Therefore, a PCN is required in this case as census tract is significantly overconcentrated; • Notably, only one other Census Tract within the City has as many as 9 off-sale alcohol licenses (Terra Vista). Approving PCN would result in the subject census tract becoming most overconcentrated census tract in the City. Staff Concerns with PCN and CUP • Project proposes to locate across the street from elementary school (Cucamonga Elementary) and within vicinity of middle school (Rancho Cucamonga Middle School); • Sheriff's data suggests proximity of such uses to schools may increase alcohol/tobacco sales to minors. Exercise conducted at 22 locations throughout City. 4 locations within proximity to schools (2 elementary, 1 private, and 1 high school), were found to sell alcohol/tobacco products to minors. • Summary of PCN Findings for denial: • 1) Census tract already significantly overconcentrated; • 2) use proposed within proximity to schools; • 3) both of these concerns were substantiated via concerns raised by multiple neighbors at two neighborhood meetings. Staff Concerns with PCN and CUP • Regarding CUP, Development Code requires a CUP for the 14-pump service station, convenience store, and off-sale alcohol sales. One CUP is required to allow the service station and convenience store, which is considered an off-sale establishment, pursuant to the Development Code. • In part, findings for a CUP require that a project be consistent with all applicable provisions of the zoning code, municipal code and general plan. Findings for a CUP also require that that a use not be detrimental to the public interest, health, safety, convenience and welfare. Staff Concerns with PCN and CUP • Summary of CUP Findings for denial: • 1) The project is not consistent with the General Plan as it fails to meet General Plan Goals LU-1 and LU-6, which promote the protection of neighborhoods from uses which may have negative impact on residential land uses and which promotes the stability of Southwest Rancho Cucamonga residential neighborhoods by encouraging commercial and community services that meet community needs. • 2) The project does not meet CUP findings as it proposes a use which is detrimental to public interest, health, safety, convenience and welfare. • Request for the PCN for off-sale alcohol sales within an overconcentrated census tract; • Most overconcentrated census tract in the City (and associated frequency of gas stations); • Proximity of project to schools and evidence suggesting correlation between school proximity and alcohol/tobacco sales to minors. CITY OF RANCHO CUCAMONGA t1• Neighborhood Meetings/Concerns • On November 11, 2020, the applicant held a virtual Neighborhood Meeting. Notices were sent out to all property owners within 660 feet. 6-7 people attended meeting, opposing project. Comments included: • Proliferation of convenience stores within area; • Proximity of project to school(s); • Perceived Concentration of Service Stations; • Hours of Operation; • Traffic, Noise and Glare. • Considering nature of concerns, staff held a second neighborhood meeting on January 11, 2021. To ensure maximum participation, staff expanded notice radius and provided interpreter at the meeting. 12 residents attended, with all but one expressing opposition to project stating same or similar concerns as previous meeting. There is a school across the street on Archibald and some of the older students walk home. They will cross Archibald and continue on 9th Street to their homes. They will travel by this convenience store that proposes to sell liquor. Even though they cannot purchase liquor they will enter the store to buy snacks and other age appropriate food. The convenience store staff will not be able to monitor all of the store activities and I fear that some customers will interact with the children and maybe buy them liquor. The other concern is an increase in traffic for people to purchase gasoline, This will increase traffic activity in this area. It will also impact the safety of our children walking to and from school. People stopping for gas during the morning and afternoon hours when children are present will endanger their safety. Will the store owners pay for street crossing guards to escort children and families? So I don't believe this construction is in the best of these students or our community in that exposes our vulnerable children to these hazards. Brown road signs, like the "Historic Route 66" signs, marking the old trail alignment are going up on existing city lamp posts in Upland and San Bernardino.We are anxious to continue the signage in Rancho.
