FD2023.003 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE RANCHO CUCAMONGA FIRE PROTECTION DISTRICT, RANCHO CUCAMONGA, CALIFORNIA, ESTABLISHING, REVISING, AND UPDATING VARIOUS FEES A. RECITALS. 1. The California Government Code allows the Rancho Cucamonga Fire Protection District to establish fees and charges for services, provided such fees and charges do not exceed the estimated reasonable cost to the District in providing the service to which the fee or charge applies. 2. Data indicating the estimated or actual cost to provide each service, for which the fees and charges set forth herein apply, was made available to the public at least ten (10)days prior to the date of the public hearing. 3. On February 1, 2023,the Board of Directors of the Rancho Cucamonga Fire Protection District conducted and concluded a duly noticed public hearing concerning the proposed fees and service charges, as required by law. 4. All legal prerequisites prior to the adoption of this Resolution have occurred. B. RESOLUTION. The Board of Directors of the Rancho Cucamonga Fire Protection District finds and resolves as follows: SECTION 1: The Board of Directors hereby specifically finds that all the fads set forth in the Recitals, Part A, of this Resolution are true and correct. SECTION 2: The Board of Directors hereby specifically finds that the fees and charges set forth do not exceed the estimated reasonable cost of providing the service for which the fee or charge be levied. SECTION 3: The Board of Directors hereby authorizes the Chief Executive Officer, or designee, to make annual adjustments to fees, commencing on July 1, 2024, and each year thereafter, without further action of the Board of Directors, based on the Employment Cost Index for State and Local Government Employees, Total Compensation, during the 12-month period ending on December 31st of the immediately preceding year, as released by the U.S. Department of Labor's Bureau of Labor Statistics and rounded to the nearest whole dollar. If this index is discontinued, a replacement index, as determined by the Board of Directors, shall be utilized. SECTION 4: The Board of Directors hereby approves and adopts the fees included herein as Exhibit A effective 60 days from adoption of this resolution. All previously adopted and existing fees for performance of District Services identified in Exhibit A are hereby deemed to be superseded and replaced by the fees herein. SECTION 5: The Board of Directors hereby repeals the permit and inspection fees included herein as Exhibit B effective 60 days from adoption of this resolution. Resolution No. FD2023-003 - Page 1 of 2 SECTION 6: The Board of Directors hereby repeals the All Risk Training Center Fee and Charges Schedule identified in Section 4 of Resolution FD 18-003 and adopts new facility use fees and charges included herein as Exhibit C effective 60 days from adoption of this resolution. SECTION 7: The Secretary of the Rancho Cucamonga Fire Protection District shall certify to the adoption of this Resolution.
