AUTHORIZE THE ADVERTISING OF THE "NOTICE INVITING BIDS" FOR
THE RANCHO CUCAMONGA NEIGHBORHOOD CENTER LIGHTING
PROJECT TO BE FUNDED FROM THE COMMUNITY DEVELOPMENT
BLOCK GRANT PROGRAM, ACCOUNT NO. 28-4333-9105.
RECOMMENDATION
It is recommended that the City Council approve the plans and specification documents for the
Rancho Cucamonga Neighborhood Center Lighting Project and approve the attached Resolution
authorizing the City Clerk to advertise the "Notice Inviting Bids".
BACKGROUND/ANALYSIS
The subject project specifications have been completed and reviewed by staff and approved by the
Community Development Director. The Scope of Work will include replacement of lighting
fixtures in the Mission Room. The Engineer's estimate for improvements is $5000. Legal
advertising is scheduled for December 29, 1994 and January 10, 1995, with a pre-bid meeting
scheduled for 2:00 p.m. January 19, 1995, and bid opening at 2:00 p.m. on Thursday, February 2,
1995.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF RANCHO CUCAMONGA APPROVING PLANS AND
SPECIFICATIONS FOR THE "RANCHO CUCAMONGA
NEIGHBORHOOD CENTER LIGHTING PROJECT",IN
SAID CITY AND AUTHORIZING AND DIRECTING THE
CITY CLERK TO ADVERTISE TO RECEIVE BIDS
WHEREAS, it is the intention of the City of Rancho Cucamonga
to construct certain improvements in the City of Rancho Cucamonga.
WHEREAS, the City of Rancho Cucamonga has prepared plans and
specifications for the construction of certain improvements.
NOW, THEREFORE, BE IT RESOLVED that the plans and
specifications presented by the City of Rancho Cucamonga be and are
hereby approved as the plans and specifications for the "Rancho
Cucamonga Neighborhood Center Lighting Project".
BE IT FURTHER RESOLVED that the City Clerk is hereby
authorized and directed to advertise as required by law for the
receipt of sealed bids or proposals for doing the work specified in
the aforesaid plans and specifications, which said advertisement
shall be substantially in the following words and figures, to wit:
"NOTICe. INVITING S~.AT.RD RIDS OR PROPOSAT.S"
This project is 100% federally financed by the U.S. Department of
Housing and Urban Development (24 CFR, Part 57) and subject to
certain requirements including payment of Federal prevailing wages,
compliance with "Section 3" Affirmative Action Requirements,
Executive Order #11246 and others. The aforementioned are
described in the "Special Federal Provisions" Section of the bid
documents. Additional information pertaining to the Federal
requirements is on file with the City of Rancho Cucamonga's
Community Develpment Department.
Pursuant to a Resolution of the Council of the City of Rancho
Cucamonga, San Bernardino County, California, directing this
notice, NOTICE IS HEREBY GIVEN that the said City of Rancho
Cucamonga will receive at the Office of the City Clerk in the
offices of the City of Rancho Cucamonga, on or before the hour of
2:00 o'clock P.M. on the 2nd day of February 1995, sealed bids or
proposals for "THE RANCHO CUCAMONGA NEIGHBORHOOD CENTER LIGHTING
PROJECT" in said City.
A prebid meeting is scheduled for 2:00 P.M., Thursday, January 19,
1995, at 10500 Civic Center Drive. This meeting is to inform DBEs
of subcontracting and material supply opportunities. Bidder's
attendance at this meeting is a prerequisite for demonstrating
reasonable effort to obtain DBE participation.
Bids will be publicly opened and read immediately in the office of
the City Clerk, 10500 Civic Center Drive, Rancho Cucamonga,
California 91730.
Bids must be made on a form provided for the purpose, addressed to
the City of Rancho Cucamonga, California, marked, "Bid for
Construction of THE RANCHO CUCAMONGA NEIGHBORHOOD CENTER LIGHTING
PROJECT".
PREVAILING WAGE: Notice is hereby given that in accordance with
the provisions of California Labor Code, Division 2, Part 7,
Chapter 1, Articles i and 2, the Contractor is required to pay not
less than the general prevailing rate of per diem wages for work of
a similar character in the locality in which the public work is
performed, and not less than the general prevailing rate of per
diem wages for holiday and overtime work. In that regard, the
Director of the Department of Industrial Relations of the State of
California is required to and has determined such general
prevailing rates of per diem wages. Copies of such prevailing
rates of per diem wages are on file in the office of the City Clerk
of the City of Rancho Cucamonga, 10500 Civic Center Drive, Rancho
Cucamonga, California, and are available to any interested party on
request. The Contracting Agency also shall cause a copy of such
determinations to be posted at the job site.
MINIMUM WAGE RATE: Notice is hereby given that this project is
funded with U.S. Department of Housing and Urban Development funds
and that the rate of wages for each craft or type of workman or
mechanic employed under this contract shall be not less than as
specified under the U.S. Department of Labor General Wage Decision
in the locality in which the work is to be performed as modified
within ten (10) days prior to the bid opening date as required
under the Davis-Bacon Act. Notwithstanding the conditions
hereinabove, the California Labor Code stipulates that not less
than the general prevailing rate of per diem wages for each craft
or type of workman or mechanic needed to execute the contract in
the locality in which the work is to be performed, and not less
than the general prevailing rate of per diem wages for holiday and
overtime work as determined by the Director of Industrial Relations
of the State of California shall be paid to all workmen employed.
Where a discrepancy exists between the federal and state prevailing
wage rates, the policy of the California Department of Labor is to
require that the higher of the two prevailing wage rates shall
apply.
Pursuant to provisions of Labor Code Section 1775, the Contractor
shall forfeit, as penalty to the City of Rancho Cucamonga, not more
than fifty dollars ($50.00) for each laborer, workman, or mechanic
employed for each calendar day or portion thereof, if such laborer,
workman, or mechanic is paid less than the general prevailing rate
of wages hereinbefore stipulated for any work done under the
attached contract, by him or by any subcontractor under him, in
violation of the provisions of said Labor Code.
Attention is directed to the provisions in Sections 1777.5 and
1777.6 of the Labor Code concerning the employment of apprentices
by the Contractor or any subcontractor under him.
Section 1777.5, as amended, requires the Contractor or
subcontractor employing tradesmen in any apprenticable occupation
to apply to the joint apprenticeship committee nearest the site of
the public works project and which administers the apprenticeship
program in that trade for a certificate of approval. The
certificate will also fix the ratio of apprentices to journeymen
that will be used in the performance of the contract. The ratio of
apprentices to journeymen in such cases shall not be less than one
to five except:
A. When unemployment in the area of coverage by the joint
apprenticeship committee has exceeded an average of 15 percent in
the 90 days prior to the request of certificate, or
B. When the number of apprentices in training in the area exceeds
a ratio of one to five, or
C. When the trade can show that it is replacing at least 1/30 of
its membership through apprenticeship training on an annual basis
statewide or locally, or
D. When the Contractor provides evidence that he employs
registered apprentices on all of his contracts on an annual average
of not less than one apprentice to eight journeymen.
The Contractor is required to make contributions to funds
established for the administration of apprenticeship programs if he
employs registered apprentices or journeymen in any apprenticeable
trade on such contracts and if other Contractors on the public
works site are making such contributions.
The Contractor and subcontractor under him shall comply with the
requirements of Sections 1777.5 and 1777.6 in the employment of
apprentices.
Information relative to apprenticeship standards, wage schedules,
and other requirements may be obtained from the Director of
Industrial Relations, ex-officio the Administrator of
Apprenticeship, San Francisco, California, or from the Division of
Apprenticeship Standards and its branch offices.
Eight (8) hours of labor shall constitute a legal day's work for
all workmen employed in the execution of this contract and the
Contractor and any subcontractor under him shall comply with and be
governed by the laws of the State of California having to do with
working hours as set forth in Division 2. Part 7, Chapter 1,
Article 3 of the Labor Code of the State of California as amended.
The Contractor shall forfeit, as a penalty to the City of Rancho
Cucamonga, twenty-five dollars ($25.00) for each laborer, workman,
or mechanic employed in the execution of the contract, by him or
any subcontractor under him, upon any of the work hereinbefore
mentioned, for each calendar day du=ing which said laborer,
workman, or mechanic is required or permitted to labor more than
eight (S) hours in violation of said Labor Code.
Contractor agrees to pay travel and subsistence pay to each workman
needed to execute the work required by this contract as such travel
and subsistence payments are defined in the applicable collective
bargaining agreement filed in accordance with Labor Code Section
1773.8.
The bidder must submit with his proposal cash, cashierts check,
certified check, or bidderts bond, payable to the City of Rancho
Cucamonga for an amount equal to at least ten percent (10%) of the
amount of said bid as a guarantee that the bidder will enter into
the proposed contract if the same is awarded to him, and in event
of failure to enter into such contract said cash, cashier~s check,
certified check, or bond shall become the property of the City of
Rancho Cucamonga.
If the City of Rancho Cucamonga awards the contract to the next
lowest bidder, the amount of the lowest bidder's security shall be
applied by the City of Rancho Cucamonga to the difference between
the low bid and the second lowest bid, and the surplus, if any,
shall be returned to the lowest bidder.
BONDS: The amount of the bond to be given to secure a Faithful
Performance of the Contractor of said work shall be one hundred
percent (100%) of the contract price thereof, and an additional
bond in the amount of one hundred percent (100%) of the contract
price for said work shall be given to secure the payment of claims
for any materials or supplies furnished for the performance of the
work contracted to be done by the Contractor, or any work or labor
of any kind done thereon, and the Contractor will also be required
to furnish a certificate that he carries compensation insurance
covering his employees upon work to be done under contract which
may be entered into between him and the said City of Rancho
Cucamonga for the construction of said work.
AFFIRMATIVE ACTION: The City of Rancho Cucamonga hereby notifies
all bidders that it will affirmatively ensure that in any contract
entered into pursuant to this advertisement, minority business
enterprise will be afforded full opportunity to submit bids in
response to this invitation and will not be discriminated against
on-the grounds of race, color, sex, or national origin, in
consideration for the award.
No proposals will be considered from a Contractor whom a proposal
form has not been issued by the City of Rancho Cucamonga.
Contractor shall possess any and all contractors licenses, in form
and class as required by any and all applicable laws with respect
to any and all of the work to be performed under this contract;
including but not limited to a "C-10" (Electrical Contractor)"
License in accordance with the provisions of the Contractor's
License Law (California Business and Professions Code, Section 7000
et. seq.) and rules and regulations adopted pursuant thereto.
The Contractor, pursuant to the "California Business and
Professions Code", Section 7028.15, shall indicate his or her State
License Number on the bid, together with the expiration date, and
be signed by the Contractor declaring, under penalty of perjury,
that the information being provided is true and correct.
The work is to be done in accordance with the profiles, plans, and
specifications of the City of Rancho Cucamonga on file in the
Office of the City Clerk at 10500 Civic Center Drive, Rancho
Cucamonga, California. Copies of the plans and specifications,
available at the Community and Park Development Office, will be
furnished upon application to the City of Rancho Cucamonga and
payment of TEN DOLLARS ($10.00), said TEN DOLLARS ($10.00) is
nonrefundable.
Upon written request by the bidder, copies of the plans and
specifications will be mailed when said request is accompanied by
payment stipulated above, together with an additional
nonreimbursable payment of FIFTEEN DOLLARS ($15.00) to cover the
cost of mailing charges and overhead.
The successful bidder will be required to enter into a contract
satisfactory to the City of Rancho Cucamonga.
In accordance with the requirements of Section 9-3.2 of the General
Provisions, as set forth in the Plans and Specifications regarding
the work contracted to be done by the Contractor, the Contractor
may, upon the Contractor's request and at the Contractor's sole
cost and expense, substitute authorized securities in lieu of
monies withheld (performance retention).
The City of Rancho Cucamonga, California, reserves the right to
reject any and all bids.

of subcontracting and material supply opportunities. Bidder's

reasonable effort to obtain DBE participation.

PREVAILING WAGE: Notice is hereby given that in accordance with
the provisions of California Labor Code, Division 2, Part 7,
Chapter 1, Articles 1 and 2, the Contractor is required to pay not
less than the general prevailing rate of per diem wages for work of
a similar character in the locality in which the public work is
performed, and not less than the general prevailing rate of per
diem wages for holiday and overtime work. In that regard, the
Director of the Department of Industrial Relations of the State of
California is required to and has determined such general
prevailing rates of per diem wages. Copies of such prevailing

MINIMUM WAGE RATE: Notice is hereby given that this project is
funded with U.S. Department of Housing and Urban Development funds
and that the rate of wages for each craft or type of workman or
mechanic employed under this contract shall be not less than as
specified under the U.S. Department of Labor General Wage Decision
in the locality in which the work is to be performed as modified
within ten (10) days prior to the bid opening date as required
under the Davis-Bacon Act. Notwithstanding the conditions
hereinabove, the California Labor Code stipulates that not less
than the general prevailing rate of per diem wages for each craft
or type of workman or mechanic needed to execute the contract in
the locality in which the work is to be performed, and not less
than the general prevailing rate of per diem wages for holiday and
overtime work as determined by the Director of Industrial Relations
of the State of California shall be paid to all workmen employed.
Where a discrepancy exists between the federal and state prevailing
wage rates, the policy of the California Department of Labor is to
require that the higher of the two prevailing wage rates shall
apply.
Pursuant to provisions of Labor Code Section 1775, the Contractor
shall forfeit, as penalty to the City of Rancho Cucamonga, not more
than fifty dollars ($50.00) for each laborer, workman, or mechanic
employed for each calendar day or portion thereof, if such laborer,
workman, or mechanic is paid less than the general prevailing rate
of wages hereinbefore stipulated for any work done under the
attached contract, by him or by any subcontractor under him, in
violation of the provisions of said Labor Code.
Attention is directed to the provisions in Sections 1777.5 and
1777.6 of the Labor Code concerning the employment of apprentices
by the Contractor or any subcontractor under him.
Section 1777.5, as amended, requires the Contractor or
subcontractor employing tradesmen in any apprenticable occupation
to apply to ~he joint apprenticeship committee nearest the site of
the public works project and which administers the apprenticeship
program in that trade for a certificate of approval. The
certificate will also fix the ratio of apprentices to journeymen
that will be used in the performance of the contract. The ratio of
apprentices to journeymen in such cases shall not be less than one
to five except:
A. When unemployment in the area of coverage by the joint
apprenticeship committee has exceeded an average of 15 percent in
the 90 days prior to the request of certificate, or
B. When the number of apprentices in training in the area exceeds
a ratio of one to five, or
C. When the trade can show that it is replacing at least 1/30 of
its membership through apprenticeship training on an annual basis
statewide or locally, or
D. When the Contractor provides evidence that he employs
registered apprentices on all of his contracts on an annual average
of not less than one apprentice to eight journeymen.
The Contractor is required to make contributions to funds
established for the administration of apprenticeship programs if he
employs registered apprentices or journeymen in any apprenticeable
trade on such contracts and if other Contractors on the public
works site are making such contributions.
The Contractor and subcontractor under him shall comply with the
requirements of Sections 1777.5 and 1777.6 in the employment of
apprentices.
Information relative to apprenticeship standards, wage schedules,
and other requirements may be obtained from the Director of
Industrial Relations, ex-officio the Administrator of
Apprenticeship, San Francisco, California, or from the Division of
Apprenticeship Standards and its branch offices.
Eight (8) hours of labor shall constitute a legal day's work for
all workmen employed in the execution of this contract and the
Contractor and any subcontractor under him shall comply with and be
governed by the laws of the State of California having to do with
working hours as set forth in Division 2. Part 7, Chapter 1,
Article 3 of the Labor Code of the State of California as amended.
The Contractor shall forfeit, as a penalty to the City of Rancho
Cucamonga, twenty-five dollars ($25.00) for each laborer, workman,
or mechanic employed in the execution of the contract, by him or
any subcontractor under him, upon any of the work hereinbefore
mentioned, for each calendar day during which said laborer,
workman, or mechanic is required or permitted to labor more than
eight (8) hours in violation of said Labor Code.
Contractor agrees to pay travel and subsistence pay to each workman
needed to execute the work required by this contract as such travel
and subsistence payments are defined in the applicable collective
bargaining agreement filed in accordance with Labor Code Section
1773.8.
The bidder must submit with his proposal cash, cashier's check,
certified check, or bidder's bond, payable to the City of Rancho
Cucamonga for an amount equal to at least ten percent (10%) of the
amount of said bid as a guarantee that the bidder will enter into
the proposed contract if the same is awarded to him, and in event
of failure to enter into such contract said cash, cashier's check,
certified check, or bond shall become the property of the City of
Rancho Cucamonga.
If the City of Rancho Cucamonga awards the contract to the next
lowest bidder, the amount of the lowest bidder's security shall be
applied by the City of Rancho Cucamonga to the difference between
the low bid and the second lowest bid, and the surplus, if any,
shall be returned to the lowest bidder.
BONDS: The amount of the bond to be given to secure a Faithful
Performance of the Contractor of said work shall be one hundred
percent (100%) of the contract price thereof, and an additional
bond in the amount of one hundred percent (100%) of the contract
price for said work shall be given to secure the payment of claims
for any materials or supplies furnished for the performance of the
work contracted to be done by the Contractor, or any work or labor
of any kind done thereon, and the Contractor will also be required
to furnish a certificate that he carries compensation insurance
covering his employees upon work to be done under contract which
may be entered into between him and the said City of Rancho
Cucamonga for the construction of said work.
AFFIRMATIVE ACTION: The City of Rancho Cucamonga hereby notifies
all bidders that it will affirmatively ensure that in any contract
entered into pursuant to this advertisement, minority business
enterprise will be afforded full opportunity to submit bids in
response to this invitation and will not be discriminated against
on -the grounds of race, color, sex, or national origin, in
consideration for the award.
No proposals will be considered from a Contractor whom a proposal
form has not been issued by the City of Rancho Cucamonga.
Contractor shall possess any and all contractors licenses, in form
and class as required by any and all applicable laws with respect
to any and all of the work to be performed under this contract;
including but not limited to a Class "B" (General Contractor)-
License and a Class "C-15" (Flooring and Floor Covering Contractor)

DR 94-06, located on the south side of Jersey Boulevard, east of Milliken Avenue, in the
Minimum Impact Heavy Industrial designation (Subarea 9) of the Industrial Specific Plan was
approved by The Community Development Department, Plsning Division, on June 9, 1994.
This project is for the cormaction of a 300,000 square foot industrial building on 18.65 acres
of land.
The Redevelopment Agency is providing the guarantee for the completion of the off-site street
improvements along Jersey Boulevard in the following amounts:

The Developer. Mission Mexican Foods, Inc., is requesting that the City vacate the flood
inundation area on Parcel 22 per Amended Parcel Map 11891 (see Exhibits "C" and "D"). A
final drainage study has been approved by the City staff creating a new location of on-site
inundation areas and making the old on-site inundation areas unnecessary.
Section 8333b of the Streets and Highways Code states that local agencies may summarily
vacate Coy resolution) a public service easement wherein the date of dedication or acquisition
is less than five years, and more than a year, immediately preceding the proposed vacation,
and the easement was not used continuously since that date.
The Consent and Waiver to Annexation form signed by the Developer is on file in the City
Clerk's office.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, ORDERING THE
ANNEXATION OF CERTAIN TERRITORY TO LANDSCAPE
MAINTENANCE DISTRICT NO. 3B AND STREET LIGHTING
MAINTENANCE DISTRICT NOS. 1 AND 6 FOR DR 94-06
WHEREAS, the City Council of the City of Rancho Cucamonga, California, has previously
formed a special maintenance district pursuant to the terms of the "Landscaping and Lighting Act
of 1972', being Division 15, Pan 2 of the Streets and Highways Code of the State of California, said
special maintenance district known and designated as Landscape Maintenance District No. 3B, Street
Lighting Maintenance District No. 1 and Street Lighting Maintenance District No. 6 (hereinafter
referred to as the "Maintenance District"); and
WHEREAS, the provisions of Article 2 of Chapter 2 of the "Landscaping and Lighting Act
of 1972" authorize the annexation of additional terntory to the Maintenance District; and
WHEREAS, at this time the City Council is desirous to take proceedings to annex the
property described on Exhibit "A" attached hereto and incorporated herein by this referenced to the
Maintenance District; and
WHEREAS, all of the owners of property within the territory proposed to be annexed to the
Maintenance District have filed with the City Clerk their written consent to the proposed annexation
without notice and hearing or filing of an Engineer's "Report".
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA
HEREBY RESOLVES AS FOLLOWS:
SECTION 1: That the above recitals are all true and correct.
SECTION 2: That this legislative body hereby orders the annexation of the property as
shown in Exhibit "A" and the work program areas as described in Exhibit "B" attached hereto to the
Maintenance District.
SECTION 3: That all future proceedings of the Maintenance District, including the levy of
all assessments, shall be applicable to the terntory.

RECOMM~.NDATIONS
It is recommended that the City Council accept all bids as submitted and award and authorize for
execution, the contract for Right-Turn Lane at Archibald Avenue and Base Line Road, to the lowest
responsive bidder, EGN Construction, Inc., for the amount of $129,834.00 and authorize the
Administrative Services Director to expend $142,817.40 ($129,834.00 plus 10% contingency), to be
funded from Gas Tax Account No. 09-4637-9211.
BACKGROUND/ANAl ,YSIS
Per previous Council action, bids were solicited, received and opened on May 10, 1994, for the Right-
Turn Lane at Archibald Avenue and Base Line Road. The proposed project generally consists of
removal and placement of curb and gutter, placement of asphalt concrete pavement, traffic signal
relocation and storm drain modification to provide for a northbound right-turn lane on Archibald
Avenue at Base Line Road. The intersection of Archibald and Base Line is fully improved and the
above proposed modifications are necessary to provide for the proposed right-turn lane.
EGN Construction, Inc. is the apparent lowest responsive bidder, with a bid amount of $129,834.00
(see attached bid summary). The Engineer's estimate was $110,861.00. Staff has reviewed all bids
received and found them to be complete and in accordance with the bid requirements. Staff has
completed the required background investigation and finds all bidders to meet the requirements of the
bid documents.

APPROVAL OF JOINT FACILITIES USE AGREEMENT BETWEEN THE CITY OF
RANCHO CUCAMONGA AND THE ETIWANDA SCHOOL DISTRICT
RECOMMENDATION: Staff recommends entering into an agreement with the Etiwanda School District
for joint use of facilities. The agreement involves no additional costs to the City or District.
BACKGROUND: In 1987, the City and District entered into an agreement for joint use of Windrows
Elementary School and Windrows Park. This agreement has been very. successful for both parties. Since
that time, additional schools have been built or planned in the Etiwanda School District adjacent to City
parks. The use of these park sites greatly enhances the school programs. Also, the recreational needs of the
City and community groups have likewise grown. These community recreation programs are
accommodated at the school multi-purpose rooms or on school fields. Therefore, a long-term joint use
agreement between the City and District would be in the best interest of both parties.
ANALYSIS: The agreement with the Etiwanda School District is a thirty (30) year agreement. It provides
the following:
City use of multi-purpose rooms, classes and school play areas during non-school hours; minimum use
of 3.5 hours per day, two days a week.
· School use of specified park space during school hours. Traditionally, this space is limited to ball fields
and does not include playgrounds, picnic areas or restrooms.
Each agency is responsible for supervision, signage and general maintenance. Additional expenses are the
responsibility of the using party.
Both City and School District staff shall prepare annual and quarterly calendar of activities to ensure proper
usage and overall communication.

JOINT FACILITIES USE AGREEMENT

This Agreement is made and entered into this 21st day of December, 1994, by
and between the CITY OF RANCHO CUCAMONGA, a Municipal Corporation (hereinafter
referred to as "CITY"), and the ETIWANDA SCHOOL DISTRICT (hereinafter referred to
as "DISTRICT"), as an addendum to that certain Facilities Use Agreement heretofore
entered by and between the parties hereto, and setting forth rights and obligations with
respect to specific property to be jointly used, as described herein.
A. Recitals.
(i) CITY and DISTRICT have heretofore entered into a Facilities Use Agreement
setting forth general rights and obligations with respect to the joint use of CITY and
DISTRICT property (hereinafter referred to as "the Master Agreement.")
(ii) CITY desires to allow DISTRICT to use certain CITY-owned property, and
DISTRICT desires to allow CITY to use certain DISTRICT-owned property.
B. Agreement.
NOW, THEREFORE, IT IS AGREED by and between CITY and DISTRICT as
follows:
1. This Agreement shall be effective from July 1, 1994 to June 30, 2024, unless
sooner terminated by either party providing thirty (30) days written notice of such intent
to terminate to the other at its respective principal place of business.
2. This Agreement shall concern the following described DISTRICT property
and/or facility ("the DISTRICT property" hereina~er): All schools located within the
boundaries of the city of Rancho Cucamonga. Multipurpose rooms, hardcourt play
areas, turf play areas and classrooms not used by instructional staff will be available for

use. Additional request not covered by this agreement will be considered on an
individual basis. The District will be responsible for applicable signage located on
District-owned property.
3. Obligations of CITY with respect to its use of the DISTRICT property or
facilities will be as stipulated in the general agreement and include the following: a
calendar of activities will be prepared with mutual input and agreement by the CITY and
the District schools, keys to needed facilities may be issued to City personnel, and the
CITY will provide adequate supervision of the activities it sponsors in District facilities.
4. This Agreement shall concern the following described CITY property and/or
facility ("the CITY property" hereinafter): Portions of CITY-owned park space that would
be designated for school use. The CITY will be responsible for applicable signage
located on CITY-owned property.
5. Obligations of DISTRICT with respect to its use of the CITY property or
facilities will be as stipulated in the general agreement and will include the following: A
calendar of activities will be prepared with mutual input and agreement by the District
schools and the CITY, and the schools will provide adequate supervision of the activities
it sponsors on CITY-owned property.
6. Except as may be expanded by the "master schedule" described in
paragraph 8, below, the DISTRICTs minimum use of the CITY property is as follows:
Monday through Friday, 7:30 a.m. to 4:00 p.m., excluding weekends and holidays for
exterior facilities. Use of interior space will be by mutual agreement on an individual
basis.

7. Except as may be expanded by the "master schedule" described in
paragraph 8, below, the CITY's minimum use of the DISTRICT property is as follows:
Will be 3.5 hours per night, alternating evenings, and a minimum use of two nights per
week.
8. To avoid conflicts in usage of the property, CITY and DISTRICT agree to
mutually develop and to thereafter abide by a master schedule setting forth dates and
times each party hereto shall be entitled to use the property, including where necessary,
descriptions of which baseball diamonds, tennis courts, multipurpose rooms, etc., are
reserved for use by the CITY or DISTRICT.
Notwithstanding the foregoing, the party owning the property may permit its use
for any and all of its activities not in conflict with the hours of its operations thereon.
The master schedule referred to herein may be modified at any time upon thirty
(30) days prior written notice to the user.
9. It shall be the sole responsibility of the party providing or sponsoring the
activity to provide any supervision on the property.
10. The party providing or sponsoring the activity shall be solely responsible for
obtaining any necessary permits, licenses or other necessary approvals with respect to
the activities to be conducted on the property.
11. The parties agree, upon completion of each use of the property, that the
property shall be left free and clear of any and all litter, waste and/or refuse left by any
of the participants involved in the activities.

12. The provision of food or drink shall not be permitted on the property, or
inside buildings unless mutually agreed to by both parties.
13. Payment of costs in providing utilities to the property, including, but not
limited to, electrical power and water, shall be the responsibility of the party owning the
property.
14. The party providing or sponsoring the activity may utilize all equipment,
fixtures and apparatus existing on the property which is consistent with and necessary
to the activities. Additional equipment will be provided by the party sponsoring the
activity. Prior to being used, the additional equipment must be approved by both parties.
15. Custodial service, normal maintenance and upkeep of the property and the
equipment, fixtures and apparatus thereon, shall be the responsibility of the party owning
the property.
16. DISTRICT and CITY agrees to abide by, and cause its participants to abide
by, any and all policies and procedures of which they have been previously made aware,
in writing or by virtue of this Agreement or the Use Agreement, which are applicable to
the property or facilities to be used.
17. The terms of this Agreement may be mutually modified in writing by the
parties hereto at any time during the term hereof. Authorized representatives of the
parties hereto shall be authorized to amend, by written mutual consent, Sections 3, 5,
12, 13 and/or 14 hereof, without affecting the validity of this Agreement.
18. This Agreement supersedes and preempts any inconsistent provisions
contained in the Use Agreement. Excepting only such inconsistent provisions, each and

every other provision of the Facilities Use Agreement shall continue in full force and
effect throughout its term. In the event the Facilities Use Agreement is terminated, this
Addendure shall terminate concurrently therewith, unless the parties hereto otherwise
mutually agree in writing.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement as of
the day and year first above written.

RECOMMFNDATIONS
It is recommended that the City Council adopt the attached resolution approving an agreement
of Revocation, Release, Satisfaction and Cancellation of Agreement for Tract 14486 and
authorizing the Mayor and City Clerk to sign said agreement and to cause same to record.
BACKGROUND/ANAl .YSIS
On April 1, 1992, the City Council entered into an agreement to allow the postponement of
CC & R's for Tract 14486. The agreement was recorded on May 19, 1992.
The CC & R's are now completed and recorded; therefore, the previous agreement to assure
their preparation may now be released.
A copy of the release agreement is available in the City Clerk's office.

Approve the attached letter of support for Wesley Chesbro.
Backgronnd
Wesley Chesbro has served as a Boardmember to the California Integrated Waste
Management Board (CIWB) since 1990. As a member of the CIWB, Mr. Chesbro has
worked to promote waste prevention and recycling to save money, produce jobs, and
protect the environment. As a Boardmember, Mr. Chesbro also assisted the City of
Rancho Cucamonga with a number of process issues associated with the submittal of the
City's Source Reduction and Recycling Element.
Mr. Chesbro's background includes 16 years as a City Council member and County
Supervisor before he was appointed to the California Integrated Waste Management
Board. He was appointed by the Senate Rules Committee after a grassroots support
campaign by local elected officials from all over the State.
Mr. Chesbro has also served for ten years as a member of the Local Government
Commission Board of Directors and has been a champion of progressive local
government solutions to environmental and social problems for over twenty years. His
experience continues to help local governments.

environment. At the same time, he has sought to make sure that implementation of AB
939 is not oppressive and overly restrictive on cities and counties who are taking the
recycling law seriously and working to implement the law.

DISCUSSION OF AN ORDINANCE TO PREVENT CONVENIENCE STORE
ROBBERIES
The Public Safety Subcommittee has had opportunity to review the Gainesville
Convenience Store Ordinance and the comments received in the workshops
and at the Planning Commission. After reviewing this information we would
recommend that we adopt a similar ordinance in Rancho Cucamonga.
As you recall, the key provisions of the Gainesrifle ordinance are:
1. Removal of signs posted in windows to provide a clear and
unobstructed view of the cash register and sales area;
2. Locate sales area so that the clerk and customer are clearly
visible from the street;
3. Post a conspicuous sign in the window which states:
a) the cash register has $50 or less,
b) employee has access to $50 or less, and
c ) a drop-safe or time release safe is maintained in the store:
4. Parking lots are to be lit at an intensity of 2-foot candles per
square foot, with a uniformity ratio of no more than 5:i;
5. Install a security camera of a type and number approvcd by the
city;
6. Provide mandatory robbery prevention training to all employees
who work between the hours of 7 PM and 5 AM:
7. Require two employees be on duty between the hours of 8 PM and
4 AM.

With the exception of requiring two clerks after 8 P.M., the subcommittee
would like to see a similar ordinance enacted. The subcommittee recommends
that staff be directed to take the attached draft ordinance to the Chamber of
Commerce and convenience store representatives for final comments and that
the ordinance and the comments be brought back to the City Council for first
reading.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMONGA, CALIFORNIA, ADDING ANEW CHAgTER 9.28 TO THE
Ri~NCHOCUCAMONGAMUNICIPALCODE ESTABLISHING REGULATIONS
PERTAINING TO CONVENIENCE FOOD STORES.
WHEREAS, homicides and robberies at Convenience Food Stores between the
hours of 8 p.m. and 4 a.m. may result in loss of life and/or property and is
contrary to the public health and safety and the welfare of the employees and
customers of Convenience Food Stores; and
WHEREAS, these regulations provide essential requirements that will
minimize or eliminate a significant number of incidents of homicide and/or
robbery at Convenience Food Stores; and
WHEREAS, on August 23, 1994, a public workshop was conducted to obtain
public input; and
WHEREAS, on , 1994, the City Council conducted and
concluded a duly noticed pubic hearing concerning the subject amendment to the
Municipal Code; and
WHEREAS, all legal prerequisites prior to the adoption of this Ordinance
have occurred.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Rancho
Cucamonga, California:
SECTION 1: The Rancho Cucamonga Municipal Code is hereby amended to add
a new Chapter 9.28, to read, in words and figures, as follows:
Chapter 9.28
CONV~.NIENCE FOOD STORRS.
Sections:
9.28.010 Definitions.
9.28.020 Regulations.
9.28.010 Definitions. The following terms and phrases, when used
in this Chapter, shall have the meanings ascribed to them in this
Section, except where the context clearly indicates a different meaning:
A. "Convenience Food Store" is a business establishment that:

1. Derives 50 percent or more of its gross income, excluding
motor fuels, from the sale of goods, merchandise, or other articles of
value in their original containers; and
2. Offers a limited quantity and variety of food, household,
and sundry items; and
4 a.m.; and
Operates at any time between the hours of 8 p.m. and
4. Does not sell or have for sale prescription drug items.
B. "Owner" is the person, corporation, partnership, joint venture,
or other group enterprise having lawful possession of the premises upon
which the Convenience Food Store is operated.
C. "Employee" is the person, corporation, partnership, joint
venture, or group enterprise legally responsible for the day-to-day
operation of the Convenience Store.
9.28.020 Recrulations. All Convenience Food Stores shall comply
with the following regulations:
A. Locate any signs posted in the windows so as to provide a clear
and unobstructed view of the cash register and sales area from the
street.
B. Locate the sales area so that the clerk and customer are fully
visible from the street at the time of the sales transaction.
C. Post a conspicuous sign, not exceeding 2 square feet in area,
in the window which states the cash register has $50.00 cash or less in
it.
D. Have no more than $50.00 cash available and readily accessible
to employees.
E. Maintain a drop-safe or time release safe at the Convenience
Food Store which is bolted to the floor or installed in the floor or
weighs at least 500 pounds.
F. Post a conspicuous sign, not exceeding 2 square feet in area,
in the window which states that there is a safe at the store and it is
not accessible to the employees.

G. The entire area of the parking lot area utilized by customers
of the Convenience Food Store must be lighted during all hours of
darkness when the employees and/or customers are on the premises as
follows:
1. Minimum average maintained il!uminance must be two foot
candles or greater with a uniformity ratio (average to minimum) of no
more than 5:1.
2. Additionally, all such lighting shall be in accordance with
the applicable City's Lighting Code requirements, and shall be verified
through the submittal of a detailed lighting plan to the Planning
Commission and the Crime Prevention Bureau of the Rancho Cucamonga Police
Department.
H. Install a security camera of a type and number approved by the
City Manager or his designee. Said camera must be capable of producing
a retrievable image on film or tape that can be made a permanent record
and that can be enlarged through projection or other means. Cameras
meeting the requirements of this section shall be maintained in proper
working order at all times and shall be subject to periodic inspection
by the City Manager or his designee.
I. Any owner or employee who works between the hours of 7 p.m. and
5 a.m. at a Convenience Food Store shall complete a course in Robbery
Prevention to be given by the Rancho Cucamonga Police Department, or a
program certified by the City Manager or his designee, within 30 days
after he or she begins employment. If the Rancho Cucamonga Police
Department's Robbery Prevention course is utilized, the City Manager or
his designee shall determine the cost of training per employee to the
City and the Convenience Food Store shall pay the cost to the Rancho
Cucamonga Police Department prior to the training of the employee.
S~CTION 2: If any section, subsection, sentence, clause, phrase, or
portion of this Ordinance is for any reason deemed or held to be invalid or
unconstitutional by the decision of any court of competent jurisdiction, such
decision shall not affect the validity of the remaining portion of this
Ordinance. The City Council of the City of Rancho Cucamonga hereby declares that
it would have adopted this Ordinance and each section, subsection, sentence,
clause, phrase, or portion thereof, irrespective of the fact that any one or more
sections, subsections, sentences, clauses, phrases, or other portions might
subsequently be declared invalid or unconstitutional.
SECTION 3: The Mayor shall sign this Ordinance and the City Clerk shall
cause the same to be published within 15 days after its passage at least once in
the Inland V~lley Daily Bulletin, a newspaper of general circulation published
in the City of Ontario, California, and circulated in the City of Rancho
Cuca~onga, California.

STATUS REPORT ON OLD LIBRARY BUILDING AT LIONS COMMUNITY
PARK
At the December 7, 1994 City Council Meeting, staff was requested to provide a status report on the
Old Library Building at Lions Community Park.
The County Library will be vacating the Old Library Building by the end of December 1994. The
original building was constructed in 1964, and major renovation work would be required to convert
the building into a usable programming facility such as the Lions Community Center. The Old
Library Renovation Project is anticipated to be considered in the upcoming 1995/96 Annual Budget
process.
The Community Services staff has discussed possible recreation programs and uses for the Old
Library Building. One recommendation would be to utilize the Old Library Building for youth
oriented programs such as Playschool classes, teen programs, and family oriented classes and
programs. Lions Community Center could then be used for community-wide programs such as
recreation classes and for community rentals as is currently scheduled at the Center.
The planning process for the Old Library can be expedited by proceeding with the preparation of a
request for proposal for the conceptual design and development for the Renovation Project. Staff
will bring this item for Council consideration in January 1995, and the Project construction can
commence in the new 1995/96 fiscal year.
It should be noted that plans are in progress for a major renovation project for the Lions Community
Center. This project would provide handicapped accessibility to the Center as well as a major
upgrading and facelift of the facility. Staff recommends that this project commence after the Old
Library Building has been renovated. Current programs at the Lions Community Center could then
be temporarily transferred to the Old Library Building while Lions is under construction. This
would insure the least disruption of recreation programs to the public.

The Rancho Cucamonga Neighborhood Center is home to the Senior Citizen and Human Services
Programs outlined in attached Exhibit "A." These programs include the senior nutrition program,
senior classes, senior monthly special events, billiards. Commodities (surplus food program),
English as a Second Language (ESL), Information and Referral Program, etc.
The Neighborhood Center also serves as a Community Center and offers a playschool program
during the day, recreation classes in the late afternoons and evenings, and facility rentals for the
