A RESOLUI~ON OF THE BOARD OF DIREL~IDRS OF THE RANC~O
CUCAMONGA FIRE PROTELTION DISTRICT, CITY OF RANCMO
~, OOUNTYOFSANBERNARDINO, STATE OFCALIFORNIA,
MAKING APPOINTMM/I~ IN A~ FACILITY DISTRICT
WHEREAS, the Board of Directors of the Rancho Cucamonga Fire Protec-
tion District, ba~ replaced the Foothill Fire Protection District as the
legislative body of, and will take all future actions relating to the
proceedings for M~.T O-ROOS ~ FACTT.TTIES DISTRICT NO. 85-1 (hereinafter
referred to as the "District"); and
WHEREAS, said Board of Directors desires to annex territory to the
existing District pursuant to the terms and provisions of the '~4ello-Roos
C~mt,onity Facilities Act of 1982", being Chapter 2.5, Part 1, Division 2,
Title 5 of the Gove~xatent Code of the State of California, and specifically
Article 3.5 thereof; and
WHEREAS, the area proposed to be annexed shall be known and
designated as MMTI~-R00S OCM~3NITY FACILITIES DISTRICT NO. 85-1, ANNEXATION
NO. 92-1 (hereinafter referredto as the "annexed territory"); and
WHEREAS, the legislative body desires to make the required
appointments and designating persons to perform certain duties, in order to
allow the proceedings to go forward to c~¥~letion in accordance with the
provisions of law.
NOW, THEREFORE, the Board of Directors of the Rancho Cucamonga Fire
Protection District does hereby resolve as follows:
S~CTION 1: That the above recitals are all true and correct.
S~fION 2: That the Board of Directors of the Rancho Cucamonga Fire
Protection District will be taking all future actions and steps relating to
these proceedings for the previously authorized and formed Mello-Roos
Ommmmity Facilities District No. 85-1, inasmuch as the Rancho Cucamonga Fire
Protection District ban superceded and replaced the Foothill Fire Protection
District.
SECTION 3: That throughout the course of these proceedings, the
Board of Directors of the Rancho Cucamonga Fire Protection District will be
acting as the legislative body of the Mello-Roos C~ut~nity Facilities District
No. 85-1, a legally constituted gove~-~,,~ental entity as defined by Section
53317 of the Govermnent Code of the State of California.
S~fION 4: All regulatory rules of the Rancho Cucamonga Fire
Protection District, including date, time and place of meetings, as well as
notice requirements, shall be applicable for all proceedings conductedbythis
legislative body as the governing body of the Con~,~nity Facilities District.
S~CTION 5: That the INIAND VAT.T.RY DATT.Y BUT.T.RIIN is hereby
designated as the newspaper for all publications as required by law and as
necessary for ccmpletion of this District.

SEETION 6: Ihat B~0WN, HARPER, BURNS & ~, Attorneys at Law,
is hereby appointed to act as Bond Counsel for the purposes of preparing
proceedings and resolutions relating to the annexation proceedings, and upon
the completion of the election, COUPSel shall be paid a flat fee of $1,000.00.

District do hereby certify that the foregoing Resolution was duly passed,
approved, and adopted by the Board of Directors of the Rancho Cucamonga Fire
Protection District, at a regular meeting of said Board held on the 15th day
of January, 1992.
