HomeMy WebLinkAbout2020-003 - ResolutionRESOLUTION NO.2020-003 A RESOLUTION OF THE CITY COUNCIL OF RANCHO CUCAMONGA, CALIFORNIA, ADOPTING A COST RECOVERY FEE RELATED TO THE ETIWANDA HEIGHTS NEIGHBORHOOD AND CONSERVATION PLAN A. Recitals. WHEREAS, the California Government Code allows the City to establish fees and charges for municipal services, provided such fees and charges do no exceed the estimated reasonable cost to the City in providing the service to which the fee or charge applies; and WHEREAS, on October 2, 2019, the Rancho Cucamonga City Council adopted the Etiwanda Heights Neighborhood & Conservation Plan (EHNCP), a new specific plan governing future development in an area including 305 acres within City boundaries, and an additional 4,393 acres in the City's Sphere of Influence that is in the process of annexation into the City; and WHEREAS, Government Code Section 65456(a) provides that the legislative body, after adopting a specific plan, may impose a specific plan fee upon persons seeking governmental approvals which are required to be consistent with the specific plan; and WHEREAS, Section 1.16.010 of the Rancho Cucamonga Municipal Code provides that the City Council may adopt a resolution to establish a specific plan fee. Now therefore, the City Council of the City of Rancho Cucamonga finds and resolves as follows: SECTION 1: The City Council hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Ordinance are true and correct. SECTION 2: The City Council hereby specifically finds that the fees and charges set forth do not exceed the estimated reasonable cost of providing the service for which the fee or charge be levied. SECTION 3: The City hereby amends Resolution 18-040, effective 60 days after the adoption of this resolution, and adopts the following fees applicable to development within the EHNCP boundaries to recover some of the costs associated with the preparation and adoption of the Etiwanda Heights Neighborhood and Conservation Plan: Fee per residential unit in the Neighborhood Area: $1,101 per unit Fee per residential unit in the Rural Conservation Area: $1,914 per unit Fee for commercial and other non-residential development: $.28 per square foot These fees will be collected prior to issuance of the Certificate of Occupancy. SECTION 4. The fees established in Section 3 above will be adjusted annually, commencing on July 1, 2020, and each year thereafter, without further action of the City Council, based on the Employee Cost Index for State and Local Government Employees, Total Compensation, during the 12 month period ending on December 31st of the immediately preceding year, as released by the U.S. Department of Labor's Bureau of Labor Statistics and rounded to the nearest whole dollar. If this index is discontinued, a replacement index, as determined by the City Council, shall be utilized. SECTION 5: The City Clerk shall certify to the adoption of the Resolution.
