D1. TIME EXTENSION DRC2019-00955– RICHLAND COMMUNITIES – A request for a one (1)
year time extension for a previously approved Tentative Tract Map SUBTT14749—The
subdivision of approximately 168.77 acres into 269 residential lots located in the Low (L)
Residential District and Flood Control (FC) District within the Etiwanda North Specific Plan,
and the northeast corner of Day Creek Boulevard and Etiwanda Avenue– APNs: 1087-081-
04, through -09, and 1087-081-14.

TIME EXTENSION DRC2019-00559 – SALLY CHENG – A request to allow for the first one
(1) year time extension of a previously approved 6-lot Tentative Tract Map (SUBTT20026)
on 1.67 acres of land within the Low (L) Residential District, located at 10235 19th Street;
APN: 1076-121-03. Planning Department staff has determined that the project is
categorically exempt from the requirements of the California Environmental Quality Act
(CEQA) and the City’s CEQA Guidelines as a Class 32 (CEQA Guidelines Section 15332)
exemption, which covers in-fill development on no more than 5 acres substantially
surrounded by urban uses.

APPEALS
Any interested party who disagrees with the City Planning Commission decision may appeal the
Commission’s decision to the City Council within 10 calendar days. Any appeal filed must be directed to the
City Clerk’s Office and must be accompanied by a fee of $3,114 for all decisions of the Commission. (Fees
are established and governed by the City Council).

D1. ENVIRONMENTAL ASSESSMENT AND TENTATIVE PARCEL MAP SUBTPM20006 AND
DESIGN REVIEW DRC2018-00529 – REDROCK DEVELOPMENT, INC. FOR SCHEU
MANAGEMENT COMPANY - A request to subdivide 13.6 acres of land for four (4) separate
parcels and develop the site with four (4) industrial/warehouse buildings totaling 240,710
square feet within the General Industrial (GI) District, located at the northeast corner of
Archibald Avenue and 7th Street – APN: 0209-211-24. Related File: Design Review DRC2018-
00529 and Tentative Parcel Map SUBTPM20006. A Mitigated Negative Declaration of
environmental impacts has been prepared for consideration.
Mike Smith, Principal Planner, presented Commissioners with a Staff Report and PowerPoint
presentation (copy on file).
Michael Morris, Red Rock Development representing the applicant. Presented a check
payable to Clerk of the Board of Supervisors for MND. Introduced his team and expressed
their excitement and see it as a major milestone moving forward.
No public comments.
Commissioner Dopp, stated the project looks impressive. Mentioned there is a need for
certain types of spaces for businesses that need to expand, especially a warehouse, it
brings something extra to the community.

Chairman Guglielmo mentioned it will be an added improvement to the neighborhood. A
well-thought-out project.

DESIGN REVIEW DRC2019-00590 – SHEAN KIM FOR XEBEC REALTY - A request for site
plan and architectural review of a 103,945 square foot warehouse distribution building on 4.75
acres of land in the General Industrial (GI) District on the east side of Pecan Avenue south of
Arrow Route; APN: 0229-171-02. This item is exempt from the requirements of the California
Environmental Quality Act (CEQA) and the City’s CEQA guidelines under CEQA Section
15332 – Infill Development Projects.
Tabe van der Zwaag, Associate Planner, presented Commissioners with a Staff Report and
PowerPoint presentation (copy on file).
Paige Fennie, Lozeau Drury, expressed concerns on an environmental safety issue.
Requesting City to conduct an EIR on this project.
Commissioner Dopp requested for City Attorney Ghirelli to weigh in on the comment conflict
with CEQA application.
Attorney Ghirelli explained he reviewed the letter with Staff, and it does not claim the project
qualifies for any of the elements of class 32 exemption. CEQA’s categorical exemptions are
subject to exceptions. (There are 5 exceptions.) Two were raised in this case. Staff
determined that because the project is an industrial project in an area zoned for industrial
uses, and surrounded by other industrial uses, there was really nothing unusual about placing
the warehouse of this size, and this type at this location. Without any unusual circumstance,
Staff feels that the findings that were provided in support of the class 32 exemption are
supported and the exemptions are implacable in this case.
Commissioner Dopp commented on the recent trend of law firms representing environmental
groups challenging the CEQA findings, then later settling with the applicants. As City Attorney
said, it is zoned for industrial area. It appears to be the best fit for the land, the categorical
exemption is appropriate. He expressed his approval for this project moving forward.
Vice Chair Oaxaca stated he reviewed the documentation. He also supports the project.

Commissioner Morales stated he believes all the concerns have been addressed. Project will
complement the area.
Chairman Guglielmo stated he agrees and added the current use there is impactful with
trucking and will be an improvement to the neighborhood for building to be built there.
Commissioner Dopp mentioned, before making the motion to approve he added, if it’s taking
over a trucking company and we are building something else in that land, you could make a
theatrical argument that could actually be a benefit to the area because based off the amount
of truck traffic that potentially goes through there vs. a warehouse. Not saying it’s 100% true
but you could make the argument.

D3. DESIGN REVIEW DRC2019-00381 AND CONDITIONAL USE PERMIT DRC2018-00936 –
KEN KANG FOR 8166 FOOTHILL BOULEVARD, LLC - A request for site plan and
architectural review for the reconstruction and expansion of a service station and convenience
store located in the Mixed-Use (MU) District and Foothill Boulevard Overlay District Subarea
1 at the northeast corner of Foothill Boulevard and Red Hill Country Club Drive, at 8166 Foothill
Boulevard; APN: 0207-112-20 and 23. This item is exempt from the requirements of the
California Environmental Quality Act (CEQA) and the City’s CEQA guidelines under CEQA
Section 15303 – New Construction or Conversion of Small Structures.

PowerPoint presentation (copy on file).
Chairman Guglielmo asked a question for Engineering regarding the new realignment and
how it will work, concerns channeling cars to create more traffic. Is that a valid point or will
alignment improve.
Brian Sandona answered, the alignment will improve the flow of traffic in the area. The existing
Red Hill Country Club will be vacated, and that land will revert back to the original owners but
after the new alignment is dedicated and constructed.

Commissioner Dopp stated he is satisfied with how staff and applicant addressed some of
the issues.
Vice Chair Oaxaca stated he agrees with Commissioner Dopp, expressed the project is very
nicely designed and definitely designed for the future.
Commissioner Morales stated with the reconstruction and updated architecture enhances
the entry way into the City and agrees it will be a good project.
Chairman Guglielmo agrees with his fellow Commissioners. It’s a good design and an
improvement to that entry point.

D4. TIME EXTENSION DRC2019-00939 – YOULITA AND KIRYAKOS, LLC - A request to allow
for a one (1) year time extension of a previously approved Tentative Tract Map (SUBTT18823)
along with related Variance DRC2012-00135 and Minor Exception DRC2012-00513 to
subdivide 3 parcels of land totaling 12.93 acres into 19 lots for the future development of
single-family residences in the Very Low (VL) Residential District of the Etiwanda North
Specific Plan (.1 to 2 dwelling units per acre) located on the west side of Wardman Bullock
Road, south and east of Blue Sky Court - APN: 0226-081-15, 16 and 17. Related files
Tentative Tract Map SUBTT18823, Variance DRC2012-00135, and Minor Exception
DRC2012-00513. On January 23, 2013, a Mitigated Negative Declaration of environmental
impacts was adopted by the Planning Commission for Tentative Tract Map SUBTT18823. The
California Environmental Quality Act provides that no further environmental review or Negative
Declaration is required for subsequent projects or minor revisions to the project within the
scope of the previous Mitigated Negative Declaration.

Chairman Guglielmo asked what has caused the delay.
Carlos Cueva, with Rancho Wardman is here tonight on behalf of the applicant. Explained
the problems with break-ins of homes at the project site and working with the Police to
resolve issue. Also, working on environmental issues to be resolved and how to submit the

next set of plans to the Engineering department. Trying to move through that as quickly as
possible.
Commissioner Dopp asked the applicant about project timing going forward.
Carlos Cueva answered that it must get done within this calendar year. They do not have
extension period. Trying to get Engineering approved and Environmental addressed.

MUNICIPAL CODE AMENDMENT DRC2020-00004 – CITY OF RANCHO CUCAMONGA –
A request to amend Title 17 (Development Code) of the Rancho Cucamonga Municipal Code
to modify the development standards applicable to single-family residential development
within a specific area of the Red Hill community that is generally located north of Foothill
Boulevard, south of Base Line Road, west of Vineyard Avenue, and east of Grove Avenue
(the City’s west boundary). This item is exempt from the requirements of the California
Environmental Quality Act (CEQA) and the City’s CEQA guidelines under CEQA Section
15061(b)(3). This item will be forwarded to City Council for final action.
Continued from January 22, 2020 HPC/PC Meeting.
David Eoff, Senior Planner, presented Commissioners with a Staff Report and PowerPoint
presentation (copy on file).
Commissioner Morales asked, since time is of the essence for the proposed code
amendments, how much time do we have until it has to be addressed.
Anne McIntosh, Planning Director explained, that there are a number of vacant lots along
south side of the street. Without design standards in place, applications could go forward as
the previous applications have under the current standards. Moving this forward quickly would
benefit both the projects and concerns of the neighbors. The neighbors are aware and still
were more comfortable allowing that additional time. The City Manager’s Office agrees.
Oscar Gonzalez, Camino Predero resident stated, when developing this code for his
neighborhood street, to please consider what’s best for its general curb appeal.

Jane Adams, Camino Predero resident, expressed her objection to the amendment of the
code. Does not see the need for neighborhood meetings due to the hostility and pity of
neighbors. Requests the decision makers (Planning) to please make a decision.
Rob Patel, Camino Predero resident, stated he went to every single house in the community
and got the curb heights. Realized some issues with the code that are being proposed by
staff. Produced a drawing of property line and setbacks and submitted findings to Planning.
Anne McIntosh, Planning Director, commented that Mr. Patel did an extensive analysis that
goes beyond what he just presented. He spoke with her earlier today and she mentioned staff
would be happy to accept his research analysis and incorporate that in the subsequent report
and will be brought back to the Commission once submitted officially.
Renee Massey, stated she will be providing a petition of signatures showing support of Staff’s
recommendation for continuance.
Shena Ice, Camino Predero lot owner and sister of Rob Patel (continued where Rob Patel left
off), stating they went to all the community and lot owners to see what they thought. Hoping
the City would review the information and move forward with the right proposal.
Chuck Buquet, stated he was never approached by the Patel’s. Expressed he is open to
talking but was never contacted. He suggests staff recommend the continuance, which will
allow neighbors to come back and communicate.
Christopher Nosrat, resident, expressed his feelings about the neighborhood. He does not
understand why hostility. Expressed not everyone is going to be happy with the outcome but
a decision needs to be made.
Susan McNinch, resident, stated she disagrees with Rob Patel about going around talking to
neighbors because no one came to her door and approached her. Expressed how residents
need to look after each other and take care of each other or they will be back in two years with
same situation.
Commissioner Dopp, stated there are two different perspectives and at some point, the
Commission is going to have to make a decision one way or the other. He asked Staff to
provide a record of what is being said at community meetings. He is open to see more

technical analysis of what Mr. Patel provided with roofing and setbacks. Asking staff to bring
to the next public hearing a more visualization of what these setbacks look like at street level
and at a slightly elevated view. He likes the idea about the trees that maybe could help
alleviate some of the view issues.
Vice Chair Oaxaca, mentioned we do have a current set of codes and those are in place for
any individual who wishes to construct in the City based on the codes are allowed to do so.
He is not supportive of the use of outside pressure to inhibit what is allowed legally under the
existing codes. He was happy to hear there has been progress in the discussions.
Commissioner Morales, stated that progress is being made. He hopes that additional time will
be productive and resolve outstanding issues for everyone involved. He hopes the community
will be able to move forward and live in a peaceful and beautiful neighborhood.
Chairman Guglielmo, asked staff what is the plan going forward.
Anne McIntosh, answered to make clear, the overlay that staff had proposed would be an
option to property owners. It does not replace the underlying Hillside standards that are in
place. Property owners can continue to come under the existing guidelines if they wanted to.
After tonight, additional comments were submitted, and staff can arrange for another meeting.
Chairman Guglielmo requested for staff to bring concrete results from neighborhood meetings
to avoid mixed messaging. He recommends this item be continued and for the neighbors to
work towards a compromise.

SUBJECT: TIME EXTENSION DRC2019-00955– RICHLAND COMMUNITIES – A request
for a one (1) year time extension for a previously approved Tentative Tract Map
SUBTT14749—The subdivision of approximately 168.77 acres into 269
residential lots located in the Low (L) Residential District and Flood Control (FC)
District within the Etiwanda North Specific Plan, at the northeast corner of Day
Creek Boulevard and Etiwanda Avenue– APNs: 1087-081-04 through -09, and
1087-081-14. Related files: Annexation DRC2003-01051, Specific Plan
Amendment DRC2003-00409, General Plan Amendment DRC2003-00410 and
Development Agreement DRC2003-00411. Staff finds the project to be within
the scope of the project covered by a prior Environmental Impact Report
certified by City Council on June 21, 2004 (State Clearinghouse #2003081085)
by Resolution 04-240 and does not raise or create new environmental impacts
not already considered in the Environmental Impact Report.
RECOMMENDATION:
Staff recommends that the Planning Commission take the following action:
• Approve Time Extension DRC2019-00955 through the adoption of the attached
Resolution of Approval.
PROJECT AND SITE DESCRIPTION:
The project site consists of approximately 168.77 acres of undeveloped land located at the
northeast corner of Day Creek Boulevard and Etiwanda Avenue. The subject parcel has a linear
dimension, from north to south, of approximately 1,800 feet and approximately 2,500 feet from
east to west. The project is covered with ornamental grasses and gravel.

The design of the proposed subdivision is consistent with the surrounding residential subdivisions
within the area. The proposed 269 lots will be developed in accordance with the Low (L)
Residential District, Etiwanda North Specific Plan standards.
BACKGROUND:
Tentative Tract Map 14749 (SUBTT14749) was approved by the planning Commission on June
9, 2004. This approval was appealed to the City Council on July 21, 2004. The appeal was denied,
and the project was approved with the second reading of Ordinances No. 729 (Specific Plan
Amendment) and Ordinance 730 (Development Agreement) on August 4, 2004. A lawsuit was
subsequently filed on August 18, 2004, against the City over the approved project (Spirit of the
Sage Council vs. City of Rancho Cucamonga, with the applicant, Traigh Pacific L.P., as the Real
party of Interest). The case was settled on December 20, 2005, with the applicant agreeing to pay
a settlement to the petitioner and the original City approval remaining intact. The settlement
agreement became effective on February 10, 2006, with the lawsuit dismissed 7 days later on
February 17, 2006.
On June 12, 2007, the City Attorney informed staff that pursuant to California Code Section
66452.6(c), the subject tentative tract map was entitled to an automatic time extension for the
period between the date the lawsuit was filed (August 18, 2004) and the date the lawsuit was
settled (February 10, 2006), or 541 days. The duration of the approval period for tentative tract
maps is 3 years. Thus, the start date of the approval period was the date of the second reading
by the City Council for the Specific Plan Amendment and the Development Agreement (final
approval of all aspects of the project) – August 4, 2004. With the time extension, and with the
lawsuit taken into account, the official start date of the approval period for SUBTT14749 was
January 27, 2006, with the expiration date occurring on January 27, 2009.
At various points in time throughout the life of the project, the State Legislature approved
legislation automatically extending the approval period of active Tentative Maps throughout the
State. Specifically, Senate Bill 1185 was approved on July 15, 2008 providing a one (1) year
extension; Assembly Bill 333 was approved on July 15, 2009, providing a two (2) year extension;
Assembly Bill 208 was approved on July 13, 2011, providing another two (2) year time extension;
and Assembly Bill 116 was approved on July 11, 2013 granting yet another two (2) year time
extension. These extensions granted by the State Legislature extended the approval period of
the subject tentative tract map by a total of 7 years. Additionally, the Planning Commission
approved four separate one-year time extensions on the dates shown in the table below. With
these extensions, Tentative Tract Map SUBTT14749 was extended to January 27, 2020. The
applicant submitted the subject time extension request on December 2, 2019, and the earliest

been four-time extensions previously granted to this project by the Planning Commission, the
subject time extension application, is the final time extension that can be granted for this project
by the City pursuant to Development Code Section 16.16.170(C).

ANALYSIS:
A. Subdivision Map: Municipal Code Section 16.20.100 (Extensions) states that tentative tract
maps may be extended for a time period not exceeding five years. The municipal code
requires that a request for a time extension be submitted not less than 60 days prior to the

expiration date. The applicant submitted a letter (Exhibit B) on December 2, 2019, stating a
one (1) year extension is necessary to allow time for the completion of environmental permits
(SBKR critical habitat designation) and a resolution for the required equestrian center. The
applicant is not requesting/proposing any changes to the approved map. Flexibility with the
60-day submittal period has been afforded to applicants in the past who were unaware of the
submittal time limit. This application involves one (1) year time extension request, which would
set the expiration date to February 26, 2021. If approved, this will be the final time extension
for the Tentative Tract Map.
B. Public Art: This subject Tentative Tract Map Time Extension is exempt from providing public
art as outlined in Chapter 17.124 of the Development Code as the project is not associated
with any applications to develop the site. However, public art will be required as a condition
of approval for any future development applications.
C. Environmental Assessment: Pursuant to the California Environmental Quality Act (CEQA) and
the City’s local CEQA Guidelines, the City adopted an Environmental Impact Report on August
4, 2004 in connection with the City’s approval of SUBTT14749. Pursuant to CEQA Guidelines
Section 15162, no subsequent or supplemental EIR or Negative Declaration is required in
connection with subsequent discretionary approvals of the same project unless: (i) substantial
changes are proposed to the project that indicate new or more severe impacts on the
environment; (ii) substantial changes have occurred in the circumstances under which the
project was previously reviewed that indicate new or more severe environmental impacts; or
(iii) new important information shows the project will have new or more severe impacts than
previously considered; or (iv) additional mitigation measures are now feasible to reduce
impacts or different mitigation measures can be imposed to substantially reduce impacts.
The applicant submitted a Biological Resource Memorandum (ESA Consulting; November 13,
2019) which reviewed whether changes have occurred on the project site that would
necessitate new or different mitigation measures. The report concluded that no substantial
changes have occurred on the project site that would necessitate new or modified mitigation
measures. The report also concluded that the recommended mitigation measures that were
detailed in the 2003 Tracy Development EIR, the 2011 PCR Biological Assessment, and the
2017 and 2018 ESA Biological Resource Memo are consistent with the site conditions that
were observed later 2019.
Staff has evaluated Time Extension DRC2019-00955 and concludes that substantial changes
to the project or the circumstances surrounding the project have not occurred which would
create new or more severe impacts than those evaluated in the previous Mitigated Negative
Declaration. The application is for a one (1) year time extension of a previously approved
Tentative Tract Map with no proposed changes to the scope of the original approval. Staff
further finds that the project will not have one or more significant effects not discussed in the
previous Environmental Impact Report, nor have more severe effects than previously
analyzed, and that additional or different mitigation measures are not required to reduce the
impacts of the project to a level of less than significant.
The applicant has not proposed any changes to the originally approved entitlements.
Therefore, pursuant to CEQA, staff recommends that the Planning Commission concur with

the staff determination that no additional environmental review is required in connection with
the City’s consideration of Time Extension DRC2019-00955.
FISCAL IMPACT:
The project site currently is assessed an annual property tax. A percentage of this annual tax is
shared with the City. The proposed development will increase the value of the project site and the
City’s annual share of the property tax will increase accordingly. The project proponent will also
be responsible for paying one-time impact fees. These fees are intended to address the increased
demand for City services due to the proposed project. The following types of services that these
impact fees would support include the following: library services, transportation infrastructure,
drainage infrastructure, animal services, police, parks, and community and recreation services.
COUNCIL GOAL(S) ADDRESSED:
Although a specific current City Council goal does not apply to the application, the proposed map
extension for 269 single-family detached homes will enhance the premier community status by
adding additional housing which will increase the City’s housing supply. This project is also
consistent with the goals and policies of the General Plan and the objectives of the Development
Code as the General Plan land use and zoning designations of the project site are Low Residential
and the subdivision is for residential purposes.
CORRESPONDENCE:
This item was advertised as a public hearing with a regular page legal advertisement in the Inland
Valley Daily Bulletin newspaper, the property was posted, and notices were mailed to all property
owners within a 660-foot radius of the project site. To date, no comments have been received
regarding the project notifications.

A. Recitals.
1. Richland Communities, Inc. filed an application a time extension to extend the approval
period of Tentative Tract Map SUBTT14749, as described in the title of this Resolution.
Hereinafter in this Resolution, the subject Tentative Tract Map Time Extension request is referred
to as "the application."
2. On February 26, 2020, this Commission adopted Resolution No. 20-18, thereby
approving the application subject to specific conditions and time limits.
3. On February 26, 2020, the Planning Commission of the City of Rancho Cucamonga
conducted a noticed public hearing for the application and concluded said hearing on that date.
4. On February 26, 2020, the Planning Commission of the City of Rancho Cucamonga
approved a one (1) year time extension for Tentative Tract Map SUBTT14749, extending the
approval period to February 26, 2021.
5. All legal prerequisites prior to the adoption of this Resolution have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning
Commission of the City of Rancho Cucamonga as follows:
1. This Commission hereby specifically finds that all of the facts set forth in the Recitals,
Part A, of this Resolution are true and correct.
2. Based upon substantial evidence presented to this Commission during the above-
referenced public hearing on February 26, 2020, including written and oral staff reports, together
with public testimony, this Commission hereby specifically finds as follows:
a. The application applies to a 168.77-acre parcel of land located on the northeast
corner of Day Creek Boulevard and Etiwanda Avenue with a linear dimension, from north to south,
of approximately 1800 feet and approximately 2500 feet from east to west and is presently
undeveloped; and

b. The site is surrounded by vacant land from north to south, single-family
residential to the west and the Etiwanda Creek to the east. The zoning of the subject property is
located in the Low (L) Residential District, Etiwanda North Specific Plan, Equestrian Overlay
District, and the Flood Control District. The zoning for the properties to the north and south are
Utility Corridor, the zoning for the property on the east is Flood Control District, and the zoning for
the properties on the wert are Low (L) Residential District, Etiwanda North Specific Plan, and the
Equestrian Overlay District; and
c. The subdivision of the project site conforms to all applicable development
standards of the Development Code for the Low (L) Residential District, Etiwanda North Specific
Plan, Equestrian Overlay District, and the Flood Control (FC) District; and
d. This application is a request to extend the approval period of Tentative Tract Map
SUBTT14749 for one (1) additional year. The time extension is necessary to allow time for the
completion of environmental permits (SBKR critical habitat designation) and a resolution for the
required equestrian center. This is the fifth and final time extension granted.
3. Based upon the substantial evidence presented to this Commission during the
above-referenced public hearing and upon the specific findings of facts set forth in Paragraphs
1 and 2 above, this Commission hereby finds and concludes as follows:
a. The previously approved Tentative Tract Map is consistent with the City's current
General Plan, Municipal Code, ordinances, plans, codes, and policies. The proposed project is
for the subdivision of 168.77 acres of land for 269 single-family detached lots development. The
project site is within the Low (L) Residential District, Etiwanda North Specific Plan, Equestrian
Overly District, and Flood Control (FC) District, which permits the development of single-family
projects with a density of maximum 4 dwelling units per acre. The approved 269-unit single-family
development on the project site has a density of approximately 1.6 dwelling units per acres; and
b. The site is physically suitable for the type of development proposed. Currently
the site is undeveloped. The project involves grading of the site to comply with City requirements
and to be consistent with previously approved tract maps within the vicinity of the subject property;
and
c. The proposed subdivision, together with the conditions applicable thereto, will
not be detrimental to the public health, safety or welfare, or materially injurious to properties or
improvements in the vicinity; and
d. The proposed subdivision complies with each of the applicable provisions of the
Development Code. The proposed subdivision complies with all development standards outlined
in the Development Code for single-family projects within the Low (L) Residential District,
Etiwanda North Specific Plan, Equestrian Overlay District, and Flood Control (FC) District,
including density, setbacks and design; and
e. The time extension is within the time limits established by State law and local
ordinance. State law allows for one (1) year time extensions.
4. Based upon the facts and information contained in the application, together with all
written and oral reports included for the environmental assessment for the application, the
Planning Commission finds that no subsequent or supplemental environmental document is

required pursuant to the California Environmental Quality Act (CEQA) in connection with the
review and approval of this application based upon the following findings and determinations:
a. Pursuant to the California Environmental Quality Act (“CEQA”) and the City’s
local CEQA Guidelines, the City adopted An Environmental Impact Report on August 4, 2004, in
connection with the City’s approval of Tentative Tract Map SUBTT14749. Pursuant to CEQA
Guidelines Section 15162, no subsequent or supplemental EIR or Negative Declaration is

report was submitted as part of the request for the one (1) year time extension request. The
November 2019 report states that no substantial changes have occurred on the project site that

recommended mitigation measures that were detailed in the 2003 Tracy Development EIR, the
2011 PCR Biological Assessment, and the 2017 and 2018 ESA Biological Resource Memo are
consistent with the site conditions that were observed later 2019. Staff further finds that the project
will not have one or more significant effects not discussed in the previous Environmental Impact
Report, nor have more severe effects than previously analyzed, and that additional or different
mitigation measures are not required to reduce the impacts of the project to a level of less than
significant.
c. Based on these findings and all evidence in the record, the Planning Commission
concurs with the staff determination that no additional environmental review is required pursuant
to CEQA in connection with the City’s consideration of Tentative Tract Map SUBTT14749.
5. Based upon the findings and conclusions set forth in Paragraphs 1, 2, 3 and 4 above,
this Commission hereby grants a time extension. The new expiration date for Tentative Tract Map
SUBTT14749 is February 26, 2021.
6. All applicable Conditions of Approval in Resolution No. 20-18 for SUBTT14749 shall
apply to Time Extension DRC2019-00955.
The Secretary to this Commission shall certify to the adoption of this Resolution.

staff has determined that the project is categorically exempt from the
requirements of the California Environmental Quality Act (CEQA) and the City’s
CEQA Guidelines as a Class 32 (CEQA Guidelines Section 15332) exemption,
which covers in-fill development on no more than 5 acres substantially
surrounded by urban uses.
RECOMMENDATION:
• Approve Time Extension DRC2019-00559 for Tentative Tract Map SUBTT20026 through the
adoption of the attached Resolution of Approval.
PROJECT AND SITE DESCRIPTION:
The project site is a “double-frontage” parcel located between 19th Street on the north and
Hamilton Street on the south. Hermosa Avenue and Haven Avenue are about 950 feet and 1,425
feet to the west and east of the site, respectively. There are currently several structures including
a single-family residence on the property. The property is generally level with an elevation at the
north and south sides of about 1,441 and 1,430 feet, respectively. The existing Land Use, General
Plan and Zoning designations for the project site and adjacent properties are as follows:

move forward to the Planning Commission for final review and approval. Since no house product
was proposed, the project was not reviewed by the Design Review Committee.
ANALYSIS:
A. General: This time extension request is the first request to extend the approval period of
Tentative Tract Map SUBTT20026 for one (1) year. The original approval of SUBTT20026
was on October 26, 2016, for a time period of 3 years. The applicant filed a time extension
application on July 25, 2019, prior to the original approval’s October 26, 2019 expiration
date.
On January 6, 1999, the City Council amended the City’s Subdivision Ordinance to
establish a 3-year initial approval period for tract and parcel maps (increased from 2 years
previously). The amendment also allows the Planning Commission to grant time
extensions in 12-month increments for up to an additional 5 years (a maximum of 8 years
from the original time approval), which is the maximum allowed under the State
Subdivision Map Act Section 66452.69 (e). This application involves a third 1-year time
extension request, which would set the expiration date to October 26, 2020. The approvals
for the subject tentative tract map including the proposed time extension are outlined in
the table below:

At this time, no changes have occurred from what was previously approved, which
involves the subdivision of 1 lot into 6 lots, with 3 lots fronting 19th Street and 3 lots fronting
Hamilton Street. All lots continue to comply with the development standards applicable to
the Low (L) Residential Zoning district, as described in the Development Code.
B. Public Art: Tentative Maps are exempt from providing public art as outlined in Chapter
17.124 of the Development Code. The future development of the six (6) single-family
residences on the subject tentative map will be required to fulfill the public art requirement.
Based on the number of future residential units, the total art value required per Section
17.124.020.C. is $4,500 (6 lots X $750 per Unit).
C. Environmental Assessment: The Planning Department staff previously determined that
the project is categorically exempt from the requirements of the California Environmental
Quality Act (CEQA) and the City's CEQA Guidelines. The project qualified under the Class
32 exemption under State CEQA Guidelines Section 15332 - In-Fill Development Projects,
as the project includes in-fill development consistent with the applicable General Plan
designation and regulations. In addition, there was no substantial evidence that the project
may have a significant effect on the environment. The Planning Commission reviewed the
project and the Planning Department's determination of exemption, and based on its own
independent judgment, concurred in staff's determination of exemption on October 26,

2016. There continues to be no substantial evidence that the project may have a
significant effect on the environment.
FISCAL IMPACT:
The project proponent will be responsible for paying one-time impact fees. These fees are
intended to address the increased demand for City services due to the proposed project. The
following types of services that these impact fees would support include the following: library
services, transportation, infrastructure, drainage infrastructure, animal services, police, parks, and
community and recreation services. The proposed development will increase the value of the
project site and the parcels will be assessed an annual property tax. A percentage of this annual
tax is shared with the City.
COUNCIL GOAL(S) ADDRESSED:
Although a specific current City Council goal does not apply to this application, the proposed
tentative map time extension will further the City Council’s 2019 goal of enhancing our premier
community status by providing an opportunity for the future development of market rate for-sale
residences on the 1.68-acre infill parcel. With this time extension, the site retains the approved
entitlement to subdivide the project site into 6 single-family lots, consistent with the goals and
policies of the General Plan and the objectives of the Development Code.
CORRESPONDENCE:
This item was advertised as a public hearing with a regular legal advertisement in the Inland
Valley Daily Bulletin newspaper, the property was posted, and notices were mailed to all property
owners within a 660-foot radius of the project site. To date, no comments have been received
regarding the project notifications.

RANCHO CUCAMONGA, CALIFORNIA, APPROVING TIME EXTENSION
DRC2019-00559, A REQUEST TO ALLOW FOR THE FIRST ONE (1)
YEAR TIME EXTENSION OF A PREVIOUSLY APPROVED 6-LOT
TENTATIVE TRACT MAP (SUBTT20026) ON 1.67 ACRES OF LAND
WITHIN THE LOW (L) RESIDENTIAL DISTRICT, LOCATED AT 10235
19TH STREET; AND MAKING FINDINGS IN SUPPORT THEREOF - APN:
1076-121-03.
A. Recitals.
1. Sally Cheng filed an application for the extension of the approval of Tentative Tract
Map SUBTT20026, as described in the title of this Resolution. Hereinafter in this Resolution, the
subject Tentative Tract Map Time Extension request is referred to as "the application."
2. On October 26, 2019, the Commission adopted Resolution No. 16-52, thereby
approving the application subject to specific conditions and time limits.
3. On February 26, 2020, the Planning Commission of the City of Rancho Cucamonga
conducted a noticed public hearing on the application and concluded said hearing on that date.
4. All legal prerequisites prior to the adoption of this Resolution have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning
Commission of the City of Rancho Cucamonga as follows:
1. This Commission hereby specifically finds that all of the facts set forth in the Recitals,
Part A, of this Resolution are true and correct.
2. Based upon substantial evidence presented to this Commission during the above-
referenced public hearing on February 26, 2020, including written and oral staff reports, together
with public testimony, this Commission hereby specifically finds as follows:
a. The application applies to a 1.67-acre parcel of land located at 10235 19th Street;
and
b. The subject property is within the Low (L) Residential District and is generally
level with an elevation at the north and south sides of about 1,441 and 1,430 feet, respectively;
and
c. The subject property is surrounded by single-family residential development to
the north, east, and west, within the Low (L) Residential District. The lot to the south across
Hamilton Street, is developed with an elementary school within the Low (L) Residential District;
and
d. The subdivision of the project site conforms to all applicable development
standards of the Low (L) Residential District; and

e. This application is a request to extend the approval period of Tentative Tract Map
SUBTT20026 for one (1) additional year. The time extension is necessary to provide the applicant
time to sell the project site. The expiration date with the approval of Time Extension DRC2019-
00559 will be October 26, 2020.
3. Based upon the substantial evidence presented to this Commission during the
above-referenced public hearing and upon the specific findings of facts set forth in Paragraphs
1 and 2 above, this Commission hereby finds and concludes as follows:
a. The previously approved subdivision is consistent with the City's current General
Plan and Zoning Code. The approved project is for the subdivision of 1.67 acres of land for the
future development of 6 single-family residences. The approved subdivision is consistent with
each of the related City requirements for the project site; and
b. The site is physically suitable for the type and density of the previously approved
subdivision. The project site is well suited for the approved subdivision as there are similar
residential developments to the north, east, and west of the site; and
c. The previously approved subdivision, together with the conditions applicable
thereto, will not be detrimental to the public health, safety or welfare, or materially injurious to
properties or improvements in the vicinity. The project qualifies under the Class 32 exemption
under State CEQA Guidelines Section 15332 (In-Fill Development Project) because the project
involves the construction of development within City limits on no more than 5 acres that is
substantially surrounded by urban uses. Additionally, approval of the project would not result in
any significant effect relating to traffic, noise, air quality, or water quality; and
d. The previously approved subdivision complies with each of the applicable
provisions of the Development Code. The previously approved subdivision complies with all
development standards outlined in the Development Code for the development of single-family
lots within the Low (L) Residential District; and
e. The time extension is within the time limits established by State law and local
ordinance. State law allows for one (1) year time extensions of tentative maps.
4. The Planning Department staff previously determined that the project is categorically
exempt from the requirements of the California Environmental Quality Act (CEQA) and the City's
CEQA Guidelines. The project qualified under the Class 32 exemption under State CEQA
Guidelines Section 15332 - In-Fill Development Projects, as the project includes in-fill
development consistent with the applicable General Plan designation and regulations. In addition,
there was no substantial evidence that the project may have a significant effect on the
environment. The Planning Commission reviewed the project and the Planning Department's
determination of exemption, and based on its own independent judgment, concurred in staff's
determination of exemption on October 26, 2016. There continues to be no substantial evidence
that the project may have a significant effect on the environment.
5. Based upon the findings and conclusions set forth in Paragraphs 1, 2, 3 and 4 above,
this Commission hereby grants a one (1) year time extension. The new expiration date for
Tentative Tract Map SUBTT20026 is October 26, 2020.

The Pre-Application Review process provides an opportunity for conceptual designs to
be presented to the Planning Commission prior to a formal application submittal. The pre-
application review workshop is intended to provide broad, general comments and
direction to the applicant and staff. The focus of the workshop is a discussion by the
Planning Commissioners on the concept, function, and vision of the project. The meeting
is not a forum for debate and no formal decision or vote is made.
Attached are the exhibits for a pre-application review of a proposed mixed-use
development located at the northeast corner of Haven Avenue and 4th Street. The
proposal includes roughly 600 apartment units within two structures, three commercial
buildings, and additional commercial space along the ground floor of one of the apartment
structures. Both structures will have a “podium” design in which parking is provided on
the ground floor with three stories of apartments above it.
An oral presentation of the project will be provided by staff that will highlight the general
concept of the project and identify characteristics and features of the project for the
Commission’s review and discussion. Staff will present the areas of concern that were
shared with the applicant and topics for discussion at the meeting. Staff will also discuss
the City’s overall vision and expectations for the project and the project site. This will be
followed by a presentation by the applicant. Following the meeting, written comments
summarizing the feedback from the Commission and staff will be provided to the
applicant.
The exhibits included for your review are conceptual but represent a potential
development scenario for the project site. As the concepts and designs will be developed
and refined further by the applicant, the project will be presented to the Planning
Commission at a second follow up pre-application review workshop in the future.
