This is the time and place for the general public to address the City Council on any item listed on the
Special Meeting Agenda. State law prohibits the City Council from addressing any issue not previously
included on the Agenda. Comments are to be limited to five minutes per individual or less, as deemed
necessary by the Mayor, depending upon the number of individuals desiring to speak.
In accordance with AB 361, and to ensure the health and safety of our residents by limiting contact that could
spread the COVID–19 virus, members of the public have the option to participate in this City Council/Fire
District meeting via a teleconference. Members of the public may also attend the meeting in person. Those
wishing to speak during public communication may call at the start of the meeting by dialing (909)7742751 to
be added to the queue for public comment. Calls will be answered in the order received.

SUBJECT:Adoption of Resolution Certifying November 8, 2022, Municipal Election
Results; Administration of Oath of Office and Presentation of Certificate
of Election and Remarks from Newly Elected Officials. (RESOLUTION
NO. 2022-156) (CITY)
RECOMMENDATION:
Staff recommends:
1. The City Clerk Services Director recites into the minutes the results of the Canvass of the
November 8, 2022 election; and
2. City Council adopt a Resolution declaring the results of the November 8, 2022, General
Municipal Election.
3. Administer Oath of Office and Present Certificate of Election to newly elected officials.
4. Remarks by newly elected officials.
BACKGROUND:
On June 15, 2022, the City Council adopted Resolution No. 2022-071, calling and giving notice
of holding a General Municipal Election to elect one (1) Member of the City Council from District
2; one (1) Member of the City Council from District 3; and one (1) Mayor elected at large, each
for the full term of four years. Additionally, the City Council adopted Resolution No. 2022-072,
calling and giving notice of a Special Municipal Election to elect a Member of the City Council,
District 1, for a two-year term. These elections were consolidated with the November 8, 2022 San
Bernardino County Statewide election.
California Elections Code, Sections 10262 and 10264 require that upon Certification of the results
of an election by the County Elections Office, the City Council shall meet to declare the election
results. The City Council is required to adopt a Resolution declaring the results, and the City Clerk
is required to enter into the minutes a statement of the results.
ANALYSIS:
Official Canvass: The Registrar of Voters of the County of San Bernardino has until December 8,
2022, to canvass the election returns and provide the City with a Certification of Election Results.

The Registrar of Voters of the County of San Bernardino canvassed the returns of the election
and has certified the results to the City of Rancho Cucamonga. Upon certification, the City
Council shall meet to declare the election’s outcome. The “Official Canvass” is attached to the
Resolution.
Oath of Office/Presentation of Certificates of Election: At the close of the nomination period
Friday, August 12, 2022, only one candidate for each Mayor and Member of the City Council,
District 3, offices had filed. This allowed the provisions in California Election Code 10229 to be
enacted, which is to appoint qualified nominees and cancel the election for those positions.
On August 23, 2022, City Council adopted Resolution No. 2022-122 (Attachment 2) providing for
the appointment of L. Dennis Michael to the Office of Mayor and Ryan A. Hutchison to the Office
of Member of the City Council, District 3 and canceling the election for those offices that were to
be held on November 8, 2022. As stated in California Election Code 10229, the persons appointed
shall qualify and take office and serve exactly as if elected at a municipal election for the
offices. The Oath of Office and presentation of Certificates of Election will be conducted for these
offices and the two newly elected Members of the City Council for Districts 1 and 2.
At the time of writing the staff report and resolution, precinct results were not available. These
results will be forthcoming and made available prior to the City Council meeting.
FISCAL IMPACT:
Adoption of the Resolution has no fiscal impact.

RESOLUTION NO. 2022-XXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMONGA, CALIFORNIA, RECITING THE FACT OF THE GENERAL
MUNICIPAL ELECTION HELD IN SAID CITY ON NOVEMBER 8, 2022,
DECLARING THE RESULTS AND SUCH OTHER MATTERS PROVIDED BY
PROVISION OF LAW
WHEREAS, a General Municipal Election was held and conducted in the City of
Rancho Cucamonga, California, on Tuesday, November 8, 2022, as required by law; and
WHEREAS, notice of the election was given in time, form and manner as prescribed
by law; that voting precincts were properly established; that election officers were appointed
and that in all respects the election was held and conducted and the votes were cast,
received and canvassed and the returns made and declared in time, form and manner as
required by the provisions of the Elections Code of the State of California, for the holding of
elections in general law cities; and
WHEREAS, On August 23, 2022, City Council adopted Resolution No. 2022-122
providing for the appointment of L. Dennis Michael to the Office of Mayor and Ryan A.
Hutchison to the Office of Member of the City Council, District 3 and canceling the election
for those offices that were to be held on November 8, 2022, pursuant to Elections Code

Section 1. That the number of registered voters in the City was XXXXX, making a

Section 5. The City Council does declare and determine that:
Ashley Stickler was elected as Member of the City Council, District 1 for a short term
of two years;
Kristine Scott was elected as Member of the City Council, District 2 for the full term of
four years;
Section 6. The City Clerk shall enter on the records of the City Council of the City
of Rancho Cucamonga, a statement of the result of said election, showing:
1. The whole number of votes cast in the City.
2. The names of the persons voted for.
3. The measure voted upon.
4. For what office each person was voted.
5. The number of votes given at each precinct to each person, and for and
against each measure;
6. The total number of votes given to each person, and for and against each
measure.
Section 7. That the City Clerk shall immediately make and deliver to the person
elected, a Certificate of Election signed by the City Clerk and authenticated; that the City
Clerk shall also administer to the person elected the Oath of Office prescribed in the
Constitution of the State of California and shall have them subscribe to it and file it in the
Office of the City Clerk. Whereupon, each person so elected shall then be inducted into the
respective office to which they have been elected.
Section 8. The City Clerk shall certify to the passage and adoption of this
Resolution and enter it into the book of original resolutions.
