A RESOLUTION OF THE CITY OF RANCHO CUCAMONGA,
CALIFORNIA, AUTHORIZING THE EXECUTION AND SIGNING
OF PROGRAM SUPPLEMENT NO. 002-M7 TO
ADMINISTERING AGENCY-STATE AGREEMENT NO. 08-5420,
BETWEEN THE CITY OF RANCHO CUCAMONGA AND THE
STATE OF CALIFORNIA TO PROVIDE FUNDING FOR
PRELIMINARY ENGINEERING, CONSTRUCTION AND
CONSTRUCTION ENGINEERING TO EXPAND THE PARKING
AND SOUTH LOADING PLATFORM AT THE CITY'S
METROLINK STATION LOCATED AT THE SOUTHWEST
CORNER OF MILLIKEN AVENUE AND THE AT&SF RAILROAD
WHEREAS, the City Council of the City of Rancho Cucamonga (hereinafter
referred to as "Local Agency") has for its consideration and execution Program Supplement No.
002-M1 to administering Agency-State Agreement No. 08-5420 authorizing reimbursement of
State and Federal Share Funds for Preliminary Engineering, Construction and Construction
Engineering to expand the parking and south loading platform at the City's Metrolink Station
located at the southwest corner of Milliken Avenue and the AT&SF Railroad; and
WHEREAS, the State of California, Department of Transportation, District Office
8 (hereinafter referred to as "State") processes and monitors State funded projects; and
WHEREAS, as a condition of reimbursement payment of State and Federal
Share funds for said project, the City shall approve and execute said Program Supplement No.
002-M1.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMONGA, does hereby resolve to:
1. Authorize the Execution of Program Supplement No. 002-M1 to
administering Agency-State Agreement No. 08-5420 for the
reimbursement of State and Federal Share Funds for Preliminary
Engineering, Construction and Construction`ngirieering to expand
the parking and south loading platform at the City's Metrolink Station
located at the southwest corner of Milliken Avenue and the AT&SF
Railroad.
2. To authorize the Mayor to sign said Supplement and direct the City
Clerk to attach a certified copy of this Resolution, as well as type in
the Resolution Number and Date in the blanks in the third block of
said Supplement, and for the return of the original copies of said
Supplement to the State of California Department of Transportation
along with the certified copy of this Resolution.
BE IT FURTHER RESOLVED that the Local Agency shall also comply with the
"Special Govenants or Remarks" attached to-said supplement including:

1. It is mutually understood between the parties that this contract may
have been written before ascertaining the availability of legislative
appropriation of funds, for the mutual benefit of both parties, in order
to avoid program and fiscal delays that would occur if the agreement
was executed after the determination was made.
The total amount of State funds payable by the State shall not exceed
$295,936.00 and the total amount of Federal funds payable by the
Federal Government shall not exceed $2,284,064.00.
This agreement is valid and enforceable only if sufficient funds are
made available by the California State Legislature. Said reimbursable
funds as received will be deposited into Accounts No. 151-4637-9932
and No. 1-230-303-5650.
