includes an administrative department and 8 classrooms to accommodate approximately 50 students. The
entire build -out is interior based. No exterior construction is required.

Cambridge College, Inc., together with Rancho Office Buildings, LLC (property owner),
presents this request for a Conditional Use Permit (CUP) to operate a teaching facility that will
be located at the Vintner's Grove Business Park in Rancho Cucamonga. .

Cambridge College's Inland Empire Regional Center proposed for Vintner's Grove
Business Park in Rancho Cucamonga will be operated as follows:
■ Hours of Operation - Monday thru Sunday 7:OOAM to 10:00PM
■ Staffing - by seven employees Monday thru Friday 7:OOAM to 6:OOPM
■ Faculty - 2 to 8 faculty on .site depending on courses being offered

WHERE IS The Planning Director of the City of Rancho Cucamonga will be holding a public

TELLO FOR CAMBRIDGE COLLEGE - A request to utilize approximately 12,000
square feet of the first floor of an existing 60,765 square foot three story office
building to operate an educational facility within the Haven Overlay in the Industrial
Park (IP) District (Subarea 6), located at the northwest corner of Haven Avenue and
26th Street at 8686 Haven Avenue Suite 100 - APN: (Old - 0209-092-04) (New -
0209-092-07). This action is categorically exempt per the California Environmental
Quality Act (CEQA) pursuant to State CEQA Guidelines Section 15301 (Class 1
Exemption - Existing Facilities).

SUBJECT: NON -CONSTRUCTION CONDITIONAL USE PERMIT DRC2010-00851 —
NELSON TELLO FOR CAMBRIDGE COLLEGE - A request to utilize approximately
12,000 square feet of the first floor of an existing 60,765 square foot three-story office
building to operate an educational facility within the Haven Overlay in the Industrial Park (IP)
District (Subarea 6), located at the northwest corner of Haven Avenue and 26th Street at
8686 Haven Avenue, Suite 100 - APN: (Old - 0209-092-04) (New - 0209-092-07). This
action is categorically exempt per the California Environmental Quality Act (CEQA)
pursuant to State CEQA Guidelines Section 15301 (Class 1 Exemption - Existing Facilities).
SITE DESCRIPTION:
A. Surrounding Land Use and Zoning:
Site - Office Buildings - Industrial Park District (Subarea 6) Haven Office Overlay District
North - Vacant Lot - Industrial Park District (Subarea 6)
South - Manufacturing Building - Industrial Park District (Subarea 6)
West - Single -Family Residences - Low -Medium Residential (2-4 dwelling units per acre)
East - Office Buildings - Industrial Park District (Subarea 6)
B. General Plan Designations:
Project Site - Industrial Park (IP)
North - Industrial Park (IP)
South - Industrial Park (IP)

C. Site Characteristics: The project site is located at the northwest corner of Haven Avenue and
26th Street. The subject parcel is approximately 6.7 acres in size and contains two existing
60,765 square foot, three-story office buildings with 498 total parking spaces in the first phase of
the larger office development project. The abutting parcels to the north were approved along
with the subject parcel and are currently undeveloped. The abutting property to the east is
developed with light industrial uses; to the west is developed with single-family residences; and
the property to the south is developed with a vacant existing industrial building.
ANALYSIS:
A. Entitlement Requirement: Development Code Section 17.30.030 permits Educational
Institutions in Subarea 6 of the Industrial Park District subject to a Conditional Use Permit. The
purpose of a Conditional Use Permit is to create the flexibility necessary to achieve the
objectives of the Development Code and General Plan and to ensure that the proposed use is

compatible with the neighboring uses. If necessary, conditions may be required to provide
adequate mitigation of any potentially adverse impacts.
B. Use Description: Cambridge College will provide programs ranging from bachelors and masters
degrees for educators, counselors, managers, and human service providers, to doctoral
programs in educational leadership. Classes will take place within approximately 12,000 square
feet of the first floor of the office building located at 8686 Haven Avenue in Suite 100.
The proposed school will offer three terms per year, fall, spring, and summer, with an average
class size of 9 students. The semester enrollment of the school will have up to 120 students.
However, there will be a maximum of 40 students on -site from Monday through Friday and a
maximum of 60 students on -site Saturday and Sunday. Additionally, there will be 7 employees,
as well as 8 faculty members on -site depending on the courses being offered.
C. Hours of Operation: The hours of operation will be Monday through Sunday from 7:00 a.m. to
10:00 p.m. Classes will take place seven days a week; Monday through Friday from 7:00 a.m. to
10:00 p.m.; and Saturday and Sunday from 9:00 a.m. to 6:00 p.m. Typical office hours will
occur 7:00 a.m. to 6:00 p.m.
D. Parking: The parking requirement for private educational uses is 1 parking space for every
3 students, plus 1 parking space for every 2 faculty members. However, it has been staff's
findings that the current parking requirement for this specific use may create possible hardships
for the neighboring businesses within the subject property. Therefore, staff is requiring 1
parking space for every student.
The entire site was developed with 498 parking spaces. Parking for office buildings is calculated
at 1 parking space for each 250 square feet of gross floor area. This translates into a parking
requirement of 438 parking spaces for the remaining 109,530 square feet of office space within
the two buildings on the subject site, leaving a total of 60 parking spaces available for the
proposed school use.
There will be a maximum of 7 employees, 8 faculty, and 40 students on -site during weekday
classes. This will require a total of 48 parking spaces, which does not exceed the remaining 60
parking spaces available. However, there will be a maximum of 7 employees, 8 faculty, and 60
students on=site during weekend classes, which will require 68 parking spaces to be available for
the proposed school use. This will create a parking deficiency of 8 spaces. Since typical hours
of operation for most businesses that would be permitted in this industrial park are from
7:00 a.m. to 6:00 p.m. Monday through Friday, and there are no current parking issues on -site,
staff finds that the proposed maximum student occupancy of 60 during the weekend will not
create a parking deficiency for the future tenants. However, staff is including a condition within
the attached resolution that states if the operation of the facility causes adverse effects upon the
adjacent businesses or operations including, but not limited to parking, the Conditional Use
Permit shall be brought before the Planning Director for review.
E. Land Use Compatibility: Staff finds that the proposed educational use will be compatible with
the allowable uses within the office complex. The educational activities will be conducted
entirely indoors and do not pose any noise, odor or vibration impacts. The major concern would
be parking, which staff has determined is more than adequate for the proposed use and
remaining office space on -site.

F. Environmental Assessment: The Planning Department staff has determined that the project is
categorically exempt from the requirements of the California Environmental Quality Act (CEQA)
and the City's CEQA Guidelines. The project qualifies as a Class 1 exemption under State
CEQA Guidelines Section 15301, which covers the operation, repair, and maintenance of
existing private structures involving negligible or no expansion of use beyond that existing at the
time of the lead agency's original determination. Because the project only involves interior
tenant improvements within an existing building to accommodate the subject use, staff
concludes that there is no substantial evidence that the project will have a significant effect on
the environment. The Planning Director has reviewed the Planning Department's determination
of exemption, and based on his own independent judgment, concurs in the staff's determination
of exemption.
CORRESPONDENCE: This item was advertised as a public hearing in the Inland Valley Daily
Bulletin newspaper, the property was posted, and notices were mailed to all property owners within a
660-foot radius of the project site. Staff has not received any letters or phone calls expressing
concern over the Conditional Use Permit application.
RECOMMENDATION: Staff recommends approval of Non -Construction Conditional Use Permit
DRC2010-00851 through adoption of the attached Resolution of Approval with conditions.

A. Recitals.
1. Nelson Tello, representing Cambridge College, filed an application for the issuance of Conditional
Use Permit DRC2010-00851, as described in the title of this Resolution. Hereinafter in this Resolution, the
subject Conditional Use Permit request is referred to as "the application."
2. On the 21 st day of December 2010, the Planning Director of the. City of Rancho Cucamonga
conducted a duly noticed public hearing on said application and concluded said hearing on that date.
3. All legal prerequisites prior to the adoption of this Resolution have occurred.
B. Resolution.
NOW, THEREFORE, it is herebyfound, determined, and resolved bythe Planning Directorof the City of
Rancho Cucamonga as follows:
1. The Planning Director hereby specifically finds that all of the facts set forth in the Recitals, Part A,
of this Resolution are true and correct.
2. Based upon the substantial evidence presented to the Planning Director during the
above -referenced public hearing on December 21, 2010, including written and oral staff reports, togetherwith
public testimony, the Planning Director hereby specifically finds as follows:
a. The application applies to Suite 100, within a three-story building located at
8686 Haven Avenue. The subject building is on a 6.7-acre parcel that is shared by an additional three-story
building. There are 498 parking spaces on the site; and
b. The site contains two office buildings. The General Plan and Development District
designation of the subject property and the properties to the north, south, and east is Industrial Park (IP). The
site is within Subarea 6 of the Industrial Park District. The property located to the west is designated
Low -Medium Residential (LM) District; and
C. The applicant proposes providing classes with a maximum of 40 students on -site from
Monday to Friday and a maximum of 60 students on -site Saturday and Sunday and an enrollment of up to
120 students per semester who are working towards their bachelors, masters, and doctorate degrees. The
classes will take place in approximately 12,000 square feet of the first floor of an existing 60,765 square foot
three-story office building; and
d. The classes will take place 7 days a week, Monday through Friday from 7:00 a.m. to
10:00 p.m.; and Saturday and Sunday from 9:00 a.m. to 6:00 p.m.; and

e. Development Code Section 17.30.030 permits schools in the Industrial Park District,
Subarea 6, subject to a Conditional Use Permit and Planning Director approval; and
f. The site contains a total of 498 parking spaces with 60 spaces available for the proposed
use; Staff is requiring 1 parking space for every student, plus 1 parking space for every 2 faculty members
and employees. There will be a maximum combined total of 15 staff and faculty members with 40 students
from Monday through Friday and 60 students Saturday and Sunday. This translates into a parking
requirement of 48 spaces from Monday through Friday and 68 parking spaces Saturday and Sunday which
creates a parking deficiency of 8 spaces on the weekend because of student and faculty occupancy. Since
typical hours of operation for most businesses that would be permitted in this industrial park are from
7:00 a.m. to 6:00 p.m. Monday through Friday, and there are no current parking issues on -site, staff finds
that the proposed maximum student occupancy of 60 during the weekend will not create a parking deficiency
for future tenants.
g. Staff finds that the proposed educational use will be compatible with the allowable uses
within the office complex. It will provide educational activities that are quiet in nature and conducted entirely
indoors. The major concern would be parking, which staff has determined is adequate for all the uses in the
building..
h. The proposed school compliments the office corridor by providing an educational facility
which staff has determined is compatible with the surrounding offices; and
i. The educational activities will be conducted entirely indoors and do not pose any noise, odor,
or vibration impacts.
3. Based upon the substantial evidence presented to the Planning Director during the
above -referenced public hearing and upon the specific findings of facts set forth in Paragraphs 1 and 2
above, the Planning Director hereby finds and concludes as follows:
a. The proposed use is in accord with the General Plan, the objectives of the Development
Code, and the purposes of the district in which the site is located.
b. The proposed use, together with the conditions applicable thereto, will not be detrimental to
the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity.
C. The proposed use complies with each of the applicable provisions of the Development Code.
The proposed development meets all standards outlined in the Development Code and the design and
development standards and policies of the City.
4. The Planning Department staff has determined that the project is categorically exempt from the
requirements of the California Environmental Quality Act (CEQA) and the City's CEQA Guidelines. The
project qualifies as a Class 1 exemption under State CEQA Guidelines Section 15301, which permits minor
alterations of existing private structures involving negligible or no expansion of the use beyond that existing at
the time of the lead agency's original environmental determination. Because the project only involves interior
tenant improvements within an existing development to accommodate the subject use, staff concludes that
there will be no substantial evidence that the project will have a significant effect on the environment. The
Planning Director has reviewed the Planning Department's determination of exemption, and based on its own
independent judgment, concurs in the staff's determination of exemption.

5. Based upon the findings and conclusions set forth in Paragraphs 1, 2, 3, and 4 .above, the
Planning Director hereby approves the application subject to each and every condition set forth below and in
the Standard Conditions, attached hereto and incorporated herein by this reference.
Planning Department
1) Approval is for the operation of an education facility providing adult and college
level instruction that will utilize approximately 12,000 square feet of the existing
office building located at 8686 Haven Avenue within Suite 100 - APN: (Old -
0209-092-04) (New - 0209-092-07).
2) The maximum enrollment shall be limited to 120 students, and the maximum
combined number of employees and faculty shall be limited to 16. Any
proposed increase to this number will require modification to the Conditional Use
Permit.
3) The maximum number of students on -site from Monday to Friday (weekdays)
shall be limited to 40 at any time. Any proposed increase to this number will
require modification to the Conditional Use Permit.
4) The maximum number of students on -site from Saturday to Sunday (weekends)
shall be limited to 60 at any time. Any proposed increase to this number will
require modification to the Conditional Use Permit.
5) If the operation of the facility causes adverse effects upon the adjacent
businesses or operations including, but not limited to parking, the Conditional
Use Permit shall be brought before the Planning Director for consideration and
possible termination of the use.
6) All signs shall comply with the previously approved Uniform Sign Program
No. 190 for this site and shall require review and approval by, the Planning
Director prior to installation.
7) Approval of this request shall not waive compliance with any sections of the
Development Code, State Fire Marshal's regulations, Uniform Building Code, or
any other City Ordinances.
8) The applicant shall agree to defend at his sole expense any action brought
against the City, its agents, officers, or employees, because of the issuance of
such approval, or in the alternative, to relinquish such approval. The applicant
shall reimburse the City, its agents, officers, or employees, for any court costs
and attorney's fees which the City, its agents, officers, or employees may be
required by a court to pay as a result of such action. The City may, at its sole
discretion, participate at its own expense in the defense of any such action but
such participation shall not relieve applicant of his obligations under this
condition.
9) Any modification or any intensification of the use beyond what is specifically
approved by Conditional Use Permit DRC2009-00851 and the Conditions of
Approval shall require review and approval by the Planning Director.

10) Any change in occupancy loads will require the parking to be reviewed and
analyzed for approval by the Planning Director.
11) If the approved operation of the business creates law enforcement and/or fire
safety problems such as, but not limited to, loitering and disturbances, noise,
overcrowding, at the premises, blocked fire exits, etc. the Conditional Use Permit
shall be brought before the Planning Director for consideration of modification
and or revocation.
12) Bells shall not be used to announce the beginning/end of class sessions.
13) Vehicle parking in the public right-of-way and/or on adjacent properties is not
permitted.
Engineering Department
1) CD-1 required if valuation is over $100,000.00 (Please refer to fee handout for
deposit and fee amounts).
Fire Construction Services
FIRE CONSTRUCTION SERVICES STANDARD CONDITIONS FOR TENANT
IMPROVEMENT
Because of the occupant load capacity of the building a complete automatic fire alarm
system in compliance with CBC and CFC Section 907.2.2 must be installed. Submit
plans to Building and Safety for fire review; include in the plans a copy of the CA Fire
code Chapter 14 for "Fire Safety During Construction and Demolition." The plans shall
provide the building data such as square footage (existing and proposes) type of
construction, occupancy group(s), the number of stories, and indicate if the building is
equipped with automatic fire sprinklers." Provide the following notes in the plans:
"FIRE PREVENTION NOTES"
BEFORE CALLING FOR INSPECTION PLEASE COMPLY WITH THE FOLLOWING
REQUIREMENTS:
1) A fire inspection and final approval is required before the Building Department
will accept a building final inspection request. Please call (909) 477-2713 for a
fire inspection.
2) A Knox box must be purchased and installed in accordance with RCFPD policy,
unless the Knox -box exists on the building.
3) The key to the building or suite must be given to the fire inspector at the time of
final inspection. The key will be locked in the Knox box for fire department
emergency access.
4) Fire extinguishers must be installed per the RCFPD policy. See the policy in
these plans.

5) The occupant must fill out the blue FCS's "Emergency Contact Information" form
prior to final inspection. Present the completed form to the fire inspector at the
time of final fire inspection.
6) Sprinkler modifications require a separate plan submittal and approval. Work
shall not commence until a permit is obtained. Inspection of rough piping must
be performed prior to concealment. Ceiling tiles must not be installed unless
approved by the fire inspector.
7) . Because of the occupant load capacity of the building a complete automatic fire
alarm system in compliance with CBC and CFC Section 907.2.2 must be
installed. Fire Alarm System (fire sprinkler monitoring, automatic or manual)
modifications require a separate plan submittal and approval. Work shall not
commence until a permit is obtained.
8) Place a sign above the main entrance door stating, "THIS DOOR MUST
REMAIN UNLOCKED DURING BUSINESS HOURS."
9) All doors designated as exits, except for the main entrance, must be equipped
with common knowledge lever type, single-action hardware unless otherwise
noted.
10) Additional exit signs may be required at the time of the final inspection; if the
ones shown on the plans do not meet the intent of the code.
11) -If As -Built plans are required to be submitted, additional fees will be due.
12) The general contractor must confirm that the 5-year certification of the fire
sprinkler system is current. The certificate must be affixed to the system riser. If
the system is not certified, the General Contractor must contact the building
owner. A qualified company must certify the system prior to final inspection.
13) The suite address must be installed on all exterior doors of the suite in 4-inch
high letters contrasting with the background.
15) When emergency illumination is existing and/or required, fixtures must be
installed as shown on the plans. Fixtures must provide a minimum of one foot
candle at floor level throughout the exit path. Additional fixtures may be required
upon inspection.
16) The duct smoke detectors required by the 2007 CA Mechanical Code for HVAC
shut down must not be interconnected to the fire sprinkler monitoring alarm; the
duct detectors must have and audible and visual notification device in
accordance to the 2007 CA Fire Code.
17) Fire safety during construction must be observed; please, familiarize yourself
and your employees with the California Fire Code Chapter 14 regulations; these
regulations are reproduced in this plan.

1. The site shall be developed and maintained in accordance with the approved plans which include
site plans, architectural elevations, exterior materials and colors, landscaping, sign program, and
grading on file .in the Planning Department, the conditions contained herein, and the
Development Code regulations.
