FD 2023-002 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE RANCHO CUCAMONGA FIRE PROTECTION DISTRICT, RANCHO CUCAMONGA, CALIFORNIA, ESTABLISHING AND WAIVING THE COLLECTION OF CERTAIN PERMIT AND INSPECTION FEES WHEREAS,the Rancho Cucamonga Fire Protection District("RCFPD") is a public agency located in the County of San Bernardino, State of California; and WHEREAS, the California Government Code requires that prior to levying a new fee or increasing an existing fee or service charge, as hereinafter set forth, the local agency shall hold a noticed public hearing to consider the matter; and WHEREAS, On February 1, 2022, the Rancho Cucamonga Fire Protection District conducted and concluded a duly noticed public hearing concerning the proposed fees, as required by law; and WHEREAS, all legal prerequisites to adoption of this Resolution have occurred. NOW, THEREFORE, THE BOARD OF DIRECTORS OF THE RANCHO CUCAMONGA FIRE PROTECTION DISTRICT HEREBY FINDS AND RESOLVES AS FOLLOWS: 1. The foregoing Recitals are true and correct. 2. The Fire District has conducted a study of all costs incurred by the District in providing inspection and permit services. Costs to the District in providing the Services include, but are not limited to, salary and benefits paid to District employees, cost of maintaining the necessary equipment and facilities, asset usage costs, and risk management costs. 3. The Fire District has calculated the minimum number of staff-hours that will necessarily be expended based upon the specific type of Services required. 4. The fee amounts established herein do not exceed the minimum cost to the District in providing each of the listed services to include the initial inspection and one re-inspection. 5. The Fire Code of the Rancho Cucamonga Fire Protection District as adopted and amended by Ordinance No. FD 58 has required operational permits and special event inspections which were not included in previous ordinances. 6. Fees for the aforementioned operational permits and special event inspections have not been established in fee resolutions previously approved by the Board. 7. The Board hereby approves and adopts new permit and inspection fees included herein as Exhibit A effective 60 days from adoption of this resolution. 8. The Board hereby repeals the Fire Alarm Services Fee adopted in Resolution FD 12-057 and adopts a new Fire Alarm Services Fee in the amount of$110. Resolution No. F02023-002—Page 1 of 2 9. As previously determined by Resolution FD 2022-028, for fiscal year 2022-23, there does not exist a fiscal need to collect the fees approved herein. 10. The Board hereby waives the collection of the fees approved herein for fiscal year 2022-23 only. Thereafter, said fees will be collected unless the Board again approves a waiver as to such collection. 11. Nothing in this Resolution shall be deemed to affect any other fees of the District currently in effect. 12. The Secretary shall certify to the adoption of this Resolution.
