RESOLUTION OF NECESSITY OF THE CITY COUNCIL OF
THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, TO
EXERCISE RIGHT OF EMINENT DOMAIN TO ACQUIRE
PROPERTY FOR DRAINAGE AND FLOWAGE PURPOSES
RESOLVED, by the City Council of the City of Rancho Cucamonga,
California:
The public safety, welfare, convenience, interest and necessity
require the acquisition by the City of Rancho Cucamonga, California, of
the property hereinafter described for public use, to wit: for the
maintenance of storm drains and other structures for the drainage and
flowage of water.
That the City of Rancho Cucamonga is authorized to acquire the
property by eminent domain pursuant to Government Code Section 37350.5.
That the City Council of the City of Rancho !~camonga finds and
!termines that:
(1) The public interest and necessity require the proposed pro-
ject.
(2) The proposed project is planned, or located, or planned and
located, in the manner that will be the most compatible with the reatest
public good and the least private injury.
(3) The property described herein is necessary for the proposed
project.
BE IT FURTHER RESOLVED, that the City of Rancho Cucamonga is hereby
authorized to acquire, in the name of the City of Rancho Cucamonga, the
following described lands by donation, purchase or by condemnation in
accordance with the provisions of the Constitution of the State of
California and the laws of the State of California relating to eminent
domain.
That the City Attorney of the City of Rancho Cucamonga is hereby
authorized and instructed to prepare and prosecute, in the name of the
City of Rancho Cucamonga, such suit or suits in the lawful Court having
jurisdiction thereof as is necessary to condemn said lands for the
purposes hereinabove described.
The real property to which the City of Rancho Cucamonga is, by this
Resolution, authorized to acquire is situate, lying and being in the
City of Rancho Cucamonga, County of San Bernardino, State of California,
and is particularly described as follows:
The Easterly 20.00 feet of the Westerly
92.00 feet of Parcel No. 3 of Parcel Map
No. 65 as per plat recorded in Book 1 of
Parcel Maps, page 49, records of said
County.
PASSED and ADOPTED by the City Council of the City of Rancho
Cucamonga, California, on the 19th day of March, 1980, by the following
vote:
AYES: Schlosser, Mikels, Palombo, Bridge, Frost
NOES: None
