Mayor Michael called the meeting to order at 5:00 p.m. Present were Council Members: Ryan Hutchison, Kristine Scott, Sam Spagnolo, Mayor Pro Tern Lynne Kennedy (via Zoom), and Mayor L. RECESS The closed session recessed at 6:57 p.m. REGULAR MEETING - 7:00 p.m. CALL TO ORDER- COUNCIL CHAMBERS The regular meetings of the Rancho Cucamonga Fire Protection District, Housing Successor Agency, Successor Agency, Public Finance Authority, and the City of Rancho Cucamonga City Council were held on January 5, 2022, in the Council Chambers at City Hall, located at 10500 Civic Center Drive, Rancho Cucamonga, California. Mayor Michael called the meeting to order at 7:03 p.m. Present were Council Members: Ryan Hutchison, Kristine Scott, Sam Spagnolo, Mayor Pro Tern Lynne Kennedy (via Zoom), and Mayor L. Dennis Michael. Mayor Michael announced that all Council Members are present and Mayor Pro Tern Kennedy would be participating via Zoom and in order for her to participate via Zoom the City Council would need to add item Al to tonight's agenda by 2/3 vote. Also present were: John Gillison, City Manager; Nicholas Ghirelli, City Attorney; and Jasmin Oriel, CMC, Executive Assistant. Council Member Hutchison led the Pledge of Allegiance. AMENDMENTS TO THE AGENDA City Attorney Ghirelli informed that Mayor Pro Tern Kennedy's virtual attendance via Zoom came to the City's attention after the City Council Agenda was posted and was proposed for purposes of preventing the spread of COVID-19 and for everyone's safety. He recommended that the City Council add item Al relating to AB 361 to make certain findings in order to have a virtual meeting tonight. Mayor Michael entertained a motion to add item Al: AB 361 Findings for Special Brown Act Requirements for Teleconference Meetings to the agenda. MOTION: Moved by Council Member Scott seconded by Council Member Hutchison, to add item Al: AB 361 Findings for Special Brown Act Requirements for Teleconference Meetings to the agenda. Roll Call Vote: Council Member Hutchison: Aye, Mayor Pro Tern Kennedy: Aye, Council Member Scott: Aye, Council Member Spagnolo and Mayor Michael: Aye. Motion carried, 5-0. Al. AB 361 Findings for Special Brown Act Requirements for Teleconference Meetings. (CITY/FIRE) City Manager Gillison introduced City Attorney Ghirelli, who provided a verbal report with an overview of AB 361 and informed that the bill amends the Brown Act to establish special requirements for teleconference meetings if a legislative body of a local public agency makes findings pursuant to Government Code Section 54953(e)(3). Mayor Michael asked if the City Council would have to make the findings at each City Council Meeting. City Attorney Ghirelli informed that once the findings were made the City Council may continue to meet virtually and would have to adopt the findings on a monthly basis (every 30 days)thereafter. MOTION: Moved by Council Member Hutchison, seconded by Council Member Scott, to make the following findings: (1) the City Council has reconsidered the circumstances of the COVID-19 state of emergency; and (2) the COVID-19 state of emergency continues to directly impact of the ability of the members of the City's legislative bodies to meet safely in person. Mayor Michael and Members of the City Council presented City Attorney Ghirelli with a Certificate of Appointment. B2. Presentation of a Proclamation to Outgoing Historic Preservation/Planning Commissioners Tony Guglielmo and Francisco Oaxaca for their Dedicated Service to the Historic Preservation/Planning Commission. Presentation of a Certificate of Recognition to the Rancho Cucamonga High School Resource Officer Deputy John Cadogan and School Nurse Yolanda Warren for Heroically Saving the Life of a Student on Campus. Fire Chief McCliman shared the heroic efforts by Rancho Cucamonga High School Resource Officer Deputy John Cadogan and School Nurse Yolanda Warren during an incident involving a student who suffered a medical emergency while on campus. Mayor Michael and Members of the City Council recognized John Cadogan and Yolanda Warren and thanked them for their courage and service. C. PUBLIC COMMUNICATIONS No public communications were made.
