A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, FINDING THAT THE
PROPOSED ACQUISITION OF 1.85 ACRES OF REAL PROPERTY
WITHIN THE EMPIRE LAKES SPECIFIC PLAN, PLANNING AREA 10,
AND LOCATED AT 9070 MILLIKEN AVENUE (APN: 0209-272-27) IS IN
CONFORMANCE WITH THE CITY'S GENERAL PLAN
A. Recitals
1. The City of Rancho Cucamonga proposes the acquisition of 1.85 acres of real property
as described in the title of this Resolution. Hereinafter in this Resolution, the subject acquisition
is referred to as the "proposal."
2. On the 8th day of July 2020, the Planning Commission of the City of
Rancho Cucamonga received and considered the subject Director's Report on said proposal on
that date.
3. All legal prerequisites prior to the adoption of this Resolution have occurred.
B. Resolution
NOW, THEREFORE, it is hereby found, determined, and resolved by the
Planning Commission of the City of Rancho Cucamonga as follows:
1. This Commission hereby specifically finds that all of the facts set forth in the Recitals,
Part A. of this Resolution are true and correct.
2. Based upon the substantial evidence presented to this Commission during the
above -referenced Director's Report on July 8, 2020, including written and oral staff reports,
together with public testimony, this Commission hereby specifically finds as follows:
a. The subject property (the "site") is a parcel of 1.85 acres located at the southwest
corner of the intersection of Milliken Avenue and Azusa Court. The site is bound on the west by
Anaheim Place.
b. The parcel has dimensions of approximately 320 feet (north -south) by 250 (east -
west). The site is fully developed with a parking lot.
C. The existing Land Use, General Plan and Zoning designations for the project site
and adjacent properties are as follows:

d. Government Code Section 65402(a) requires a city's planning agency, i.e.
Planning Commission, review and report upon whether the location, purpose, and extent of a
proposed real property acquisition by the city for public purposes is consistent with the General
Plan as described below:
If a general plan or part thereof has been adopted, no real property shall
be acquired by dedication or otherwise for street, square, park or other
public purposes, and no real property shall be disposed of, no street shall
be vacated or abandoned, and no public building or structure shall be
constructed or authorized, if the adopted general plan or part thereof
applies thereto, until the location, purpose and extent of such acquisition or
disposition, such street vacation or abandonment, or such public building
or structure have been submitted to and reported upon by the planning
agency as to conformity with said adopted general plan or part thereof. The
planning agency shall render its report as to conformity with said adopted
general plan or part thereof within forty (40) days after the matter was
submitted to it, or such longer period of time as may be designated by the
legislative body.
e. The City is in the process of the acquisition of the site for potential economic
development and integration with potential redevelopment on the properties that generally
surround the site and on the publicly owned parking lot located immediately to the north of the
site that serves the Metrolink train station;
f. The location, purpose, and the extent of the acquisition conforms with the
applicable policies set forth in the City's General Plan, including:
1) Land use policy LU-2.1 which states that the City should "plan for
vibrant, pedestrian -friendly mixed use and high -density residential
areas at strategic infill locations along transit routes" such as the
Metrolink station.
2) Land use policy LU-3.2 which encourages "a mix of retail, service,
industrial and manufacturing, and professional uses that create diverse,
well -paying employment opportunities" and is a long-term goal of the
City.
3) Land use policy LU-3.7 which encourages "new development projects
to build on vacant infill sites within a built -out area, and/or redevelop
previously developed properties that are underutilized' such as the
inactive parking lot on the property.
4) Community mobility policy CM-2.2 which encourages "all feasible
measures to reduce total vehicle miles traveled by automobiles,
including enhanced transit access and land use approaches that
provide compact and focused development along major transit
corridors" such as the BNSF railway that is the route for Metrolink

1) (commuter rail service) and Milliken Avenue which is a route for
Omnitrans (bus transit).
2) Community mobility policy CM-3.2 which supports "Omnitrans'
expansion of Bus Rapid Transit (BR7) into the City ... with stops at all
major north -south streets..." such as Milliken Avenue.
2. Based upon the findings set forth in paragraph 2 above, this Commission hereby
determines that the proposed acquisition of the site forpotential economic development conforms
with the City's General Plan.
3. This Commission hereby directs the Planning Director to forward a copy of this
Resolution to the City Council.
4. The Secretary to this Commission shall certify to the adoption of this Resolution.
