CITY OF RANCHO CUCAMONGA FIRE PROTECTION DISTRICT, HOUSING SUCCESSOR AGENCY, SUCCESSOR AGENCY, PUBLIC FINANCE AUTHORITY AND CITY COUNCIL REGULAR MEETINGS MINUTES The City Council of the City of Rancho Cucamonga held a closed session on Wednesday, December 1, 2021, in the Tri-Communities Conference Room at the Civic Center, 10500 Civic Center Drive, Rancho Cucamonga, California. Mayor Michael called the meeting to order at 5:00 p.m. Present were Council Members: Ryan Hutchison, Kristine Scott, Sam Spagnolo, Mayor Pro Tern Lynne Kennedy, and Mayor L. Dennis Michael. Also present were: John Gillison, City Manager; James L. Markman, City Attorney; Lori Sassoon, Deputy City Manager/Administrative Services; Elisa Cox, Deputy City Manager/Cultural & Civic Services and Matt Burris, Deputy City Manager/Economic and Community Development. CALL TO ORDER- COUNCIL CHAMBERS The regular meetings of the Rancho Cucamonga Fire Protection District, Housing Successor Agency, Successor Agency, Public Finance Authority, and the City of Rancho Cucamonga City Council were held on December 1, 2021, in the Council Chambers at City Hall, located at 10500 Civic Center Drive, Rancho Cucamonga, California. Mayor Michael called the meeting to order at 7:00 p.m. Present were Council Members: Ryan Hutchison, Kristine Scott, Sam Spagnolo, Mayor Pro Tern Lynne Kennedy, and Mayor L. Dennis Michael. Markman, City Attorney; and Patricia Bravo-Valdez, Deputy Director of City Clerk Services. City Attorney Markman led the Pledge of Allegiance. Mayor Michael announced the upcoming retirement of City Attorney Markman who has represented the City since 1985. A. AMENDMENTS TO THE AGENDA None. B. ANNOUNCEMENTS/PRESENTATIONS B1. Presentation of a Certificate of Sympathy in Memory of Heinz Lumpp, Former Planning Commissioner. Mayor Michael announced that at the conclusion of this City Council Meeting, we will have a moment of silence and adjourn the meeting in memory of Heinz Lumpp, Former Planning Commissioner. The City and City Council expressed their heartfelt condolences to Heinz Lumpp's wife, Violet Lumpp. Mayor Michael and Members of the City Council presented a Certificate of Sympathy to Mrs. Lumpp. B2. Presentation of a Certificate of Recognition to Alta Loma High School Student Bodie Chapman and Campus Security Officer Corey Richardson for Heroically Saving the Life of a Driver in a Car Crash. Fire Chief Rojer shared the heroic efforts by Alta Loma High School Student Bodie Chapman and Campus Security Officer Corey Richardson during an incident involving an elderly male driver who suffered a medical emergency while driving on Base Line Road. Mayor Michael and Members of the City Council recognized Bodie Chapman and Officer Richardson and thanked them for their courage and service. B3. Announcement and Request for Community Action Regarding State Redistricting and the Effort to Stop the Proposal to Split Rancho Cucamonga Into Multiple Congressional and State Districts. Hope Velarde, Management Analyst I, City Manager's Office, shared a PowerPoint presentation informing the community of the state's redistricting proposal to split Rancho Cucamonga into multiple Congressional and State Districts. Mayor Michael encouraged the community to voice their concerns to keep Rancho Cucamonga whole by visiting www.wedrawthelinesca.org/contact. C. PUBLIC COMMUNICATIONS Janet Walton read a story and offered a prayer. D. CONSENT CALENDAR D1. Consideration of Meeting Minutes for the Special Meeting of November 3, 2021. D2. Consideration to Approve City and Fire District Bi-Weekly Payroll in the Total Amount of$2,830,522.36 and City and Fire District Weekly Check Registers (No Checks Issued to Southern California Gas Company) in the Total Amount of$6,048,786.35 Dated November 08, 2021 Through November 18, 2021. Consideration to Adopt a Resolution Approving the Salary Schedules for Fiscal Year 2021-22 for Job Classifications Employed by the City. Consideration of Second Reading and Adoption of the Following: Ordinance No. 989 AN ORDINANCE OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, ADDING CHAPTER 8.15 (MANDATORY ORGANIC WASTE DISPOSAL REDUCTION) TO TITLE 8 HEALTH AND SAFETY OF THE RANCHO CUCAMONGA MUNICIPAL CODE, AND MAKING A DETERMINATION OF EXEMPTION UNDER CEQA MOTION: Moved by Council Member Spagnolo, seconded by Council Member Hutchison, to adopt Ordinance No. 989, by title only and waive full reading. Consideration of Second Reading and Adoption of the Following: Ordinance No. 990 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING SPECIFIC PLAN AMENDMENT DRC2016-00730, A REQUEST TO CHANGE THE ZONING DESIGNATION FOR A 6.96 ACRE SITE WITHIN THE ETIWANDA SPECIFIC PLAN FROM ESTATE RESIDENTIAL (ER)TO VERY LOW(VL) RESIDENTIAL FOR A SITE LOCATED ON 12774 BANYAN AVENUE; AND MAKING FINDINGS IN SUPPORT THEREOF—APN: 0225-111-07 MOTION: Moved by Council Member Scott, seconded by Mayor Pro Tern Kennedy, to adopt Ordinance No. 990, by title only and waive full reading. Public Hearing to Consider Fee Adjustments for the Community Services, Engineering, and Planning Departments. (RESOLUTION NO. 2021-129)(CITY) City Manager Gillison introduced Jennifer Nakamura, Management Analyst II, who provided a PowerPoint presentation with an overview of the proposed fee adjustments for the Community Services, Engineering, and Planning Departments. Mayor Michael opened the Public Hearing. There were no public communications. Mayor Michael closed the Public Hearing. MOTION: Moved by Mayor Pro Tern Kennedy, seconded by Council Member Scott, to adopt Resolution No. 2021-129. Motion carried, 5-0. G2. Public Hearing to Consider First Reading of Ordinance No. 991, to be Read by Title Only and Waive Further Reading, Adding Chapter 3.76 to the Rancho Cucamonga Municipal Code to Establish a Non- Residential Affordable Housing Development Impact Fee, and Resolution 2021-131, Establishing Non-Residential Affordable Housing Development Impact Fees. (ORDINANCE NO. 991)(RESOLUTION NO. 2021-131) (CITY) City Manager Gillison announced that it is recommended that the Public Hearing be continued to the December 15, 2021 City Council meeting, as the City is currently working with stakeholders involved with this item. Mayor Michael opened the Public Hearing and noted that the Public Hearing would be continued to the December 15, 2021 City Council Meeting. No public communications were made. MOTION: Moved by Council Member Scott seconded by Council Member Hutchison, to continue the Public Hearing to the Regular City Council Meeting on December 15, 2021 at 7:OOPM in the Council Chambers, 10500 Civic Center Drive, Rancho Cucamonga, CA 91730. Motion carried, 5-0. H. CITY MANAGERS STAFF REPORT(S) H1. Consideration to Approve Actions Related to the Acquisition of 8234 Almond Street. (FIRE) City Manager Gillison introduced the item along with Mike McCliman, Deputy Fire Chief, and Augie Barreda, Deputy Fire Chief, who provided a PowerPoint presentation on the proposed acquisition of 8234 Almond Street. Deputy Fire Chief McCliman shared the importance of the property location for the Cucamonga Foothill Preservation Alliance as the property is uniquely situated to serve as a base of operations during an emergency due to its location and proximity to Cucamonga Canyon. City Manager Gillison informed that once the City has acquired the property the City plans to move forward in acquiring an adjacent property to have more access for the Cucamonga Foothill Preservation Alliance and make necessary improvements. In response to Mayor Michael, City Manager Gillison reviewed the process for the U.S. Forest Service to ratify the final Cucamonga Canyon Management Plan. MOTION: Moved by Council Member Hutchison, seconded by Council Member Scott, to approve the Board President's execution of an agreement with the County of San Bernardino and The Jane Anne Morgan Revocable Living Trust dated September 18, 2019 to purchase 8234 Almond Street(APN: 1061-172-19). Motion carried, 5- 0. Receive Presentation on Senate Bill 9 (Housing Development) and Provide Direction to Staff on Responding to Upcoming SB 9 Regulations. (CITY) City Manager Gillison introduced the item and Sean McPherson, Senior Planner, who provided a PowerPoint presentation with the background and overview of Senate Bill 9 (Housing Development). Senior Planner McPherson detailed Senate Bill 9 provisions, policy and development code considerations and possible impacts to the community. He concluded by stating that upon receiving direction from the City Council, staff intends to return to the City Council within the first quarter of 2022 with recommendations on Development Code Amendments to comply with SB-9 and to maintain the public health, safety and welfare of the City. Council and staff discussion ensued regarding SB-9 provisions, impacts and limitations, including the regulation of provisions. MOTION: Moved by Council Member Hutchison, seconded by Mayor Pro Tern Kennedy,to receive and file report and approve further research into the following areas: Objective Standards for Zoning, Objective Standards for Subdivisions, Historic District, Very High Fire Severity Zones, Public Health and Safety Considerations, SB 9 Units as Affordable Housing and return to the Council in the first quarter of 2022 with Development Code Amendments to maintain compliance with SB 9 regulations. Motion carried, 5-0. H3. Update Regarding State Redistricting by the California Redistricting Commission and its Potential Impacts on Rancho Cucamonga's Representation in Congress and in the California State Legislature. (CITY) City Manager Gillison introduced Hope Velarde, Management Analyst I, who provided a PowerPoint presentation on State Redistricting by the California Redistricting Commission. She advocated the need for effective representation and keeping the City whole and urged the community to voice their opinions and concerns at www.wedrawthelinesca.org/contact. Mayor Michael encouraged the public to reach out and voice their opinion on maintaining the City as a whole. I. COUNCIL BUSINESS 11. COUNCIL ANNOUNCEMENTS None. 12. INTER-AGENCY UPDATES None. J.
