(CITY/FIRE) RECOMMENDATION: Staff recommends that the City Council/Board of Directors of the Fire Protection District make the following findings in order for the City’s legislative bodies to continue meeting virtually: (1) the City Council has reconsidered the circumstances of the COVID-19 state of emergency; and (2) the COVID-19 state of emergency continues to directly impact of the ability of the members of the City’s legislative bodies to meet safely in person BACKGROUND: On March 4, 2020, Governor Newsom proclaimed a state of emergency to exist in California due to the spread of COVID-19. This proclamation is still in effect. The Governor subsequently issued numerous executive orders suspending or modifying state laws to facilitate the response to the emergency. Among other things, these executive orders superseded certain Brown Act requirements and established special rules to give local public agencies greater flexibility to conduct teleconference meetings. The special rules included provisions allowing local public agencies to conduct teleconference meetings without having to provide a physical location from which the public may attend or comment; without having to use teleconference locations that are publicly accessible; and without having to identify teleconference locations on the agenda. Those special rules expired on September 30, 2021. On September 16, 2021, in anticipation of then-imminent expiration of his special rules for teleconference meetings, Governor Newsom signed AB 361. In key part, this bill amends the Brown Act to establish special requirements for teleconference meetings if a legislative body of a local public agency makes two findings pursuant to Government Code Section 54953(e)(3). Like the special rules in the Governor’s executive orders, the special Brown Act requirements in AB 361 include provisions allowing public agencies to conduct teleconference meetings without having to use teleconference locations that are publicly accessible; and without having to identify teleconference locations on the agenda. The AB 361 special Brown Act requirements are scheduled be repealed on January 1, 2024. Page 29 Page 2 1 6 2 5 In order for a local public agency to be subject to the AB 361 special Brown Act requirements for teleconference meetings, a legislative body of a local public agency first must make a finding that it has “reconsidered” the circumstances of a declared state of emergency. Second, there must be a finding that such emergency continues to directly impact the ability of legislative body members to meet safely in person. Alternatively, for the second finding, there must be a finding that state or local officials continue to impose or recommend social distancing measures. These findings must be made within 30 days after the first teleconference under AB 361 and on a monthly basis thereafter. ANALYSIS: Due to the continuing, rapid spread of the variants of COVID-19, staff is recommending that the City Council make the necessary findings in order to continue holding teleconference meetings. The findings were first made at the January 5, 2022 City Council meeting. Federal and state officials continue to recommend social distancing measures, including limiting in-door gatherings, in order to limit the spread of COVID-19 variants. It is expected that virtual meetings will only be conducted pursuant to AB 361 where a City Council Member or other member of a commission/committee is unable to meet in person due to exposure to COVID-19. Under AB 361, the public must also be given an opportunity to participate in a virtual meeting via a teleconference option, and the amended agenda provides call-in information. However, the public will continue to be permitted to attend the meeting in person. It is unclear if future meetings will require teleconferencing. FISCAL IMPACT: There is no fiscal impact caused by this item. The City already has the necessary equipment to hold a teleconferenced meeting. (CITY) RECOMMENDATION: It is recommended that the City Council receive and file the AB 1600 Development Impact Fee Report for the Fiscal Year Ended June 30, 2022. BACKGROUND: California Government Code Sections 66000-66025 (the "Mitigation Fee Act") sets forth the legal requirements for enactment of a development impact fee program, the bulk of which was adopted as 1987's Assembly Bill (AB) 1600 and thus commonly referred to as "AB 1600 requirements". The AB 1600 requirements stipulate that fees imposed on new development have the proper nexus to any project on which they are imposed. In addition, AB 1600 requires that any local agency that imposes development impact fees prepare an annual report providing specific information about those fees as defined in Government Code Sections 66006(b) and 66001(d). Each year the City prepares the Development Impact Fee Report to meet these requirements. In the following years, the City Council approved additional development impact fees for Transportation (RCMC Chapter 3.28), Drainage Systems (RCMC Chapters 13.08 and 13.09), Community and Recreation Center (RCMC Chapter 3.52), Library (RCMC Chapter 3.56), Animal Center (RCMC Chapter 3.60), Police (RCMC Chapter 3.64), and Park In-Lieu/Park Impact (RCMC Chapter 3.68). Nexus procedures were developed to establish the relationship between the proposed development and its impact on the City. Pursuant to the Municipal Code, impact fees have been periodically updated since considering the initial Development Impact Fee Resolutions by the City Council. A. California Government Code Sections 66006(b) and 66001(d) California Government Code Section 66006(b) defines the specific reporting requirements for local agencies that impose AB 1600 DIFs on new development. Page 35 2 DESCRIPTION OF DEVELOPMENT IMPACT FEES Fund 111 – Park Land Acquisition: This fee intends to provide funding for the development and acquisition of parks. Due to the provisions of the Quimby Act applying only to land acquisition and only in residential subdivisions, separate park impact fees for park Land acquisition in non-subdivision projects and park improvements are necessary. The park fees are calculated for a single service area encompassing the entire City. Impact fees for this fund are calculated in accordance with Resolution No. 14-128 using the per capita costs and average population per dwelling unit. The impact fee per dwelling unit varies depending on the development type. BACKGROUND: In May 2022, the City entered into a professional services agreement with Civic Solutions to provide planning project management services. The initial assignments managed by Civic Solutions included long range planning initiatives, including Development Code updates to implement the goals, policy and vision of the General Plan. The contract was expected to last approximately six months. ANALYSIS: Since the initiation of the contract, the Planning and Economic Development Department has experienced some staff attrition. The department has many complex mixed use and housing projects under review that need highly skilled project managers that can navigate our new form- based code and applicable state housing laws. In searching for contract planning services to assist, Civic Solutions indicated they had the capacity and expertise necessary to take on additional complex development project management. Their existing work with our General Plan and Development Code gives them the ability to manage projects with successful resolution based on the vision of the General Plan. The proposed contract amendment will increase their existing contract, which is nearly expended, by $141,050, which will provide project management services for up to six months. FISCAL IMPACT: Funding for this contract will be achieved through the use of existing budget funds, including salary savings from budgeted, but not yet filled Planning and Economic Development positions. No additional funding appropriation is needed. SMG Rancho Cucamonga Premier Food Services LLC has been effectively managing and operating the spaces. ANALYSIS: Staff is recommending approval of Amendment No. 3, a one (1) month extension, to Contract 19- 072 with SMG. During this extension period, Staff will negotiate new terms with SMG with a goal to continue to have City facilities available for events while maintaining a steady stream of income that will be reinvested into cultural programming for community benefit. Approve and authorize a purchase order for the purchase of twenty-five streetlight poles and forty aluminum pole arms from Ameron Pole Products, LLC in the amount of $68,100; and 2. Authorize an appropriation in the amount of $44,000 from the General City Street Light Fund (Fund 150) to fully fund the purchase. BACKGROUND: In 2017, the City took ownership of approximately 15,700 standard concrete streetlight poles and 95 decorative concrete streetlight poles from Southern California Edison. The poles and light fixtures are managed by the Rancho Cucamonga Municipal Utility. Staff identified the need to have an inventory of poles, arms, and light fixtures on hand when a streetlight knockdown occurs for installation of a replacement pole. The lead time for streetlight poles is currently at a minimum of twenty weeks and having poles available immediately allows for the replacement to be completed in an efficient manner for public safety. All the City’s streetlight poles are currently standardized as an Ameron Contemporary 1C123 and 1C128 octagonal pole standard with base. This meets the City’s Standard Drawing 410 and the Ameron drawings specifically done for the City. The design of these poles also accounts for the structural engineering calculations that were conducted to ensure the footings meet or exceed the City’s structural standards. Any changes in the pole design would require the City to conduct another study for structural footing which would add additional costs to the City. ANALYSIS: The purchase of these streetlight poles and arms is needed to ensure that the City has an adequate inventory level available when a knockdown occurs. Ameron is the only manufacturer providing the style of poles that can offer manufacturing, delivery and erection from their facility in Fillmore, CA and will be a sole source purchase. A quote was obtained from Ameron Pole Products and staff determined the quote to be deemed as reasonable. (ORDINANCE NO. 1014) (CITY) RECOMMENDATION: Staff recommends that the City Council conduct the first reading of the attached ordinance, to be read by title only, to amend the Rancho Cucamonga Municipal Code (RCMC) Sections 10.56.10 Unrestricted Truck Routes, Section 10.56.20 Restricted Truck Routes, and Section 10.56.030 Terminal Access Routes for Extra Large Trucks of Chapter 10.56. BACKGROUND: In December 1988, the City Council adopted Ordinance No 373 (RCMC Chapter 10.56) utilizing California Vehicle Code sections 35400 and 35401 which allow local agencies to regulate commercial vehicles on City streets. The ordinance designates unrestricted truck routes for commercial vehicles over 3 tons and the streets where these vehicles can travel and restricted truck routes where streets have limited turning radius and truck trailer combinations over a certain length are prohibited. Terminal access routes for extra-large interstate trucks, which need access to service, or distribution facilities are also included. These designated truck routes allow commercial vehicles to travel on City streets even without an origin or destination within the city while restricting through truck traffic from incompatible routes such as neighborhood streets. ANALYSIS: The City of Rancho Cucamonga General Plan Update was adopted in late 2021. “Figure M-9 Truck Routes” of the General Plan Update outlines the designated unrestricted and restricted truck routes within the city and designated routes to be considered for potential removal. However, the Rancho Cucamonga Municipal Code Sections 10.56.10 Unrestricted Truck Routes, 10.56.20 Restricted Truck Routes, and 10.56.030 Terminal Access Routes for Extra Large Trucks have not been updated since March 3, 1992. Therefore, the attached ordinance was created to amend the RCMC Code Sections to resolve any inconsistencies between the existing Code Sections and the adopted General Plan. The majority of the changes proposed in the attached ordinance update the municipal code to reflect changes in street names and the addition of the State Route 210 freeway in the early Page 59 Page 2 1 5 9 9 2000s. Some more substantial changes include the removal of the Unrestricted Truck Route designation for the portion of 19th Street from the West City limit to Haven Avenue and the removal of the blanket truck access on streets in the industrial zone that were not specifically listed in the existing ordinance. While trucks that have a destination with a direct route utilizing these or other streets not specifically designated as truck routes are permitted to do so by the Vehicle Code, this will eliminate through truck traffic on these streets as such through truck traffic is intended to follow designated routes and may be incompatible with the vision for adjacent land uses as laid out in the General Plan. The General Plan also recommended consideration to remove truck access from Foothill Boulevard. However, staff recommends retaining this truck route at this time. As the development of Foothill Boulevard progresses into a more urban environment and the corridor becomes more accessible to cyclists and pedestrians, its truck route designation will be reconsidered. Staff will continue to monitor the development of Foothill Boulevard and reevaluate in approximately 12 to18 months. Specific amendments to the truck routes are outlined in the attached ordinance. FISCAL IMPACT: Fiscal impact from this action will be minimal resulting from replacement of signs to effect the changes in truck routes as outlined in the ordinance. These costs will be covered by the City’s operating budget for Fiscal Year 2022/23. XXX AN ORDINANCE OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, AMENDING SECTIONS 10.56.010, 10.56.020, AND 10.56.30 OF THE RANCHO CUCAMONGA MUNICIPAL CODE TO ALTER TRUCK ROUTES, MAKING FINDINGS IN SUPPORT THEREOF, AND MAKING A DETERMINATION THAT THE ORDINANCE IS EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT I. Recitals. A. The City of Rancho Cucamonga (“City”) is authorized by Article XI, Section 7 of the State Constitution to exercise the police power of the State by adopting regulations to promote public health, safety, and welfare. B. The City has authority pursuant to Sections 21101 and 35700 of the California Vehicle Code to prohibit the use of particular highways by certain vehicles, including by weight, subject to certain exceptions. C. This Ordinance is adopted pursuant to the above referenced authorities in order to modify the existing truck routes within the City. II. Findings. A. This City Council hereby finds and concludes that this Ordinance is consistent with the General Plan’s goals, policies, and implementation programs. The City’s General Plan identifies the allowable truck routes throughout the City in Figure M-9 of Chapter 4 “Mobility and Access” of Volume 2 of the General Plan. These identified truck routes and truck routes with a 38-foot kingpin limit are reflected in the updates to the identified truck routes and 38-foot kingpin limit truck routes of Municipal Code Sections 10.56.010, 10.56.020, and 10.56.030 of this Ordinance. The updates to the Municipal Code that Sections 10.56.010, and 10.56.020, and 10.56.30 contained herein reflect changes to street names and freeways that have occurred in the City since 2000 and mirror the truck routes identified in the General Plan. B. Pursuant to the California Environmental Quality Act (“CEQA”) and the City’s local CEQA Guidelines, the City Council finds that adoption of this Ordinance is covered by general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. The City Council finds that there is no possible significant effect directly related to adoption of this Ordinance, therefore no further action is required under CEQA pursuant to Section 15061(b)(3) of the State CEQA Guidelines (14 CCR § 15061(b)(3)). This is because the number of trips by heavy vehicles on City streets by heavy vehicles on City streets will not be affected and neither will levels of traffic, noise and air pollution. Furthermore, the truck routes included within this Ordinance were environmentally reviewed in the EIR for the General Plan. III. Ordinance. The City Council of the City of Rancho Cucamonga does ordain as follows: SECTION 1. Section 10.56.010 (Unrestricted Truck Routes) of Chapter 10.56 (Truck Routes and Restrictions) is amended as follows: Page 62 Ordinance No. XXX – Page 2 of 4 3 1 7 2 “10.56.010 Unrestricted truck routes. A. Except as hereinafter provided, or as otherwise provided by law, commercial vehicles and vehicle combinations described in Vehicle Code §§ 35400 and 35401, or their successor provisions, and vehicles which exceed a maximum gross weight of three tons, may be operated only on streets designated as “unrestricted truck routes.” Unrestricted truck routes in the city include: 1. Base Line Road from the west city limits to the east city limits; 2. Foothill Boulevard from the west city limits to the east city limits; 3. Arrow Route from Vineyard Avenue to the east city limits; 4. Eighth Street from the west city limits to Vineyard Avenue; 5. Sixth Street from Archibald Avenue to Etiwanda Avenue; 6. Fourth Street from the west city limits to the east city limits; 7. Grove Avenue from 8th Street to Foothill Boulevard; 8. Vineyard Avenue from 8th Street to Foothill Boulevard; 9. Archibald Avenue from 4th Street to Foothill Boulevard; 10. Haven Avenue from 4th Street to State Route 210; 11. Milliken Avenue from 4th Street to State Route 210; 12. Rochester Avenue from 6th Street to Foothill Boulevard; 13. Day Creek Boulevard from Foothill Boulevard to State Route 210; 14. Etiwanda Avenue from 4th Street to Foothill Boulevard; B. The provisions of this section may be enforced when and where the city traffic engineer has provided signing designating unrestricted truck routes. C. Extra large trucks, as defined in section 10.56.030, may operate only on the routes designated in said section. D. Exceptions. 1. Nothing in this section shall prohibit the ingress and egress from a designated unrestricted truck route by vehicles and vehicle combinations described herein onto a city street when necessary for the purpose of making pickups or deliveries of goods, wares and merchandise from or to any building or structure located on a city street, or for the purpose of delivering materials to be used in the actual and bona fide repair, alteration, remodeling Page 63 Ordinance No. XXX – Page 3 of 4 3 1 7 2 or construction of any building or structure upon a city street for which a building permit has previously been obtained. 2. The provisions of this section shall not apply to a passenger bus under the jurisdiction of the public utilities commission or any public entity, or which is owned by a bus company licensed by the city, or to any vehicle owned by a public utility while necessarily in use in the construction, installation or repair of any public utility, or to any vehicle owned by the city, or a city contractor, while necessarily in use in the construction, installation or repair of or on city property. 3. The provisions of this section shall not apply to any city licensed refuse hauling vehicles while picking up refuse, waste or garbage pursuant to such license.” SECTION 2. Section 10.56.020 (Restricted Truck Routes) of Chapter 10.56 (Truck Routes and Restrictions) is amended as follows: “10.56.020 Restricted truck routes. A. Vehicle Code § 35401(d) allows any city, upon finding that certain streets cannot safely sustain the operation of trailers or semitrailers having the maximum kingpin to rearmost axle distance permitted under Vehicle Code § 35400, to restrict the use of such streets by trailers or semitrailers having a maximum kingpin distance as determined. Certain city streets have been determined to be able to safely accommodate a maximum such distance of 38 feet. Except as otherwise provided by law, trailers and semitrailers having a kingpin to rearmost axle distance in excess of 38 feet are prohibited from using the aforedescribed streets. The streets described in this section shall be known as “restricted truck routes.” Restricted truck routes in the city include: 1. Vineyard Avenue from Foothill Boulevard to Carnelian Street; 2. Carnelian Street from Vineyard Avenue to State Route 210; 3. Archibald Avenue from Foothill Boulevard to State Route 210. B. The provisions of this section may be enforced when and where the city traffic engineer has provided signing designating restricted truck routes.” SECTION 3. Section 10.56.030 (Terminal Access routes for extra large trucks) of Chapter 10.56 (Truck routes and Restrictions) is amended as follows: “10.56.030 Terminal access routes for extra large trucks. A. Except as otherwise provided by law, truck-tractors and semitrailers, and truck-tractors, semitrailers and trailers, which exceed any of the size limitations set forth in Vehicle Code §§ 35400 and 35401, or their successor provisions, and which are exempted from such limitations pursuant to Vehicle Code § 35401.5(a), may be operated only on streets designated as “terminal access routes.” Such tractor-trailer combinations may be operated on terminal access routes only for the purpose of accessing facilities where freight is consolidated to be shipped or where full load consignments may be off-loaded or at which the vehicle combinations are regularly maintained, stored or manufactured. Page 64 Ordinance No. XXX – Page 4 of 4 3 1 7 2 B. City streets designated as terminal access routes are: 1. Foothill Boulevard from the west city limits to the east city limits; 2. Fourth Street from the west city limits to the east city limits; 3. Archibald Avenue from 4th Street to Foothill Boulevard; 4. Milliken Avenue from 4th Street to Foothill Boulevard. C. The provisions of this section may be enforced where the city traffic engineer has provided signing designating terminal access routes. (Code 1980, § 10.56.030; Ord. No. 373, § 1, 1988; Ord. The City Council declares that, should any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance for any reason be held invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional. SECTION 5. Neither the adoption of this Ordinance nor the repeal of any other Ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date hereof, nor be construed as a waiver of any penalty or the penal provisions applicable to any violation thereof. SECTION 6. The City Clerk shall certify to the adoption of this Ordinance and shall cause it to be published in the manner required by law.
