• Tentative Parcel Map (TPM) — To allow lot split;
• Minor Design Review (MDR) — Construction of new building and various
site improvements;
• Conditional Use Permit (CUP) — To allow the service station,
convenience store, and off-sale alcohol sales;
• Public Convenience or Necessity (PCN) — Required by California
Department of Alcoholic Beverage Control (ABC) to permit off-sale
alcohol license for convenience store (Type 20).
*Proposed restaurant component proposes on-site alcohol sales (Type 41) which is
permitted by right.

February 24 Public Hearing
At the February 24 Public Hearing, Commissioners raised a number of
concerns, some of which were also reflected in comments from public:
• Overconcentration and proximity of off-sale alcohol sales to schools (denied
by Resolution adopted on March 10);
• Desire to see the project serve as more of a local "neighborhood market" by
expanding fresh food and grocery offerings;
• Concerns that signage and lighting might impact residences across Archibald
Avenue;
• Lack of quality amenities in Southwest Cucamonga and questions as to
whether the service station with a convenience store is a benefit to the
neighborhood;
• Commissioners also noted a perceived concentration of service stations
located within proximity to proposed project.

Applicant's Response to Concerns
• As a result of the denial of the CUP for alcohol, the applicant has
withdrawn the request for a PCN;
• Fresh food and grocery items have been expanded to those areas which
were previously dedicated to alcohol sales;
• Signage and lighting along Archibald frontage treated sensitively.
Landscaped area to also be illuminated at pedestrian scale;
• Tobacco products not be advertised in any window areas and not be
accessible to customers;
• To provide a quality amenity to Southwest, the project now also
incorporates:
• Two EV Charging stations (4 ports in total);
• If diesel gasoline is proposed, applicant has agreed to Bio-diesel gasoline;
• Applicant offers to design the building to LEED Silver standards and a condition
of approval requiring the building to be certified has been added.

Moratorium on Service Stations
• Regarding the concerns for overconcentration of service stations, there
is no "concentration ordinance," which prohibits service stations at the
subject site.
• On April 21, 2021, the City Council approved an Urgency Ordinance
enacting a 45-day moratorium on service stations citywide. City Council
will consider whether to extend moratorium on June 5, 2021.
• Subject project was exempt from the moratorium, provided that
building permits are issued by October 21, 2021.
Project Summary and
Recommendation
• Project meets all relevant development standards;
• Project qualifies for a Class 32 Categorical Exemption;
• The applicant has revised the project to address previous concerns
raised; CUP for off-sale alcohol has been denied, and applicant has
withdrawn request for PCN.
• Staff recommends approval of the Tentative Parcel Map, Minor Design
Review and Conditional Use Permit (for the service station and
convenience store) through adoption of the attached Resolutions;
• Alternatively, if the Commission determines that certain findings cannot
be made, they may direct staff to return with Resolutions for denial.
Revised Condition
"The applicant shall design the project to meet Leadership in Energy and
Environmental Design ("LEED") silver standards and obtain certification as
such by the U.S. Green Building Council (USGBC) prior to issuance of
Certificate of Occupancy. Upon plan check submittal, the applicant shall
provide a letter from a LEED-Certified Consultant or equivalent stating
that all requirements to achieve LEED Silver are exhibited in the design
set of plans and that the required process to obtain certification from the
USGBC or State equivalent will be met in full."
