A. CALL TO ORDER
A regular meeting of the Rancho Cucamonga City Council was held on Wednesday, September 21, 1994, in
the Council Chambers of the Civic Center, located at 10500 Civic Center Drive, Rancho Cucamonga,
California. The meeting was called to order at 7:16 p.m. by Mayor Dennis L. Stout.
Present were Councilmembers: William J. Adexander, Chades J. Buquet II, Rex Gutierrez, Diane Willjams, and

B2. Presentation of Proclamation declaring the week of September 19 through 25, 1994 as "Pollution
Prevention Week' in Rancho Cucamonga.
Mayor Stout presented the proclamation to Bob Zetterberg, Integrated Waste Coordinator.
B3. Presentation of Proclamation declaring the week of September 24 through 30, 1994 as Code
Enforcement Week.
Mayor Stout presented the proclamation to Brad Buller, City Planner.
B4. Mayor Stout presented a proclamation to Hank Stickhey of the Quakes organization for winning the Cal
League Championship. A special appearance was also made by Tremor. Addffionally, Mr. Stickney made a
special presentation to the Council.

Kim Aylor, reskient, business owner and candidate for Mayor, commented on the political signs placed
throughout the City. He stated he would volunteer his staff and time to help Don Kurth remove them.
He stated he would not put his s~gns up any earlier than October 9 and encouraged all the candidates
to do the same.

Mayor Stout opened the meeting for public hearing. Addressing the City Council was:
John Mannedno, 9333 Base Line road, representing Sam's Place, stated they are ready to abandon
the bar and will hopefully find another place for its location. He stated they would like for Sam's sons
to take over the restaurant allowing for coin operated machines and one night karaoke. He continued
to state they are reapplying for a beer and wine license. He stated he has talked to the landlord, who
will allow Mr. Pellegdno's son to continue at the premises as a restaurant. He also commented on the
conditions they were asked to take care of at the previous Council meeting.
Councilmember Gutierrez asked if there has been any complaints form residents over the summer.
Nancy Fong, Sr. Planner, stated they have not heard of any.

Mayor Stout felt Foothill Boulevard should be considered in working on this project.
Coundlmember Willjams asked if there could be suppoffing documentation as to the ones that are existing and
would be affected, and asked for supportive data from the Police Department giving past history on those
particular sites. She felt a matrix of some sort would help.
Mayor Stout felt it should come back to the City Council before it goes to the Planning Commission.

Mark Davidson stated he is getling ready to sign a lease at the Terra V~sta Town enter and stated he

Councilmember Williams stated she was present at a meeting recently with Councilmember Alexander
whereby Assembly man Fred Aguiar spoke on the subject and quoted him by saying "No. 3 - experts reviewing
the document indicates that the mandates and goals contained in the FIP are based on technology that does
not currently exist." She stated she felt this says an awful lot for the kinds of things we are trying to deal with.
She felt the City needed to be more aggressive and outspoken about this kind of treatment and felt the city
should move forward on this.

MONITORING SYSTEM PROJECT TO BE FUNDED FROM THE
COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM, ACCOUNT
NO. 28-4333-93 15.
RECOMMENDATION
It is recommended that the City Council approve the specification documents for the Rancho
Cucamonga Neighborhood Center CCTV and Monitoring System Project and approve the
attached Resolution authorizing the City Clerk to advertise the "Notice Inviting Bids".
BACKGROUND/ANALYSIS
The subject project specifications have been completed and reviewed by staff and approved by the
Community Development Director. The Scope of Work will include the addition of a video
monitor and recorder at the Reception desk, a camera at each public entry, and a sound attenuator
(chime) for the south public entry. The Engineer's estimate for improvements is $3500.00. Legal
advertising is scheduled for December 15 and 27, 1994, with a pre-bid meeting scheduled for 2:00
p.m. January 12, 1995, and bid opening at 2:00 p.m. on Thursday, January 19, 1995.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF RANCHO CUCAMONGA APPROVING PLANS AND
SPECIFICATIONS FOR THE "RANCHO CUCAMONGA
NEIGHBORHOOD CENTER CCTV AND MONITORING SYSTEM
PROJECT",IN SAID CITY AND AUTHORIZING AND
DIRECTING THE CITY CLERK TO ADVERTISE TO
RECEIVE BIDS
WHEREAS, it is the intention of the City of Rancho Cucamonga
to construct certain improvements in the City of Rancho Cucamonga.
WHEREAS, the City of Rancho Cucamonga has prepared plans and
specifications for the construction of certain improvements.
NOW, THEREFORE, BE IT RESOLVED that the plans and
specifications presented by the City of Rancho Cucamonga be and are
hereby approved as the plans and specifications for the "Rancho
Cucamonga Neighborhood Center CCTV and Monitoring System Project".
BE IT FURTHER RESOLVED that the City Clerk is hereby
authorized and directed to advertise as required by law for the
receipt of sealed bids or proposals for doing the work specified in
the aforesaid plans and specifications, which said advertisement
shall be substantially in the following words and figures, to wit:
"NOTICR INVITING SRAI.RD RIDS OR PROPOSAl.S-
This project is 100% federally financed by the U.S. Department of
Housing and Urban Development (24 CFR, Part 57) and subject to
certain requirements including payment of.Federal prevailing wages,
compliance with "Section 3" Affirmative Action Requirements,
Executive Order #11246 and others. The aforementioned are
described in the "Special Federal Provisions" Section of the bid
documents. Additional information pertaining to the Federal
requirements is on file with the City of Rancho Cucamonga's
Community Develpment Department.
Pursuant to a Resolution of the Council of the City of Rancho
Cucamonga, San Bernardino County, California, directing this
notice, NOTICE IS HEREBY GIVEN that the said City of Rancho
Cucamonga will receive at the Office of the City Clerk in the
offices of the City of Rancho Cucamonga, on or before the hour of
2:00 o'clock P.M. on the 19th day of January 1995, sealed bids or
proposals for "THE RANCHO CUCAMONGA NEIGHBORHOOD CENTER ROOFING
PROJECT" in said City.
A prebid meeting is scheduled for 2:00 P.M., Thursday, January 12,
1995, at 10500 Civic Center Drive. This meeting is to inform DBEs
of subcontracting and material supply opportunities. Bidder's
attendance at this meeting is a prerequisite for demonstrating
reasonable effort to obtain DBE participation.
Bids will be publicly opened and read immediately in the office of
the City Clerk, 10500 Civic Center Drive, Rancho Cucamonga,
California 91730.
Bids must be made on a form provided for the purpose, addressed to
the City of Rancho Cucamonga, California, marked, "Bid for
Construction of THE RANCHO CUCAMONGA NEIGHBORHOOD CENTER CCTV
AND MONITORING SYSTEM PROJECT".
PREVAILING WAGE: Notice is hereby given that in accordance with
the provisions of California Labor Code, Division 2, Part 7,
Chapter 1, Articles 1 and 2, the Contractor is required to pay not
less than the general prevailing rate of per diem wages for work of
a similar character in the locality in which the public work is
performed, and not less than the general prevailing rate of per
diem wages for holiday and overtime work. In that regard, the
Director of the Department of Industrial Relations of the State of
California is required to and has determined such general
prevailing rates of per diem wages. Copies of such prevailing
rates of per diem wages are on file in the office of the City Clerk
of the City of Rancho Cucamonga, 10500 Civic Center Drive, Rancho
Cucamonga, California, and are available to any interested party on
request. The Contracting Agency also shall cause a copy of such
determinations to be posted at the job site.
MINIMUM WAGE RATE: Notice is hereby given that this project is
funded with U.S. Department of Housing and Urban Development funds
and that the rate of wages for each craft or type of workman or
mechanic employed under this contract shall be not less than as
specified under the U.S. Department of Labor General Wage Decision
in the locality in which the work is to be performed as modified
within ten (10) days prior to the bid opening date as required
under the Davis-Bacon Act. Notwithstanding the conditions
hereinabove, the California Labor Code stipulates that not less
than the general prevailing rate of per diem wages for each craft
or type of workman or mechanic needed to execute the contract in
the locality in which the work is to be performed, and not less
than the general prevailing rate of per diem wages for holiday and
overtime work as determined by the Director of Industrial Relations
of the State of California shall be paid to all workmen employed.
Where a discrepancy exists between the federal and state prevailing
wage rates, the policy of the California Department of Labor is to
require that the higher of the two prevailing wage rates shall
apply.
Pursuant to provisions of Labor Code Section 1775, the Contractor
shall forfeit, as penalty to the City of Rancho Cucamonga, not more
than fifty dollars ($50.00) for each laborer, workman, or mechanic

employed for each calendar day or portion thereof, if such laborer,
workman, or mechanic is paid less than the general prevailing rate
of wages hereinbefore stipulated for any work done under the
attached contract, by him or by any subcontractor under him, in
violation of the provisions of said Labor Code.
Attention is directed to the provisions in Sections 1777.5 and
1777.6 of the Labor Code concerning the employment of apprentices
by the Contractor or any subcontractor under him.
Section 1777.5, as amended, requires the Contractor or
subcontractor employing tradesmen in any apprenticable occupation
to apply to the joint apprenticeship committee nearest the site of
the public works project and which administers the apprenticeship
program in that trade for a certificate of approval. The
certificate will also fix the ratio of apprentices to journeymen
that will be used in the performance of the contract. The ratio of
apprentices to journeymen in such cases shall not be less than one
to five except:
A. When unemployment in the area of coverage by the joint
apprenticeship committee has exceeded an average of 15 percent in
the 90 days prior to the request of certificate, or
B. When the number of apprentices in training in the area exceeds
a ratio of one to five, or
C. When the trade can show that it is replacing at least 1/30 of
its membership through apprenticeship training on an annual basis
statewide or locally, or
D. When the Contractor provides evidence that he employs
registered apprentices on all of his contracts on an annual average
of not less than one apprentice to eight journeymen.
The Contractor is required to make contributions to funds
established for the administration of apprenticeship programs if he
employs registered apprentices or journeymen in any apprenticeable
trade on such contracts and if other Contractors on the public
works site are making such contributions.
The Contractor and subcontractor under him shall comply with the
requirements of Sections 1777.5 and 1777.6 in the employment of
apprentices.
Information relative to apprenticeship standards, wage schedules,
and other requirements may be obtained from the Director of
Industrial Relations, ex-officio- the Administrator of
Apprenticeship, San Francisco, California, or from the Division of
Apprenticeship Standards and its branch offices.
Eight (8) hours of labor shall constitute a legal day's work for
all workmen employed in the execution of this contract and the
Contractor and any subcontractor under him shall comply with and be
governed by the laws of the State of California having to do with
working hours as set forth in Division 2. Part 7, Chapter 1,
Article 3 of the Labor Code of the State of California as amended.
The Contractor shall forfeit, as a penalty to the City of Rancho
Cucamonga, twenty-five dollars ($25.00) for each laborer, workman,
or mechanic employed in the execution of the contract, by him or
any subcontractor under him, upon any of the work hereinbefore
mentioned, for each calendar day during which said laborer,
workman, or mechanic is required or permitted to labor more than
eight (8) hours in violation of said Labor Code.
Contractor agrees to pay travel and subsistence pay to each workman
needed to execute the work required by this contract as such travel
and subsistence payments are defined in the applicable collective
bargaining agreement filed in accordance with Labor Code Section
1773.8.
The bidder must submit with his proposal cash, cashier's check,
certified check, or bidder's bond, payable to the City of Rancho
Cucamonga for an amount equal to at least ten percent (10%) of the
amount of said bid as a guarantee that the bidder will enter into
the proposed contract if the same is awarded to him, and in event
of failure to enter into such contract said cash, cashier's check,
certified check, or bond shall become the property of the City of
Rancho Cucamonga.
If the City of Rancho Cucamonga awards the contract to the next
lowest bidder, the amount of the lowest bidder's security shall be
applied by the City of Rancho Cucamonga to the difference between
the low bid and the second lowest bid, and the surplus, if any,
shall be returned to the lowest bidder.
The amount of the bond to be given to secure a faithful performance
of the contract for said work shall be one hundred percent (100%)
of the contract price thereof, and an additional bond in an amount
equal to fifty percent (50%) of the contract price for said work
shall be given to secure the payment of claims for any materials or
supplies furnished for the performance of.the work contracted to be
done by the Contractor, or any work or labor of any kind done
thereon, and the Contractor will also be required to furnish a
certificate that he carries compensation insurance covering his
employees upon work to be done under contract which may be entered
into between him and the said City of Rancho Cucamonga for the
construction of said work.
BONDS: The amount of the bond to be given to secure a Faithful
Performance of the Contractor of said work shall be one hundred
percent (100%) of the contract price thereof, and an additional
bond in the amount of one hundred percent (100%) of the contract
price for said work shall be given to secure the payment of claims
for any materials or supplies furnished for the performance of the
work contracted to be done by the Contractor, or any work or labor
of any kind done thereon.

AFFIRMATIVE ACTION: The City of Rancho Cucamonga hereby notifies
all bidders that it will affirmatively ensure that in any contract
entered into pursuant to this advertisement, minority business
enterprise will be afforded full opportunity to submit bids in
response to this invitation and will not be discriminated against
on the grounds of race, color, sex, or national origin, in
consideration for the award.
No proposals will be considered from a Contractor whom a proposal
form has not been issued by the City of Rancho Cucamonga.
Contractor shall possess any and all contractors licenses, in form
and class as required by any and all applicable laws with respect
to any and all of the work to be performed under this contract;
including but not limited to a Class "C-7" (Low Voltage
Contractor), or a "C-10" (Electrical Contractor)" License in
accordance with the provisions of the Contractor's License Law
(California Business and Professions Code, Section 7000 et. seq.)
and rules and regulations adopted pursuant thereto.
The Contractor, pursuant to the "California Business and
Professions Code", Section 7028.15, shall indicate his or her State
License Number on the bid, together with the expiration date, and
be signed by the Contractor declaring, under penalty of perjury,
that the information being provided is true and correct.
The work is to be done in accordance with the profiles, plans, and
specifications of the City of Rancho Cucamonga on file in the
Office of the City Clerk at 10500 Civic Center Drive, Rancho
Cucamonga, California. Copies of the plans and specifications,
available at the Community and Park Development Office, will be
furnished upon application to the City of Rancho Cucamonga and
payment of TEN DOLLARS ($10.00), said TEN DOLLARS ($10.00) is
nonrefundable.
Upon written request by the bidder, copies of the plans and
specifications will be mailed when said request is accompanied by
payment stipulated above, together with an additional
nonreimbursable payment of FIFTEEN DOLLARS ($15.00) to cover the
cost of mailing charges and overhead.
The successful bidder will be required to enter into a contract
satisfactory to the City of Rancho Cucamonga.
In accordance with the requirements of Section 9-3.2 of the General
Provisions, as set forth in the Plans and Specifications regarding
the work contracted to be done by the Contractor, the Contractor
may, upon the Contractor's request and at the Contractor's sole
cost and expense, substitute authorized securities in lieu of
monies withheld (performance retention).
The City of Rancho Cucamonga, California, reserves the right to
reject any and all bids.

WASTE OIL BLOCK GRANT
RECOMMENDATION
It is recommended that the City Council of Rancho Cucamonga approve a resolution for a
Waste Oil Block Grant application.
BACKGROUND
In 1991, the Legislature passed AB 2076(Sher), the California Oil Recovery
Enhancement Act(Act). The Act requires oil manufactures to pay $0.04 to the California
Integrated Waste Management Board for each quart of lubricating oil sold in the State of
California, beginning October 1, 1992. This Act includes a ten million dollar government
"block grant" program. Block grant funds are available to governmental agencies to
establish and administer used oil collection programs.
ANALYSIS
The Block Grant funds are non-competitive and have very few requirements. The
requirements are; the funds must be used for Oil Recycling related programs only, the
City pass a resolution, and there be one certified center per 100,000 population within the
City limits. Block Grant funds are based on per capita (116,480) of the City, at rate $.31
per resident, equating to $36,110.00 for the City of Rancho Cucamonga. However, if a
City does not have a certified center per one hundred thousand residents that City is only
eligible for one half the grant amount. Currently, there are no State certified drop off
centers within the City of Rancho Cucamonga. Without a State Certified Collection
Center the City of Rancho Cucamonga will be entitled to $18,000.00 in grant funds. We
are working with a consulting firm that specializes in waste oil programs, to encourage a
business to become a State Certified Center for waste oil collection. Funding to seek
participation as a State Certified Center is part of a previous Used Oil Block Grant that
will end in June of 1995.
PROGRAM ANALYSIS
In 1993 the City of Rancho Cucamonga received a Used Oil Block Grant to upgrade its
Household Hazardous Waste site, provide for staff time at the used oil collection center,
provide used oil containers to the community, and promote the used oil program.
The following is an overview of what staff has proposed in the 1994/95 Used Oil
Recycling Block Grant.
Identify potential collection centers, beside the City's HHW site and
certified centers.
Provide the costs of operating the existing HHW site at station #3. i.e.
waste oil recycling\disposal costs and staff salaries.
Outreach programs that will get the message out to the community
through, flyers, mailings, and posters.
Informing and educating the public why they should recycle waste oil is an on-going pan
of both AB 939 and National Pollutant Discharge Elimination System (NPDES). Grant
funds will be used to get this message out and meet the requirements of these
environmental programs.
An adopted Resolution is to be submitted with the application. When Council approves
the attached Resolution a copy will be sent to the Board with the completed package.
Staff is recommending that Council approve the attached resolution in order to complete
the application package.

FOR GRANT FUNDS FROM THE USED OIL RECYCLING
FUND UNDER THE USED OIL RECYCLING ENHANCEMENT
ACT
WHEREAS, the people of the State of California have enacted the California Oil Recycling
Enhancement Act that provides funds to cities and counties for establishing and maintaining local
used oil collection programs that encourage recycling or appropriate disposal of used oil; and
WHEREAS, the Califomia Integrated Waste Management Board (Board) has been delegated
the responsibility for the administration of the program within the state, setting up necessary
procedures governing application by cities and counties under the program; and
WHEREAS, said procedures established by the California Integrated Waste Management
Board require the applicant to certify by resolution the approval of application before submission
of said application to the state; and
WHEREAS, the applicant will enter into an agreement with the State of California for the
development of the project.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA
HEREBY RESOLVES AS FOLLOWS:
Approve the filing of an application for the California Used Oil Recycling
Block Grant Program under the California Oil Recycling Enhancement Act for
state assistance for the project specified above; and
2. Certify that said applicant has or will have sufficient funds to operate and
maintain the project; and
Appoint the City Engineer as agent of the City Council to conduct all
negotiations, execute and submit all documents including, but not limited to
applications, agreements, amendments, payment requests and so on, which

CONSIDERATION OF MILLS ACT AGREEMENT 94-01 - CUCAMONGA
SERVICE CLUB - Approval of a Mills Act Contract with the Cucamonga Service
Club for the restoration of the Central Public School (Sweeten Hall), a designated
local landmark, located at 9324 San Bemardino Road - APN: 208-111-09.
RECOMMENDATION
At its meeting of November 9, 1994, the Historic Preservation Commission recommended that the
City Council approve Mills Act Agreement 94-01 between the City of Rancho Cucamonga and the
Cucamonga Service Club to implement a reduction in property tax on their historic property, the
Central Public School, known as Sweeten Hall.
BACKGROUND/ANALYSIS
In August of 1988, the City Council approved incentives that would encourage and promote the
preservation and restoration of the City's historic and architectural resources. The Mills Act allows
for the owner of a designated landmark to realize property tax reductions upon entering into a
preservation contract with the City. The successful initiation.of this agreement would mark the
City's eighth use of the Mills Act to help property owners in their preservation efforts. Because the
City's share of the amount of property tax collected is small, the annual loss to the City is less than
$100 per contract.
The Central Public School, built in the then popular Mission Revival style around 1917, stands as
one of the oldest, unaltered schools in the City. Since the ftrst school building in Cucam'onga was
built on this northeast comer of Hellman Avenue and San Bemardino Road in 1890, children have
been traveling to and from this site and service groups and many other clubs have spent countless
hours working together in a spirit of community outreach and cohesiveness. The City Council
designated the Central Public School as a local landmark on September 16, 1992,.

CONCLUSION
The City continues to provide incentives to owners of historic buildings for the preservation of these
community resources and the use of the Mills Act is an important tool in these efforts. Staff concurs
with the recommendation of the Historic Preservation Commission. The money saved can be put
to use to maintain and restore the landmark, which is a benefit to the entire community, present and
future.

RECOMMENDATIONS
It is recommended that the City Council approve the subject agreement with General Dynamics Corporation
and authorize the Mayor and the City Clerk to sign said agreement and causing the same to record.
BACKGROUND/ANA I ,YSIS
In April 1994, the Planning Commission conditionally approved General Dynamics Tentative Parcel Map
14647. General Dynamics project proposed to eliminate the need for the installation of the master plan storm
drain in Sixth Street. The project proposed to provide for drainage of public waters, generated from the
Metrolink site, through the golf course. The tentative map was conditioned to enter into an agreement with
the City and provide a drainage easement.
The drainage easement agreement provides for the public waters to drain through the golf course down to
Fourth Street. General Dynamics, or any subsequent property owner, is responsible for the design,
installation, and maintenance oft he drainage facilities.
The agreement is in the office of the City Clerk.

It is recommended that the City Council award authorize for execution the contract for Traffic Signal &
Safety Lighting at the intersection of Archibald Avenue and Eighth Street, to the second lowest responsive
bidder Hovey Electric for the amount of $114, 180.00($103,800.00 plus 10% contingency) to be funded from
Intermodal Surface Transportation Efficiency Act ( formerly Federal Aid Urban) Account No. 24-4637-8914
BACKGROUND/ANALYSIS:
Per previous Council action, bids were solicited, received and opened on September 6, 1994, for the subject
project. Hovey Electric is the second lowest bidder, with a bid amount of 103,800.00 (see attached bid
summary). AAA Electric Services was the apparent low bidder. The Engineer's estimate was $120,000.00.
Staff has reviewed all bids received and discovered that several bidders, including the apparent low bidder,
did not return the sole addendum issued during the bidding of this project. Additionally, the apparent low
bidder did not purchase his plans and specifications from the City as required by the "Notice Inviting Bids".
Both of these discrepancies have been discussed with the City Attorney. He has concurred with staff in
recommending the award to the second low bidder. Staff has completed the required background
investigation and finds Hovey Electric to meet the requirements of the bid documents.

RECOMMENDATIONS
It is recommended that the City Council accept all bids as submitted and award and for execution,
the professional services agreements for preparation of technical specifications and special
provisions for j anitorial and painting service contracts to I WA Engineers of Fountain Valley in the
amount of $14,708.00 and to and Fundament and Associates of Irvine for preparation of Heating
Ventilation and Air Conditioning service contract technical specifications and special provisions in
the amount of $6,000.00 both as the best qualified responsible bidders. Funding to be provided from
Facilities Maintenance Account 01-4245-6028.
BACKGROUND/ANALYSIS:
Requests for proposals have been received and evaluated by Staff based on four criteria. Those
criteria are: Proposal preparation relative to understanding of the project; cost vs hours invested in
project development; experience and overall cost.
Two firms have been selected from a field of four to prepare technical specifications and special
provisions for janitorial, painting and HVAC service contracts.
We have managed to sustain a reasonable level of service with our janitorial and HVAC service
contractors for sometime now. However, we have also needed to perform a comprehensive needs
analysis and develop state of the an service contract specifications in order to better manage and

control our contractors' performance and to get the best prices when the contracts are out to bid.
Also, we have been in need of a well designed city wide painting contract for many years.
The development of detailed specifications unique to our City facilities and existing equipment is
the first step in bringing our service contracts up to date. The consultants we have selected are well
qualified by virtue of their demonstrated understanding of the City's needs and their experience in
their respective fields.

RECOMMENDATION
It is recommended that City Council adopt the attached Resolution ordering the annexation to
Landscape Maintenance District No. 3B and Street Lighting Maintenance District Nos. 1 and 6 for
MDR 94-21.
BACKGROUND/ANALYSIS
MDR 94-21, located at the southwest comer of Buffalo Avenue and Eighth Street, is required to
fulfill certain conditions of approval along with the normal processing. As part of those conditions
the Developer is required to have the project annexed into the appropriate lighting and landscape
maintenance districts.
The Consent and Waiver to Annexation form has been receive'd from the Developer and is on file
in the City Clerk's office. Attached is the Resolution requiring adoption by the City Council to
complete the proposed annexation.

WHEREAS, the City Council of the City of Rancho Cucamonga, California, has previously
formed a special maintenance district pursuant to the terms of the "Landscaping and Lighting Act
of 1972". being Division 15, Pan 2 of the Streets and Highways Code of the State of California, said
special maintenance district known and designated as Landscape Maintenance District No. 3B,
Street Lighting Maintenance District No. 1 and Street Lighting Maintenance District No. 6
(hereinafier referred to as the "Maintenance District"); and
WHEREAS, the provisions of Article 2 of Chapter 2 of the "Landscaping and Lighting Act
of 1972" authorize the annexation of additional territory to the Maintenance District; and
WHEREAS, at this time the City Council is desirous to take proceedings to annex the
property described on Exhibit "A" attached hereto and incorporated herein by this referenced to the
Maintenance District; and
WHEREAS, all of the owners of property within the territory proposed to be annexed to the
Maintenance District have filed with the City Clerk their written consent to the proposed annexation
without notice and hearing or filing of an Engineer's "Report".
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA

BACKGROUND/ANALYSIS
Conditional Use Permit 93-04, located at the southeast comer o~ 5th Street and Lucas Ranch Road,
was approved by the Planning Commission on September 22, 1993, for the development of a
mack/storage facility on a 3.57 acre site containing a 1,560 square foot office building and a 1,056
square foot repair garage in the General Industrial District (Subarea 5) of the Industrial Area Specific
Plan.
The Developer, EZE Tracking, Incorporated, is submitting an agreement and security to guarantee
the construction of the off-site improvement in the following amounts:

Due to the custom home nature of the subject development, and the
extremely weak market for such residences in recent years, many of the
lots are as yet to be built upon. Since our company only assumed the
obligation to complete sidewalks and driveway approaches (from M.J.
Brock) on a portion of the tract, and since it is impractical to make such
improvements prior to construction of custom homes, we feel that the
requested'extension is justified.
I apologize for the delay in responding, but having been out of town I did
not receive your letter until the past few days.

personnally have a commercial building construction in progress until

The subject site to be improved is on East Ave. in Ettiwanda area,
and our partnership hasn't been able to recover of the real estate
loss from these years recession. However, the suject property has
been manrained properly and all securities presented in time
certificates, consigned to the City are automatically renewable.
In consideration of our financial difficulty, we would like to hereby
apply for another extension of one year for faithful fulfillment of

Various Locations project, Contract No. 94-028, as complete, authorize the City Engineer to file a "Notice
of Completion, and retain the Faithful Performance in the amount of $589,238.62 to be used as the
Maintenance Bond and authorize the release of the Labor and Materials Bond and authorize the release of
the Labor and Materials Bond in the amount of $589,238.62 six months after the recordation of said notice
if no claims have been received. Also, authorize the release of the retention in the amount of $38,557.56,
35 days after the approval of the fmal contract amount of $77,151.26.
BACKGROUND/ANALYSIS
The subject project has been completed in accordance with the approved plans and specifications and to
the satisfaction of the City Engineer. The final contract amount, based on project documentation is
$771,151.26, which includes one contract change order in the amount of $97,666.86 for additional slurry
seal in the Red Hill area. The original amount approved by Council was $648,162.48 and the revised
amount approved by Council is $771,151.26.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA ADOPTING DEVELOPMENT CODE AMENDMENT
NO. 94-05, AMENDING THE DEVELOPMENT CODE, CHAPTER
17.24, HILLSIDE DEVELOPMENT REGULATIONS, AND MAKING
FINDINGS IN SUPPORT THEREOF.
A. Recitals.
1. The purpose and intent of this Ordinance is to streamline the
review process for individual single family residences in hillside areas.
This Council hereby finds and declares its intent:
a. To simplify the review process without compromising the
quality of development.
b. To create greater efficiency in the process to allow the
Planning Commission to focus on broader policy issues.
c. To maintain a process that is timely, fair, and thorough.
2. On October 12, 1994, the Planning Commission of the City of Rancho
Cucamonga conducted a duly noticed public hearing concerning the above
referenced Development Code Amendment and, following the conclusion thereof,
adopted its Resolution No. , recommending that the City Council of the
City of Rancho Cucamonga adopt these amendments.
3. On November 16, 1994, the Council conducted and concluded a duly
noticed public hearing concerning the subject amendments to the Development
Code.
4. All legal prerequisites prior to the adoption of this Ordinance
have occurred.
B. Ordinance.
The City Council of the City of Rancho Cucamonga does ordain as
follows:
SECTION 1. The City Council hereby specifically finds that all of the
facts set forth in the Recitals, Part A, of this Ordinance are true and
correct.
SECTION 2. The City Council of the Cfty of Rancho Cucamonga hereby
finds that this amendment is established and adopted to protect and promote
public health, safety, morals, comfort, convenience, welfare, and more
particularly;
!. To implement the goals and objectives of the General Plan and to
g~:de and manage the future growth of the City in accordance with such plan;
2. To protect the physical, social, and economic stability of
commercial, office, and other land uses within the City to assure its orderly and
beneficial development;
3. To reduce hazards to the public resulting from the inapproprlate
location, use, or design of buildings, and other improvements; and
4. To attain the physical, social, and economic advantages resulting
from comprehensive and orderly land use and resource planning.
SECTION 3. The City Council of the City of Rancho Cucamonga hereby finds
that the project has been prepared and reviewed in compliance with the California
Environmental Quality act of 1970, as amended, and the Guidelines promulgated
thereunder, and further, specifically finds that, based upon substantial
evidence, it can be seen with certainty that there is not a possibility that the
proposed Ordinance will have a significant effect on the environment and
therefore, the proposed Ordinance is exempt pursuant to State CEQA Guidelines
Section 15061 (b) (3).
SECTION 4. Section 17.24.020 is hereby amended to read as follows:
Section 17.24.020
Review Procedures
All projects within a hillside area (8 percent slope or greater),
including but not limited to, parcel maps, tentative tract maps, and site plans
for development review, as well as General Plan and Development District
Amendments, shall be subject to Grading Committee and Deei~m Review C~--~4ttee
review with approval by the City Planner, or Planning Commission in accordance
with the provisions contained in Sections 17.06.010 and 19.04.060. Additionally,
review by the Grading Committee and Desi~a Re~i~ C-----4ttee with approval by the
City Planner or Planning Commission will also be required for other types of
development or grading which meet the criteria specified in Sections 17.24.020A,
B, and C.
City Planner Review. The City Planner shall review all site
development applications and shall impose conditions deemed
appropriate when one or more of the following activities are
proposed.
Natural slopes which are 8 percent or greater but less
than 15 percent on all or part of a sub3ect site, or on
less steep land which may be affected by areas of greater
slope (e.g., flat parcel between or adjacent to steep
hillside).
For fills or excavations equal to or exceeding 3 feet but
less than 5 feet in vertical depth, at their deepest
measured from the natural ground surface.
For excavations or fills, or any combination thereof,
equal to or exceeding 100 cubic yards, but less than 1,500
cubic yards.
Residential construction imvolving four or less dwelling
units, such as custem h~mes, regardless of matural slope
or the emouat of fill or e~cavation.
Planning Commission Review. The Planning Commission shall
review site development applications and impose conditions
deemed appropriate when one or more of the following activities
are proposed:
Natural slopes equal to or greater than 15 percent on all
or part of a subject site.
For fills or excavations equal to or exceeding 5 feet in
vertical depth at their deepest point measured from the
natural ground surface.
For excavations or fills, or any combination thereof,
equal to or exceeding 1,500 cubic yards.
Any excavation or fill which will encroach onto or alter
a natural drainage channel or watercourse. (Should be
prohibited unless alternate drainage is provided).
Any other proposal referred to the Planning Commission by
the Grading Committee or City Planner.
Exceptions. Projects which are limited in scope (e.g.,
regarding of yard areas, pool/spa construction, additions to
existing structures and/or construction of accessory structures
which are less than 250 square feet) may be deferred to staff
level review and approval by the City Planner. However,
projects which require grading of'large flat areas, including,
but not limited to, such items as tennis courts or riding
rings, shall be reviewed by the City Planner or may be referred
to the Planning Commission if determined necessary by the City
Planner.
InterPretation of Standards. If ambiguity arises concerning
interpretation of the provisions contained in Sections
17.24.010 through 17.24.090, the City Planner shall review to
determine compliance with the provisions contained within the
section or he may refer the matter to the Planning Commission
for consideration.
SECTION 5. PUBLICATION - The Mayor shall sign this Ordinance and the
City Clerk shall cause the same to be published within 15 days after its passage
at least once in the Inland Vailev Daily Bulletin, a newspaper of general
circulation published in the City of Ontario, California, and circulated in the
City of Rancho Cucamonga, California.

AMENDMENT TO THE COMPREHENSIVE FEE SCHEDULE
Recommendation
Staff recommends the adoption of the following three resolutions which will amend the City's
Comprehensive Fee Schedule establishing facility rental and related fees for the adult sports
park, allow the recovery of fees for towing, storing or impounding vehicles, and establish a fee
for citation corrections.
Background/Analysis
The Adult Sports Complex was officially dedicated and open for use on April 8, 1993. Since
that time, the complex has been utilized for the Quakes baseball games, stadium sports and
special event rentals and Community Services sports and special event programs.
Staff has conducted a fee and use analysis of other stadium and special event facilities and with
the experience obtained from this facility, has developed a fee schedule for use of the adult sports
park.
The Police Department has reviewed cost recovery for storing, impounding and towing vehicles
with other jurisdictions and determined that a fee of $75.00 should be established for costs
associated with these services. The process includes registration checks, paperwork completion,
tow requests, waiting for tow vehicle to arrive, owner notification, phone contacts, log entries,
release of vehicle, sending of teletypes, etc. The police department currently has one clerk
assigned to deal exclusively with towed, stored or impo.unded vehicles.

Release fees would not be charged to:
Vehicles whose owner/drivers are crime victims, whose vehicles are towed
for evidentiary reasons;
Owners/drivers of vehicles involved in non-criminal traffic collisions; and
When the vehicle is stored at the owner/driver's request.
In all instances where fees are assessed to recover costs, the individual is entitled to a toys'
heating to determine if the application of the fee is appropriate.
Additionally, because of its proximity to the county courthouse, the Rancho Cucamonga Police
recommends the establishment of a $15.00 fee for proof of correction signoffs on citations. This
fee will not apply to persons residing or working within the City of Rancho Cucamonga or to
citations issued by the Rancho Cucamonga Police.
Proof of Corrections require a physical inspection to assure the correction has been made. In
addition, a further inspection is done to assure that there are no further violations on the vehicle.
Inspections are time consuming and take time away from duties that employees should be doing
for residents of the city.
The fees proposed by the Rancho Cucamonga Police through adoption of these resolutions are
new and are for the purpose of cost recovery only.

Vehicle is being operated by an unlicensed driver
There are more than five outstanding parking tickets against the vehicle
The owner/operator was arrested and it was not practical to legally park and lock
the vehicle.
EXCEPTIONS
Release fees would not be charged to:
Vehicles whose owners/drivers are crime victims, and their vehicles are towed for
evidentiary reasons;

The purpose of this memorandum is to advise present

options which have been provided by the Government Code and the
options which are left to the Council due to th~ fact that
certain ordinances have not been enacted which would have
cho3cn other alternatives-
Following are the options set forth in Ca|~fornia
Government Code Section 36512:
The first option provided by Government Code Section
30512 is for the Council to either fill the vacancy by
appointment or call a special election to fill the vacancy,
which election is to be hold on the next regularly established
election date not less than 114 days from the date when the
Council calls for the election. Either one of those actions
must occur within thirty days from the date when the office
becomes vacal]t. The office become3 vacant when Bill takes his
oath as Mayor.
Other o~tions have been provided in Government Code
Se~Liuiz 36512. One option would ~equire thc City to call a
special election immediately to fill the vacancy. Again, that
ulu~Liu~t would occur at the next regularly scheduled election
at least 114 days after the call of the election. The section

also provides an option for petitions to be filed requiring the
call of a special election. Section 36512 also provides a
third option. That option allows the Council to appoint a
person to fill the vacancy only until the date of a special
election to be immediately called. Again, that special
el~ct~n would occur at the first regularly scheduled election
to be held throughout the City not less than 114 days from the
call of the ~p~cial election. Again, ~ must inform the Council
that the other options provided in Section 36512 are not
available because thRy only may be exercised if the Council
previously has enacted an ordinance adopting it. Such an
ordinance has not been enacted.
In accordance with th~ above-referenced materials,
the only choice available to the City Council is to either make
an appointment or call a special election w~thln thirty days
from BAll becoming Mayor. Also, whichever action is chosen
must be properly aggndized pursuant to the Brnwn Act.
