RESOLUTION OF NECESSITY OF THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, TO EXERCISE RIGHT OF EMINENT
DOMAIN TO ACQUIRE PROPERTY FOR CONSTRUCTING OR IMPROVING
A PUBLIC HIGHWAY AND ACCOMPLISHING ALL NECESSARY INCIDENTS
THERETO.
RESOLVED, by the City Council of the City of Rancho Cucamonga,
California:
The public safety, welfare, convenience, interest and necessity
require the acquisition by the City of Rancho Cucamonga, of the property
hereinafter described for public use, to wit: For constructing or improv-
ing a public highway and accomplishing all necessary incidents thereto.
That the City of Rancho Cucamonga is authorized to acquire the
property by eminent domain pursuant to Government Code Section 37350.5.
That the City Council of the City of Rancho Cucamonga finds and
determines that:
(1) The public interest and necessity require the proposed project.
(2) The proposed project is planned, or located, or planned and
located, in the manner that will be the most compatible with the greatest
public good and the least private injury.
(3) The property described herein is necessary for the proposed
project.
BE IT FURTHER RESOLVED, that the City of Rancho Cucamonga is hereby
authorized to acquire, in the name of the City of Rancho Cucamonga, the
following described lands by donation, purchase or by condemnation in
accordance with the provisions of the Constitution of the State of Cali-
fornia and the laws of the State of California relating to eminent domain.
That the City Attorney of the City of Rancho Cucamonga is hereby
authorized and instructed to prepare and prosecute, in the name of the City
of Rancho Cucamonga, such suit or suits in the lawful Court having juris-
diction thereof as is necessary to condemn said lands for the purposes
hereinabove described.
The real property to which the City of Rancho Cucamonga is, by this
Resolution, authorized to acquire is situate, lying and being in the City of
Rancho Cucamonga, County of San Bernardino, State of California, and is
particularly described as follows:
The North 90 feet measured Southerly from the South line
of Baseline Avenue, of that portion of Lot 12, Subdivision
"C", CUCAMONGA VINEYARD TRACT, in the County of San Bernar-
dino, State of California, as per plat recorded in Book 21,
page 67 of M~aps, lying East of a straight line which com-
mences at a point on the Southeast boundary of said lot
distant 150 feet West of the West boundary of Hellman,
and runs thence North 0° 7' 30" West, parallel to and
150 feet distant from the West line of Hellman Avenue
(excepting at the corner of Baseline and Hellman Avenue
where said West line of Hellman Avenue changes direction
Westerly to the North line of said Lot 12).
PASSED, APPROVED, and ADOPTED by the City Council of the City of
Rancho Cucamonga, California, on the 6th Day of December 1978, by the
following vote:
