into twelve (12)lots for sale and three (3)lettered lots to
be retained by the project proponent,located within the
Etiwanda Heights Neighborhood and Conservation Plan
(EHNCP).
Where:North of Banyan Street,east of Milliken Avenue,and
west of Day Creek Boulevard.

Project Description
Etiwanda Heights Neighborhood and
Conservation Plan (EHNCP)
•The 1,166-acre project site is part of the 4,303-acre EHNCP,
adopted by the City Council on October 2,2019.
•The EHNCP extends from Haven Avenue,easterly to the City’s
boundary with Fontana,and from the 210 Freeway,northerly into
the San Bernardino National Forest boundary.
•EHNCP is comprised of two areas:A 3,603-acre
Rural/Conservation Area primarily intended for open space
retention,habitat conservation,and recreational access,and a
790-acre Neighborhood Area,primarily intended for residential
and commercial development.

Committees and Meetings
•Design Review Committee:Not required.Project is for the
subdivision of property only.Future development applications will
be reviewed by the Design Review Committee as they are
submitted.
•Neighborhood Meeting:Not required.Outcome of this project is
the creation of separate lots and there is no additional information
of significance to convey that warrants a neighborhood meeting.
Environmental
•The City certified an Environmental Impact Report (EIR) on
October 2, 2019 (SCH No.2017091027) in connection with the
City’s approval of the EHNCP.
•Pursuant to CEQA Guidelines Section 15162, no subsequent or
supplemental EIR or Negative Declaration is required as there
have been:
a)no substantial changes proposed to the project that indicate new or more
severe impacts on the environment
b)no substantial changes have occurred in the circumstances under which the
project was previously reviewed that indicates new or more severe
environmental impacts
c)no new important information shows the project will have new or more
severe impacts than previously considered
d)no additional mitigation measures are now feasible to reduce impacts or
different mitigation measures can be imposed to substantially reduce
impacts.
Noticing
•Notices were mailed to all property owners within 660 feet (1,365
property owners) on January 12, 2021 and published in the Inland
Valley Daily Bulletin on January 13, 2021.
•On January 20,2021,staff received a phone call from a property
owner within the notification radius asking general questions about
the proposal.Staff answered the inquirer’s questions to their
satisfaction.
Staff Recommendation
•Staff recommends that the Planning Commission adopt Resolution
21-06 to approve the Tentative Tract Map with the attached
Conditions of Approval.
Public Art Fee Deferral

Background
•Public Art Program established in 2017
•Allows projects to meet art requirement in
three ways:
–Install art on site
–Donate art to City
–Pay in -lieu fee
Proposed Change
•Provide an option to allow payment of in-lieu
fee to be deferred to prior to final inspection
•System checks are in place to ensure
compliance
•Part of a larger fee deferral program that will
be presented to Council in February
Recommendation
•Recommend to Council adoption of a
municipal code amendment to provide a
payment deferment option for the public art
in-lieu fee
