title 17 (Development Code) of the Rancho Cucamonga Municipal Code to
modify standards for accessory dwelling units in compliance with state law. This item is exempt
from the requirements of the California Environmental Quality Act CEQA) and the City’s CEQA
guidelines under CEQA Section 15282(h). This item will be forwarded to City Council for final
action.
Jennifer Nakamura, Management Analyst II, presented Commissioners with a Staff Report
and PowerPoint presentation (copy on file).
No Public Comments.
Commissioner Dopp, expressed his disappointment with the state regarding the code
changes. It’s going to present some challenges for us moving forward but there is nothing we
can do.
Commissioner Oaxaca, agress it’s a little disconcerting when the state legislation gets into the
code business. It might be interesting at some point to hear back from staff if we really see it
activates any land rush of Accessory Dwelling Units or see any change at all. If it will activate
a number of applications, more than you had in the past.
Jennifer Nakamura, answered since some of these changes were made in 2018 became
effective, the number of Accessory Dwelling Units (ADU) that we have had basically doubled.

Keep in mind that number is still under 30 for last year that were permitted. We only had
maybe two or three that were garage conversions. Most of them as proposed were detacted
ADU’s. Some choose to build a garage in addition to the ADU’s. One of the things we are
finding in some cases the barrier to this is in some cases the cost. They are not set up for
utilities or sewer, they are relatively expensive to build. Looking at somewhere between
$60,000 to $70,000 for the unit itself, in addition to foundation, etc. It is relatively an expensive
proposition.
Commissioner Williams, stated she also dislikes the state legislators taking control. Asked
what controls do we have of what it looks like.
Jennifer Nakamura, answered we do have some basic design standards. It’s bascially the roof
pitch matches the existing home, the roof materials and then colors. If they wanted to get
more creative, we want them to have those opportunities as well.

D6. MUNICIPAL CODE AMENDMENT DRC2020-00004 – CITY OF RANCHO CUCAMONGA –
A request to amend Title 17 (Development Code) of the Rancho Cucamonga Municipal Code
to modify the development standards applicable to single-family residential development
within a specific area of the Red Hill community that is generally located north of Foothill
Boulevard, south of Base Line Road, west of Vineyard Avenue, and east of Grove Avenue
(the City’s west boundary). This item is exempt from the requirements of the California
Environmental Quality Act (CEQA) and the City’s CEQA guidelines under CEQA Section
15061(b)(3). This item will be forwarded to City Council for final action.
Anne McIntosh, Planning Director mentioned brought before the Commissioners tonight are a
set of standards we would like for you to consider, discuss and evaluate. Are we improving
our regulations so that we are increasing our ability to protect the general community welfare.
What we would like to do instead of having you adopt a resolution tonight, make a final
decision, is get your direction and come back with actual ordinace that we would be taking to
Council. The resolution in your packet refers to the content of the standards but does not have
the ordinance attached. We would like to come back at the next meeting with the ordinance
so you would continue the hearing over.

Renee Massey, expressed her concern over the item presented. Requesting the
Commissioners to table the approval of Municipal Code Amendment that staff is
recommending and suggests to direct staff to work with neighbors in small meetings or
workshops in order to create a more standard that all will be proud of and eager to approve.
H. Lynn Massey, spoke about the lot at 8045 Camino Predera and it’s previous owners/ real
estate history. Requesting to reconsider the 14 foot height allowance. The neighbors on the
north side of street would like to share the view with the neighbors on the south side of the
street and have it preserved.
Chuck Buquet, spoke on going back and taking a look at the 14 foot height limitation. Stating
it will devastate the whole hillside area.
John Adams, spoke about the views, topography and explained that each lot is different. The
rules and comments do not apply equally with all the different lots.
Saurabh Patel, spoke about his concern over the 14 foot height restriction. He requests
Commissioners take additional time to think this over and let residents on North side property
owners get together and come up with a clear and concise code.
Ms. Patel, spoke about why the focus is specifically for Camino Predera south side only. What
is City and Staff doing about the view for north side residents. She asks Commissioners to
look into why it’s inconsist.
Maria Alamat, mentioned she lives on Red Hill Country Club Drive and many of the neighbors
are not concerned about Camino Predera. Stating there is a lot of history on Red Hill with
cascading views they all share.
Commissioner Dopp, requesting if Staff can provide some insight in terms of view sharing and
how they arrived at the 14 foot number.
Mike Smith, explained regarding the view sharing, the City does not have a view preservation
ordinance in the Development Code or Municipal Code so there is no parallel statement in the
code that can be applied to housing, so what we have to do is review against what is specified
in the code. One of the reasons that we started down this road with apposing to amend the
Municipal Code is some of the standards left a lot to perhaps some interpretation where we
have to do is make is subjective as possible. One of those things took away from the

workshops with Red Hill was that there was concern about the height of the house relative to
the curb, which seems the best way to measure because it’s a feature and it will not move.
The way we arrived at the 14 feet figure, one story, and then you add whatever the roof might
be above it, allowing for a 8 foot floor and then up to 14 feet to account for the roof pitch.
Commissioner Dopp, stated there is going to be a situation where people are going to win and
people are going to lose. He does agree there needs to be some work to evolve between the
residents.
Vice Chairman Oaxaca mentioned in conversations like this, context is really important to him
to hear from project applicants and from members of the public and a lot of times it’s a little bit
of a task to put together of what we are trying to accomplish here. When all of you moved into
your homes on the north side, there was vacant land to the south, sooner or later there was
going to be homes there. He does know it is uneven topography to the south and that needs
to be taken into account as well. He believes you do need some more time but as a
Commissioner, he personally feels that we do not need to take forever to do this. We need to
arrive at a concurred solution and hope to do that by the next meeting. There has been
sufficient notification and sufficient opportunitunty now to see what Staff has proposed. He
hopes when we come back there will be a spirit of cooperation and solution for everyone
involved.
Commissioner Williams, expressed her concern to take a little bit more time. Suggests for
one more neighborhood meeting. Asked about the common side sitbacks on the north side
of street. Are they 20 feet apart.
Mike Smith, answered he would have to look at an aerial photo. The house to the west looks
10 feet. The house to the west of that also has a long driveway that leads to the backyard.
Each adjacent house to the west and north has some condition which forced the house to be
10 feet required, by default design.
Commissioner Williams, stated some of the houses are way to close together. There needs
to be some breathing air. She does not like the feeling that Staff is saying this is the way it’s
going to be. She is not ready to take this draft and bring back in two weeks and okay it. Maybe
give it a month.

Commissioner Morales, stated he knows this item was brought today with good intent but he
does realize some more work is needed. Suggesting a community outreach and get the
feedback from all stakeholders involved.
Chairman Guglielmo, mentioned a few things to point out for Staff. He noticed in the audience
a few times when the illustration about 14 feet and noticed people shaking their heads. It
seems like there is confusion what that means. He asks if Staff can do better in defining the
illustrations to visualize it better. One other thing is about the trees on the lots that are further
East along the trail. He asks if Staff can provide some information about those trees.
Mike Smith, answered regarding the trees, we have a section of the code that specifies when
a removal of a tree has to be reviewed by the City. Generally, it has to be 30 feet high or
higher. If it requires additional review, we have applicants submit an application for an tree
removal permit and justify the removal of the tree. Explain the purpose and sometimes it’s a
matter of health or it being in the way of development on property.
Anne McIntosh, commented one of the things about timing the direction to undertake this
effort came out of after the final hearing on a house on Camino Predera was heard by Council
on appeal, ultimately the direction to do this came from the City Manager’s Office. Also, as
you know we had another hearing with this body on another house on Camino Predera and
the Commission denied that application and that is now on appeal. The issue of time is critical
because the longer we wait the more the existing conditions will be in place and applications
will continue to come in. We will not be able to solve this problem as applications are coming
in. We really do need to be thinking about the timing of this and come to a solution sooner
than later.
Your comment about having another meeting with the neighbors, we can do that. It will give
them an opportunity to talk to see if there is recommendations they might come back. The
rules that are in place right now will be in place until you make a change. The frustration the
existing property owners have is that they’ve designed to the literal guidelines and the Council
have found there is a compatibility issue with the neighborhood. What we are trying to do here
is would it be compatible with the neighborhood. What kind of profile along south side of
Camino Predera would provide that compatibility. And what is in the code now isn’t, then how
can we shape more carefully those profiles to create that compatibility.
When the Commission heard the last case on an individual project, the issue of bulk and
massing and this distancing between bulldings was part of what you considered and where

concerned about. So that is what lead us to increase the set back. If we increase the set
back a little bit on each side that would provide that space. Kind of managing the height it
seemed from the street creates a sense of space from both sides of the street without
completely making the houses invisible but it does not allow them to go up so high that it would
feel massive. That is what kind of contributed to the recommendations that we brought
forward. We are close to meeting your criteria. It will not take as much time as you think it
might to find a recommendation.
Moved by Commissioner Williams, second by Vice Chairman Oaxaca; carried 5-0-0 to
continue the public hearing to February 12, 2020, and direction for Staff to hold another
workshop/neighborhood meeting regarding the proposed development standards and Staff is
to return a draft ordinance for consideration with additional language to amend the code to
accommodate those standards.

APPEALS
Any interested party who disagrees with the City Planning Commission decision may appeal the
Commission’s decision to the City Council within 10 calendar days. Any appeal filed must be directed to the
City Clerk’s Office and must be accompanied by a fee of $3,114 for all decisions of the Commission. (Fees
are established and governed by the City Council).
