A RESOLUTION OF THE BOARD OF DIRECIDRS OF THE RANC~O
CUCAMONGA FIRE PROTECTION DISTRICT, CAIIFORNIA,
PETITIONING THE SAN BERNARDINO ~ BOARD OF
SUPERVISORS NOT TO APPEAL THE DECISION RENDERED BY
RIVERSIDE SUPERIOR COURT JUDGE MICHAEL KAISER IN THE
lAWSUIT BETWRFN THE COUNTY (ICR4A), THE CITY OF SAN
BERNARDINO AND OTHER RESPONDERrS REGARDING CLARIFICATION
OF EMERGENCY MtDICAL SERVICES AUTHORITIES
WHEREAS, the current economy is causing severe economic hardship on
the State, the County of San Bernardino and local governments within the
County requiring layoffs, reductions in employees salaries and an overall
reduction in services tot he public; and
WHERFAS, fire and life safety and emergency medical services provided
by the State, County, cities and fire districts within this County have been
negatively impacted due to a significant reduction in the revenue received
from the State and the reduction in revenue raised locally; and
WHEREAS, the recent lawsuit brought by the County of San Bernardino
(ICR4A) against the City of San Bernardino, other cities and fire districts in
the County to determine who has jurisdiction over the delivery of enez~/ency
medical services, has been divisive, poor public policy and costly; and
WHEREAS, the recent ruling by Riverside Superior Court Judge Michael
Kaiser in this lawsuit, clarified California Health and Safety Code Section
1797.200 recognizing the County Emergency Medical Authority's role in medical
control and quality assurance matters and the exclusive right and authority of
the local government to deliver emergency medical services in the manner they
deem appropriate; and
WHEREAS, this "Friendly Lawsuit", brought by the County of San
Bernardino to settle the issue by an impartial third party, has been
adjudicated in Superior Court rendering an inIk3rtial interpretation of the law
inquestion; and
WHEREAS, an appeal of this ruling by the County of San Bernardino
(ICR4A) would only serve to continue the argument and, in these severe
economic times, would cost the County and local governments enjoined in this
legal matter revenue that could be better spent elsewhere, further
compromising govex-x-~ent, fire, life safety and eane~gency medical services we
provide and do a disservice to the public we are here to serve.
NOW, THEREFORE BE IT RESOLVtD, that the Board of Directors of the
Rancho Cucamonga Fire Protection District hereby respectfully petitions the
San Bernardino County Board of Supervisors not to appeal the decision rendered
by Riverside Superior Court Judge Michael Kaiser in the lawsuit between the
County of San Bernardino (ICHMA), the City of San Bernardino and other
respondents.
