A RESOLUTION OF NECESSITY OF THE CITY COUNCIL OF THE CITY
OF RANCHO CUCAMONGA, CALIFORNIA, TO EXERCISE THE RIGHT OF
EMINENT DOMAIN TO ACQUIRE EASEMENTS ACROSS PROPERTY FOR THE
CONSTRUCTION AND MAINTENANCE OF PUBLIC STREETS.
RESOLVED by the City Council of the City of Rancho Cucamonga,
California:
The public safety, welfare, convenience, interest and necessity
require the acquisition by the City of Rancho Cucamonga of easements
across the property hereinafter described for public use, to-wit: for
the construction and maintenance of public streets.
That the City of Rancho Cucamonga is authorized to acquire the
property by eminent domain pursuant to Government Code Section 37350.5
and Streets and Highways Code Section 4090.
That the City Council of the City of Rancho Cucamonga finds and
determines that:
(1) The public interest and necessity require the proposed
project.
(2) The proposed project is planned, or located, or planned
and located, in the manner that will be the most compatible with the
greatest public good and the least private injury.
(3) The property described herein is necessary for the proposed
project.
BE IT FURTHER RESOLVED, that the City of Rancho Cucamonga is
hereby authorized to acquire, in the name of the City of Rancho Cucamonga,
easements across the following described land by donation, purchase or by
condemnation in accordance with the provisions of the Constitution of the
State of California and the laws of the State of California relating to
eminent domain.
That the City Attorney of the City of Rancho Cucamonga is
hereby authorized and instructed to prepare and prosecute, in the name of
the City of Rancho Cucamonga, a suit or suits in the lawful court having
jurisdiction thereof as is necessary to condemn easements across said
lands for the purposes hereinabove described.
The real properties across which the City of Rancho Cucamonga
is, by this Resolution, authorized to acquire easements are situated,
lying and being in the City of Rancho Cucamonga, County of San Bernardino,
State of California, and particularly described as follows:
Project Parcel No. 1: See Exhibit "A" attached hereto
and incorporated herein by reference.
Project Parcel No. 3: See Exhibit "B" attached hereto
and incorporated herein by reference.
Project Parcel No. 5: See Exhibit "C" attached hereto and
incorporated herein by reference
Project Parcel No. 6: See Exhibit "D" attached hereto and
incorporated herein by reference.
Project Parcel No. 7: See Exhibit "E" attached hereto and
incorporated herein by reference.
PASSED, APPROVED, and ADOPTED this 2nd day of January, 1980.
